County Administrator Cordes thanked Clerk Upton, she has been trying to get the personnel policy manual into a complete book for years. The Military Leave resolution changes language to be in federal compliance.

Following resolution was adopted:

#a.10 RESOLUTION NO. 18-788

In the matter of repealing and adopting new Section 6.7 -)Military Leave of the Board of Commissioners Personnel) December 12, 2018Personnel Policy Manual )

WHEREAS, it is the intent of the Board to clarify the Section A on Military Leave, Section A in accordance with federal laws.

BE IT RESOLVED by the Board of Commissioners of Lorain County, Ohio that all previous versions of Section 6.7 of the Board of Commissioners Personnel Policy Manual are hereby repealed, and in their stead the Board of Commissioners hereby adopts the following.

A. Any permanent public employee who is a member of the Ohio organized militia, or a member of other reserve components of the Armed Forces of the United States including the Ohio National Guard is entitled to a military leave of absence from his respective duties without loss of pay for such time as he is performing service in the uniformed services for periods not to exceed one (1) month (meaning twenty-two [22] working days, or one hundred seventy-six [176] hours for a forty [40] hour per week employee) for each federal fiscal year (October 1 to September 30) in which the employee performs service in the uniformed services. For the purposes of this policy, "permanent public employee" means an employee who holds a position with the County that requires him to work a regular schedule of twenty-six (26) consecutive bi-weekly pay periods, and such is not limited to a specific season or duration. This definition does not include student help; intermittent, seasonal, temporary employees: or individuals covered by personal services contracts. Other provisions for military leave shall be controlled by state and federal laws.

B. Any permanent public employee called to military duty for a period in excess of the twenty-two (22) working days because of an executive order issued by the President of the United States or because of an act of Congress or because of an order to perform duty issued by Governor pursuant to RC Section 5919.29, may receive, during this period, the lesser of the following: 1. The difference between the employee’s gross monthly wage or salary from the County and his gross uniformed service pay and allowances received in a particular month; or2. Five hundred dollars ($500.00).

C. An employee requesting such leave will be required to submit the necessary documentation and/or complete the necessary leave papers.D. Active Duty Military Leave

1. A permanent public employee is entitled, upon giving notice to the Appointing Authority, to a leave of absence to serve in the uniformed service. Such leave is without pay and is considered as a leave of absence from service with reinstatement rights. No leave, or combination of uniformed service leaves of absence, may exceed five (5) years or a single, longer period required to complete an initial period of obligated service.

2. An employee returning from uniformed service leave without pay must apply for reinstatement. The application must be made to the Appointing Authority within the period set forth below.a. Leave of less than thirty (30) days: immediately upon release from uniformed service, but Appointing Authority must

allow for travel time and eight (8) hours of rest;b. Leave of thirty-one (31) to one hundred and eighty (180) days: within fourteen (14) days of completing uniformed

service requirement; orc. Leave of more than one hundred eighty (180) days: within ninety (90) days of completing uniformed service

requirement.3. If the leave of absence is for more than ninety (90) days, the Appointing Authority may require, with the application, evidence

showing that the application is timely, the duration of all such leaves of absence does not exceed five (5) years, or the time to complete the initial period of obligated service, and the employee’s entitlement to re-employment has not terminated pursuant to the Federal Uniformed Services Employment and Re-employment Rights Act.

4. Upon return from a period of duty in the uniformed service lasting ninety (90) calendar days or less, the employee is to be returned to the same or similar position within his former classification. If the period of duty lasts more than ninety (90) days, the employee may be placed in any position of equivalent status, seniority, and pay. Regardless of the duration of duty, if the Appointing Authority demonstrates to the Director of the Ohio Department of Administrative Services that reinstatement is impossible or would impose undue hardship, the employee may be assigned to another position with like seniority, status, and pay, or the nearest approximation thereof consistent with the circumstances of the case.

5. If the employee is unable to perform the duties of his former position due to a permanent injury or illness incurred or aggravated during uniformed service, the Appointing Authority will make reasonable efforts to accommodate the employee’s disability.

6. If an employee who is entitled to reinstatement is unable to report for or perform the duties of his position at the date of his application for reinstatement because of a temporary injury or illness incurred or aggravated during uniformed service, he shall have up to two (2) years to recover from such illness or injury before being required to report or reapply.

7. A reinstated employee is entitled to receive all rights and benefits generally available to employees in a comparable leave of absence without pay, including the following:a. All sick leave and vacation leave which had been accumulated at the time of entering service;b. All seniority that would have accrued had the employee been on the job;

c. Automatic salary adjustments associated with the position and due the employee had the employee been on the job;d. other than waiting periods or exclusions that would have applied even if there had been no absence for uniformed service. (Please note that this rule does not apply to the coverage of any illness or injury determined by the Secretary of Veterans’ Affairs to have been incurred in, or aggravated during, performance of service in the uniformed service.)

The Lorain )County Planning Commission is currently in the process )of finalizing the approval of a new 39 lot subdivision on )the south side of Sprague Road in Columbia Township. ) December 12, 2018This subdivision includes all of Lorain County parcels )identified by the Auditor as 12-00-100-000-015 and 12-00-)100-000-006. As part of this project, the developer is )requesting that sanitary sewer service be extended from )Olmsted Township in Cuyahoga County to the proposed )subdivision. In June of 2018, NOACA approved FPA )modification and October 17, 2018 Commissioners )Res#18-678 approved Sanitary Sewer Service Agreement )between Lorain and Cuyahoga County to provide an outlet )for the new sanitary sewers that will be constructed as part )of the subdivision. The final approval requires an )amendment to the service agreement between Lorain )County and the Northeast Ohio Regional Sewer District )

County Administrator Cordes asked Mr. Klaiber if the agreement with the Developer requires the big truck on Sprague to be connected into. Mr. Klaiber said that agreement is with Cuyahoga County. Mr. Cordes said this will provide service to the north side, there are a lot of pocket development over there, but there is nothing on the south side. The line of both counties is down the middle of the Sprague Road and we need to get progress density in Columbia Township to get the big sewer built and thanked Mr. Klaiber for all his work on this.

Application to the Northeast Ohio Regional Sewer District for Inclusion Within the District of Certain Unincorporated Territory of Lorain County, Located in Columbia Township

WHEREAS, the unincorporated territory of Lorain County, Ohio is partially, but not wholly included within the Northeast Ohio Regional Sewer District (hereinafter, “District”); and

WHEREAS, the Commissioners have found that certain territory, which is described in the “Exhibit 1” attached hereto and incorporated herein, is among the territory not currently within the District; and

WHEREAS, it is understood by the Commissioners that the Additional Territory shall not become part of the District unless and until the Board of Trustees of the District accept this application; and

WHEREAS, it is understood that the District’s acceptance of this application will not be considered unless and until the Board of Trustees of Columbia Township adopts a resolution approving a amendment to the stormwater service agreement between the Township and the District to add the Additional Territory to the stormwater service area covered under said service agreement; now, therefore,

BE IT RESOLVED by the Board of Commissioners of Lorain County, Ohio:1. That the Board hereby makes application to the Northeast Ohio Regional Sewer District (the "District") to include within the

territory of the District the said County territory in Columbia Township depicted in “Exhibit 1” attached hereto and incorporated herein (herein, the “Additional Territory”).

2. That the Board hereby declares that the inclusion of the Additional Territory within the District to be necessary and conducive to the public health, safety, convenience, or welfare, and that it is practical and feasible for the Additional Territory to be included within the District.

That the Board hereby authorizes Lorain County Sanitary Engineer Ken Carney, to submit to the District this Resolution, with “Exhibit 1” as a complete application for inclusion of the Additional Territory within the District, and to take any additional action or to execute any additional documents subsequently deemed necessary to complete such application to the District for inclusion of the Additional Territory within the District and to effectuate its inclusion in the District.

4. That, in furtherance of this application, the Board hereby approves a Fourth Amendment To Service Agreement No. 3162 By and Between the Northeast Ohio Regional Sewer District and the Lorain County Board of Commissioners Providing for the Inclusion of Certain Territory of Lorain County in Columbia Township into the Northeast Ohio Regional Sewer District, and hereby authorizes the President of the Board of Commissioners to execute the same.

BE IT RESOLVED, by the Lorain County Board of Commissioners that we hereby approve and enter into an agreement on behalf of Lorain County Transit with the City of Oberlin for Connector and Modified Fixed Route transit service two days per week for nine hours of service, including deadhead time, for each of those days; the Modified Fixed Route service shall consist of periodic trips from Oberlin to Elyria and/or Lorain. Residents of Elyria or Lorain travelling to Oberlin may be accepted by LCT as long as there are no adverse impacts on Oberlin residents.

Said agreement is considered a part hereof to this resolution by reference thereto and can be found on file in the Commissioners/Purchasing and LCT offices, effective Wednesday, January 2, 2019 and ending Monday, December 30, 2019.

Said agreement specifies Oberlin service fares that are consistent with LCT fares plus a special one-way fare of $1.00 for Oberlin residents of LMHA facilities who are declared by the City of Oberlin as low-income and provided with an Oberlin-issued ID card entitling them to receive the fare discount through the agreement period and on the Oberlin Connector only.

FURTHER BE IT RESOLVED, City of Oberlin will provide the County with local funds in the amount of $24.07 per hour to be used by LCT as match to an equal amount of grant funds in order to support the service, plus a $50.00 monthly fee to cover administrative expenses, no County general funds dollars will be used for said service.

WHEREAS, the LCDJFS Agreement includes a provision that Lorain County Transit may subcontract the non-emergency medical transportation services; and

WHEREAS, Lorain County Transit desires to contract with First Transit, Inc. to provide non-emergency medical transportation services for LCDJFS effective December 1, 2018 through September 30, 2019

WHEREAS, the Lorain County Board of Commissioners agree to reimburse First Transit, Inc. based on a gate-to-gate hourly rate of $48.14 and a monthly fixed rate fee of $9.075.

County Administrator Cordes said this will continue to correct the flooding for Elyria and Sheffield Township. Sheffield Township Hall and Fire Department had water issues as well as 36th Street ditch and St. Lads. He stated the county purchased land behind Lake & Elyria Avenue owned by Lady of Wayside and permission was given to people to log from Lady of the Wayside but they had never restored the area, so it turned into a wetland. Therefore the county applied for a grant to do storm water restoration but we were not able to retain enough water with a slow release so we found an area between the Lorain County Board of Elections and Gargus Hall, being secured through Port Authority/Land Bank. Commissioner Kalo said this is a good project. Mr. Cordes said it will give relief to the City of Lorain. Commissioner Lundy said when there is a heavy rain it is known to flood bad in this area and one time he had to move his car because of the flooding.

CTL Engineering, Inc. will provide general Geotechnical and Environmental Engineering, Materials Testing and Construction Inspection as part of a 12-month task order basis with fees based upon the number of hours worked in accordance with their hourly rates. The one year contract amount is $25,000 and funds are available through the Engineer's MVGT funds.”:

Commissioner Lundy thanked Chris Pyanowski, Prosecutors Office for the collection of delinquent taxes of $20 million, but the county only receives $1.62, and majority goes to the schools.

Commissioner Lundy thanked Virginia Haynes and Community Alliance for a great roundtable discussion and to Marcia Ballinger, President, LCCC receiving the Mike Whitmore Award.

Commissioner Lundy said just like the state sales tax they increased without voter approval and we at the county have to do a tax increase and get ridiculed.
