A. Well, I 1 m always referred to or addressed as

Dr. Swilling, Jacob Swilling.

Q. Okay. Dr. Swilling, have you had your

deposition taken before?

A. No.

Q. I'm sure your counsel has explained what

we're doing here today in the deposition procedure, but

just so that we're both on the same wavelength and

understand what we're doing today, let me discuss those

procedures with you.

First of all, as you note, you were

administered the oath to tell the truth under penalty of

perjury, which is the same oath that's given in a court of

law. And even though we sit here informally around a

conference table in a law office, the proceedings are

formal in the sense that the oath that we use here is that

same oath that's used in a courtroom and the penalties of

perjury that would apply in a courtroom apply here in the

deposition setting also.

A. Yes, sir.

Q. All right. Everything that we say, unless we

go off the record at the request of one of the attorneys,

will be taken down by a court reporter, Ms. Burlason.

After the deposition she will arrange to have what we say

this matter. The moral of the story, then, so to speak,

is that it's important not to make changes, and so to

avoid making changes, you should not guess or speculate at

an answer. If my question 1s not clear and you feel you

have to guess or speculate to answer it, you shouldn't do

that. You should tell me to rephrase the question or

restate it for you in a manner so that it's understandable

to you.

A. No.

A. s;nce December of 1996.

Q. What 1s the reason that the un;vers;ty 1s no

A. A dec;s;on that was taken to meet the

requ;rements of new legislat;on that has recently been

introduced by the Department of Education.

that resulted ,n the university no longer awarding

degrees?

A. It's affected all of the private and

secondary schools throughout the state in that they are

required to meet new requirements in the legislation for

degree programs.

Q. Have you been employed full time at the

International University?

A. No.

Q. When did you first become employed by the

International University?

A. 1986. July, 1986, is my recollection.

Q. What position did you first have at the

International University?

A. I was an associate professor in South Africa,

and in 1986 was appointed vice-president, and then,

subsequently, president.·

Q. You testify you were appointed associate

profess~r 1n South Africa?

A. Um-hmm. Correct.

Q. The International University had a branch ,n

South Africa at that time?

A. I was responsible for.a campus, a small

campus, 1n Johannesburg in South Africa.

A. There was a faculty that was actually

appo;nted 1n conjunct;on with the univers;ty here in the

United States.

Afr; ca at that time?

A. There were three.

A. Yes.

A. Approx;mately 20.

A. Yes. We need to qua 1 i fy that, though. I had

to attend a challenge exam and get my degrees presented at

a graduation ceremony here at the university.

Q. Okay. When you say you need to qualify it,

I'm not sure I understand what you mean.

A. Well, the question was did re ce 1 ve i t 1 n

South Africa. I received it when I was in South Africa.

Q. What year?

A. My recollection was 1n 1983, 1984 --

Q. So you received your B.S. degree in 1983 or

1984 while in South Africa; is that correct?

A. Yes.

Q. And that was before you came to the United

States; is that correct?

A. Yes.

Q. And you received that degree from the

International University for Nutrition Education located

1n Chula Vista; is that correct?

A. At that time the university was located in

Huntington Beach, 1n northern Ca 1 i f o rn i a . It subsequently

re 1 ocated.

Nutrition Education had a branch at that time 1n South

A. Yes.

A. A suburb that is known as Auckland Park.

Q. And where were you awarded your Master's 1n

Science Degree from the International University for

Nutrition Education?

A. In South Africa, while I was in South Africa.

Q. And then in 1986 you traveled to the United

States or 19- --

A. 1985.

And .did you receive your Ph.D. degree from

the International University for Nutrition Education while

you were still in South Africa?

A. Yes.

Q. And that degree was awarded by the

International University for Nutrition Education which was

located in Huntington Beach but which is now located in

Chula Vista.

A. Correct.

A. I was a trainee ,n an advertising agency,

having left college.

A. Well, my recollection is 1955 to 1960.

Q. After that, what was your full-time

employment?

A. I became an executive of the same advertising

agency.

Q. What time period were you an executive?

A. It was really during the same period.

can't recollect the exa~t years, but it was between '65

and '60.

Q. After 1960, what was your next full-time

employment?

A; I actually became self-employed.

Q. In what kind of work?

A. In the health field.

Q. And how long did you remain self-employed in

the health field?

A. Well, I continued. That's been my life's

work since that time.

Q. What did you do in 1960 in the health field

as part of your self-employment?

A. I was a consultant to the health food

industry.

Q. And as a consultant, what kinds of consulting

did you do?

A. It had to do with formulation or formulating

health supplements and foods as well as my own private

practice as a counselor in nutrition.

Q. In private practice as a counselor, you mean

A. Right up until the time I emigrated to the

A. Yes.

Q. What was the reason you chose to emigrate to

the United States, then?

A. I was invited to participate on the board of

the university. They sponsored my application.

Q. Was there anyone in particular whom you had

conversations with on that subject at the International

University?

A. Linda Bunting, and the president at that time

was a Dr. Kurt -- that's K-u-r-t, Donsbach,

D-o-n-s-b-a-c-h.

A. No. I need you to just rephrase that

A. No.

Q. After you arrived 1n the United States 1n

1985, where did you reside?

A. In Huntington Beach.

Q. How long did you reside there?

A. It was until the university relocated, which

believe was the end of 1989.

Q. While you were 1n Huntington Beach, what was

your occupation?

A. Vice-president.

occupation during that time?

A. No.

A. Assisting in development of curr;culum and

course material.

Q. How many students did the International

University have at that time, full-time students?

A. That's my recollection: There were 4,000

students.

Q. And these 4,000 stud~nts attended the

university on a full-time basis?

A.· No. It's directed study. There wasn't

that's really what it is, it's directed study.

Q. What is directed study?

A. The students are not required to ~o resfdent

classroom training on a regular basis. They have periods

that they come to the institution to challenge exams, but

faculty members were the mentors of the student in helping

them to complete their studies wherever they were located.

Q. Is this sort of like a correspondence school?

A. No. It was never categorized as a

correspondence school.

Q. So the 4,000 students would reside throughout

the world?

A. Correct.

Q. And the only time they had to be present at

the university was to take exams?

A. Correct.

Q. In 1989, what did you do?

A. I continued to perform my duties as

company, of the institution.

A. It was in 1987, as far as my recollection 1s.

Beach from 1987 to 1989; is that correct?

A. Yes.

Q. And you say in 1989 the university moved from

Huntington Beach to Chula Vista; is that· correct?

A. Correct.

Q. What was the reason for the move?

A. It was a consolidation to be near additional

facilities.

Q. Has the International University been 1n

Chula Vista from '89 to the present?·

A. Yes.

Q. How many buildings does the International

University in Chula Vista consist of?

A. It's one, one building.

A. The delivery program of nutrition has

textbooks, course material, study aids, special projects,

universities or in libraries.

their final exams at a university in Maine or New York or

A: really would not like to hazard a guess.

But it wasn't substantial. It was minimal.

A. No. Those that failed.

A. Yes. There were others that would just

withdraw that didn't complete.
