    circulation of the same in the Philippines shall becovered by or be subject to the provisions ofthis Decree.

    Section 4

    Any person who publishes a newspaper,magazine, periodical or other publication abroadand desiresto circulate it in the Philippines

    shall do so through a Filipino citizen or a firmor association wholly owned or controlled bycitizens of the Philippines, and the saiddistributor shall be responsible for compliance

    with any requirements of Philippine law, rulesor regulations and be liable for any criminal orcivil action against the publication.

    Section 5

    Violation of the provisions of this decree shallsubject the person or corporation guilty ofsuch violation to cancellation of its permit.

    In addition, any person found guilty ofviolating this Decree shall be punished byimprisonment of from six (6) months to

    five (5) years or a fine of Ten Thousand(P10,000) Pesos, or both such fine andimprisonment at the discretion of the Court.

    1) The ownership andmanagement of mass media shall

    be limited to citizens of thePhilippines, or to corporations,

    cooperatives or associations,wholly-owned and managed bysuch citizens.

    In December 2008, GMA Network Inc., CitynetTelevision, and ZOE Broadcasting Network filed alawsuit against the management of TV5, allegingMPB Primedia Inc. (a subsidiary of Media PrimaBerhad, a Malaysian company, which entered ablock time agreement withAssociated BroadcastingCompany to sell the airtime of TV5) of violatingArticle XVI, Section 3, of the 1987 PhilippineConstitution.[44]
