Subject:- Establishment of Directorate of Prosecution and Jammu and Kashmir Prosecution Service.

Whereas, with the enforcement of the Jammu & Kashmir Reorganization Act, 2019, the Code of Criminal Procedure, 1973 (Cr.PC) shall come into force on and from 3 1.10.2019; and

2. Whereas, this requires bringing the legal framework in sync with the National Norm, viz; to ensure Prosecutorial independence, as emphasised by the Hon'ble Supreme Court in case titled S.B. Shahane and Ors. Vs State of Maharashtra (AIR 1995 SC 1628). establish a Directorate of Prosecution with a separate prosecution service, directly responsible and under the administrative control of the Government. It is also a crucial element of reforms of the Criminal Justice System, implementation whereof is being closely monitored by the Ministry of Home Affairs, Government of India; and

3. Whereas, at present, 'Prosecution' is a wing of the Police Department, having a separate cadre of officers, their conditions of service and matters connected thereto being governed by the Jammu and Kashmir Police (Gazetted) Service Recruitment Rules, 2002 in respect of Gazetted officers and Police Rules. 1960 in respect of Non-Gazetted officers; and

4. Whereas, considering that officers of the existing Prosecution wing have been appearing in the Courts for conducting criminal cases and have gained valuable experience, their services are sought to be utilized, in accordance with the provisions of the Cr.PC, 1973 as Public Prosecutors (PPs), Additional PPs and Assistant PPs: and

5. Whereas, the severance of prosecution from police being sine qzrn non to achieve prosecutorial independence, apart from being a statutory obligation of the Government, warrants alteratiodcessation of the present status of the

members of the existing 'Prosecution' wing of the police, notwithstanding their initial appointment under the Police Rules, 1960, so as to make them eligible for being part of the prosecution service;

6. Now, therefore, sanction is hereby accorded to:

i). establishment of a Directorate of Prosecution, headed by a Director General (Prosecution), consisting of such posts as may be prescribed;

ii). creation of a separate prosecution service, to be known as the 'Jammu & Kashmir Prosecution Service', comprising the members of the Jammu and Kashmir Police (Gazetted) Service [Prosecution Wing] and the Prosecuting Officers (Non-Gazetted), as per A ~ e x u r e . Thereupon, the said persons shall cease to be the Police Officers and, accordingly, excluded from the ambit of the Jammu and Kashmir Police (Gazetted) Service and the Police Rules;

iii). provision of allowances, other facilities and benefits, as per their present entitlement. notwithstanding such exclusion. However, appropriate orders shall be issued separately. to provide for such allowances or equivalent thereto:

iv). notification of recruitment rules, providing for method of recruitment and service conditions of the members of the Prosecution Service, after due consideration of the requirement for fresh creation of posts and promotional avenues, apart from provision of reserves to meet the requirement of the Anti Corruption Bureau, Vigilance Commission, Training Institutes and various Police formations, etc.

7. Further, sanction is also accorded to engagement of the retired officers, of and above the rank of Sr. POs. by police formations. with the prior approval of the Home Department, to meet any severe manpower deficit, wherever felt necessary, initially for a period of six months.

8. This is in supersession of all the rules, regulations, notifications and orders issued in this regard by the Government, from time to time.
