FITMENT OF SALARY OF CLERKS AND SPECIALASSISTANTS ON PROMOTION AS OFFICERS INJUNIOR MANAGEMENT GRADE SCALE I

The pay scales of workmen staff were revised under NinthBipartite Settlement w.e.f. 1.11.2007. The pay scales of Officerswere also revised w.eJ. 1.11.2007.

2. The All India PNB Employees Federation had raised anindustrial dispute vide demand dated 20.06.2012 before the RegionalLabour Commissioner (Central), New Delhi in respect of fitment ofclerks and Special Assistants upon promotion as Officers in JuniorManagement Grade Scale I on and after 1.11.2007. The saiddispute raised by All India PNB Employees Federation has beenamicably settled during the course of conciliation proceedings-Aeld on10.07.2012 and a conciliation settlement dated 10.07.2012 has beensigned by the parties before Regional Labour Commissioner (Central),New Delhi. A copy of the Settlement dated 10.07.2012 arrived atbetween the parties during the course of conciliation proceedings isenclosed.

3. The Incumbents In charge are advised to make necessaryfitment of promotee Officer in terms of conciliation settlement dated10.07.2012 and arrear sheet be prepared as per Annexure-I to thiscircular and arrears, if any, be paid by 31.8.2012. The arrear sheetin respect of each promotee Officer shall be prepared in duplicateand shall be thoroughly checked before releasing the arrears, if an\-

and a copy thereof shall be sent to the concerned Circle Office forpost audit purposes. In case of promotee Officers working inAdministrative Offices/Head Office Divisions, a copy of the arrearsheet so prepared, shall be forwarded to Revenue Audit Cell, HeadOffice, Rajendra Bhawan, Rajendra Place, New Delhi for post auditpurpose. The payment of arrears shall be subject to usual deductionof income tax, if any.

SHORT RECITAL OF THE CASE

WHEREAS the Management of Punjab National Bank (hereinafter referred to as the

Bank) and All India PNB Employees Federation (hereinafter referred as Employees

Federation) had signed a settlement on 06.6.2007 regarding fitment of salary on

promotion from clerical cadre to officer in JMG Scale-I, in the course of conciliation

proceedings before the Regional Labour Commissioner (Central) New Delhi.

AND WHEREAS the said Employees Federation has raised an industrial dispute before

the Regional Labour Commissioner (Central) New Delhi vide its letter dated 20.6.2012,

inter alia, demanding that pay scale of the workmen and officers have been revised

w.e.f. 1.11.2007 by way of an industry level settlement/joint note dated 27.4.2010 and

accordingly, the fitment upon promotion from clerical cadre to officer in JMG Scale-I, as

agreed to vide settlement dated 06.6.2007 requires revision.

AND WHEREAS the bank has submitted its detailed reply dated 22.6.2012 to the

demands raised by the Employees Federation and sought the good office of the

Regional Labour Commissioner (Central) New Delhi to intervene in the matter to help

both the parties to resolve the matter amicably.

AND WHEREAS the Regional Labour Commissioner (Central) New Delhi had held

discussions with both the parties and held conciliation proceedings.

And now therefore, the parties have arrived at settlement described below, in the

conciliation proceedings, before the Regional Labour Commissioner (Central), New

TERMS OF SETTLEMENT

That in supersession to provisions of settlement dated 06.6.2007, it is agreed

that workmen in clerical cadre promoted on or after 1.11.2007 as officer in JMG

Scale-I shall be fitted in the pay scale as applicable to officers in JMG Scale I as

per the following Table:-

Note:(1) The promotee officer after fitment as above, will draw his next increment in theOfficers' scale on the anniversary date of his last increment in clerical cadre andthereafter he will draw his further increments every year on the same date.However, in view of the clubbing of stages in the fitment table, the employee inthe lower clubbed stage of clerical scale of pay will get his next increment afterpromotion on the anniversary date of promotion.

(2) Those who were drawing a basic pay between the 1st and s" stage in the clericalscale given in the above table, will be fitted at the minimum of the Officers' Scaleand will draw their next increment on the anniversary date of promotion.

(3) (a)Those who have completed more than one year at basic pay ofRS.18300/19300, RS.19100/20100, RS.19900/20900, RS.20700/21700,RS.21500/22500 will draw their next increment on the anniversary date of theirlast increment in the clerical cadre immediately following the date of promotionand will draw their subsequent annual increment on the same date.

Those who have completed less than one year at basic pay of RS.18300/19300,RS.19100/201 00, Rs.19900/20900, RS.20700/21700, RS.21500/22500 will drawtheir next increment after fitment, on the anniversary date of promotion andthereafter draw their annual increments every year on the same date.

(b) Those who have completed more than one year at basic pay of RS.22300/23300,RS.23100/241 00 and RS.23900/24900 will be given fitment in the Officers' Scaleat RS.25700 and will earn their next increment on the anniversary date ofpromotion subject to their crossing their Efficiency Bar as per guidelines issuedby the Government under Regulation 5 of Officers' Service Regulations.

(c) In all cases where promotee officers reach the maximum stage in the substantiveJMG Scale I (Rs.25700), further increment in the next higher scale will be subjectto their crossing their Efficiency Bar as per guidelines issued by the Governmentunder Regulation 5 of Officers' Service Regulations.

4. Promotees who are drawing Fixed Personal Pay in terms of Settlement dated27.04.2010 may continue to draw the same quantum of Fixed Personal Pay evenafter promotion which shall remain unaltered till revised.

5. If the promotee officer has passed JAIIB or CAIIB at the time of his promotion,notional basic pay will be arrived at after reducing the increments earned forpassing JAIIB/CAIIB, from the clerical basic pay. He shall then be fitted in theOfficers' Scale in accordance with the above table and appropriate one or twoincrements in the Officers' Scale shall be added with basic pay so fixed. The

This adjustment, however, will not be made where the number of increments tobe reduced is higher than the number of increments to be granted.

6. If despite the fitment as given above, the emoluments (basic pay and dearnessallowance) drawn as an officer on promotion are less than the emoluments (basicpay and stagnation increment if any, functional special pay on permanent basisand dearness allowance) drawn as a clerk, the difference may be protected byway of Temporary Personal Allowance to be wiped off, in three years, at the rateof 1/3 Temporary Personal Allowance. This allowance will not rank of dearnessallowance and superannuation benefits.

7. If an employee has passed CAIIB after reaching the zo" stage of the clericalcadre and promoted to Officers' scale subsequently, he/she shall be granted oneincrement for passing CAIIB Part-I/JAIIB and another increment for passingCAIIB Part-II after fitment in Officers' scale as per his/her clerical stage of paybefore promotion.

8. It is clarified that clerical employee who have been promoted to officer cadre onor after 1.11.2007 would be entitled to the arrears, if any, of basic pay and theallowances, in view of the fitment given to them under this settlement, inaccordance with the provisions of PNB (Officers) Service Regulations 1979 inthis regard.

9. That the arrears, if any, under this settlement shall be paid to the promoteeofficer by 31.8.2012. Further, in case any person in clerical cadre promoted onor after 1.11.2007 has at any time received emoluments in excess of the oneprovided under this settlement, the excess amount paid if any, shall be recoveredin 24 equal monthly installments from the promotee officers commencing fromJuly, 2012.

10. Both the parties agreed to submit separately a report on implementation of thesettlement so as to reach the Regional Labour Commissioner (Central) NewDelhi latest by 31.7.2012 failing which it shall be presumed that this settlementhas been fully implemented.

11. If any doubt or difficulty arises regarding interpretation and implementation of anyof the provisions of the settlement, the matter shall be taken only at the level ofPersonnel Administration Division HO, New Delhi and All India PNB EmployeesFederation for discussions and settlement~ () ./
