(cabana). 2. To permit a building height of 6.25 metres for the accessory building (cabana). 3. To permit a height of 4.26 metres to the nearest part of the roof of the accessory

A maximum floor area of 67 m2 is permitted. 5. A total maximum lot coverage of 10% is permitted. 6. A minimum interior side yard setback of 2.0 metres is permitted to the retaining

During the discussion between the Committee and the agent, it was agreed to adjourn the application to the next meeting to allow the Planning Department time to review Engineering’s revised comments. 27. FILE NO.: A114/08 APPLICANT: ANTONELLA CAROGIOIELLO PROPERTY: Part of Lot 22, Concession 8, (Lot 10, Registered Plan No. 65M-3747, municipally

known as 20 Nightfall Court, Kleinburg). ZONING: The subject lands are zoned RR, Rural Residential under By-Law 1-88 as amended and

further subject to exception 9(557). PURPOSE: The purpose of this application is to request variances to permit the construction of a

two storey single family detached dwelling with attached garages as follows: Proposal 1. Maximum lot coverage of 14.95% 2. A minimum sideyard setback of 2.30m. 3. A maximum driveway width of 11.18m on the lot. By-Law Requirements: 1. Maximum lot coverage of 10% 2. A minimum sideyard setback of 4.5m. 3. A maximum driveway width of 9m on the lot. A sketch is attached illustrating the request. Letters of support were received from Mr. & Mrs. Nick Panarese, 10 Nightfall Court, Kleinburg, Ontario, L0J 1C0; and Mr. & Mrs. Ray Iannello, 30 Nightfall Court, Kleinburg, Ontario, L0J 1C0. Tony Simonella, appeared as the agent and had nothing to add to the request. There was no one in attendance either in support or opposition to the request.

There were no objections from any Departments or Agencies. THAT the Committee is of the opinion that the variances can be considered minor and are desirable for the appropriate development and use of the land. The general intent and purpose of the By-law and the Official Plan will be maintained. MOVED by L. Fluxgold Seconded by M. Panicali THAT Application No. A114/08 – ANTONELLA CAROGIOIELLO, be APPROVED, in accordance with the sketch attached, subject to the following conditions; 1. That a report by a Professional Engineer be submitted satisfactory to the Building Standards Dept. which

provides details of the on site sewage system with the proposed grading and proposed house showing there is adequate area on the subject lot fo the treatment of the on site sewage from the house as per the requirements of the Ontario Building Code, if required, to the satisfaction of the Septic System Inspection Division of the Building Standards Department.

2. That the applicant successfully obtain an Ontario Regulation 166/06 permit from the Toronto & Region

Conservation Authority for the proposed septic system, if required, to the satisfaction of the TRCA; 3. That if the conditions listed above are not fulfilled and the Building Permit is not applied for within twelve (12)

months of the date this decision becomes final and binding, the said decision shall expire and shall be deemed to have been annulled and rescinded by the Committee.(PLEASE NOTE THAT THIS TIME PERIOD CANNOT BE EXTENDED IN ANY WAY, FAILURE TO MEET THIS DEADLINE WILL RESULT IN REQUIRING A NEW APPLICATION AND FEE.)

VERY IMPORTANT: IT IS THE RESPONSIBILITY OF THE OWNER/APPLICANT AND/OR AGENT TO OBTAIN AND

PROVIDE A CLEARANCE LETTER FROM EACH AGENCY AND/OR DEPARTMENT LISTED IN THE CONDITIONS

WHETHER “IF REQUIRED” APPEARS IN THE CONDITION OR NOT, AND FORWARD THIS CLEARANCE LETTER TO

THE SECRETARY-TREASURER AS SOON AS THE CONDITIONS ARE FULFILLED. FAILURE TO COMPLY WITH THIS PROCEDURE WILL RESULT IN A LETTER BEING FORWARDED BY THE

SECRETARY-TREASURER INDICATING THIS FILE HAS LAPSED AND, THEREFORE, WILL NECESSITATE THAT A

the surrounding estate residential neighbourhood. The cabana is setback from both side yards between 18 and 21 m. The setback distances, along with existing landscaping, mitigate the impact associated with the increased height and area of the cabana on adjacent properties. The Development Planning Department has no objection to the reduced rear yard setback to the cabana. The Development Planning Department is of the opinion that Variances #1 to #5 of the proposal are minor in nature, meet the intent of the Zoning By-law and are desirable for the appropriate development of the land. Respecting Variance #6, the reduced interior side yard setback to the retaining wall has limited visual impact on the adjacent property. However, the Development Planning Department advises that it cannot fully comment on the retaining wall, as the Transportation/Development Engineering Department has requested additional information and a site visit in appropriate weather prior to commenting. Development Planning Staff’s recommendation regarding Variance #6 will be informed by Development/Transportation Engineering’s findings.

Recommendation:

Accordingly, the Development Planning Department recommends adjournment of Minor Variance Application A024/14 to allow the Development/Transportation Engineering Department to comment on the retaining wall.

The placement of the retaining walls on the submitted sketch does not correspond with the TRCA permit, and TRCA has indicated informally to Development Planning Staff that a revised permit will most likely be required. Additionally, the Development/Transportation Engineering Department has recommended adjournment until weather conditions are appropriate for a site inspection to determine that drainage and grading pattern will not be adversely affected by the proposed variances. Accordingly, the Development Planning Department recommends adjournment to allow the TRCA to review the revised placement of the retaining walls, and to allow the Development/Transportation Engineering Department to conduct a site visit in appropriate weather.

Recommendation:

Comments: The Development/Transportation Engineering Department conducted

a site visit on February 12, 2014. The proposed setbacks to the accessory building (cabana) are sufficient to provide for side lot line drainage and swale and do not negatively impact the existing drainage. Accordingly, the Development/Transportation Engineering Department has no objection to Variances 1, 2, 3, 4 and 5.

However, the proposed retaining wall(s) do not meet the current requirements of By-law 1-88, paragraph 4.1.1: “A retaining wall which exceeds 1 metre in height must be set back from the nearest property line a distance equal to its height”. Due to the current weather conditions further site inspection is required to assess the drainage conditions. The applicant shall provide legible cross section details of the retaining wall(s). Also, the retaining wall(s) shall be designed and certified by a professional engineer specialized in structural engineering with seal, signature and date affixed to the construction detail when higher than 1.0m. The design must be accompanied by calculations clearly demonstrating that it is structurally satisfactory and suitable for the particular location. The installation of retaining wall if greater than 1.0m to be inspected during construction and certified in writing by a Structural Engineer as to conformity to design and suitability for the site conditions along with the Geotechnical Engineer as it is related to the existing ground conditions prior to the construction of the retaining wall.

PowerStream has received and reviewed the proposed Variance Application. This review, however, does not imply any approval of the project or plan. All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the safe limits of approach can be established. In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be responsible for 100% of PowerStream’s cost for any relocation work.
