I. Natre of the Proiect:-

In the reference 1"t read above, the Executive Engineer, Godavari Western

Division, Nidadavole filed requisition for acquisition of land for Seshavataram

New Extension Channel under Modernization of Delta System duly enclosing L'P'

Schedules.

After verfication of atignment, the Tahsildar, Narsapur Mandal has

proposed and initiated land acquisition proposals for acquiSition of land

measuring to an extent ol Ac.8.62 cts., covered by RS Nos S9O/1B etc" of

L.B.Cherla village of Naraspur Mandal ior Seshavataram New Extension Channel'

After scrutiny, P.N. proposals have been submitted to the District Collector, W'G'

EIuru U/ s.11(1) ofthe L.A. Act 2013.

2. PreliEinarv Notiftcatlor:-

The Preliminary Notiflcation U/s.11(1) of the L.A. Act providing with 15(2)

enquiry was approved by the Collector, West Godavdi, Eluru in E.Off.Com.No.

L4617/2O151G2dt.16-10-2015 for an extent of Ac. 8.62 cents covered by R.S. Nos.

39O/ lE} etc., of L.B.Cherla village of Naraspur Mandal. The said notihcation was

published as provided under Act.

Consequent on the publication of the Preliminary Notification' Form-VIB

onquiry on 21-12-2015 at Sub-Collectors oflice, Narsapuf' In response to thc

Sec.15(2) notice, certain land owners covered b5l notification have frled objection

petition on 21-12-2015 with tlre fo[owing objections:-

l}The route plan proposed at the lirst instance b€tween R'S'No' 395-390 of

L.B.Cherla has to be implementcd;

2)At present t}re route plan is changing for extension of channel' for which they

are objectingi

3llf the 2d pLan is implemented, no.of ryots are efiecting tl.eir- crops and that to

and the ryots are dividins on two sides'

4)As well they loose their fields for drain bodies;

s)Finally requested to form the extension channel as Per route maP proposed at

first instance.

The objection petition has been referred to Dy'Executive Engineer'

Irrigation Sub Division, Narsapur to oller his remarks' The Dy'D<ecutive

Engineer, Irrigation fumished his remarks stating that the approved alignment is

only the alignment for feasibility of channel extension, that the extension channel

crossing the existing RamannaPaleE channel near Modi village, that the ryots

requested to alter arld run the channel in the opposite direction of existing flow

and hcnce t}re proposed alternative alignment is technically not feasible'

On tlte request of the ryots who wish to alter t}re alignment, the l'AO has

inspected the proposed atiSnment and altemative alignment accompanied by the

D5r.Executive Engineer, Irrigation Sub Division, NarcaPu!, Asst' Engineer'

Irrigation, Narsapur, Revenue held staff along with objecting ryots on 28- 1 2-2O 1 5

and in the inspection it is found that the ground reality for t}le altemative

alignment as requested by t}re ryots wit.h reference to ground levels and

geographical conditions and tlee elevation of t}le ground (ie) + 9.37, -0'015 and

again +0.O8, it shows ttrat the ground altemative alignment is fallen from higher

to lower ttten lower to higher and hence it is not suitable for alignment of t}re

canal as one of the oristing canat (Ramannapalem branch channel) is running in

t}le opposite direction to the proposed alternate alignment and further the

altemative alignment has to be aligned in 9o degrees ill two pLaces which is

technically not feasible and the alignment proposed for acquisition, approved by

the Irrigation department is holds good.

With regard to the grievance of th€ ryots, that their lands are splitting with

the proposed acquisition which a.re not economical for cultivation' they were told

for Seshavataram New Extension Channel under Modernization of Godavari

Western Delta System and accordingly U/s 3 (e) of l,A Act, 2Ol3 r/w. rule 21 (2),

the objections of t)le Land ou,ners are overn:Ie ald rejected. Also directed the LAO

cum Sub-Collector, Narsapur to serve the orders and to send Declaration

Proposals.

3. Declaratlou: -

Thereupon Declaration proposals were submitted to the Cotlector, W.G., forapproval for an extent of Ac. 8.76 cents. Ttre Declaration U/s. l9(f) of the L.A.

Act was approved by the Collector, WG., in E, Off. Comp. No, L46L7lZOl5tc2, Ot::

19.01.2016. This notification was also got published as provided under Act.4(al. True Arerr

The Mandal Surveyor, Narsapur after due issue of notice U/s. 6 of theSurvey & Boundaries Act measured the land and prepared the sub_divisionrecord for the lards under acquisition. The Divisional Deputy Inspector ofSurvey, Nalsapur has pre-scrutinized the Sub-Division Record. The pre_

scrutinized extents as shown below are adopted in the Declaration issued U/s.19(1) of the L.A. Act in this case.

The sale transactions from Sl No.1 & 2 have occurred on Sq.Yard basis and cannot

be relied upon. The sale transaction at Sl.No.3 occurred on Acreage basis and fetched a

rate of Rs.5,00,000/-per Acre and can be relied upon for fixation of market value for the

lands covered by acquisition.

According to Section 26 of Right to Fair compensation and Transparenc.y ln Land

Acquisition, Rehabilitation & Resettlement Ad,2013 (No.30 of 2013) which came in to force w.e.f

1.1.2014 following is the criteria in assessing and determining the market value of the lands

namely:-

a. the market vatue, lf any, specifled in the Indian Stamp Act, 1899 for the

registration of sale deeds or agreements to sell, as the case may be, In the area,

where the land is situated; or

b. the average sale price for similar type of land situated in the nearest village ornearest vicinity area; or

c. Consented amount of compensation as agreed upon under sub- section (2) ofsection 2 in case of acquisition of lands for private companies or for public

private partnership projectst whichever is higher.

The average sale price for similar type of land situated in the vicinity is Rs.5,OO,0OO/_.

under category (b).

The baslc value of the lands covered by acquisition as on the date of pN isRs.8,00,000/-per acre under category (a) .

The ( C ) category is not applicable in this LA matter.

- In view of the above , I have fixed Rs. 8,00,000/- per acre as market value for

the lands under acqulsition covered by R.S.Nos. 390/1B etc., of L.B.Cherla Village

which is the higher value when compared with(a) & (b) categories.

Valuation of Trees & Structures:

There are 66 coconut, 2 Neem, 19 Palmyrah & 3 Teak trees are existed in the

land covered by acquisition and the concerned Horticulture Officer and Forest Range

Offlcer have estimated the tree values at Rs. 1,17,884/-.

There are no permanent structures/ tombs are existed in the lands covered by

acquisition.

7l AWARD ENOUIRY:-

Notices U/s. 2l&,22 ol t}le L.A. Act have been published in the mannerprescribed directing the persons interested in the land to put-forth theirrespective interest duly adducing documentary evidence for such interest withina period of 30 days from the date of publication of the notice ard also served tothe known interested persons with a similar request besides attending before ttre

Land Acquisition Officer and Sub-Collector, Nalsapur for award enquiry on

23.02.2016 and to give their Award enquiry statements. In pursuance of the said

notice, Eight land owners covered by R.S.No. 390/118 pt., 39O /t2A pt., 4O2l69,4O2l7B, 4O2l88, 4O2l9B and 4O2ll2B measuring Ac. O-44 cts., have attendedto the Award Enquiry and established their ownership oo the notihed land. Forthe remaining extent, the title and ownership over the Iand has to beestablished. As and when, the said interested parties proved their title, they willbe paid compensation as per New L.A. Act. The claims of the individuals arediscussed in the respective part of award,

As stated above the title established extent is Ac. O_44 cts., in R.S.Nos.390/ 1lB pt., 39O / 12A pt., 4o2 / 6F., 4o2 /ZB, 402 / BB, 4o2 / 98 atd 4o2 I l2B a,,d,therefore the compensation due on the above extent as detailed in the appendedApportionment statement is ordered to be paid to the land owners by crediting totheir respective Bank Accounts.

lol FUNDS:- The award amount will be paid to the Awardees by the pay&Accounts Officer, Works & project, Eluru through transfer to the respecuve BankAccounts of the awardees.

In view of the above, drart Award is passed for an amount of Rs.1,80,39,160/-( Rs. One crore Eighty lakhs Thirty Nine Thousand One hundredand sixty only.) for payment to the land owners as per the provisionsu/ sec.24(ixa) of the RFC&TI A R&R Act 2013.

No minor Inam lands are involved in acquisition in this case. Hence thequestion of payment of Inam privileges does not arise in this case.

There is no arrangement for payment of the compensation to the laadowner other-wise tlur in cash. The compensation will be paid to the ldnd ownersby crediting to their respectivc Bank Accounts.
