Background

The International Convention for the Control and Management of Ships' Ballast Water and Sediments, 2004 was adopted by the International Conference on Ballast Water Management for Ships held at IMO's Headquarters in London from the 9 to 13 February 2004. The Convention, known as the "BWM Convention" in short, consists of 22 articles covering the obligations agreed by the Parties and an annex containing the technical regulations related to the control and management of ships' ballast water and sediments. The BWM Convention will enter into force 12 months after ratification by 30 States, representing 35% of world merchant shipping tonnage. To date, the BWM Convention has been ratified by 36 States, consists of 29.06 % of world merchant feet. While this situation meets the required number of Status (30), it does not meet the required 35 per cent world merchant fleet tonnage (30%). Lloyd’s Register has produced a guideline on BWM Convention and available technologies. Lloyd’s Register’s position

Implementation of the requirement once the convention enters into force will be a challenge for all concerned parties. It would be desirable to adopt a scheme that would flatten the peak workload to ensure timely implementation.

Lloyd’s Register will closely monitor the discussion on the use of drinking water as ballast.

With regard to sampling issues, Lloyd’s Register support the trial approach developed by the BLG Sub-Committee

Advice to clients

Most ships are expected to comply by installing and using an approved ballast water treatment system which is to be installed on a defined time scale based on the ships date of construction and ballast water capacity. Implementation scheme, i.e., establishing common understanding on the compliance date for ships constructed before the entry into force date will be the key factor for smooth implementation of the convention, once conditions for entry into force are met.

Applicability

All ships will be required to discharge ballast water in compliance with the D-2 discharge standard in accordance with a defined time scale based on the ship’s date of construction and ballast water capacity, and have onboard an approved ballast water management plan and ballast water record book. All ships over 400 gt will be required to be surveyed and issued with a ballast water management certificate valid for 5 years, subject to annual and intermediate surveys. For ships below 400 gt Administrations may specify a certification regime applicable for their fleet for ships less than 400gt. The convention states that the requirements will not apply to the following:

1. granted to a ship or ships on a voyage or voyages between specified ports or locations; or to a ship which operates exclusively between specified ports or locations;

2. effective for a period of no more than five years subject to intermediate review; 3. granted to ships that do not mix ballast water or sediments other than between the ports or

locations specified in 1 above; and

Recycling of ships (Agenda item 3)

Overview

MEPC 65 will address:

Guidelines for the development of the inventory of Hazardous Material (MEPC 65/3, MEPC 65/3/2, MEPC 65/3/3, MEPC 65/INF.9)

Guidelines for PSC Inspection (MEPC 65/3/1)

Background

On 15 May 2009, at a Diplomatic Conference in Hong Kong, the International Convention for the Safe and Environmentally Sound Recycling of Ships was adopted. The Convention will enter into force 24 months after it has been ratified by 15 states, representing 40% of the world fleet, and with an annual ship recycling capacity of 3% of that fleet. It is hoped that it will enter into force around 2015–2017. No States have ratified the Convention to date (1 May 2013). Lloyd’s Register has produced guidance on the Ship Recycling Convention and available services. Lloyd’s Register’s position

Lloyd’s Register is concerned about a submission paper on PSC which is attempting to tighten up the requirements. It is Lloyd’s Register’s understanding that the limitation on the PSC to only check the certificates is commensurate with other PSC guidelines, and only when the PSC has good reason can they doubt the certificates and extend the survey. Lloyd’s Register hopes that the member states can move to resolve the situation of threshold values at this session. Most of the discussion points are acceptable to Lloyd’s Register. The only one under debate is asbestos between 0.1% and 1%. It is worth noting that a submission document suggests that there is no significant difference. If so, 1% is more easily achievable. Readers are advised that while a polarised light microscope can be used for detection of 1% level of asbestos contamination, a scanning electron microscope (with obvious price differential) is required for the detection of 0.1% level. Lloyd’s Register hopes that 'exemptions' are progressed by the working group. This is a vital subject that will have a huge effect on the usefulness and cost of Inventories.

Advice to clients

Discussion on the threshold of hazardous material is one of the key discussions for unified implementation of the convention. Due attention is to be paid on this issue.

All ships of 500 gt or over, including MODUs, FPSOs, FSOs, etc.

Air pollution and energy efficiency (Agenda item 4 and 11)

Overview & Lloyd’s Register’s position (LR Position)

MEPC 65 will discuss various issues in relation to air pollution under this agenda item. They are:

1. Draft MEPC resolution on Promotion of Technical Co-operation and Transfer of Technology relating to the improvement of energy efficiency of ships (MEPC 65/4/1, MEPC 65/4/25, MEPC 65/4/33)

2. Technical discussions in relation to the EEDI requirements given in the reports of the second part of the Working Group at MEPC 65 (MEPC 65/4) and the Intersessional Correspondence Group (MEPC 65/4/3), including 1) Ship speed verification methods of EEDI (MEPC 65/4/15) EEDI scheme for Ro-ro cargo ships

(MEPC 65/4, MEPC 65/4/4, MEPC 65/4/18) 2) EEDI scheme for Ro-ro passenger ships (MEPC 65/4/4, MEPC 65/4/18) 3) EEDI calculation for LNG carrier (MEPC 65/4/13) 4) EEDI for cruise passenger ships having non-conventional propulsion (MEPC 65/4/6, MEPC

65/4/24) LR Position: The proposal to refrain from calculating the EEDI for those ship types which are not yet fully covered under the framework of the regulation until such time as final guidelines for their calculation enter into force is supported. In addition, clarification on how to treat this exemption within the supplement to the IEEC will be necessary.

5) EEDI calculation for duel fuel engines (MEPC 65/4/10, MEPC 65/4/12) (see also proposed amendments to the NOx technical code under agenda item 11) LR Position: With regard to dual fuel engines, in accordance with 5.3.4 of NOx Technical Code 2008, the Parent Engine test shall be undertaken at the maximum liquid-to-gas fuel ratio which will be 100% liquid fuel (i.e from 5.3.2 a petroleum derived distillate) and it is data concerning this fuel, including consumption rate at 75%, which is that which is required to be given in the Parent Engine test report. It is understood that this value would be used in the EEDI calculation. While amendments to the NOx technical code was proposed by the BLG for consideration under agenda item 11, this remains the same.

6) EEDI calculation for hybrid system (MEPC 65/4/12) 7) Minimum power guidance (MEPC 65/4, MEPC 65/4/3, MEPC 65/4/28, MEPC 65/INF.20)

LR position: Definition of “adverse weather” may require careful consideration. Lloyd’s Register is concerned about the current level of assumed “adverse condition “as Beaufort scale 5 can be considered as a normal operating environment.

8) Draft 2013 guidance on treatment of innovative energy efficiency technologies for calculation and verification of the attained EEDI and relevant discussions (MEPC 65/4/3, MEPC 65/4/31, MEPC 65/INF.23)

9) Draft 2013 guidelines for the calculation of the coefficient fw for decrease in ship speed in a representative sea condition (MEPC 65/4/3, MEPC 65/4/11, MEPC 65/4/29, MEPC 65/INF.21)

10) Sea trial for the verification of EEDI (MEPC 65/4/23, MEPC 65/4/26, MEPC 65/INF.7) LR position: any guidance for sea trial should not impose unnecessary restrictions on sea trial. (e.g., prohibition of sea trial at night)

11) Proposed revision to the 2012 Guidelines on the method of calculation of the attained Energy Efficiency Design Index (EEDI) for new ships

a. Correction factors for small ships (MEPC 65/4/5, MEPC 65/INF.8) b. Shallow water restrictions (MEPC 65/4/17)

12) EEDI data base (MEPC 65/4/31) LR position: The proposed data base will provide a technical foundation on which important decisions for all stakeholders can be based, such as those relating to the ship types to be included in the scope of the EEDI framework, the time periods and reduction rates.

13) IMO model course on energy–efficient operation of ships (MEPC 65/INF.17) 3. Interpretation and amendments of MARPOL Annex VI chapter 4

LR position: LR supports the IACS proposals, especially, IACS proposes that, in addition to platforms (including FPSOs and FSUs) and, drilling rigs, the exclusion to the requirement to keep on-board a SEEMP should be extended to any other ship without means of propulsion but which are fitted with a generator and/or pump engine (e.g. tank barges).

2) Excluding ships not propelled by mechanical means (MEPC 65/4/16) LR Position: Lloyd’s Register supports these initiatives which will provide clarity in the application of the requirements.

4. NOx control 1) Tier III feasibility study (MEPC 65/4/7, MEPC 65/4/27, MEPC 65/INF.10)

LR Position: Lloyd’s Register supports the outcome of the Correspondence Group, i.e., technologies are available.

2) Impact on yacht sector (MEPC 65/4/8, MEPC 65/4/27, MEPC 65/4/32, MEPC 65/INF.15) 3) Outcome of the BLG 17 in relation to NOx requirement under agenda item 7 and 11

Definition of “Identical engine” (MEPC 65/7/4)

Draft MEPC resolution on Guidelines as required by regulation 13.2.2 of MARPOL Annex VI in respect of non-identical replacement engines not required to meet the Tier III limit (MEPC 65/11/2)

Draft amendments to the Technical Code on Control of Emission of Nitrogen Oxides from

Marine Diesel Engines (NOx Technical Code 2008), with a view to subsequent adoption (MEPC 65/11/2)

Draft unified interpretation to regulation 13.2.2 of MARPOL Annex VI on the "time of the replacement or addition" of an engine for the applicable NOx Tier standard for the supplement to the IAPP Certificate (MEPC 65/11/2)

5. Sulphur control 1) Sulphur monitoring (MEPC 65/4/9) 2) Feasibility Study on LNG (MEPC 65/INF.4) 3) Sulphur averaging scheme – see agenda item 11 (MEPC 65/11/2, MEPC 65/11/3 and MEPC

65/11/4) LR Position: LR recognises that there are several options for compliance with the sulphur restrictions in MARPOL Annex VI, and we are ready to help clients understand the pros and cons of different options.

6. Restricting shipboard incineration in polar waters (see agenda item 11 – MEPC 65/11/5) 7. Ozone depleting substances (MEPC 65/4/2)

Lloyd’s Register noted information provided. 8. Issues relating to Volatile Organic Compounds (VOC) (MEPC 65/4/20, MEPC 65/4/21)

LR position: Submission documents have highlighted valid points. Lloyd’s Register also consider a need to encourage port facilities to have VOC collecting arrangements. Readers are to note that, depending upon the decision, some consequential work would be necessary, e.g., revision and re-approval of VOC management plan.

9. Further (future) Energy Efficiency improvement, including measures for existing ships (MEPC 65/4/19, MEPC 65/4/30, MEPC 65/4/34, MEPC 65/4/35, MEPC 65/INF.3) LR position: If a scheme for monitoring, reporting and verification (MRV) of greenhouse gas (GHG) emissions from shipping is to be developed, then it should be technically credible and internationally agreed. Any scheme should have the simplicity and accuracy of monitoring emissions using parameters which are readily and commonly available from the global fleet.

10. Black carbon in the Arctic (MEPC 65/4/22, MEPC 65/11/2, MEPC 65/11/4

Background

At MEPC 62, new MARPOL Annex VI Chapter 4 mandating EEDI (Energy Efficiency Design Index) and SEEMP (Ship Energy Efficiency Management Plan) was adopted by resolution MEPC.203(62). MEPC 63 agreed that EEDI, which has been developed in the new chapter 4 of the Annex VI to the MARPOL Convention, is for new ships and shall not be used on existing ships, and adopted various Guidelines to assist in the implementation of EEDI and SEEMP.

Advice to clients

The finalisation of guidelines for the calculation of EEDI for RoRo and passenger ship types at this session is expected in accordance with the IMO’s workplan. Further refinement of the guidelines for ships with non-conventional propulsion is also expected. It is anticipated that much of the discussion will focus on the finalisation of guidelines for determining minimum propulsion power for manoeuvring in adverse conditions which apply to Phase 0 of the EEDI, with a view to how this should be taken forward beyond Phase 0 and the work that is required. Other guidelines on the treatment of innovative technology, within the EEDI framework, are expected to be finalised. Initial proposals on how to improve the energy efficiency of existing ships, through further technical and operational measures, are expected to generate significant discussion.

Applicability

EEDI applies to new ships of certain types, as defined by the regulations, contracted on or after 1 January 2013. SEEMP is applicable to all ships. For Document submitted for this agenda please see annex 1 agenda item 4 and agenda item 11

Reduction of GHG emissions from ships (Agenda item 5)

Overview

MEPC 65 will continue its consideration of Market Based Measures (MBM) related issues for international shipping and any other submissions under this item, including the following:

The outcome of the United Nations Climate change conference 2012 (MEPC 65/5)

The outcome of the Expert Workshop on the update of GHG emissions (MEPC 65/5/2)

The outcome of the sixth Seoul International Maritime Forum (MEPC 65/INF.6)

Both technology and operational elements of MBM (MEPC 65/5/1, MEPC 65/6/3, MEPC 65/5/4)

Political and legal discussions (MEPC 65/INF.18)

Background

In 1997 IMO adopted a resolution on CO2 emissions from ships (Resolution 8 of the 1997 International

Conference of Parties to MARPOL 73/78).

The IMO Assembly further adopted resolution A.963(23) on IMO policies and practices related to the

reduction of greenhouse gas emissions from ships, which requests the MEPC to develop a greenhouse gas

emission index for ships, and guidelines for use of that index.

MEPC 55 approved the work plan to identify and develop the mechanisms needed to achieve the limitation or reduction of CO2 emissions from international shipping. The work plan reiterated the call to consider technical, operational and market-based methods for dealing with GHG emissions (action 1(d) of resolution A.963(23)). MEPC 62 adopted amendments to MARPOL Annex VI and inserted new chapter 4 by resolutions MEPC 203(62) which requires Energy Efficiency Design Index (EEDI) and Ship Energy Efficiency Management Plan (SEEMP). MEPC 63 considered the impact of MBM’s on greenhouse gas emission.

MEPC 64 agreed to the Secretariat’s proposal to update the 2009 GHG Study and a workshop will be held in 2013 to define the methodology to update this study.

Lloyd’s Register’s position

Lloyd's Register continues monitor the discussion with a view to supporting the IMO’s second round GHG study.

Advice to clients

Lloyd’s Register does not foresee any significant development on MBM at this time. Readers are invited to note that technical and operational discussion under agenda item 4 is relevant to the GHG reduction.

Consideration and adoption of amendments to mandatory instruments (Agenda item 6)

A set of amendments to the mandatory instruments will be considered for adoption under this agenda item for the following:

Revision of the IOPP certificate – removal of unit (l/h)

The text of draft Code for recognized organizations (RO Code) as well as draft amendments to MARPOL Annexes I and II to make the RO Code mandatory

These amendments are expected to enter into force on 1 Oct 2014. For documents submitted please see Annex 1

Oil pollution and Garbage management under “Interpretations of, and amendments to, MARPOL and related instruments” and “Outcome of Sub-Committees” (Agenda item 7 & 11)

Overview

In addition to the issues on Air Pollution introduced under agenda item 4 above, primary discussion under this agenda item will be as follows:

MARPOL Annex I – how to treat cooking oil (MEPC 65/7/5)

Interpretation on the bilge connection - IACS UI MPC 99, as an interim measure for sorting out problems with MARPOL Annex I regulation 12 while proper amendments to MARPOL are developed.

MARPOL Annex V (Garbage) relating issues (MEPC 65/7, MEPC 65/7/1, MEPC 65/7/2, MEPC 65/7/3,

MEPC 65/7/6, MEPC 65/7/7, MEPC 65/7/8). The environmental impact assessment in relation to the carriage of solid dry bulk cargo was provided as a report of DSC 17 under agenda item 11 (MEPC 65/11)

Reception facility relating issues – outcome of FSI 21 (MEPC 65/11/7) as follows:

Background

Under this agenda item, various interpretations and amendments to the MARPOL Convection will be discussed. However, any significant work may require approval as new planned/unplanned output prior to embarking on substantial discussions.

Lloyd’s Register’s position

In general, Lloyd’s Register welcomes the clarification of the MARPOL conventions. Among others, Lloyd’s Register has the following comments:

Some of the changes made in this version include: a proposal to measure efficiency in terms of joules of fuel energy; a proposal to use "service hours" as the surrogate for "work" in the efficiency calculation; removal of the concept of attained technical efficiency; removal of the collection of data on weather conditions; inclusion of the rating system as an optional element of the programme; and addition of new details on the process for data collection, submission, and verification.

Both technology and operational interventions have consequences for a ship's commercial operation. It is proposed that existing attempts to model technology take-up and operational choices in a future fleet do not adequately represent the technical and economic interactions. This document presents a new model that can simulate these interactions, and discusses some results for a hypothetical ship (based on a VLCC). The results imply that operation to maximize a shipowner's profits could negate emissions reductions benefits achieved through technology investment. MEPC 65/5/2 (Secretariat) - Report of the Expert Workshop on the update of GHG emissions estimate for international shipping (Update-EW)

The Expert Workshop on the update of GHG emissions estimate for international shipping (Update-EW) took place at IMO Headquarters from 26 February to 1 March 2013 under the chairmanship of Mr. Andreas Chrysostomou (Cyprus).. MEPC 65 is invited to:

.1 note that the Expert Workshop completed, as far as possible, the mandate given to it by the Committee as outlined in document MEPC 64/23, paragraph 5.6;

.2 note that the available data for use in approaches for estimating emissions have been improved and enhanced since 2007 and that, whilst there is still uncertainty, the improvements in data collection, methods and assumptions could increase confidence in the estimates derived (paragraph 36);

.3 endorse the Expert Workshop's recommendation that the same top-down (fuel sales) and bottom-up (ship activity) approaches used in the Second IMO GHG Study 2009 be used in the Update Study (paragraph 37);

.4 approve, following consideration of the text in square brackets, the Terms of Reference for the Update Study, as set out in annex 1;

.5 agree that it is important that the emission estimates obtained by the Update Study should be viewed by the IMO Membership and external interested parties as the outcome of a method agreed, if possible, by consensus (paragraph 39);

6. note and express its appreciation to the international bodies and experts that provided through seven presentations to the Expert Workshop, a comprehensive overview of the approaches for estimating emissions from international shipping, as listed in annex 2; and

IMO is preparing to update the inventory of ship GHG emissions to inform work towards agreeing additional measures to reduce GHG emissions from ships. UNEP has developed emission reduction pathways for CO2 in order to keep global warming limited to the 2°C increase target. This document draws attention to recent subsequent work undertaken by Professor David Lee and colleagues at Manchester Metropolitan University which sets unmitigated shipping (and aviation) emissions within this context. CSC believes that this work represents further strong evidence highlighting the urgent need for the IMO to take immediate action. The 65th session of MEPC should agree in particular on the early adoption of immediate measures to address GHG emissions from existing ships so as to preserve the chances of limiting global warming to 2°C. This document aims to provide clarification on ambiguities and misunderstandings which arose since the implementation of the revised MARPOL Annex V as regards the list of discharges which are essential for the operation of the ship. This document proposes that In order to provide clarity to ship crew and operators on the proper management of ship waste and discharges but also to avoid any possible ambiguities and wrong interpretations by port State control authorities, it is proposed to replace the wording "boiler/economizer blowdown" from the first row of the list with "boiler/economizer blowdown and washwater" MEPC 65/7/4 (IACS) - IACS UI MPC 103 - "Identical" replacement engines (regulation 13 of MARPOL Annex VI)

As has been discussed in the BLG Sub-Committee, this document provides in the annex a copy of IACS UI MPC 103 on "identical" replacement engines. MEPC 65/7/5 (Marshall Island) - Unified Interpretation of MARPOL Annex V relating to the disposal of cooking oils

This document is submitted in order to seek a common understanding from the Committee with regard to the disposal of cooking oil by way of the ship's oil residue (sludge) tank, as listed on the Supplement to the IOPP Certificate. In particular, confirmation is requested regarding the proposed means in which to document the disposal of cooking oil in such a manner (recording the collection of cooking oil as a Code I entry in the Oil Record Book, Part I only) and the Committee is requested to circulate a unified interpretation confirming the same. .23 approve the report in general. MEPC 65/11/3 (United States) - Outcome of BLG 17 - Guidelines for Equivalent Methods: Regional emissions averaging

The purpose of this document is to assist the Committee in its consideration of the BLG discussions regarding regulation 4 of MARPOL Annex VI equivalencies and emissions averaging of a group of ships within a defined geographic region for compliance with regulation 14. The United States considers that it may be appropriate to use "other measures" in regulation 4 of MARPOL Annex VI to develop an equivalency to regulation 14 for a designated fleet of ships over limited duration in a specific geographical region within an ECA. Further, the United States considers that, given the extensive research and analysis conducted to develop an ECA, it is appropriate to consult the port State prior to implementing an equivalency in the ECA. Given the narrow scope and limited applicability of these provisions it may not be necessary to include these provisions in guidelines. MEPC 65/11/4 (China) - Comments on the outcome of BLG 17

This document presents comments and proposals regarding the outcome of BLG 17, particularly concerning the black carbon issue and equivalent methods for emission reductions under regulation 4 of MARPOL Annex VI. China considers that:
