APPOINTED TO THE BOARD Glen Smith, P.E., P.L.S. (pictured right) welcomed by Bill McVey, PE, Board Chair (pictured left) G len W. Smith, P.E., P.L.S. was recently appointed by Governor Brad Henry to serve as a member of this Board from June 29, 2007 to June 28, 2013. He fills one of the four professional engineer positions on the Board. Mr. Smith graduated from Oklahoma State University in 1971 with a degree in Agricultural Engineering. Shortly after graduating he was employed by John Butler Engineering, Inc. and became a stockholder in 1978. He re- mained with John Butler until the formation of Smith-Roberts and Associates in 1981. He is both a licensed professional engineer and professional land surveyor in the state of Oklahoma. As a Civil Engineer, Mr. Smith has extensive design experience in private sector projects involving planning, drainage, water, sewer, and paving. Mr. Smith has served in the capacity of consulting engineer on many state and municipal funded projects dealing with drainage, roadway, and utility reloca- tion. As a Surveyor, Mr. Smith has worked with a majority of the nation’s largest title companies and law firms providing A.L.T.A. surveys for real es- tate mergers and acquisitions. Mr. Smith is active as a lecturer on legal problems as they pertain to surveying and real estate and has served as President and Member of the Board of Directors of the Oklahoma Society of Land Surveyors and on com- mittees of the American Congress on Surveying and Mapping. We look forward to working with Mr. Smith as a Board Member. With his expertise and experience in both the engineering and surveying professions, he will be a valuable addition to this Board. Glen W. Smith, P.E., P.L.S. was recently appointed by Governor BradHenry to serve as a member of this Board from June 29, 2007 to June

28, 2013. He fills one of the four professional engineer positions on the Board.Mr. Smith graduated from Oklahoma State University in 1971 with a

degree in Agricultural Engineering. Shortly after graduating he was employedby John Butler Engineering, Inc. and became a stockholder in 1978. He re-mained with John Butler until the formation of Smith-Roberts and Associatesin 1981. He is both a licensed professional engineer and professional landsurveyor in the state of Oklahoma.

If you have not visited the board office lately,located in Oklahoma City at the Oklahoma

Engineering Center, you are encouraged todrop by and see the newly renovated DresserLibrary/Board Room. What started out as a“replace the carpet and paint the walls” effort,turned into a full-fledged construction projectwith jackhammers, a new audio/video system,and a beautiful new hexagonal conferencetable. Our very capable Executive Director, Ms. Kathy Hart, coordinated theproject. She served as our ad hoc general contractor and coordinated all workincluding planning, purchasing, color selections, coordination of contractors, finalinspection and final payment to all contractors. The Oklahoma EngineeringFoundation financed the carpet, blinds, paint and plumbing for the project, and theBoard financed the furniture, furnishings, electrical work for the audio-visual andcommunication equipment and board table, and architectural services from JimLoftis, AIA. Bob Zahl, P.E., AIA, Board Member and partner in Zahl-Ford, Inc.,contributed valuable assistance with architectural and audio-visual elements of theproject and the MEP firm of which I am President, PSA Consulting Engineers,Inc., contributed the electrical engineering and design work required for theproject.

All of the new electrical systems, including power, data, audio/video, andtelephone are now distributed from below floor level. The existing concrete slab inthe floor was cut, sawed and jackhammered out for the placement of newconduits and combination power/data floor boxes. The boxes are flush mountedwith the floor surface and all new cables routed neatly from the floorboxes upunder the new table and into popup power/data outlets at the top of the table foreasy connection of systems to the laptops.

The new hexagonal configuration of the conference room table allows formore direct “face to face” conversation during meetings and disciplinaryproceedings. More and more, the board is required to review engineering andsurveying plans during disciplinary hearings to determine final disciplinary actionsin those proceedings. To help facilitate this effort, a portable interactive lecternwas installed so that exhibits can be shown on the new 63” diagonal video screen.All of the new audio/visual was part of a new system purchased from Ford Audio.The benefit of the lectern being portable is that we can also utilize it during largermeetings that are conducted at the Oklahoma Engineering Center in the largerauditorium, where we also installed a new projector in the ceiling. This equipmentwas used for the first time in the auditorium at the public meeting of the Boardregarding residential foundations in July of this year. This audio-visual equipmentis state of the art, and allows the board and enforcement staff to handle the ever-increasing volume of disciplinary matters and other matters before the Board.

We are now conducting the Board Meetings virtuallypaperless, and yes, we are saving trees. We have completed twoBoard Meetings in the newly renovated Board Room using thepaperless technology and the meetings seem to be more organizedand efficient. Each Board Member is mailed a CD approximately2 weeks prior to the Board Meeting with a proposed agenda andinformation regarding the agenda items and a copy of the formalcomplaints to be heard before the Board, for preliminary review byeach member on their own time. Once we get past the expectedtechnological learning curves we should see the full benefit of thenew systems.

Park, PE 22766;Case No. 2007-040; Through Consent: For practicing engineering in the state of Oklahoma on aproject without a certificate of authorization to do so, MSE Technology Applications, Inc. is found Guilty,assessed an administrative penalty of $2,000.00, and is Reprimanded. For practicing engineering in the stateof Oklahoma on a project without a certificate of licensure to do so, Brian T. Park is found Guilty, assessedan administrative penalty of $1,000.00 and is Reprimanded.

THE FRONT LINES OF PRACTICE

Board Rule OAC 245: 15-23-8: “When information comes to a licensee, the Board, orits employees concerning alleged misconduct by any person, firm, entity or licensee,whether through formal or informal channels, it shall be the duty of such person,

firm, or entity to refer such information to the Director of Enforcement.”A significant number of the cases investigated by this Board come from information fur-

nished by our licensees. Being on the front lines of practice, licensees are often in the best positionto observe misconduct by others and have the perspective and understanding to know that aparticular practice by an individual or firm is a violation of the laws and rules governing the prac-tice. If you are asked to be a part of a team of other architects, engineers, and surveyors whomay be from out of state or not properly licensed in Oklahoma, you may want to check first tomake sure that they are licensed to practice in Oklahoma prior to signing onto the project. Manyof our cases involve out of state engineers who begin projects in Oklahoma before they arelicensed to do so. Sometimes the individual or firm is unaware that they are violating or may be onthe verge of violation the law, and when educated in a helpful, professional manner, will promptlycome into compliance. Otherwise, it is your duty to report violations to this Board

Board Rule OAC 245: 15-23-8: “When information comes to a licensee, the Board, orits employees concerning alleged misconduct by any person, firm, entity or licensee,whether through formal or informal channels, it shall be the duty of such person,

firm, or entity to refer such information to the Director of Enforcement.”A significant number of the cases investigated by this Board come from information fur-

nished by our licensees. Being on the front lines of practice, licensees are often in the best positionto observe misconduct by others and have the perspective and understanding to know that aparticular practice by an individual or firm is a violation of the laws and rules governing the prac-tice. If you are asked to be a part of a team of other architects, engineers, and surveyors whomay be from out of state or not properly licensed in Oklahoma, you may want to check first tomake sure that they are licensed to practice in Oklahoma prior to signing onto the project. Manyof our cases involve out of state engineers who begin projects in Oklahoma before they arelicensed to do so. Sometimes the individual or firm is unaware that they are violating or may be onthe verge of violation the law, and when educated in a helpful, professional manner, will promptlycome into compliance. Otherwise, it is your duty to report violations to this Board

EXPIRATION/REVOCATION - Licenses may be revoked by the Board for non-payment of renewal fees. Licensees willbe notified of revocation by certified mail. Typically this notification is mailed 10 days following expiration.RENEWALS - Each license issued by the Board expires on the last day of the month in which renewal fees are due, andbecomes invalid on that date unless paid. One notice of the renewal is sent by first class mail to the address of record in theboard files. This in effect provides notice two months prior to revocation.REINSTATEMENT - Former licensees whose certificates have expired and were revoked for failure to pay renewal fees anddesire to reinstate shall make application for reinstatement within 180 days after expiration and pay the prescribed renewal feeand penalty. After 180 days, a new application will be required, which shall be considered specifically by the Board, both from thestandpoint of competency and of character.

If you have not visited the board office lately,located in Oklahoma City at the Oklahoma

Engineering Center, you are encouraged todrop by and see the newly renovated DresserLibrary/Board Room. What started out as a“replace the carpet and paint the walls” effort,turned into a full-fledged construction projectwith jackhammers, a new audio/video system,and a beautiful new hexagonal conferencetable. Our very capable Executive Director, Ms. Kathy Hart, coordinated theproject. She served as our ad hoc general contractor and coordinated all workincluding planning, purchasing, color selections, coordination of contractors, finalinspection and final payment to all contractors. The Oklahoma EngineeringFoundation financed the carpet, blinds, paint and plumbing for the project, and theBoard financed the furniture, furnishings, electrical work for the audio-visual andcommunication equipment and board table, and architectural services from JimLoftis, AIA. Bob Zahl, P.E., AIA, Board Member and partner in Zahl-Ford, Inc.,contributed valuable assistance with architectural and audio-visual elements of theproject and the MEP firm of which I am President, PSA Consulting Engineers,Inc., contributed the electrical engineering and design work required for theproject.

All of the new electrical systems, including power, data, audio/video, andtelephone are now distributed from below floor level. The existing concrete slab inthe floor was cut, sawed and jackhammered out for the placement of newconduits and combination power/data floor boxes. The boxes are flush mountedwith the floor surface and all new cables routed neatly from the floorboxes upunder the new table and into popup power/data outlets at the top of the table foreasy connection of systems to the laptops.

The new hexagonal configuration of the conference room table allows formore direct “face to face” conversation during meetings and disciplinaryproceedings. More and more, the board is required to review engineering andsurveying plans during disciplinary hearings to determine final disciplinary actionsin those proceedings. To help facilitate this effort, a portable interactive lecternwas installed so that exhibits can be shown on the new 63” diagonal video screen.All of the new audio/visual was part of a new system purchased from Ford Audio.The benefit of the lectern being portable is that we can also utilize it during largermeetings that are conducted at the Oklahoma Engineering Center in the largerauditorium, where we also installed a new projector in the ceiling. This equipmentwas used for the first time in the auditorium at the public meeting of the Boardregarding residential foundations in July of this year. This audio-visual equipmentis state of the art, and allows the board and enforcement staff to handle the ever-increasing volume of disciplinary matters and other matters before the Board.

GLEN SMITH, P.E., P.L.S.APPOINTED TO THE BOARD

Glen W. Smith, P.E., P.L.S. was recently appointed by Governor BradHenry to serve as a member of this Board from June 29, 2007 to June

28, 2013. He fills one of the four professional engineer positions on the Board.Mr. Smith graduated from Oklahoma State University in 1971 with a

degree in Agricultural Engineering. Shortly after graduating he was employedby John Butler Engineering, Inc. and became a stockholder in 1978. He re-mained with John Butler until the formation of Smith-Roberts and Associatesin 1981. He is both a licensed professional engineer and professional landsurveyor in the state of Oklahoma.

As a Civil Engineer, Mr. Smith has extensive design experience inprivate sector projects involving planning, drainage, water, sewer, and paving.Mr. Smith has served in the capacity of consulting engineer on many state andmunicipal funded projects dealing with drainage, roadway, and utility reloca-tion. As a Surveyor, Mr. Smith has worked with a majority of the nation’slargest title companies and law firms providing A.L.T.A. surveys for real es-tate mergers and acquisitions.

Mr. Smith is active as a lecturer on legal problems as they pertain tosurveying and real estate and has served as President and Member of theBoard of Directors of the Oklahoma Society of Land Surveyors and on com-mittees of the American Congress on Surveying and Mapping.

We look forward to working with Mr. Smith as a Board Member.With his expertise and experience in both the engineering and surveyingprofessions, he will be a valuable addition to this Board.
