Levy, Alex Rubin, Gedalyah Felder, Nachum L. Rabinovitch and Nota Schiller by their petition have represented that it is desirable to incorporate an insti- tution for studies and research in higher Jewish learning and cognate fields within the Province of Ontario; and whereas the petitioners have prayed for special legislation to effect such purpose; and whereas it is expedient to grant the prayer of the petition; Therefore, Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows: \ 1. tion to branches of higher Jewish learning, and suchdiplomas as It deems appropnate, but such powershall only be effective if, as the result of federation,affiliation or agreement, provision is in effect forcourses not directly related to higher Jewish learningto be taken by its students at or under the super-vision of a university which has had degree-granting rights conferred by the Legislature of theProvince of Ontario;

(c) to affiliate with, or take into affiliation or federatewith, other colleges, schools, universities and in-stitutions of learning on such terms and for suchperiods of time as the Board of Governors maydetermine;

(d) to publish and distribute periodicals and booksrelated to studies and research in higher Jewishlearning;

(e) to establish fellowships for students engaged instudies and research in higher Jewish learning.

tation Act, the power to purchase or otherwise acquire, takeor receive by gift, deed, bequest or devise or otherwise anyreal or personal property necessary for its actual use andoccupation or for carrying on its undertaking absolutely or intrust and to hold and enjoy any estate or property whatsoever,and to sell, grant, convey, mortgage, hypothecate, pledge,charge, lease and otherwise dispose of the same or any partthereof from time to time as occasion may require, and toacquire other estate and property in addition thereto withoutlicence in mortmain and without limitation as to the periodof holding.

(d) to issue bonds, debentures and obligations on suchterms and conditions as the Board of Governorsmay decide and to pledge or sell such bonds, deben-tures and obligations for such sums and at suchprices as the Board of Governors may decide andmay mortgage, charge, hypothecate or pledge all orany part of its real or personal property to secureany such bonds, debentures and obligations.

4:. The funds of Maimonides Schools not immediately re- ~~~ve:;~entquired for its purposes and the proceeds of all property thatcome into Maimonides Schools, subject to any trusts affectingthe same, may be invested and reinvested in such invest-ments as the Board of Governors of Maimonides Schoolsdeems proper and all its property and revenue shall be appliedfor the attainment of the objects for which MaimonidesSchools is constituted and to the payment of expenses incur~'edfor objects legitimately connected with or depending on thepurposes aforesaid.

5.-(1) There shall be a Board of Governors of Mai- g~~~~nO:rsmonides Schools that shall consist of the persons named insection 1, who shall hold office until their successors are electedor appointed, and such other persons, not exceeding eighteenin number, as may be elected or appointed in such mannerand for such term as may be provided in the by-laws of theBoard.

(2) The Board of Governors shall appoint persons to fill Vacanciesvacancies that occur in the Board.

(3) If, within any fiscal year of Maimonides Schools, a Idemmember of the Board of Governors, not having been' grantedleave of absence by the Board, attends less than 50 per centof the regular meetings of -the Board, the Board may, byresolution, declare vacant the seat of such member.

6. The Board of Governors has the control, management Mantag~-and government of l\Iaimonides Schools and has power to ~~~m~nides. Schoolsmake by-laws, rules and regulatiOns not contrary to law or theprovisions of this Act,

(a) for the working and management of MaimonidesSchools;

(b) for determining the number of members of theBoard that shall constitute a quorum;

(c) respecting the election or appointment of membersof the Board; and

(d) regulating all matters pertaining to meetings of theBoard.

President 7.-(1) The first President of Maimonides Schools shall beRabbi Yaakov S. Weinberg, and his successors and all subse-quent Presidents shall be appointed by the Board of Gover-nors and the Senate of Maimonides Schools from a panelof candidates to be recommended by an international boardof educators in higher Jewish learning, which board shall beappointed by the Senate.

Idem(2) The President shall be responsible, with the advice of

the Senate of Maimonides Schools, for supervising, directingand regulating the system of education of Maimonides Schools,for determining the courses of study and standards of ad-mission and qualifications for degrees, for conferring degrees,and for appointing and removing members of the faculty andthe officers and servants of Maimonides Schools.

Senate8.-(1) There shall be a Senate of Maimonides Schools

composed of,

(a) the President, who shall be its Chairman;

(b) two members of the Board of Governors;

(c) two representatives elected by the student body;

(d) the Dean or Director, as the case may be, of eachfaculty or department of Maimonides Schools;

(e) not fewer than three and not more than seven mem-bers of the faculty to be elected by the faculty.

Vacancy (2) The body possessing the power of election or appoint-ment may fill a vacancy on the Senate for the unexpiredportion of any term.

9. Nothing herein contained has the effect or shall beconstrued to have the effect of rendering all or any of themembers or officers of Maimonides Schools, or any personwhatsoever, individually liable or accountable for or by reasonof any debt, contract or security incurred or entered into foror by reason of Maimonides Schools or for or on account or inrespect of any matter or thing whatsoever relating to Mai-monides Schools.

Taxexemption 10. Property vested in Maimonides Schools and any

property leased to and occupied by Maimonides Schools arenot liable for taxation for provincial, municipal or school pur-poses and are exempt from every description of such taxation,so long as the same are actually used and occupied for thepurposes of the Maimonides Schools.

11. All property vested in Maimonides Schools shall, as ~tJt1~~~i~Olbrfar as the application thereto of any statute of limitations is limitationsconcerned, be deemed to have been and to be real propertyvested in the Crown for the public use of Ontario.

12. Real property vested in Maimonides Schools is not ~r~a~ertyliable to be entered upon, used or taken by any corporation, ~~~~~ap~\~~oexcept a municipal corporation, or by any person possessing tionthe right of taking real property compulsorily for any purpose,and no power to expropriate real property hereafter conferredextends to such real property unless in the Act conferring thepower it is made in express terms to apply thereto.
