Sub. : Fixation of Revised Pension in respect of Pre 1-1-2006 Pensioner/Family Pensioner

under the State Govt.

Sir,

Consequent upon die Govt, decision on the recommendation of The Assam Pay

Commission 2008 announced under Govt. Resolution No. FPC 85/2009/1, dated 4/2/2010 as published

in the Extra Ordinary issue No. 25 of the Assam Gazette dated 4/2/2010 regarding the

regulation/revision of pension/family pension in respect of Pre 1/1/2006 pensioner/family pensioner, I

am directed to say that the Government in the P & P. G. Department have already issued necessary

OFFICE MEMORANDUM and communicated to all concerned vide Govt. O. M. No. PPG(P)

88/2010/26 dated 1/6/2010.

It has come to the notice of the Govt. that, dispute has arisen in the minds of some

implementing authority as to the applicability of Section 3(b)I of the said O. M. in connection with the

fixation of revised pension of Pre 1/1/2006 pensioner/family pensioner causing confusion in disposing

of pension cases of concerned pensioners, whose cases are governed as per the Assam Services

(Pension) Rules 1969.

The Finance PRU Department was consulted and the Department vide their U/O

No. FPC 147/2010 dated 30/9/2010 and No. FPC 89/2012 dated 26/7/2012 has further clarified the

matter that, the provision contained in para 3(b) (I) of Office Memorandum

No. PPG(P)88/2010/26 dated 1/6/2010 appears to be clear and is in order.

In view of above, you are requested to take in to account the Ready Reckoner and

the provision of Section 3(b) (I) of the O.M. No. PPG(P)88/2010/26 dated 1/6/2010 while fixing of

pension/family pension of Pre 1/1/2006 pensioner subject to the maximum limit of Rs. 27,500/-

(twenty seven thousand & five hundred) per month.

It is further clarified that this order shall be applicable to pensioner who have

drawing pension on 01/01/2006 in the Pre Revised Scale.

ORDERS BY THE GOVERNOR

PENSION AND PUBLIC GRIEVANCES DEPARTMENT

OFFICE MEMORANDUM NO.PPG(P)88/2010/26 Dated Dispur, the 1st June, 2010. In pursuance of the Government decisions on the recommendations of

the Assam pay Commission, 2008 announced under Government Resolution

No.FPC.85/2009/1 dated 04th February, 2010 as published in the Extra-

Ordinary Issue No.25 of the Assam Gazette dated 04th February/2010,

sanction of the Governor of Assam is hereby accorded to the

regulation/revision of pension/family pension with effect from 01st January

2006 in respect of pre 01/01/2006 pensioners/family pensioners in the

manner indicated herein in succeeding paragraphs.

1. These orders shall apply to all pensioners/family pensioners who

were drawing/ entitled to pension/family pension on 31/12/2005 under The

Assam Services (Pension) Rules, 1969 as amended.

2. In these orders following terms are used in the sense explained

herein below:-

a. “Existing pensioner/Family pensioner” means a pensioner/family

pensioner who was drawing or entitled to pension/family pension on

31/12/2005.

b. “Existing pension” means basic pension inclusive of commuted portion,

if any, due on 31/12/2005. It covers all classes of pension under Assam

Services (pension) Rules, 1969 as amended.

c. “Existing Family pension” means the basic family pension drawn or

entitled to as on 31/12/2005 under The Assam Service (Pension) Rules, 1969

as amended.

3. Consolidation/revision of pension/Family pension.

a. The pension/Family pension of existing pensioner/family pensioner i.e.

pre 01/01/2006 pensioner shall be consolidated/revised w.e.f

01/01/2006 notionally by adding together-

I. Existing Basic pension/family pension as on 31/12/2005.

II. Fitment benefit equal to 40% of basic pension/family pension and

III. Dearness Relief at the Rate of 86% of Basic pension/Family pension.

IV. The amount so computed on the basis of the above principles shall be

rounded off to the next multiple of Rs.10 and will be Basic Pension for

all purposes with effect from 01/01/2006.

b. The above computation is subject to the following conditions:

I. The revised Basic pension in no case shall be lower than fifty percent of the sum of minimum of the pay in the Pay Band and the Grade Pay thereon corresponding to the pre revised pay scale from which the pensioner had retired.

II. Pension for the purpose of this calculation will include commuted portion of pension if so commuted.

III. Payment of revised pension shall be subject to exclusion of Commuted portion till the restoration is due.

IV. No fresh commutation will be admissible on the revised Pension.

4. Dearness Relief:

The rates of Dearness Relief admissible to the State Government

Pensioners, family pensioners and Extra-ordinary pensioners are indicated

below:-

I. From 01/04/2009 - 22% II. From 01/07/2009 - 27% III. From 01/01/2010 - 35%

5. Payment of Arrear –

Revision of pension/ family pension with effect from 01/01/2006 to

31/03/2009 is to be done notionally and no arrear shall accrue during this

period. Arrear with effect from 01/04/2009 may be calculated and paid by

the pension disbursing authorities including selected Nationalised Public

Sector Banks in a single installment. The Interim Relief sanctioned vide

O.M. No.FPC 6/2008/13 dt 30/05/2008, O.M No.FPC,6/2008/pt/4 dt

02/01/2009 and O.M No.FPC 6/2008/30 dt 04/09/2009 to the pensioners

and family pensioners and drawn with effect from 01/04/2009 will be

adjusted (deducted) from the arrears arising out of revision of pension

which will be paid w.e.f. 01/04/2009.

6. Expenditure on account of revision/consolidation of pension/family

pension, revised rate of Dearness Relief is debitable to the appropriate

Budget Head to which it relates.

7. Assam Services (pension) Rule, 1969 shall be deemed to have been

amended by these orders contained herein. Formal amendments will be

issued in due course.

8. Power of interpretation of rules: In case of any doubt/confusion

relating to this OM, it shall be referred to the P & PG Department,

Government of Assam whose decision thereon shall be final.

9. Ready Reckoner for fixation of pension/family pension is given at

Annexure I.

This issues with the concurrence of Finance (PRU) Department

conveyed vide their U/O No.FPC 122/2010 dated 1/6/2010.
