The following provides additional information concerning each item on the above checklist. 1. Designated Wilderness Areas: Based on a review of the Wilderness.net - U.S. National Wilderness Preservation System Map and information provided by EDR’s NepaCheck Report, the tower site is not located within an officially designated wilderness area. 2. Designated Wildlife Preserves: Based on a review of the US Fish and Wildlife Service: National Wildlife Refuge Locator and information provided by EDR’s NepaCheck Report, the tower site is not located within an officially designated wildlife preserve. 3a. Listed Threatened or Endangered Species or Designated Critical Habitats: Based on a review of the U.S. Fish and Wildlife Species by County Report for federally listed threatened and endangered species within Davison County, as obtained from the Environmental Conservation Online System, information provided by EDR’s NepaCheck Report, and on-site observations, no indications of listed threatened or endangered species were noted on the tower site. 3b. Proposed Threatened or Endangered Species or Designated Critical Habitats: Based on a review of the proposed threatened and endangered species within the region, as obtained from the U.S. Fish and Wildlife Service: Environmental Conservation Online System, information provided by EDR’s NepaCheck Report, and on-site observations, no indications of proposed threatened or endangered species were noted on the tower site. The tower site is also not located within an area qualifying as proposed critical habitat. 4. Historical Places: Based on our review of the National Register of Historic Places, information provided by the South Dakota Historic Preservation Office, and information provided by EDR’s NepaCheck Report, the tower will not adversely affect properties listed on or eligible for listing on the National Register of Historic Places within the 1.5 mile Area of Potential Effect (APE). In addition, the existing tower is not pending an environmental review before the FCC. The South Dakota State Historic Preservation Office has issued a letter of concurrence with the determination that there are no known historic sited within the APE for direct effects, and that the tower will not affect any historic properties within the APE for visual effects. 5. Indian Religious Sites: Based upon a review of available information obtained from the USGS-Indian Reservations listing, Department of the Interior-Bureau of Indian Affairs, National Association of Tribal Historic Preservation Officers and information provided by EDR’s NepaCheck Report, no known Indian religious sites will be affected. Interested tribes were invited to consult on the project in accordance

with Section 106 of the NPA and have issued letters determining that no cultural resources will be affected by the tower construction. 6. Floodplains: Based on a review of the floodplain map of the area (FIRM Community-Panel No. 46061C0105C, dated 09/02/2009), the tower site is located within an area of minimal flood hazard as determined by FEMA. 7. Surface Features: Based on our on-site investigation and a review of the National Wetland Inventory map of the area, the tower is not anticipated to result in a significant change or modification of surface features such as fill in jurisdictional wetlands, deforestation, or water diversion. 8. Zoning/High Intensity White Lights: The tower is 400 feet above ground level (AGL) and will be equipped with FAA approved lighting. 9. Antenna Power and Elevation: Installation details include 92.1 MHz and 100 kW ERP. Based on the specified elevation of the proposed tower (>10 meters) and because the site will be located within a restricted area, no further study concerning radio frequency emissions is required.

Abstract

On September 19, 2015, Brad Noisat, Principal Investigator of Niwot Archaeological Consultants, Inc, performed a Level III Inventory of a 6-acre block area surrounding Riverfront Broadcasting LLC’s proposed KZKK Tower in the city of Mitchell, Davison County, South Dakota. The proposed APE for Direct Effects will include a 400 ft high triangular steel tower supported by three guy wire locations in addition to associated utility runs and a short access road. The new tower will be sited adjacent to an existing 415 ft high radio tower. The proposed APE for Visual Effects is defined by 3/4-mile radius surrounding the proposed tower. No cultural resources occur within the Direct Effects APE of the project. Two Historic Properties, 39DV2003 and 39DV2007, occur within the Visual Effects APE of the project. Both are historic railroad lines. The proposed undertaking will have No Effect on visual appreciation of these two cultural resources within the APE for Visual Effects. Section 106 cultural resource clearance for the proposed undertaking is recommended. Project Description

Riverfront Broadcasting LLC of Yankton, South Dakota proposes to construct the KZKK Tower, a radio tower, at Old Highway 16 one mile east of SD Highway 37 in the city of Mitchell, Davison County, South Dakota. The project area location corresponds to the SE1/4, SE1/4, SW1/4, Section 23, T103N-R60W, 5th PM (USGS 7.5’ Riverside, South Dakota 1974 quadrangle). Attachment 1 shows the project location and Visual Effects APE on the Riverside quadrangle. Attachment 2 provides photographic views of the project area. Figure 1 is a Google Earth aerial view of the project area. An existing 415 ft high radio tower is present within the project area.

The APE for Directs Effects is defined as a 6-acre block area (555 ft N/S x 480 ft E/W) bounded by property lines fences on all sides. Proposed construction within the 6-acre APE will include: (a) a 400 ft high triangular steel AM/FM radio tower; (b) three guy wire support anchor locations extending 240 ft from the tower base; and (c) associated locations including a small utility shed adjacent to the tower, buried utility service lines, and a short access. Ground-disturbing construction associated with the installation of these facilities, in addition to the movements of heavy construction equipment and vehicular traffic over project area surfaces, may have adverse effects to Historic Properties, if present. The 6-acre Direct Effects APE effectively defines the spatial limits of these potential adverse effects to potential Historic Properties. Per FCC requirements, the APE for Visual Effects of the project is defined as a ¾-mile radius surrounding the proposed tower. The subject property is privately owned by Riverfront Broadcasting LLC. Project data are stored at the State Archaeological Research Center of South Dakota, Rapid City.

Level I Cultural Resource Inventory

On September 8, 2015, a Level I inventory was performed using GIS data supplied by Terri Bruce of the State Archaeological Research Center of South Dakota (ARC), Rapid City. The Level I inventory identified all known previous inventories, historic districts,

prehistoric and historic sites, structures, and bridges within an expanded 1.5-mile radius of the proposed tower. These data are used herein to identify known Historic Properties that might be adversely affected by the proposed undertaking.

The project area is located within South Dakota Archaeological Region #16, Lower James (Winham and Hannus 1991). Table 1 summarizes the prehistoric chronology for Region #16.

The ARC records show that no previous inventories have been performed within the Direct Effects APE of the project, and that no previously recorded sites are known to occur within the Direct Effects APE of the project. Table 2 lists the 14 previous inventories that have been performed within 3/4-mile of the project area.

Table 3 lists two known Historic Properties (with SHPO concurrence) within the

Visual Effects APE of the project. Site 39DV2003, the Chicago and Northwestern Railway (C&NW RR), also known as the “Northwestern,” is a system of various acquired rail lines initially chartered in the Chicago area in 1859. A branch of the C&NW RR reached the Mitchell area in 1887. Site 39DV2007 is the Chicago, Milwaukee, St. Paul & Pacific Railroad (CMStPP RR). Also known as the “Milwaukee Road,” the CMStPP RR was constructed into the Mitchell area in 1881. Both are standard-gauge railroads lines that contributed significantly to the development of South Dakota settlement and economy, and are thus considered NRHP-eligible under Criterion A. A thorough historic overview of the two railroads in South Dakota can be found in Hufstetler and Bedeau (1998).

One GLO plat of T103N-R66W dating to 1870 is available for the project area. No cultural activity is shown within the project area at that date. However, a NW/SE road depicted in adjacent Section 26 may be a forerunner of 39DV2007.

Site 39DV0067, an archaeological site, was field-recommended as eligible but is listed by the South Dakota SHPO as Unevaluated. This site is potentially significant under Criterion D for its scientific rather than visual qualities.



Level III Inventory On September 19, 2015, the author performed a Level III field inventory of the 6-acre

Direct Effects APE of the project. The project area is located about one mile from the southwest urban core of Mitchell. A modest family home lies immediately west. Other residences of this sort dating to the 1960s-1970s+ surround the immediate environs of the project area. Contemporary housing developments are present north of the project area, and more substantial estate-and-acreage developments associated with a golf course adjacent to Firesteel Creek are present to the northeast. None of these housing developments are shown on the 1974 Riverside quadrangle.

Ground elevation at the proposed tower location is 1300 ft. South Dakota Geological Survey GIS data show that the substrate is composed of Quaternary glacial till and minor moraine deposits. Sediments in the project area consist of light brown sandy loam loess. The project area was once cultivated, but the cropland has since been abandoned and the grounds have been reclaimed by a last-stage succession association of mixed grasses and weedy forbs. The northern periphery of the project area is represented by a high stream bank under juniper cover. The entrenched stream below the bank is dry.

The 6-acre project area was examined using sinuous pedestrian transects spaced at intervals no greater than 10 m. Ground visibility over most of the project area was 10% or less. The wooded stream bank on the northern periphery of the project area was treated as a potential “archaeologically sensitive area.” Ground visibility in that area was 40% and rodent burrow areas and deflated surfaces were also present.

Widely scattered instances of guy wire cabling and other miscellaneous pieces of metal and equipment associated the existing tower were found within the project area. However, no cultural resources are present within the Direct Effects APE.

Visual Effects Assessments: 39DV2003 and 39DV2007

The previously recorded and evaluated segment of 39DV2003, the CNW RR grade, is situated at the limits of the Visual Effects APE, or about 0.75 mile northeast of the proposed tower location. This location is on S. Gale St, which is now part of an expansive golf course estate development. As shown in Figure 2, the RR grade at this location has been abandoned and re-purposed as a private access road. Access to any other possibly extant segment in the immediate vicinity of this location was access-prohibited. Nonetheless, the visual relationship between the new tower and the abandoned RR grade anywhere within the immediate vicinity would be similarly represented by the top and bottom photographs, insofar as the existing 415 ft tower forms an adequate visual reference for this relationship. Since the recorded segment of 39DV2003 within the Visual Effects APE is no longer extant (all integrity lost), the proposed undertaking will have No Effect on visual appreciation of this resource.

The visual relationship between the nearest previously recorded and evaluated segment of 39DV2007, the CMStPP RR line, is shown in Figure 3. This segment is situated 0.42 mile west of the proposed tower. Site 39DV2007 is an active RR line along its entire length, recorded and unrecorded. The railroad grade in the vicinity of the project area typically follows deeply entrenched stream beds and lower slopes, where only the upper portions of a 400 ft+ tower might be visible from the grade. photograph in Figure 3 was taken from the elevated overpass on S. Burr St in urban Mitchell; access to the recorded segment of actual grade at this location was prohibited. But as seen in that bottom photograph, the high tree cover adjacent to ground level at the grade would probably block views of all but the upper portions of the new tower. This slight difference (new and existing towers) to the existing visual context of the site would have No Effect on visual appreciation of 39DV2007.



In summary, based on the visual effects assessments of the new KZKK Tower to sites 39DV2003 and 39DV2007, the proposed undertaking will have No Effect on these two resources for the reasons cited below:

• The new KZKK Tower will not appreciably alter the existing visual landscape

associated with 39DV2003 and 39DV2007, given its siting adjacent to the existing 415 ft tower.

• The segment of 39DV2003 is no longer extant.

• Views of the new KZKK Tower from 39DV2007 would be highly limited due to

intervening slope and tree cover. The new tower will thus go unnoticed. • In any event, at this location, 39DV2007, a simple active railroad grade, is

primarily significant for its Criterion A historical values rather its visual qualities. Recommendations

Based on the Level III inventory results, direct effects and visual effects of the proposed KZKK Tower Project are as follows:

No Historic Properties occur within the APE for Direct Effects.

Two Historic Properties occur within the APE for Visual Effects: railroad

lines 39DV2003 (CNW RR) and 39DV2007 (CMStPP RR). The proposed undertaking will have No Effect on visual appreciation of these resources.

Cultural resource clearance for the proposed KZKK Tower Project is recommended.

If subsurface remains are found during construction, these should be reported immediately to the South Dakota State Historic Preservation Office, Pierre.

National Wetland Inventory Maps are produced by the U.S. Fish and Wildlife Service, a sub-department

of the U.S. Department of the Interior. In 1974, the U.S. Fish and Wildlife Service developed a criteria for

wetland classification with four long range objectives:

· to describe ecological units that have certain homogeneous natural attributes,

· to arrange these units in a system that will aid decisions about resource management,

· to furnish units for inventory and mapping, and

· to provide uniformity in concepts and terminology throughout the U.S.

High altitude infrared photographs, soil maps, topographic maps and site visits are the methods

used to gather data for the productions of these maps. In the infrared photos, wetlands appear as

different colors and these wetlands are then classified by type. Using a hierarchical classification,

the maps identify wetland and deepwater habitats according to:

· system

· subsystem

· class

· subclass

· modifiers

(as defined by Cowardin, et al. U.S. Fish and Wildlife Service FWS/OBS 79/31. 1979.)

The classification system consists of five systems:

1. marine

2. estuarine

3. riverine

4. lacustrine

5. palustrine

The marine system consists of deep water tidal habitats and adjacent tidal wetlands. The riverine

system consists of all wetlands contained within a channel. The lacustrine systems includes allnontidal wetlands related to swamps, bogs & marshes. The estuarine system consists ofdeepwater tidal habitats and where ocean water is diluted by fresh water. The palustrine system

includes nontidal wetlands dominated by trees and shrubs and where salinity is below .5% in tidal

areas. All of these systems are divided in subsystems and then further divided into class.

National Wetland Inventory Maps are produced by transferring gathered data on a standard 7.5

minute U.S.G.S. topographic map. Approximately 52 square miles are covered on a National

Wetland Inventory map at a scale of 1:24,000. Electronic data is compiled by digitizing these

National Wetland Inventory Maps.

distance and the Area of Potential Effect. Each photograph should have the actual location of the tower

marked.

2. A general state-wide map showing the regional location (i.e. with towns,cities, roads and major geographic

features).

�3. A topographic map(derivedfrom the USGS 7.5 Topographic Quadrangle series) zoomed out to a scale of

about 1:20,000 to clearly show the landscape (i.e. with the location in a surrounding area of at least four

square miles).

4. A map showing the locations of any known cultural sites of indigenous peoples (i.e., archaeological sites)

within a half-mile of the APE.

5. If relevant, a map showing the location of any indigenous cultural site (i.e., archaeological site) within or

adjacent to the APE in relation to the locations of proposed structures.

6. A succinct description of the site of the proposed undertaking with bulleted descriptions of local

topography, typical vegetation, existing disturbances, archaeological survey results (i.e. as per Section 106,

NHPA), and acharacterization by the applicant's archaeologist of the potential for buried cultural resources or

Traditional Cultural Properties.

Each report should include maps that show the location of the proposed project and topographic features of

the proposed project area. Each map should show the standard Area of Potential Effects as determined by the

height of the tower and the FCC's Nationwide Programmatic Agreement.

When SHPO site files are referenced, please include the SHPO's file number, site name, and a brief narrative

summary as to the type of site. The summary should be sufficient to enable the reader to understand why the

site was documented. We would also like to know how far the site is from the project. Each report should

include photographs of the tower and the surrounding landscape.

The Tribe does not consider predictive modeling to be adequate in the identification of cultural resources.

Literature review, aerial photographs, and statistical probability are not a replacement for boots on the

ground.

The Northern Cheyenne Nation has a long and rich history in the area including oral histories going back

millennia. Under 36 CFR 800 .4 we have the right to evaluate federal undertakings with the potential to effect

cultural resources. Our unique knowledge of sites and their potential significance under the National and

Tribal Register make it essential for us to evaluate all sites within the area of potential effect.

Also, please include a summary of all newly recorded cultural resources identified for the current undertaking.

If a full Class III survey report was not required, please state the reason why one is not attached, such asno

If cultural materials are discovered during construction please notify the Tribal Historic Preservation Office. Under the authority of Section 106 of the National Historic Preservation Act of 1966 and in accordance with 36CFR800.2A4, after reviewing the materials you gave us for the project, the Sisseton Wahpeton Oyate Tribal Historic Preservation Department finds there should be no effect by the proposed undertaking on cultural resources. The proposed undertaking is near known and documented cultural resources. Many of these resources are Native American sites. The vicinity of the project is significant to the Sissetonowan (People of the Marsh) Wahpetonwan (Dwellers Among the Leaves) Oyate (People). For millennia, the Sissetonowan Wahpetonwan Oyate have Wo Wacekiya (prayed), gathered pejuta (medicines), Wicoti (camped) the surrounding vicinity, and Wicah’pi (buried our dead). Since the area around the project was HEAVILY utilized in prehistoric times, it is particularly important for the construction to remain in the areas designated in the archaeological survey. No further cultural resource work is necessary for this project as long as the areas outlined are adhered to. If additional work is necessary outside the areas designated, please notify our department and we can make the necessary arrangements. Please be aware though, because cultural inventories are done at different times of the year and under different circumstances there can be variations in the effectiveness of pedestrian surveys. At times, certain resources are not visible. For instance, medicinal plants, some very significant to the ongoing traditions and lifeway of the Spirit Lake people, may only be seen in the spring or summer of the year. Other times, the grass is too deep for certain features or artifacts to be located through pedestrian surveys. With this in mind, we recommend that cultural resources not be forgotten with this letter of finding of no properties affected.
