The total capacity of existing port is 88.10 MMTPA and proposed additional capacity will be 37.49 MMTPA. The total port capacity will be 125.59 MMTPA. after expansion. Cost of project is Rs" 845 Crores. lt is reported that no mangroves are present at proposed sites. However, mangroves were observed outside the project sites. The distance of nearest mangroves from the project site is 1532.8 m. The Kambalakonde Wildlife Sanctuary is located at a distance of 5503.7 m. As a part of the proposed developments in Visakhapatnam Port, the following facilities are proposed to be developed: (i) Up-gradation of Existing Facility and creation of new facility at VPT for iron ore handling on DBFOT basis (OHC & WQ-l) by providing closed conveyor with built up dust suppression system and to replace the ship loader so as to improve the handling efficiency resulting in modernized equipment for dust control at all transfer points. This has reference to your online proposal no. ltuAP/MlSi655/2012 dated 8.2.2016alongwith project documents including Form l, Terms of References, Pre-feasibility Report,EIA/EMP Report regarding above mentioned project.

2.0 The Ministry of Environment, Forest and Climate Change has examined theapplication. lt is noted that the proposal is for modernization of existing facility and addition ofnew facilities entailing capacity at Vishakhapatnam Port. The total capacity of existing port is88.10 MMTPA and proposed additional capacity will be 37.49 MMTPA. The total portcapacity will be 125.59 MMTPA. after expansion. Cost of project is Rs" 845 Crores. lt isreported that no mangroves are present at proposed sites. However, mangroves wereobserved outside the project sites. Development of West Quay North (WO-7 & WO-8) berth with mechanized handlingfacilities for handling bulk cargoes on DBFOT basis: Presently the cargo such as blastfurnace slag, gypsum and ores other than iron ore proposed under this project (WQ-7 &WQ-8), which are already being handled in the semi mechanized method elsewhere inport and in now proposed to be changed to fully mechanized handling system.

Extension of Existing Container Terminal in the Outer Harbour of Visakhapatnam Port onDBFOT basis.

9,0 The present pr,oposal envisages transportatior+-of containers by rail movement /shuttling operations with a contiguous rail line. The Rail share of the evacuation which iscurrently Zero would be slowly improved with the active participation of all the stake holders.

4"0 Quantity of capital dredging will be 9.66 lakh cum. Sediment transport studyconducted by. lt is reported that spoil ground of 2.6 km2 area is suitable for proposeddumping. The details of CRZ classification of the project area are as given below:

5^0 ln order to address the dust generation problem, mechanization of cargo handling isproposed, wherein bulk cargo/coal unloaded from ship falls in a hopper, from hopper passedon to closed conveyor, conveyor to stack yard, from stack yard to silo with bucket wheelreclaimer/conveyor arrangement, loading into railway wagons from silo etc. andtransportation to the destination. ln the said process, transport to stack yards throughdumpers by road will be avoi-ded and conventional handling will be avoided. Alsoenvironmental measures viz. sprinkling and dry fogging at unloading points, transfer housesin conveyor system are also proposed and thereby dust generation is minimized. Wastewaterfrom the port viz. workshops, truck parking areas, etc will be treated in the sewage treatmentplant (STP). Portable oil skimmer will be provided at the berth to remove oil and grease in thewater. Treated sewage will be reused for horticulture purpose. Greenbelt will be developedon the periphery of the area proposed to be developed for WQ- North ( WO-7 & WQ-8) berthin the inner harbour of Vishakhapatnam. 8.0 All the projects related to Ports and Harbour i.e. >5 million TPA of cargo handlingcapacity (excluding fishing harbours) are listed at 7(e) of schedule of EIA Notification, 2006covered under category 'A' and appraised at central level.

9.0 The proposal was considered by the Expert Appraisal Committee (lndustry) in itsmeetings held during 25th - 26th March, 2013,18th- 19th January,2016 and 28th - 29th March,2016 respectively. Project Proponent and the EIA Consultant namely M/s WAPCOS, havepresented EIA / EMP report as per the TOR. EAC has found the EIA / EMP Report andadditional information to be adequate and in full consonance with the presented TORs. TheCommittee recommended the proposalfor environmental & CRZ clearance.

10.0 As per the recommendations of EAC, the Ministry of Environment, Forest & ClimateChange hereby accords Environmental and CRZ Clearance for the above-mentioned project"Modernization of existing facility and addition of new facilities entailing capacity atVishakhapatnam Port by M/s Vishakhapatnam Port Trust", under the provisions of theEnvironment lmpact Assessment Notification, 2006 & Coastal Regulation Zone (CRZ)Notification, 2011 and amendments thereto and Circulars issued thereon and subject to thecompliance of the following specific conditions, in addition to the general conditionsmentioned below:

A. SPECIFICCONDITIONS:

(i) The environmental clearance is subject to obtaining prior clearance from Wildlifeangle including clearance from the Standing Committee of the National Board forWildlife as applicable.

Construction activity shall be carried out strictly according to the provisions ofCRZ Notification, 2011. No construction work other than those permitted inCoastal Regulation Zone Notification shall be carried out in Coastal RegulationZone area.

The Project proponent shall ensure that there shall be no damage to the existingmangroves patches near site and also ensure the free flow of water to avoiddamage to the mangroves.

The Project proponent shall ensure that no creeks or rivers are blocked due toany activities at the project site.

Shoreline should not be disturbed due to dumping. Periodical study on shore linechanges shall be conducted and mitigation carried out, if necessary. The detailsshall be submitted along with the six monthly monitoring report.

The commitments made during the Public Hearing and recorded in the Minutesshall be complied with letter and spirit. A hard copy of the action taken shall besubmitted to the Ministry. I

All the conditions stipulated in the earlier Clearance including therecommendations of Environment Management Plan, Disaster management Planshall be strictly complied with.

Cargo shall be unloaded directly into hopper from the ship and transported to thestack yards through closed conveyor system only. lnbuilt dust suppressionsystems shall be provided at hoppers and all the transfer points / storage yards.Cargo shall not be unloaded directly onto the berth. Water meters shall beprovided at different locations to record the consumption of water used for dustsuppression and daily log shall be maintained.

Disposal sites for excavated material should be so designed that the revised landuse after dumping and changes in the land use pattern do not interfere with thenatural drainage.

There shall be no ground water drawal in no development zone of CRZ area.

Necessary arrangements for the treatment of the effluents and solid wastes mustbe made and it must be ensured that they conform to the standards laid down bythe competent authorities including the Central or State Pollution Control Boardand under the Environment (Protection) Act, 1986.

Marine ecology shall be monitored regularly also in terms of sea weeds, seagrasses, mudflats, sand dunes, fisheries, echinoderms, shrimps, turtles, corals,coastal vegetation, mangroves and other marine biodiversity components as part

of the management plan.

The marine ecology management plan being drawn up with regards to theenvironmental impacts of natural disasters, oil spills and other wastes, dredgingand dumping on marine ecology (all micro, macro and mega biotic components)shall be scrupulously implemented. lt shall be ensured that the marine ecology inthe area of influence is not adversely affected.

Marine ecology shall be monitored regularly also in terms of all micro, macro andmega floral and faunal components of marine biodiversity.

Measures should be taken to contain, control and recover the accidental spills offuel and cargo handle.

(xvii) All the mitigation measures submitted in the EIA report shall be prepared in amatrix format and the compliance for each mitigation plan shall be submitted to I

(xviii) Ships/barges/vessels calling at the jetty shall not be allowed to release any oilybilge waste or ballast water/ dump wastes during the berthing period in the sea.Any effluents from the Jetty which have leachable characteristics shall besegregated and recycled/disposed as per SPCB guidelines.

(xix) Location of DG sets and other emission generating equipment shall be decidedkeeping in view the predominant wind direction so that emissions do not effectnearby residential areas. lnstallation and operation of DG sets shall comply withthe guidelines of CPCB.

All the mechanized handling systems and other associated equipments such ashoppers, belt conveyors, stacker cum reclaimers shall have integrated dustsuppression systems. Dust suppression systems shall be provided at all transferpoint.

(xx)

(xxi) No product other than permitted under the CRZ Notification, 2A11 shall be storedin the CRZ area.

(xxii) The quality of treated effluents, solid wastes, emissions and noise levels and thelike, from the project area must conform to the standards laid down by thecompetent authorities including the Central or State Pollution Control Board andunder the Environment (Protection) Act, 1986.

(xxiii) All the mitigation measures suggested in the EIA report and the marineenvironment study of CWPRS, Pune shall be implemented. The compliance foreach of these measures shall be submitted to concerned SPCB and R.O. of thisMinistry along with six monthly compliance i'eports.

(xxiv) Periodlcal study on shore line changes shall be conducted and mitigation carriedout, if necessary. The details shall be submitted along with the six monthlymonitoring report.

(xxv) lt shall be ensured by the Project Proponent that the activities does not causedisturbance to the fishing activity, movements of fishing boats and destruction tomangroves during the construction and operation phase.

(xxvi) The Project Proponent shall take up and earmark adequate fund for socio-economic development and welfare measures as proposed under the CSRProgramme. This shall be taken up on priority.

(xxvii) The project proponent shall set up separate environmental management cell foreffective implementation of the stipulated environmental safeguards under thesupervision of a Senior Executive.

(xxviii) The funds earmarked for environment management plan shall be included in thebudget and this shall not be diverted for any other purposes.

(xxix) The proponent shall abide by allthe commitments and recommendations made inthe EIfuEMP report so also during their presentation to the EAC.

(xxx) 10 m thick greenbelt shall be developed on the periphery of the area proposed tobe developed for WQ- North ( WO-7 & WO-8) berth in the inner Hrbour ofVisakhapatnam Port.

(xxxi) Company shall have own Environment Management Cell having qualified personswith proper background.

(xxxii) Company shall prepare operating manual in respect of all activities" lt shall coverall safety & environment related issues and system. Measures to be taken forprotection. One set of environmental manual shall be made available at theproject site. Awareness shall be created at each level of the management. All theschedules and results of environmental monitoring shall be available at the projectsite office.

(xxxiii) Corporate Social Responsibility:a. The Company shall have a well laid down Environment Policy approved by the

Board of Directors.b. The Environment Policy shall prescribe for standard operating process/procedures

to bring into focus any infringements/ deviation/violation of the environmental orforest norms/ conditions.

c. The hierarchical system or Administrative Order of the company to deal withenvironmental issues and for ensuring compliance with the environmentalclearance conditions shall be furnished.

d. To have proper checks and balances, the company shall have a well laid downsystem of reporting of non-compliances/ violations of environmental norms to theBoard of Directors of the company and/or shareholders or stakeholders at large.

GENERAL CONDITIONS:

'Consent for Establish' shall be obtained from State Pollution Control Board under theAir (Prevention and Control of Pollution) Act, 1981 and the Water (Prevention andControl of Pollution) Act,1974.

Appropriate measures must be taken while undertaking digging activities to avoid anylikely degradation of water quality.

Full support shall be extended to the officers of this Ministry/ Regional Office atBangalore by the project proponent during inspection of the project for monitoringpurposes by furnishing full details and action plan including action taken reports inrespect of mitigation measures and other environmental protection activities.

A six-Monthly monitoring report shall need to be submitted by tne project proponentsto the Regional Office of this Ministry at Bangalore regarding the implementation of , '

(v) Ministry of Environment, Forest and Climate Change or any other competent authority

may stipulate any additional conditions or modify the existing ones, if necessary in the

interest of environment and the same shall be complied with.

(vi) The Ministry reserves the right to revoke this clearance if any of the conditions

stipulated are not complied with the satisfaction of the Ministry.

11.0 These stipulations would be enforced among others under the provisions of Water(Prevention and Control of Pollution) Act 1974,the Air (Prevention and Control of Pollution)

Act 1981, the Environment (Protection) Act, 1986, the Public Liability (lnsurance) Act, '1991

and EIA Notification 1994, including the amendments and rules made thereafter.

12.0 All other statutory clearances such as the approvals for storage of diesel from Chief

Controller of Explosives, Fire Department, Civil Aviation Department, Forest Conservation

Act, 1980 and Wildlife (Protection) Act, 1972etc. shall be obtained, as applicable by project

proponents from the respective competent authorities.

13.0 The project proponent shall advertise in at least two local Newspapers widelycirculated in the region, one of which shall be in the vernacular language informing that theproject has been accorded Environmental and CRZ Clearance and copies of clearanceletters are available with the State Pollution Control Board and may also be seen on thewebsite of the Ministry of Environment, Forest and Climate Change at

http://vrrww.env&r.nic.in. The advertisement should be made within Seven days from the date

of receipt of the Clearance letter and a copy of the same should be forwarded to the nvReglonal office of this Ministry at Bangalore.

14.0 This Clearance is subject to final order of the Hon'ble Supreme Court of lndia in thematter of Goa Foundation Vs Union of lndia in Writ Petition (Civil) No.460 of 2OO4 as may beapplicable to this project.

15.0 Status of compliance to the various stipulated environmental conditions andenvironmental safeguards will be uploaded by the project proponent in its website.

16.0 Any appeal against this Clearance shall lie with the National Green Tribunal, ifpreferred, within a period of 30 days as prescribed under Section 16 of the National GreenTribunal Act, 2010.

17.0 A copy of the clearance letter shall be sent by the proponent to concernedPanchayat, ZillaParisad/Municipal Corporation, Urban Local Body and the Local NGO, if any,from whom suggestions/representations, if any, were received while processing the proposal.The clearance letter shall also be put on the website of the company by the proponent.

18.0 The proponent shall upload the status of compliance of the stipulated EC conditions,including results of monitored data on their website and shall update the same periodically. ltshall simultaneously be sent to the Regional Office of MoEFCC, the respective Zonal Officeof CPCB and the SPCB.

'19.0 The environmental statement for each financial year ending 31" March in Form-V asis mandated to be submitted by the project proponent to the concerned State PollutionControl Board as prescribed under the Environment (Protection) Rules, 1986, as amendedsubsequently, shall also be put on the website of the company along with the status ofcompliance of EC conditions and shall also be sent to the respective Regional Offices ofMoEFCC by e-mail. t
