President’s Post Dear Members, Your Natomas Park Master Associa on (NPMA) Board of Directors, management company (FirstService Residen al), and commi ees are moving forward on the clubhouse improvement project, legal issues and more. The Club Construc on Improvements Advisory Commi ee (CCIAC; formerly the Master Plan Advisory Commi ee) con nues to make progress during and a er the holiday season. Associa on management sent Request for Qualifica ons (RFQs) to 13 architectural/engineering firms reques ng produc on of conceptual designs for the Clubhouse expansion project. Three firms submi ed responses. In December and January, CCIAC members, along with selected Board members and Associa on management staff, evaluated the proposals and conducted interviews. Next steps include selec ng a firm and nego a ng a contract. Clubhouse improvement designs will eventually be presented to the membership for a vote. In the event the membership elects not to approve expansion, the CCIAC, management, and Board reviewed and priori zed construc on defects that can be fixed with exis ng funds. Some of the 93 Ryland Garden homes have experienced water leaks in the conveyance between the city water main and the home. In December, associa on management mailed disclosure le ers to these homeowners. Addi onal informa on will be shared during a town hall mee ng as it becomes available. Associa on management is working with Paladin Security, the City of Sacramento Police Department, and legal counsel to evict a second squa er who broke into a home that the Associa on owns. Occasionally, the associa on places a lien and then forecloses on a home due to nonpayment of dues over an extended period. NPMA owns the home only un l the senior lienholder (bank or other lending ins tu on) forecloses and takes possession. When the senior lienholder forecloses, this typically ex nguishes NPMA’s junior lien. Some mes this takes a long me. In the interim, NPMA endeavors to maintain these proper es to prevent them from becoming eyesores or nuisances. Upon receipt of a valid recall pe on, the full Board appointed the FirstService Residen al Vice President of Northern California as Inspector of Elec ons. The Inspector of Elec ons carried out the recall elec on in accordance with NPMA’s governing documents. The cost of the recall elec on (not including staff me) was $30‐$31,000. Most of this amount cov‐ered mailing costs ($23,688.46), with the remainder for legal fees ($4,517.50 plus an addi‐onal unbilled amount; around $2K). As men oned previously, the Board elected to fill the

vacancy concurrent with the annual elec on this spring. Two Board posi ons will be available. On January 8, 2015, a complaint was filed against NPMA at the Superior Court in Sacramento County (case number 34‐2015‐00173763). This lawsuit requests the Court to declare the recall elec on invalid and allow Mr. Fassnacht to serve the remainder of his term (un l June 2015). The complaint also requests payment of a orney fees. As this involves pending li ga on, the Board cannot provide further informa on.

Fassnacht vs. Natomas Park Master Associa on Sacramento Superior Court Case No: 34‐2012‐00122936 Announcement of New Lawsuit William J. Fassnacht v. Natomas Park Master Associa on Sacramento Superior Court Case No.: 34‐2015‐00173763

Dear Members:

The purpose of this le er is to provide you with informa on regarding the lawsuit previously filed by William J. Fassnacht against the Associa on, and also to inform you of another lawsuit recently filed by Mr. Fassnacht against the Associa on. Mr. Fassnacht filed a lawsuit against the Associa on on April 20, 2012. In that lawsuit, Mr. Fassnacht alleged that the Board of Directors "removed the District Delegates" in 2008 and then appointed replacement delegates. Mr. Fassnacht alleged this violated the Bylaws in effect at the me. Mr. Fassnacht alleged this was done without proper no ce because it was allegedly not on an agenda. Mr. Fassnacht further alleged that because this ac on related to the Delegates, the subsequent amendments to the CC&Rs and Bylaws were invalid. Mr. Fassnacht also alleged that 75% of the mortgagees in Natomas Park were required to approve amendments to the Bylaws. The Associa on denied all of the allega ons. A full copy of the complaint filed by Mr. Fassnacht on April 20, 2012, as amended, can be found through the Sacramento Superior Court website.

In the lawsuit, Mr. Fassnacht sought an order from the Court to require the Associa on to "re‐seat the 2008 District Delegates," to prevent the Associa on from "amending the 2008 Bylaws without mortgagee approval," "requiring the Board to properly no ce mee ngs with an agenda," and "barring the Associa on from using, following or vo ng in accord with the 2008 and 2009 Amendments to the CC&Rs and Bylaws." Mr. Fassnacht further sought a declara on from the Court that the Associa on performed all of the ac ons he alleged and that the ac ons violated the Associa on's governing documents. Mr. Fassnacht also sought recovery of his a orneys' fees and court costs.

The Board of Directors and Mr. Fassnacht, along with their respec ve a orneys, a ended a full day of media on on February 19, 2014. At that media on a se lement was reached. The Associa on's insurance carrier agreed to pay for $20,000 of Mr. Fassnacht's legal fees, and the Associa on agreed to pay the remaining $4,000 of his legal fees. The se lement agreement stated that Mr. Fassnacht could issue a statement about the proposed revised governing documents (that were previously mailed and voted on) pursuant to Civil Code Sec on 5105, which governs member's rights to par cipate in elec ons equally. Mr. Fassnacht waived and released all claims he raised in his lawsuit and dismissed the case. There were no other terms of the se lement requiring any ac ons or payments, and the Associa on was not required to perform any other acts.

On January 8, 2015, Mr. Fassnacht filed another lawsuit against the Associa on. A full copy of this latest complaint filed by Mr. Fassnacht can be found through the Sacramento Superior Court website. This second lawsuit is based upon the outcome of the elec on to remove Mr. Fassnacht from the Board. In September 2014, a pe on signed by at least 5% of the members was submi ed to the Associa on calling for a special elec on to vote to remove (recall) Mr. Fassnacht from his posi on on the Board of Directors. The required special elec on was held and the ballots in that elec on were opened and tabulated on December 16, 2014. The results of the elec on were 2490.5 in favor of removing Mr. Fassnacht, and 1316.5 against removing Mr. Fassnacht. As a result, Mr. Fassnacht was removed from the Board of Directors by the members effec ve December 16, 2014. The lawsuit filed by Mr. Fassnacht on January 8, 2015, alleges that recall elec on was improper and Mr. Fassnacht is seeking to overturn the results and have the court place him back on the Board of Directors. Mr. Fassnacht is also seeking recovery of his a orneys' fees and costs.

The Board of Directors denies all of the allega ons in Mr. Fassnacht's newest lawsuit and intends to fully defend the Associa on against these latest claims.

It is the me of year when our fences are prone to failure. High winds and pouring rain can wreak havoc on our fencing. Some‐mes, when posts are weak from water damage or old age, they

can blow down or bow in one direc on or other. We have a com‐munity of "good neighbor" fencing and requirements to keep the public side painted and properly maintained. This includes those many fenced yards that are along greenbelts or park areas. Those homes have much more of a fence maintenance burden but, it is cri cal for those in par cular to be in the best possible condi on. Those are the fences that display the level of pride and standard that is the hallmark of our community.

Work out any maintenance needed between homes with your neighbors. Perhaps you are able to perform the work yourselves or you may need to hire someone to make those needed repairs. Either way, this is part of ongoing maintenance of your home that needs to be in keeping with NPMA standards. The paint color for fencing is Sherwin Williams Carabou SW 3025. There is no other subs tute color and if your fence has not had at least one fresh coat since the home was built, it is definately me to do so. It is surprising how much of a faceli this can give your landscape.

February is officially here! I think we can all agree that January flew by very quickly. It is not too late to take advantage of the gym and our wonderful fitness classes. If you

need some mo va on to get back in the gym, ask us and we can help find you a trainer or class that will suit your needs. Many members have made fitness resolu‐ons, so as a courtesy to other members;

please con nue to abide by the fitness center rules that Management has in place. These rules are listed in our pam‐phlet at the front desk and signs around the gym. Let’s all work together!

February is family me! From Valen ne’s Day to Presidents Day to our own Chinese New Year’s celebra on. Let me suggest a New Year’s “February” Resolu on that you can do together as family. Remem‐ber, when asked about your favorite memories from childhood, many people

will men on things they did with their families! For a simple ac vity, write "Punxsutawney" on a sheet of paper and see how many words you can make from the le ers in it. Example: sat, pun, tune, neat, eat, nut, tan, yes, say, set, nun, wet, saw, was, tawny, etc.

Exercise/Play‐ Go for a walk or run to‐gether or play soccer or basketball. Our community has great places to exercise and did I men on our fabulous Club!

Arts and Cra s‐ Read, paint, do puzzles, make a me capsule.

Family Ou ng‐ Go to the zoo, musical, sports event….have you taken the li le ones to Funderland!

Cooking a Meal‐ Make dinner prepara on fun by planning and cooking a meal to‐gether.

As we prepare for summer, the Club staff is working hard to get the facility ready. Please con nue to use the Sugges on box

as we strive to keep things working properly. Have you had a chance to try out new menu specials? Friday Happy Hours have been a great success and we’ve had scrump ous specials during winter. With summer only months away, we are tes ng some new favorites that might make the menu. Please stop by to enjoy new items and watch for eblasts as well.

It’s Super Bowl Time Again! This event is free so please make this year’s game a memorable one at the Club. There will be a potluck and drink specials!!! I hope that your favorite team will make the big show but if not, there is always next year.

Rules Related to the Fitness Center From NPMA’s Club Rules & Regulations

Equipment and Towels

When others are wai ng to use equipment, use of cardio‐equipment is limited to thirty (30) minutes per person.

Banging and/or dropping of weights are prohibited.

Members and guest are required to return and re‐rack weights a er use.

Use of all equipment is at Members’ and Guests’ own risk.

Personal items (i.e. coats, bags, etc.) must be stored in a lock‐er or placed in a cubby or on one of the coat racks.

Placing items on the floor is prohibited.

Do not disturb classes in session. Ask a staff member to retrieve needed equipment

Food and Beverages Food and beverages may not be brought into the Fitness Center except for water in sports bo les.

A re Proper athle c a re is required when using the fitness equip‐ment. Athle c clothing such as sweats, T‐shirts, athle c shorts, and closed‐toed fitness shoes is permi ed. Open‐toed and open back shoes are not permi ed in the fitness area. Clothing such as denim, Khaki’s, pants or shorts with belt loops and/or bu ons is not per‐mi ed. Except for weight belts, belts are not permi ed under any circumstances. Tank tops must cover chest and back.

Minors Minors under fourteen (14) years of age are not permi ed in the Fitness Center under any circumstances. Minors fourteen (14)

years of age or older may use the Fitness Center with adult supervi‐sion. Minors fourteen (14) years of age or older may use the Fitness Center without adult supervision, provided there is on file with the Operator a Consent, Waiver, Release and Indemnifica on Agree‐ment executed by such minor's parent or legal guardian.

Personal Trainers Members may not bring their personal trainers or fitness instructors into the Fitness Center as a Guest or otherwise. Members may not train another person in the Fitness Center. Person‐al trainers may be available through The Club upon prior reserva on and at charges to be set by the Operator.

Cancella on Policy Members must cancel appointments for special services twelve (12) hours prior to the scheduled appointment or the responsible Member will be charged the full amount of the service. If the Member has prepaid for the services, and has properly canceled, the Member may reschedule within the same month at no addi onal charge.

Cell Phones/Tablet type devices Members and guests may only use cell phones in the fitness areas to listen to music or watch videos and must do so wearing headphones. Taking pictures or making videos of Club staff, homeowners or guests is prohibited. As a courtesy to others, please step out of the fitness areas to receive or make phone calls.

Bath and shower areas. Cell phones are prohibited from use in the bath and shower areas.

The Kid’s Zone at The Club At Natomas Park strives to provide a safe and fun‐filled environment for your child/children. Your involvement as a parent is key to insuring the success of your child’s experience with us.

Although food is not served to the chil‐dren as part of the program, NPMA Kid’s Zone currently uses various products and play‐dough for cra projects. Please ask the a endant for a list of products and their ingredients.

A few things to remember:

Outside food is not allowed in the Kids Zone at any me.

If a child soils his/her diaper or needs assistance while using the restroom, staff will locate and inform the parent. (staff does not change diapers or assist children when using the restroom).

The Kids Zone is first come, first serve. On occasion, the Kids Zone will reach capacity, a sign will be posted and parents will have to wait un l a spot opens. Maximum Capacity of the Kids Zone is 20. However, this limit may be lowered due to staffing and ages.

Parents must be on the Club grounds while their child/children are in the Kids Zone area.

Under no circumstances may a parent leave the Club’s premises.

The Kids Zone has a 1 ½ Hour Maxi‐mum. However, if there is no one wai ng, you may purchase more me and con nue their stay. Parents must check on their child/children before the 1 ½ hour mark.

There is a five minute grace period for picking up your child late. A er 5 minutes you will be charged another 30 minutes.

If a child is showing any signs of ill‐ness, please do not bring them to the Kids Zone.

Upon entry to the Kids Zone, children must sani ze or wash their hands.

To prevent the spread of illness, chil‐dren will have their temporal temper‐ature taken. Any child with a tempera‐ture of 99.4* and above will not be allowed into Kids Zone.

Parents, please no fy the Kids Zone a endant of any allergies, food or product related, medical condi ons, or special needs your child/children may have.

It reviews op ons and makes rec‐ommenda ons on the newsle er, web‐site, email communica ons, and social media to Management and the Board of Directors. It also reviews major communi‐ca ons prior to distribu on to the mem‐bership and makes recommenda ons to the Board of Directors on the current email blast (opt‐in) system. The commi ee meets on the second Thursday of each month at 6:30 pm at The Club at Natomas Park. To be considered, you must be a deeded owner in good standing. Suspicious Person Repor ng While most persons wandering door to door may be engaged in poli cal, reli‐gious or commercial canvassing ac vi‐es, this is a common disguise used by

prowlers who are casing homes. Please do not think twice about repor ng these ac vi es. If it feels wrong, it probably is. In recent weeks there have been a number of suspicious persons within the HOA and surrounding apartment com‐muni es going door to door without apparent lawful pur‐pose, at mes even disguising their face as approaching homes and apartments.

Residen al Burglary on Blackridge Ave ‐ 11/30 A resident returned home from a week long vaca on to find that her home had been burglarized. Paladin and the Sacramento Police Department took reports of the inci‐dent.

Residen al Burglary on Eastbrook Way ‐ 12/06 A resident came home to find someone inside the house. The resident fled the house and was able to flag down a passing Paladin officer. The officer monitored the front of the house un l Sacramento Police arrived. The burglar was found to have already fled the area.

Unlawful Habita on on Riggs Ave ‐ 12/19 Paladin responded to a report of squa ers at a residence. The occupants were found to have a fake lease, and with

the assistance of Sacramento Police officers, were re‐moved from the house.

A empted Home Invasion on Mabry Drive ‐ 12/27 Paladin responded to an a empted home invasion. The suspect had fled just prior to the Paladin Officer's arrival. Based on the descrip on given by the resident, Paladin located one of the suspects in a nearby park. A er a brief chase, the suspect was arrested by the Sacramento Police department and charged with a empted burglary.

This is an ad‐hoc commi ee established to assist the Board with Club improve‐ments for both the construc on defect repairs and poten al Club expansion.

This class is suitable for beginners, decondi oned, older people, and non‐dancers who find Zumba moves too intri‐cate. The steps are simple and easy‐to‐follow with varia‐ons shown so that you can adjust the intensity to suit your
