Stillwater City Hall, 216 North 4th Street, Stillwater, MN June 8, 2017 – 6:00 p.m. Meeting Minutes
I. Call to Order: The meeting was called to order at 6:10 p.m. II. Roll Call: Present: George Hoeppner, chair; Paula O’Loughlin, vice chair; Tom Lehmann, treasurer; Jennifer Pelletier, clerk; Shelley Pearson, director; Mike Ptacek, director; Sarah Stivland, director; Superintendent Pontrelli (ex-officio) Student Members Bridget Smith and Emera Balok III. Pledge of Allegiance: Chair Hoeppner led Pledge of Allegiance. IV. District Mission and School Board Goals: The mission statement was read by Member Pelletier and the goals were read by Member Pearson. V. Approval of the Agenda Member Ptacek motioned to remove the human resources personnel report from the consent agenda to action item F, seconded by Pelletier; Vote: 7 ayes, 0 nays, Motion Carried. Motion to approve amended agenda by Ptacek; Second by: O’Loughlin; Vote: 7 ayes; 0 nays; Motion Carried. VI. Introductory Items A. Student Report Student Members reported on the final days of their senior year and provided a spring sports update. Ava Yokanovich and Annabel Gregg, new student members were introduced. Board chair Hoeppner thanked Emera and Bridget for their service over the past year and awarded them a certificate. B. District Recognition 1. Superintendent Pontrelli recognized Andy Fields, Principal of Oak-Land Junior High for his achievement in being awarded the Principal of the Year MN Capitol Division. 2. Superintendent Pontrelli recognized Don Fixer for his years of service in broadcasting the Stillwater School Board meetings. VII. Open Forum (8 speakers) 1. Laurie Sherburne, 1105 Nena Ct., Stillwater spoke about the lawsuit she has against the school board members. 2. Jessica Grythe, 1609 Greeley St., Stillwater told board and leadership that she thinks they do a bad job. 3. Kristie Mack, 421 Pine St., expressed disappointment in communications about the closing schools. 4. Lisa Day, 4479 Lake Elmo Ave. N., spoke about the new dual immersion program. 5. Kiva Sherr-Nelson, 426 Rice St. W., Stillwater expressed disappointment in communications about the closing schools. 6. Carl Blondin, 617 Sunrise Ave., Stillwater spoke about the need for a capital campaign to replace the new turf at the high school in 8 years. 7. Julie Casserly, 568 Eben Ct., Stillwater, expressed disappointment in the district’s budget.

Designate Official with Authority for MDE Recertification System – Barbara Proulx identified as official with authority for the 2017-2018 school year. L. Lake Elmo Sanitary Sewer Improvements bid awarded to Miller Excavating, Inc. of Stillwater, MN. M. Brookview Elementary Playground Equipment for $81,093.95 and Installation for $22,800.00 approved to St. Croix Recreation Fun Playgrounds, Inc. N. Brookview Elementary Playground Surfacing approved for the amount of 160,676.12 to St. Croix Recreation Fun Playgrounds, Inc. O. Northeast Metropolitan Intermediate School District 916 Long Term Facility Maintenance Motion by: Lehmann; Second by: Pelletier; Vote: 7 ayes, 0 nays, Motion Carried. IX. Reports A. Legislative and ESSA Summary Ms. Hoheisel and Dr. McDowell reviewed the legislative changes from the 2017 session and the impact to the district. X. Action Items A. Read Well By Third Grade Plan Ms. Larson, director of personal learning, requested approval of the plan. The school board members received the plan at their May 25 learning session.
Motion by: Pearson; Second by: O’Loughlin; Vote: 7 ayes, 0 nays, Motion Carried.
B. 2017-2018 Preliminary Budget Ms. Hoheisel requested approval of the 2017-2018 preliminary budget. The board received and discussed the budget at their May 25 learning session. C. Food Service Price Increase Ms. Kristen Hoheisel provided information regarding the mandatory lunch price increase that becomes effective July 1, 2017. The price of all student lunches to be increased by ten cents and secondary breakfast increased by ten cents for the 2017-2018 school year. Motion by: Stivland; Second by: Pelletier; Vote: 7 ayes, 0 nays, Motion Carried. D. Pankalo 916 Program Agreement 2017-2018 Stillwater Area Public Schools Food Service will provide meals for the Pankalo 916 Program located at 8568 Eagle Point Blvd in Lake Elmo, MN. The agreement will begin on July 1, 2017 and expire on June 30, 2018. ISD 834 staff will prepare and provide breakfast and lunch on site. Motion by: Ptacek; Second by: O’Loughlin; Vote: 7 ayes, 0 nays, Motion Carried. E. Delinquent Meal Account Policy The United States Department of Agriculture (USDA) is requiring school district’s to have a policy in place informing the public of the responsibilities, options, procedures and notifications used in public school nutrition programs. The policy was presented to the school board at their May 25, learning session. Motion by: Pearson; Second by: Stivland; Vote: 7 ayes, 0 nays, Motion Carried. F. Human Resources Personnel Report The human resources personnel report was removed from the consent agenda at the start of meeting. Motion by: Lehmann; Second by: O’Loughlin; Vote: 6 ayes, 1 nays (Ptacek), Motion Carried. XI. Superintendent and Board Member Updates A. Superintendent Report Superintendent Pontrelli reported she attended many wonderful end of the year events. She announced the district is holding a meeting regarding mental health on June 21 from 6:00-7:30 p.m. at Stillwater Public Library. B. Chairperson’s Report 1. Mr. Hoeppner reported on the learning session where board members received information and discussed the special ed. Study, Read Well Plan, Q-Comp and Instructional Coaching, Facility Fee Rates, and an update on the Pony Activity Center. C. Board Member Reports 1. Mr. Hoeppner attended the District Retirement Dinner and the Distinguished Alumni Dinner and reported on a recent EMID meeting. 2. Mr. Ptacek distributed the 916 Talking Points and announced Pankalo School is holding an open house on August 1 from 10 a.m. to 6 p.m. 3. Ms. Pearson thanked long-time volunteer Karen Rose for her service, attended the Scholarship Award Ceremony, the Baccalaureate ceremony and gave a shout out to staff for packing. 4. Ms. O’Loughlin thanked the staff and teachers for their work and recognized the last day of school was filled with emotion. 5. Mr. Lehmann Congratulated the 2017 Graduates who participated in the 141st Commencement Ceremony. He also reported attending the District Retirement Dinner and the Distinguished Alumni Dinner. 6. Ms. Pelletier announce the Partnership Plan has two big impacts grants for 2017-2018. Thanked Principal Cox and staff at Oak Park for a wonderful last day of school. 7. Ms. Stivland reported on the May 15 TAB Committee meeting and expressed disappointment in the district’s lack of recognition in the school closings. D. Working Group Reports 1. Ms. Pelletier reported that the policy working group will be meeting on June 19 to work on the discipline policy and the special education work load policy. XI. Adjournment
The meeting adjourned to closed session for negotiations at 9:48 p.m. Motion by: Lehmann; Second by: Pearson; Vote: 7 ayes, 0 nays, Motion Carried. Agreement To Provide Special Education and Related Staffing This Agreement is made and entered into by and between the Northeast Metropolitan Intermediate School District No. 916 (“Northeast Metro 916”) and Independent School District No. 834 (“School District”) on this 1st day of July, 2017, for the purpose of Northeast Metro 916 providing special education and/or related staffing to students enrolled in and receiving educational and related services at the School District.
WHEREAS, Northeast Metro 916 is a Minnesota intermediate school district providing special education and related services to students whose resident school districts request such services to be provided by Northeast Metro 916; and
WHEREAS, the School District is a Minnesota independent school district providing
educational services to or for its resident students; and
WHEREAS, the School District desires Northeast Metro 916 to provide special education and/or related services to those students enrolled in and as requested by the School District; and
WHEREAS, Northeast Metro 916 is willing and has the authority to enter into an
Agreement to provide special education and/or related services to students enrolled in the School District, pursuant to Minnesota Statutes, Chapter 136D;
NOW, THEREFORE, IT IS AGREED BY AND BETWEEN THE SCHOOL DISTRICT
AND NORTHEAST METRO 916 AS FOLLOWS: I. School District Obligations
1. The School District shall be solely responsible for ensuring that appropriate special
education and/or related services are made available to its resident students.
2. The School District shall submit any requests for educational and related services for its students in writing in any format, including electronic. Such requests shall specify the nature of the services requested, the number of students to be served, the full time equivalent (FTE) needed, and the location at which the services will be provided.
3. The School District shall be responsible to pay, on a timely basis, any and all invoices
submitted by Northeast Metro 916 for the services it provides on behalf of the School District.
4. The School District shall be responsible for state and federal reporting requirements
relating to the students receiving educational and/or related services under this Agreement, such as MARSS reporting.
5. The School District shall provide supervision of Northeast Metro 916 employees
providing special education and/or related services at the School District, as it relates to sign-in/sign-out procedures, classroom and office usage, and similar site procedures,
although the Northeast Metro 916 employees shall remain employees only of Northeast Metro 916. The School District shall notify Northeast Metro 916 of any known non- compliance by Northeast Metro 916 employees with such School District procedures.
II. Northeast Metro 916 Obligations
6. Northeast Metro 916 shall provide special education and/or related services as requested
by the School District with appropriately licensed Northeast Metro 916 employees. Northeast Metro 916 shall be responsible for STAR reporting requirements relating to the staffing provided the School District.
7. The individuals assigned to provide special education and/or related services at the
School District by Northeast Metro 916 shall be Northeast Metro 916 employees, and shall be hired, retained, assigned, directed, supervised, evaluated, compensated, disciplined or terminated by Northeast Metro 916, according to applicable Northeast Metro 916 employment agreements, Northeast Metro 916 policies and procedures and any applicable state or federal laws or regulations.
8. Despite the preceding language, the parties expect that the School District shall provide
site supervision of the Northeast Metro 916 employee while providing services at the School District as it relates to sign-in/sign-out, classroom and office usage, and other site procedures. The Northeast Metro 916 employees assigned to work at the School District shall abide by any and all School District procedures of which s/he is notified.
9. Northeast Metro 916 shall set staffing reimbursement rates for the special education and
related services it provides at the School District and shall issue billing invoices quarterly, consistent with the Northeast Metro 916 billing cycle. Billing shall also include reimbursement for staff mileage and travel time and the costs of supplies, equipment and overhead.
10. This Agreement shall not be construed to give rise to any employment relationship
between the School District and any Northeast Metro 916 employee assigned to work at the School District.
III. Transportation of Students
Student transportation shall be provided and paid for by the School District, as required by state and federal laws.
IV. Data Practices
Nothing in this Agreement shall be construed to be contrary to Minnesota Statutes, Chapter 13, the Minnesota Government Data Practices Act (“MGDPA”), and in particular, Minn. Stat. § 13.32, and the Federal Educational Rights and Privacy Act, 20 U.S.C. § 1232g (“FERPA”) regarding the creation and maintenance of educational records. All of the data created, collected, received, stored, used or maintained by the parties in performing functions under this Agreement
is subject to the requirements of the MGDPA and FERPA and the parties must comply with those requirements.
V. Insurance and Liability
Nothing in this Agreement shall constitute a waiver of the rights, privileges and benefits to which either party is entitled under Minnesota Statutes. The liability and monetary limits of liability of the School District and Northeast Metro 916 shall be governed by the Minnesota Government Tort Claims Act, Minnesota Statutes, Chapter 466, et. seq., and other applicable law. Northeast Metro 916 and the School District shall each maintain insurance against claims arising out of or relating to the provision of services under this Agreement, in an amount and of a nature consistent with each party’s Board policies, procedures or practices and as required by the laws of the State of Minnesota.
VI. Term and Cancellation
This Agreement shall commence on the date indicated below and shall remain in effect through June 30, 2018, unless Northeast Metro and the School District mutually agree to terminate or cancel the Agreement prior to that date by 60 days written notice. VII. Renewal
The parties to this Agreement may renew this Agreement if mutually agreed upon in one-year increments by executing a written renewal agreement at least sixty (60) days prior to expiration of the Agreement or any subsequent renewal period, subject to the same terms and conditions as this Agreement, or as otherwise mutually agreed upon.
VIII. Assignment
Neither party to this Agreement shall assign, delegate or transfer any rights or obligations under this Agreement without the prior written consent of the other party.
X. Amendments
This Agreement may be amended during the term of this Agreement and may only be amended in writing by the mutual agreement of the parties.
XI. Entire Agreement
This Agreement contains the entire Agreement between the parties with regard to the matters set forth herein. Adopted:
1. The District will establish general parameters for determining the workload limits of special
education staff who provide services to children with disabilities receiving direct special education services 60 percent or less of the instructional day.
2. Definitions
2.1. Special Education Staff/Special Education Teacher
2.1.1. A teacher employed by the school district who is licensed under the rules of the
Minnesota Board of Teaching to instruct children with specific disabling conditions.
2.2. Direct Services 2.2.1. Special education services provided by a special education teacher when the
services are related to instruction, including cooperative teaching.
2.3. Indirect Services 2.3.1. Special education services provided by a special education teacher which
include ongoing progress reviews; cooperative planning; consultation; demonstration teaching; modification and adaptation of the environment, curriculum, materials, or equipment; and direct contact with children with disabilities to monitor and observe.
2.4. Workload 2.4.1. A special education teacher’s total number of minutes required for all due
process responsibilities, including direct and indirect services, evaluation and reevaluation time, management of individualized education programs (IEPs), travel time, parental contact, and other services required in the IEPs.
3. Workload limits for special education teachers shall be determined by the appropriate special
education administrator, in consultation with the building principal and the superintendent.

4. In determining workload limits for special education staff, the school district shall take into consideration the following factors: student contact minutes, evaluation and reevaluation time, indirect services, management of IEPs, travel time, and other services required in the IEPs of eligible students.
5. Collective Bargaining Agreement Unaffected
5.1. This policy shall not be construed as a reopening of negotiations between the school
district and the special education teachers’ exclusive representative, nor shall it be construed to alter or limit in any way the managerial rights or other authority of the school district set forth in the Public Employment Labor Relations Act or in the collective bargaining agreement between the school district and the special education teachers’ exclusive representative.

ISD 834 Board Meeting Agenda Item: Long-term Facilities Maintenance Plan Meeting Date: July 27, 2017 Contact Person: Kristen Hoheisel, Executive Director of Finance and Operations ______________________________________________________________________________________________________________ Background: 2019 Ten-Year Plan Ms. Hoheisel presented information regarding Long-term Facility Maintenance Revenue Program at the June 22, 2017 Board of Education learning session. The 2015, 1st Special Session, Chapter 3, Article 6 sections 1-4 and 14 (2015 Education Act) established this program for school districts, intermediate districts, other cooperatives and charter schools. The Long-term Facility Maintenance Ten Year Revenue Application replaces the old Health and Safety Revenue, Deferred Maintenance Revenue and Alternative Facilities Revenue programs beginning in FY 2017.
Four documents will be required as part of the Long-term Facility Maintenance application. The application must include a Long-term Facilities Maintenance Revenue Application-Ten-year Expenditure, Long-Term Facilities Maintenance Projection, Statement of Assurances and Board of Education resolution/meeting minutes adopting the LTFM ten-year plan. We will also include Fire Marshal orders for our project costing more than $100,000.
To qualify for a 2018 payable property tax levy, the 2019 Ten Year Plan must be adopted and submitted to the Department of Education.
Administration recommends approval of the Long-term Facilities Maintenance Revenue Application.
