A RESOLUTION authorizing City Mayor Arlene B. Arcillas to sign a Memorandum of Agreement (MOA) between the City Government of Santa Rosa and the Environmental Management Bureau - CALABARZON (EMB-CALABARZON), a government agency created by virtue of Republic Act No. 8749 otherwise known as the Philippine Clean Air Act of 1999.

RESOLVED FURTHER to recommend additional provision to the Memorandum of Agreement, Page 2, No. 5 -Roles and Responsibilities of EMB 4A as follows : "5. Shall use the lot space designated temporarily. In the vent that the City of Santa Rosa needs the for space for any development and expansion program, EMB 4A shall transfer or vacate the subject lot space at their own expense without the need of judicial demand. For the EMB R4 to be able to transfer to another space, the Citv Government of Santa Rosa, Laguna shall give due notice to EMB R4 six (6) months prior to transfer date. "

MEMORANDUM OF AGREEMENT

The ENVIRONMENTAL MANAGEMENT BUREAU - CALABARZON (EMB - CALABARZON), a government agency created by virtue of Republic Act No. 87 49 otherwise known as the Philippine Clean Air Act · of 1999 herein represented by the Regional Director CARLOS J. MAGNO with offices at 5th Floor DENR by the Bay Building, 1515 Roxas Boulevard Ermita, Manila, hereinafter referred to as EMB 4A;

The CITY OF SANT A ROSA, a local government with principal office located at the 2nd floor, City Government Center, J.P. Rizal Blvd. , City of Santa Rosa, Laguna, represented herein by its Mayor ARLENE B. ARCILLA$ and hereinafter referred to as City of Santa Rosa. ·

WITNESSETH THAT:

WHEREAS, the EMB is primarily tasked for the prevention, control and abatement of all k_inds of air pollution in · the entire country pursuant to Republic Act 87 49.

WHEREAS, EMB 4A as part of its mandate and authority, shall co·ordinate with the private sector, non-government organizations, civic organizations, the local government units, and other government agencies and bureaus, with the dissemination of information related to air quality management in the entire region (CALABARZON Region);

WHEREAS, the METRO MANILA AIRSHED created under, Republic Act 8749, and comprises of part of Region Ill, National Capital Region, and part of Region IV-A, as stated in Memorandum Circular No. 2002-01 . (Initial Designation of Airshed of Metro Manila) and as revised in DENR Administrative Order No. 2011 - 12 (Revised Designation of Metro Manila Airshed)

WHEREAS, the City of Santa Rosa is a suitable site for ait quality monitoring_ of Metro Manila Airshed .

NOW, THEREFORE, in consideration of the foregoing premises, the parties have agreed on ·the following:

Roles and Respqnsibilities of EMB 4A:

1. The EMB, in coordination with the MAYOR and CITY ENRO, shall conduct site inspection within the CITY to pinpoint the actual location, acceptable to both parties, on which to install the automatic ambient air quality monitoring station;

2. Provide City Governme.nt of Santa Rosa with copies of assured air quality collected at the chosen Station;

3. Shall conduct QNQC activities in accordance with the approved EMB Quality Assurance Program Plan (QAPP);

4. At its own expense, install, operate and maintain the said station at the chosen site;

5. Shall use the lot space designated temporarily. In the event that the . City of Santa Rosa needs the lot space for any development and expansion program, EMB 4A shall transfer or vacate the subject lot space at their own expense without the need of judicial demand.

Roles and Responsibilities of the City of Santa Rosa:

1. Shall allow EMB 4A to temporarily use an open space of at least nine (9) square meters but not more than _ square meters, the location of which shall be subject to the approval of the City of Santa Rosa where the semi-fixed ambient air quality monitoring station will be installed;

2. Shall allow EMB4A to install/construct the Ambient Air Q~ality Monitoring Station and its accessories as well as operate and maintain the same within the said space, free of charge for the duration of the proj~ct. The cost of installation and construction of the ambient Air Quality Monitoring Station and its accessories. as well as the cost of maintaining the same shall be exclusively for the account of EMB 4A.

3. Shall allow EMB access to the allotted space as agreed upon for the operation and maintenance the Ambient Air Quality Monitoring Station within the said space, free of charge for the duration of the MOA;

4. Shall shoulder the cost of monthly electricity and water consumption of the station; and

This Agreement, even while in full force, ·shall be subjected to periodic review by both parties for the sole purpose of updating the parameters affecting the objectives of the aforementioned project.

And this Agreement shall be binding between parties for the duration of its effectivity. Further, that any violation of any of the provisions stipulated herein shall be cause for suspension, termination or revocation, of this Agreement w hichever m a y a ppro pria te ly a pply. ·
