The Georgia Composite Medical Board (GCMB) held its regular meeting on March 31-April 1,

CALL TO ORDER

Dr. House called the meeting of the Georgia Composite Medical Board to order at 9:30 a.m.

AGENDA

Dr. Deloach submitted a motion, seconded by Mr. Wallace, to approve the agenda of the March

31-April 1, 2016 meeting. The motion carried unanimously.

MINUTES

Dr. Deloach submitted a motion, seconded by Dr. Gross to approve the minutes of the March 3,

2016 meeting. The motion carried unanimously.

Dr. Peter Buckley, MD, Medical School Dean, made welcoming remarks and gave an overview

of the school. This is a great time to be in Augusta. They have worked to broaden the portfolio of

students and to develop a state of the art medical school. It is the ninth largest medical school in

America. They have a 9.3 survey satisfaction rate of exiting medical students.

BOARD CHAIR’S REPORT Dr. House presented the Board Chair Report.

1. FSMB symposium: Antitrust Implications for state medical boards.

2. Georgia Professional Regulation Reform Act (HB 952).

RULES HEARING

Dr. Gross convened the public hearing concerning the following proposed Rules amendments:

360-36-36 “Low THC Oil.”

Dr. Gross asked if anyone was present to address the Board on the posted Rule amendments. No

was present to address the Board.

Dr. Gross reviewed the submitted written comments with the Board members.

Dr. Gross made a motion to table and refer Rule 360-3-.02 “Unprofessional Conduct Defined”

back to the Rules Committee to address concerns.

Dr. Retterbush seconded the motion, and it carried unanimously.

Dr. Gross asked if anyone was present to address the Board on the posted Rule amendments. No

was present to address the Board.

Dr. Gross made a motion to amend Rule 360-3-.02 “Unprofessional Conduct Defined.”

that the Board find the formulation and adoption of these rules do not impose excessive

regulatory cost on any licensee and any cost to comply with the rule cannot be reduced by a less

expensive alternative that fully accomplishes the objectives of the applicable laws; that the Board

finds that it is not legal or feasible to meet the objectives of the applicable laws to adopt or

implement differing actions for businesses as listed in O.C.G.A. 50-13-4(A) (3)(A),(B),(C), and

(D).

Dr. Deloach seconded the motion, and it carried unanimously.

EXECUTIVE DIRECTOR’S REPORT

Robert Jeffery, Executive Director, presented the following information for the Board’s review.

Dr. Retterbush submitted a motion, seconded by Dr. Weil to accept the report. The motion

carried unanimously. The Board took the following actions:

1. Richard Mansfield, D.O. asked “Does the prescription of oral antibiotics and oral steroids

by a physician who has not examined the patient comply with Board rules”? Refer to

Laws and Rules.

2. The Bibb county Medical Society sent a letter urging the Board to require expert

witnesses who do not hold Georgia licensure to obtain a special certificate or limited

license. Should the Board wish to support this? Board accepted as information.

3. Peachtree Allergy Clinic urges board to oppose FSMB Position Statement four

“Compounding of Medications by Physician”. Dr. Weil motioned to oppose the

resolution. Dr. Retterbush seconded the motion and it carried unanimously.

4. USMLE issued guidance to state boards concerning its procedures for allowing

examinees to retake the exam. For information only.

5. An article by Practical Pain Management entitled “Legacy Patients from High-Dose

Opioid Era”. For information only.

6. AMA opposes Virginia’s Assistant Physician License. Dr. Gross motioned to oppose the

licensure of assistant physicians. Mr. Wallace seconded the motion and it carried. Dr.

DeLoach abstained.

7. Dr. Antalis gave a recap of his presentation of the Georgia Composite Medical Board at

the Medical Association of Atlanta. For information only.

8. Dr. Alice A. House, M.D. Chair was named to the Federation of State Medical Boards

Review Committee. For information only.

RECESS Dr. House declared the meeting in recess for the purpose of holding committee meetings.

Dr. House then declared the meeting would be open session upon completion of the investigative

interviews.

Dr. Weil made a motion, seconded by Dr. Gross, to adjourn the March 31, 2016 Board meeting at

4:40 p.m., and reconvene April 1, 2016 at 9:00 a.m. The motion carried unanimously.

submitted a motion to approve the report, and Dr. Antalis seconded the motion. The Board

accepted the report by unanimous vote.
