Employers and confederates!

LDDK is striving to contribute to the growth of thecompetitive capacity and productivity of the enterpris-es and to foster the stability of the macro economicalsituation of the country by involving into the enhance-ment of the legal environment. In 2006 the efforts aredevoted to the strengthening of the innovationprocess, promotion of the cooperation amongst thebusiness sector and the educational establishments,cultivated the role of the corporative social responsi-bility in the sustainable business growth. The voice ofLDDK is becoming more countable when the issues ofemployment and education are being solved. Thework should be continued in order to unite employersto strengthen the social dialogue with the state institu-tions and municipalities. Involvement of the municipal-ities into the social dialogue will provide the consider-able support and motivate entrepreneurs to create thenew and better work places what is not possible with-out the improvement of legislative acts in the area oflabour rights and more effective labour organization.

In the focus of attention of the business sector also inthe future will remain the active participation in pro-viding the availability of the labour force and theimprovement of its quality by means of active com-munication of business interests in the public institu-tions and the change of the attitude of all the societytowards the role of the education in our life, labormovement and the unity potential of the society. Onlythe favorable entrepreneurship environment can laybasis to the strengthening of the entrepreneurshipspirit, promotion of the movement of the small andmiddle enterprises and investors as well.

In 2007 it will be important for the members of LDDK toparticipate and to get the support of the cooperationpartners in the shaping the better legislation in the EU,state and municipal levels as well as to understand andput into practice the effective public and corporativeadministration principles to facilitate better services forthe national economy and inhabitants as well as to pro-mote usage of the public and private partnership pattern.

Acquisition of the European mutual market potentialwill mean for the Latvian entrepreneurs the more prag-matic and careful look at the innovations and changes

in EU laws and regulations, taking part into mutual dia-logue on the policy of energy, struggle against thenational protectionism and for the harmonization of taxpolicy. The European projects have given us a lot oflessons and a lot of possibilities that should be usedfor the providing of the growth of the enterprises andattainment of the so called Lisbon aims to rise the levelof welfare. The support to the unification of business istraced in the European Business Confederation.Useful is the change of experience gained in theConsulting Committee of Business and Industry whatoperates at the Organization of Economic Cooperationand Development (OECD), and we ourselves have to“follow the rules” of the tomorrow world in hand withthe International Organization of employers.

Only together we can be strong, prosperous andproud for our country, to find inspiration for new busi-ness ideas and to improve the quality of our life!

Dear members of LDDK and cooperation partners!

The time of progress and changes for enterprises,employers’ organisations and the public continue. LDDKhas invested a lot of energy to reach the positive andstrategic decisions for the business growth. Every singleday the members of LDDK ascertain that the growthmeans the continuous improvement and the search forcompromises in order let the winners be all the membersof the society. Entrepreneurs of Latvia have recognizedthat this is not possible without the clear vision, prioritiesand partners. That demonstrates the considerableincrease of the new members of LDDK and the expand-ing of the representation of our organisation as the mem-bers of LDDK employ already 30% of Latvian labour.

Recognizing that the business sector needs the stablevision of the future perspectives and plans of the coun-try growth, the work preceded on the NationalDevelopment plan and the Allocation plan of the EUstructural funds for the years 2007.–2013. to foster thequality of the financial resources exploration andinvestment planning in human resources, entrepre-neurship activity and the quality of infrastructure. LDDKdirects attention towards the providing of the macroeconomical stability, commences the collection of theopinions in respect to the issues of the powerresources, encouragement of the competition and themeasures of the inflation control in order to ensure thelong term competitive capacity of the enterprises.

Now is the important time for the facilitation of thesocial dialogue in the national, regional as well as inthe level of industries. The National TripartiteCooperation Council has commenced its work in thenew status and with new subcouncils, the quality andability of which to affect the future is in hands of thesocial partners. The social dialogue is the potential ofthe organized business society to put forward own rel-evant priorities for the improvement of the legal envi-ronment and to transform the ideas into laws and reg-ulations in that way fostering the growth and compet-itiveness of our enterprises. LDDK has commencedthe active work on the strengthening of the social dia-logue in the regions with the support of LatvianAssociation of Local and Regional Governments(LALRG) and the Association of Major Cities of Latvia.

To rise the level of the welfare of the inhabitants androot out illegal employment as well as unfair competi-tion related with that, the most considerable increase ofthe minimal salary and tax free minimum in the countryis achieved together with Free Trade UnionConfederation of Latvia and LALRG, that way promisingto continue the mutual work in revision and reduction oftax burden for the employers and employees. To fosterthe new workplaces the measures are introduced anddrafted into the Entrepreneurship environmentimprovement plan of the Ministry of Economics ofLatvia. The coordination of the public and private sec-tor should be improved, organisations should beadministered more effectively and we should prove thatthe values created by the successful public and privatepartnership is the benefit for the whole society what cul-tivates social responsible action of the each individual.

The agreement is concluded with Free Trade UnionConfederation of Latvia to set up the European socialpartners’ contracts, with that step preparing theguidelines and providing the instruments for the carv-ing of the new pattern of labour relations, improve-ment of labour organisation and enhancing the pro-ductivity in our enterprises. Basing on the proposalsof the organisations of industries and regionalemployers, LDDK and Free Trade UnionConfederation of Latvia has commenced the imple-mentation of the new general agreement devotingefforts towards the topical needs of the society.

LDDK has succeeded to introduce the certainimprovements in the development of industries aswell as facilitated the activity of the each industry byimproving the availability of the human resources andimprovement of the employment situation in ourcountry in general. The changes have affectedLabour law; significant proposals are included in thegovernment report on the facilitation of the flexibilityof labour relations. The cooperation and the scope ofthe provided services of the State EmploymentAgency has improved, also the activities of the StateLabour Inspection on the prevention of illegalemployment has enhanced. That will reduce unwill-ingness of the employers and employees to createlegal labour relations and will increase the tendencytowards the fare competition and the creation of new,better work places.

Support has gained the employers’ vision of theimprovement of the quality of educational system inorder the youth receive long-range profession butthose who already are in the labour market and thosewho will be attracted could maintain their competitive-ness in the changeable and dynamic labour environ-ment. The Ministry of Economics of Latvia will continuethe forecasting of labour market commenced by theMinistry of Welfare of Latvia, the Office of Citizenshipand Migration Affairs of the Ministry of Interior of Latviahas undertaken to solve the topical migration ques-tions. The cooperation in the administration of migra-tion processes will allow elaborating clear immigrationcriteria, to attract talented and hardworking people, tosolve the questions of remigration and public solidarity.

The events in the connection with the “Innovation Day”has provided the possibilities to demonstrate the bestsamples of the cooperation of the business sector andthe educational establishments and to confirm theconsiderable investments made by the business inthat way showing in practice the responsible attitudetowards the society. The leaders of the municipalities,entrepreneurs and young people have proposed theirideas during the video teleconferencing of the sevenLatvian cities and during the Leaders’ Forum“Educate.Protect.Earn.” where they discussed thepossible improvements of the educational system andthe new forms of the cooperation aimed to strengthenthe innovation process in our enterprises what growinto petition to the Latvian government “Education andinnovations for Latvia’s competitiveness”.

In the level of the European Union, LDDK has activelyinvolved in the fostering of those legislative acts essen-tial for entrepreneurs, which were advanced during thepresidency of Austria and Finland. The historicalagreements of mutual cooperation between LDDK andthe Union of Manufacturers and Entrepreneurs ofRussia as well as LDDK and United CoordinationCouncil of employers are signed. The cooperation withthe national organisations of employers of the othercountries is toughened what builds strong basis for thesuccessful partnership with entrepreneurs of the othercountries. The members of LDDK have highly evaluat-ed the efforts invested by the employees of theMinistry of Foreign Affairs of Latvia for entrepreneurs’new business plan execution.

LDDK is grateful for the support of the European Socialfund to elaborate and improve the services provided forits members, providing the guidelines on the mostappropriate pattern for the country of employers unifica-tion and the new training programme for the strengthen-ing of employers organisations. Seminars and trainingsof foreign languages, IT, business, finance, quality man-agement, public relations are being carried out. Fieldtrips to Austria, Belgium, Finland and Russia have facili-tated the understanding of Latvian journalists about therole of employers’ movement in Europe.

I want to thank the members of LDDK and our coopera-tion partners for the support in the improvement ofentrepreneurship environment. I wish to the new mem-bers to be actively involved in focused mutual work whatcontributes to our welfare and strengthens enterprises.

Business in Latvia experiences the rapid growth – theturnover of the enterprises increases and the marketsof goods and services expand. More and more peo-ple become entrepreneurs in that way creating thenew labour places and contributing to the competi-tion in the market. LDDK by representing the interestsof employers in the national level, in cooperation withthe government, Free Trade Union Confederation ofLatvia, ministries and other state institutions, provideconsiderable support to the adjustment of the entre-preneurship environment by supporting the reduc-tion of administrative obstacles and creating foresee-able, predictable tax policy.

Enterprises are more active in conquering the newmarkets outside Latvia that way improving the exportand import indicators in the EU and other regionsand carrying the name of Latvia to the world. In orderto compete successfully with the countries of otherregions the competitiveness of the goods should beimproved and the productivity of work increased. Itrequires considerable investments into the develop-ment of knowledge and innovations from the side ofentrepreneurs and the state. The increase of thelabour productivity, adjustment of entrepreneurshipenvironment, the quality of education, usage of science, effectiveness of production, investment yieldand adjustment of laws and regulations are theessential elements of the business growth whatensures the dynamic development of Latvia’s national economy.

LDDK is the opinion leader in the representation ofthe interests of the national economics and entrepre-neurship what finds understanding in the public insti-tutions, cooperation partners and members as wellas draws the perception of the future growth andcompetitiveness by facilitating the creation offavourable entrepreneurship environment in Latvia.

Balanced tax policy

One of the priorities of LDDK during the last years isthe reduction and integration of the tax burden whatstimulates entrepreneurship in the most direct way bypromoting the emerging of socially responsible com-panies. The improvement of the cooperation of taxadministration is the process in which are involved allthe social partners and respective parties. Tax incen-tives plans are a good tool to promote investmentsinto the growing and new companies. LDDK works atthe initiatives in the result of which the tax burden forthe employers is reduced, the responsibility on taxes’remuneration divided amongst the employer andemployee and tax incentive plans are developed.

AAcchhiieevveemmeennttss ooff 22000066n LDDK elaborated proposals for the evaluation ofthe rate of VAT and achieved the reduction of EIT rateto 15% starting from the year of 2008 for the individ-ual businessmen, self-employed persons and per-formers of the individual work thereby relieving entre-preneurship; n Elaborated proposals for the introduction of differ-ential VAT rates;n Proposals set on the application of the naturalresources tax, achieved that the tax is not applied forthe certain groups of goods starting from the year of2007 – until the elaboration of the administration planof waste treatment, determining precise costs;n LDDK in cooperation with Free Trade UnionConfederation of Latvia and Latvian Association ofLocal and Regional Governments has increaseduntaxed minimum and the minimal salary. It isachieved that starting from the year of 2007, year’sminimal salary is increased to 120 LVL and untaxedminimum to 50 LVL what considerably increases theincome of employees and reduces the tax burden ofemployers;n This year the efforts continued on the adjustmentof tax system in order the penalty for violationbecomes commensurable; n Elaborated the appeal to utilize the entrepreneur-ship risk state tax for the planned purpose.

PPrriioorriittiieess ooff 22000077n Differentiation of VAT rates;n Recognizing that the relevant increase of salariesand the pace of the inflation still remains to introducechanges in the social insurance payments by deter-mining the relocation of the social tax rate;n Considering that at the end of 2006 it wasachieved that natural resources tax starting form2007 is not applied to separate groups of chemicalgoods, to continue work on the elaboration of admin-istration system of these goods and if needed to theamendments to the rate of natural resources tax;n Work will be continued to increase untaxed mini-mum until it reaches 60% of the minimal salary;n Foster the improvement of tax administration toreduce the time necessary for employers’ tax admin-istration as well as to reduce human resources andadministrative costs by executing obligations towardsthe state – introduction of “one stop agency” principleensuring annual reports submission in one place;n Initiate the amendments to the Law on taxes andcharges in order before sanction readjustment itwould be possible to state the level of consciousness; n Facilitate the change of the policy of the StateRevenue Service towards taxpayers by devotingmore attention towards information and consultingthe taxpayers;n Achieve the change of the submission date of theVAT declaration aiming to the 20 days’ and more –the term determined in the most European countries; n Adjustment of the order of the exclusion of thecompany form the VAT payers register preventing thepossibility of the specialists of the State RevenueService to take one-sided decisions;n Continue efforts to release entrepreneurs from “cheatcharge” – utilization of the entrepreneurship state risktax for its purpose by cancelling its direction to theunsustainable agency – Insolvency Administration byseparating it into separate controllable account;n Elaborate proposals for the changes of the realestate tax to stabilize real estate market;n Work out proposals for the changes in the tax policyto motivate employers to introduce financial partnershipplans.

Efficient public administrationand formation of public–privatepartnership (PPP)

For the companies who have reached certain level ofdevelopment, have attracted local and foreigninvestors and are listed in the stock exchange, theparticipation in the public tenders as well as gettingthe support of EU structural funds, the public-privatepartnership becomes essential component. Public-private partnership is the practice of entrepreneur-ship the introduction of which could not be imaginedwithout observing the principles of good administra-tion and constant improvement to raise the productiv-ity and competitiveness of the enterprise.

The development of modern technologies and innova-tions, cooperation with private sector and society arethe basis for successful introduction of effective publicadministration and public-private partnership (PPP).

Strengthening of the innovationprocess

More successful enterprises are acknowledging theirability to integrate achievements of science into busi-ness what requires additional and regular long-terminvestments into the development of industries.Innovations are the driving force of the entrepreneur-ship and the prerequisite of the competition whatenhances productivity, rises the added value of thegoods and services.

Problems affecting business not only in Latvia butalso in other EU countries by unwelcoming to fillvacant work places, is the inadequate education andqualification of labour. A lot of industries lack qualifiedspecialists as the system of education has gaps andthe limited financing is allocated for its improvement.

In Latvia’s situation the opinion of entrepreneurs con-cerning the questions of the education are not alwayslistened because the links amongst educational sys-tem and labour market are broken as the result entre-preneurs are introducing innovations and rising pro-ductivity with hardships in this market.

AAcchhiieevveemmeennttss ooff 22000066n This year LDDK organized the event “InnovationsDay 2006” within the framework of the programme“Education and innovations for Latvia’s competitive-ness”. During it the Forum of business leaders“Educate. Protect. Earn” and students video telecon-ference amongst seven Latvia’s cities were held.

LDDK initiative in cooperation with SIA MicrosoftLatvia, the representative office of Siemens and theBaltic International academy helped to strengthenand popularise the process of innovation and thecooperation amongst the business sector and educa-tional establishments;n LDDK annual prize 2006 for the best educationaland employer organisation and/or the cooperationsample was acknowledged the cooperation ofLauma Lingerie, joint stock company and Liepajavocational secondary school;n It was for the first time when business leaders dis-cussed the cooperation options amongst enterpriseand educational establishment by elaborating theappeal to the new government proposing solutionshow to link business with knowledge what in overallfacilitate the development of knowledge based

Environment and energy

Employers more often feel the fluctuations of suchglobal impacts as climate changes and the strongerregulations on the environment for employers in thatrespect, the dependence from import and theincreasing energy costs. With increasing interde-pendence of the EU countries from the power indus-try and new players entering the market, by makingthe investment into the development of the enter-prise, the investors want to be assured for the safetyof their investments. Company sustainability and suc-cessful development more often depend from theability to observe heightened demands of the envi-ronment protection and the ability to cope withincreasing dependence form energy resources.

AAcchhiieevveemmeennttss ooff 22000066n Dialogue commenced with the Public UtilitiesCommission (PUC) to ensure timely involvement andawareness of the costs of energy resources;n The first year of work has experienced the newlyfounded Tripartite Cooperation Subcouncil of envi-ronmental affairs by examining those issues that areimportant for entrepreneurs administered by theMinistry of Health of Latvia; n Resolutions prepared on the utilization of therenewable energy resources, bio fuel and fossil fuel; n Position expressed on the long-term, safe andcompetitive policy of energy.

Social dialogue

As the leader of the implementation and promotion ofthe social dialogue in the national level, LDDK isinsisting on the implementation of the principles ofsocial dialogue into the corporative administration ofthe enterprises in the regional level and on the tripar-tite social dialogues of the industries. When formingtripartite social dialogue, concluding collective agree-ments and general agreements with cooperationpartners, the unfair competition is rooted out what isthe cause of increasing problems in public tenders.

Employers are interested in formation of organized civilsociety and facilitation of the productivity of the enterpris-es by raising the qualification of employees and to guar-antee social safety starting with the increase of the salaryand improvement of the work conditions. LDDK invites toraise the welfare and productivity of Latvia by workinginto the national and international level, by making use ofthe experience gained in the foreign countries of personswho being departed and now are returning. LDDK con-siders that in the conditions of free labour movement theefficiency of local workforce and the remigration processof the appropriate inhabitants should be improved, but incase of necessity the long term and middle term plandealing with the labour shortage problems should beworked out to prevent the crisis in labour market.

New general agreement

The first general agreement of LDDK and Free TradeUnion Confederation of Latvia (FTUCL) was made inthe year of 2004 – one day before Latvia joined theEuropean Union. In 2006 LDDK and FTUCL com-menced the elaboration of the new agreement in coop-eration with employers’ organisations and tradeunions. In the negotiation process the parties agreedon the priorities of the general agreement. The prioritiesof LDDK concern the improvement of Latvia’s socialeconomic situation in the EU by getting involved intothe solution of the issues concerning the education,employment, social security and healthcare, the cre-ation of more adequate fiscal and tax policy in order toincrease the welfare of the inhabitants and facilitate thegrowth of enterprises and formation of new employers.The new general agreement corresponds to today’s

challenges – increasing the quality of education, facili-tation of employment, adjustment of migration issues,and optimization of the tax burden and the reduction ofthe costs of the public administration.

Considering the tendency that each year more enter-prises, employers’ organizations and social partnersare involving into the facilitation of the civil society,the total number of agreements has increased in allthe levels of the social dialogue.

LDDK continues the work at the fostering of organ-ized civil society by strengthening the practice of tri-partite dialogue in Latvia.

National Tripartite CooperationCouncil

LDDK is actively involved in the National TripartiteCooperation Council (NTCC) and its subcouncilsalready more than 10 years. In 2006 the significanceand prestige of the NTCC increased when at thesupervision of the Prime Minister of the Republic ofLatvia regularly at one table met the social partners –employers, employees and municipalities. This yearthe cooperation was renewed with the Ministry ofTransport of Latvia and the Ministry of RegionalDevelopment and Local Government of Latviabyforming interdisciplinary subcouncils.

While a huge work has been done in raising the statusof NTCC, at the same time a lot of efforts still needed toimprove the work of separate sub-councils. Great role

in the successful accomplishment of this work is playedby the State chancellery what fosters the possibilities ofsocial partners’ copartnership in drafting and imple-mentation of the executive policy.

In industries

During the EU funded draft project of the Nationalprogram “Increase of the capacity of the nationalemployers” the work commenced on the fostering ofthe social dialogue of the industries and consultingemployers’ organizations what resulted in 13 newindustry members joining LDDK.

The task for the coordinators of employers’ organiza-

tions set within the project for 2007 is to examine thesituation, possibilities and possible arguments forconcluding the mutual agreement between enterpris-es of one industry. That will allow avoiding the unfaircompetition based on illegal employment. LDDK willsupport the formation of cooperation amongst indus-try employers’ organization and industry trade unions.

In regions

Unfortunately in the large part of the regions tripartitesocial dialogue is not developed in the classicalmeaning of the term. The obstacle could be weakand unbalanced regional development as well asweak organization of the civil society in general. Thatfact could burden our investment in the developmentof the country and execution of the Lisbon strategy inraising the competitiveness of the EU.

In 2006 a huge efforts were invested in the strengthen-ing of regional cooperation, formation of the represen-tation and the facilitation of the understanding betweenmunicipalities and entrepreneurs in the regions. As thetestimony to commence constructive dialogue theAssociation of Big Cities of Latvia signed the coopera-tion agreement by solving the issues of tripartite socialdialogue. The meetings were held in the largest citiesof Latvia – Liepaja, Daugavpils, Valmiera, Jelgava,Ventspils. As the result of that cooperation LDDK suc-ceed to attract the coordinators of the regional repre-sentations who will launch the active work in 2007.

In enterprises

Coordinated relations of employer and employee arevery important for socially active enterprise. The for-mation of trade union in the enterprise is one of thefirst steps towards formation of qualitative communi-cation in the enterprise where the responsibility isdivided between employer and employee. It is impor-tant for entrepreneur to speak with organized repre-sentative of employees to reach the constructivesolutions of mutually important issues. The scope ofquestions could be very wide – salaries, social guar-anties, education, increase of the qualification as wellas labour environment, labour rights, labour protec-tion, violations and other questions.

By signing the collective agreement it is possible tosolve the issues of human resources in private sectoras well as in the state and municipal sectors. Theseagreements will help the entrepreneurs to avoid thesocial dumping, help to present guarantees foremployees, settle work environment, foster labourprotection, and raise the professional qualification.

Improvement of the social dialogue in 2007

In 2007 LDDK will concentrate the attention toemployers; motivation in regions by inviting tostrengthen employers’ organizations aimed to uniteits capacity to the coparthership in the regional social

dialogue with municipalities and trade unions by con-solidating the interests and opinions of the employ-ers. It is important that regional employers getinvolved into the solution of the issues on the nation-al level by representing the interests of the regionalentrepreneurs with intermediary of LDDK.

To achieve targets set, LDDK will continue within theproject:n work of industries’ experts,n execution of the corporative communication plan,n work at formation of social partnership in industrieswith the support of 12 coordinators of social dialogue,n strengthening of regional social dialogue with thesupport of 5 regional social coordinators (Riga,Valmiera, Daugavpils, Jelgava, Liepaja).

Support to employers’ organizations

Within the EU funded project of the National program“Strengthening the capacity of LDDK”, the experts ofLDDK worked out guidelines on the most appropriateunification model of employers for Latvia, trainingprograms and have arranged the appropriate semi-nars on the following themes: n Financing aspects of employers organizations;n Management of employers organizations;n Elaboration of missions and strategies of employ-ers organizations;n The strategy of employers’ organization to attractthe members;

LDDK has completed the training of nine represen-tatives of employers’ organizations in the profes-sional MBA study program “Labour protection”.Organized the courses of the English and Frenchlanguages for the representatives of employers’organizations as well as trainings for the employeesof organizations in the spheres of IT, business,finances, quality management, and public relations.Seven seminars were held for young people on for-mation of cooperation between LDDK and youthorganizations (in Riga, Rezekne, Daugavpils,Jekabpils, Liepaja, Ventspils).

Basing on the evaluation of the potential of the serv-ices market, the elaboration of 10 new services forLDDK members:n Representation of interests;n Consultations in the questions of labour rights andlabour protection;n WEB services. Portal www.lobijs.lv;

n Elaboration and delivery of informative materials,notifications;n Organization of researches;n Administration of the public relations;n Organization of conferences;n Organization of field trips;n Assistance in project reparation and management;n Organization of trainings.

In May, 2006 LDDK launched the portal of memberswww.lobijs.lv which at present in average is visited by100 users per month, making total 2960 visits. Thenumber of registered users is 210. During the year2482 questions published in the portal (drafts of leg-islative acts, conceptions, etc.).

attention to the improvement of the policy of educa-tion to facilitate the mobility of each individual, raisethe competitiveness in the market and to ensure life-long education for each inhabitant of the country.

Achievements of 2006n National level target of LDDK is the providing of theavailability and the appropriate quality of the humanresources. LDDK participated and protected the inter-ests of employees in several work groups for theimprovement of the system of education towards theneeds of labour market. There LDDK concentrated onthe issues concerning the improvement of the supportsystem of the professional orientation and carrier andthe development of the forecasting of the labour market.LDDK will continue the work in this sphere also in 2007;n Particular efforts were devoted to the planning andapplication of the EU funds for the years 2007.–2013.to provide effective investment of the financial meansprovided for the human resources and developmentof employment, improvement of the system of educa-tion and fosters the positive development of Latvia’slabour market.n It was achieved with the support and initiative of LDDKthat in the draft of the new Law on higher education therequirement was introduced to reflect in the process ofeducation and in the educational programs the currenttendencies of the national economy and labour marketdevelopment and the interests of employers.n LDDK insists on bigger state support to the develop-ment of the entrepreneurship, facilitation of self-employ-ment and effective and purposeful use of the local work

force to ensure the competitiveness of Latvia in thesame time reducing the departure of the work force.n By taking the part into the elaboration of the draftproject of the migration policy in the context of employ-ment, LDDK considers that the issues of economicmigration and mobility of workforce should be fosteredin the state level and the government should clearlydefine its position by working out the short term andlong-term migration strategy policy planning the devel-opment of the industries of the national economy andanalyzing the needs of labour market. LDDK objec-tions have resulted into the reduction of the administra-tive obstacles and the costs of labour force attraction.

Priorities of 2007n To increase the role and responsibility of the tripar-tite coordination sub-council of the professional edu-cation and employment of the NTCC dealing withconceptual issues of the education in its new statusof Sub-council of the education and employment withbroadened objectives;n To elaborate the short-term, middle term and longterm strategy of the migration policy where all theaspects of labour resources mobility and integrationare included;n To take part in the drafting of the new legislativeact on the professional education to ensure it reflectsthe topical development tendencies of the nationaleconomy and the labour market and the interests ofemployers, as well provides employers with possibil-ities to get involved into the process of education.n To get active participation in dealing with theissues of the employment and professional educationin Latvia’s regions via regional councils of the profes-sional education and employment and by cooperat-ing with municipalities;n To defend and popularise more flexible workinghours and the advantages of remote work or workfrom home (telework) what can help to solve the prob-lems caused by labour resources shortage and moreeffectively use the modern IT and communicationtechnologies, that way rising the productivity of work;n To take part in monitoring of the implementation ofthe basic statements of the lifelong education in orderto provide for everyone the same possibilities for theeducation and professional development; n To get involved in the elaboration of the actionstrategy of the policy implementation of lifelong

education to provide people throughout whole lifewith availability of the education services whichwould develop their professional competencies andhelp to rise employment co partnership;n To get active participation in the completion of thedevelopment system of the standards of the profes-sional education, education programs of the profes-sional and higher education to ensure the observing oflabour market interests in the processes of education;n To get involved into the elaboration of the laws andregulations concerning employment as well as theevaluation of their compliance towards the actual sit-uation in the labour market;n In cooperation with the institutions of the profes-sional education, to commence the update of thenational qualification system of the professional edu-cation as well as accreditation process of those skillsgained in informal way and during work-life;n To get involved in the processes defending thereduction of the illegal and unregistered employment(including the increase of the consultative function ofthe State Labour inspection).

Labour rights

AAcchhiieevveemmeennttss ooff 22000066n Amendments in the Labour law concluded two-years long intense work. The change in the order ofbreaks assignment and maximal lengthening of theterms of part-time job contracts is the essential stepto increase the flexibility of labour relations;n Essential are also the changes in the payout order ofthe compensation allowances for the employees dur-

ing the justified absence, by replacing the obligation tocalculate and pay average wage with salary retention; n Amendments concern also the termination noticeperiod for the employee who has medical confirma-tion for health incompatibility for the period of tendays to one month. At the same time with discus-sions on the amendments the dialogue is com-menced for the possibility to pass to the state thepayment for educational leave of the employees whatcould prevent essential unwarranted costs foremployers;n Continuing the activities commenced in the previ-ous years to facilitate the flexibility of labour relations,thanks to the initiative of LDDK the informative report“On the necessary proposals to ensure flexibility andsafety in employment rights” was drafted and votedthrough the Cabinet of Ministers, according whichamendments will be made in several legislative actsin the sphere of labour rights including the rules ofthe seasonal and fixed-date job contracts and theinvitation order for guest workers; n Prevented the amendments in the law “On holi-days, remembrance and special days” what expect-ed to determine that if the holiday falls on Saturday orSunday, the next working day is determined as freeday. These amendments would cause essential los-ses for employers and employees as well as for thebudget of the country; n LDDK and the Free Trade Union Confederation ofLatvia has concluded the agreement with the help ofwhich overtook the agreement of European social part-ners on telework. legal relations determined by European Communityfoundation agreement. Namely, also in Latvia as EUmember country these issues will be looked upon byaccepting additional conditions what will help to controlemployers and employees legal relations, by allowingemployers and trade unions themselves to look for themost appropriate solutions and by mutual agreements.

Labour protection

AAcchhiieevveemmeennttss ooff 22000066n Amendments are made in the control order of per-sons with long-term disability. The amendments deter-mine the obligation for general practitioner after 60 daysof patient’s disability to send him/her to the specialistwho has to state if the disability should be terminated orcontinued, as well the obligation of the general practition-er to send the patient to the Health and disability experts’commission which will diagnose the invalidity if the dis-ability is longing already for six month. This is the firststep to limit the unfair usage of disability lists and avoid-ing from job with the help of ungrounded disability lists;n The interests of employers were observed in com-plete spectrum by overtaking the 2004/40/EK direc-tives (29

thApril, 2004) of the European Parliament and

the Council on the compulsory obligations of safetyand health protection in respect to employee’s sub-jection to the risk caused by physical factors (electro-magnetic fields) in the regulations “Labour protectionobligations for the protection of employees againstthe risks caused by electromagnetic fields at work-place” issued by the Cabinet of Ministers;

n By participating in the elaboration of the financialperspective 2007. –2013. of the EU structural funds, itwas ensured that during this period the resources forthe risks’ assessment was attracted from theEuropean Union Fund what will ensure considerablesavings for enterprises;n LDDK and the Free Trade Union Confederation ofLatvia concluded agreement that overtookEuropean social partners’ agreement on the stressin workplace.

PPrriioorriittiieess ooff 22000077 iinn LLaabboouurr rriigghhttss aanndd llaabboouurr pprrootteeccttiioonnn The year of 2007 will be prominent for the fact thatthe basis will be laid for the further development ofthe labour rights as well as labour protection policy inthe European Union. The Labour protection policy forthe years 2007.–2012. and the Green book of theEuropean Labour rights are the documents which willbe in the centre of intense discussions in Latvia’s aswell as European level. Therefore LDDK will devoteessential attention to the exploration, consolidationand representations of employers’ interests;n The second essential priority will be the commenc-ing the introduction of the legislative acts of labourrights and labour protection within the framework ofthe new funding perspectives of EU structural fundsfor the year 2007.–2013. Within the program it isexpected to provide the essential support to employ-ers for the risks’ evaluation of the labour environment,to elaborate human resources plans in several indus-tries, to consult on the introduction of legislative acts,to issue methodological materials and guidelines andmany other activities.

2006 was proclaimed the year of mobility, duringwhich Austria and Finland consecutively headed theEU presidency. Germany took over the office in 2007.Finland put competitiveness, foreign relations, thestrengthening of freedom, security and the rule oflaw, transparency of institutional activities, and theeffectiveness of resolutions at the top of the EU agen-da. Special attention was paid to the development ofthe EU’s internal market, innovation policy, raisingworkforce productivity, and the ability to carry out aunified energy policy and to lessen the bureaucraticburden for businesses.

Upon taking over the presidency, Germany outlinedthe challenged for the coming year by naming 2007as the year of equality. In order to ensure sustainedand stable growth and employment, during its presi-dency Germany has paid much attention to thestrengthening of a unified EU market within the con-text of a new unified market strategy. In addition,development of the manufacturing and service indus-tries and competitiveness of small and mid-sized busi-nesses will be promoted. Another important issue thisyear is the development of an energy policy.

LDDK in Europe

In order to stimulate international recognition of theConfederation and broaden of its partnerships, LDDKrepresentatives and members took part in variousinternational conferences and meetings in 2006. Themost significant of these were: the Business andIndustry Advisory Committee’s (BIAC) General

Assembly and the OECD forum “BalancingGlobalisation” (Paris), the 94

International Labour Conference (Geneva), and themeeting of the International Organisation ofEmployers (IOE) European members (Bucharest).

In February 2006LDDK participated in the first official BUSINESSEU-ROPE (UNICE) delegation visit to Russia, duringwhich time it supported Russia’s bid to join the WTO.;n LDDK signed a contract with the RussianManufacturers and Businessmen’s Union (RSPP)for the stimulation of economic cooperation and an agreement with the Coordinating Council ofEmployers’ Unions of Russia (CCEUR/KSORR) for cooperation regarding the promotion of socialdialogue;

n raising the level of employment;n streamlining of the internal market;n completion of EU government reforms;n combating national protectionism;n improvement of the system of social guarantees.

Social Responsibility –The Global Compact

Adherence to the 10 principles of the GlobalCompact saves entrepreneurs much time, whichwould otherwise be spent undoing the conse-quences of not following the principles, and allowsfor a much more productive use of time.

LDDK encourages all entrepreneurs to join the GlobalCompact, thereby showing a willingness on the partof the business to address corporate managementissues.

The European Commission considers that while busi-nesses themselves lead the establishment of corpo-rate social responsibility, they can best influence thedevelopment of social responsibility through theircooperation with employers’ organizations, tradeunions, NGOs, local and national governments, andacademic institutions. The promotion of corporatesocial responsibility reflects a need to defend com-mon values and increase a feeling of solidarity andcohesion.

It is significant that academic institutions also joinedthe Global Compact in 2006, thereby showing theircommitment to and confirming the observance of theCompact’s principles. The Global Compact has alsogained the attention of the ISO and is consideredgood practice and a sign of quality management. Ofcourse, that does not diminish the voluntary aspect ofthe Global Compact, nor the need for initiative on thepart of businesses.

An event aimed at promoting the 10th

principle of theGlobal Compact – anti-corruption – took place inLatvia in 2006. This event, organised together withTransparency International Latvia (“Delna”), stressedthe importance of the implementation of good busi-ness practice as laid out by the Global Compact, thedevelopment of social responsibility, and the promo-tion of honest competition (www.globalcompact.lv).
