NOTIFICATION

Whereas, Delhi Legislative Assembly vide Resolution passed on03.08.2015 under Rule 90 of the Rules of Procedure and Conduct of Business ofLegislative Assembly of the National Capital Territory of Delhi resolved that aCommission of Inquiry be constituted by the Government of National CapitalTerritory of Delhi in pursuance to section 3 of the Commission of Inquiry Act,1952 (60 of 1952) to receive complaints regarding crimes such as violence,sexual harassment, stalking, voyeurism etc. committed against women sinceFebruary, 2013 and to suggest action to the Government of National CapitalTerritory of Delhi and to address any other issue which Commission may findrelevant during the course of inquiry into the complaints committed againstwomen.

Whereas, the Government of National Capital Territory Delhi in pursuanceof the resolution of Delhi Legislative Assembly has decided to constitute anIndependent Commission of Inquiry under the Cornmtssions of Inquiry Act, 1952(60 of 1952) for inquiring complaints of crime committed against women sinceFebruary, 2013.

Now, therefore, in exercise of the powers conferred by SeCtion-3 of theCommissions of Inquiry Act, 1952, (60 of 1952) the Government of NationalCapital Territory of Delhi hereby appoints the Commission of Inquiry on WomenSafety consisting of the following persons with effect from the date ofnotification, na mely:-

1. Sh. Dinesh Dayal, Retired Distt. Judge, Chairman2. Ms. Richa Pandey Mishra Member3. Dr. Surbhi Singh Member

The terms of reference of the Commission shall be as under -1. To receive unheeded complaints regarding crimes such as violence, sexual

harassment, stalking, voyeurism etc., that are committed against womensince February, 2013, i.e. subsequent to amendments made to IPC(1860)and CrPC (1973) on the basis of some of the recommendations made byJustice Verma Committee and to suggest action to Government ofNational Capital Territory of Delhi,

2. To suggest necessary amendments to the relevant laws, if any,3. To recommend to G'overnment of National Capital Territory of Delhi

whether any case of negligence or collusion is made out prime facie in thecases examined,

4. To recommend measures to expedite all the proceedings in such criminalcases,

5. To propose measures to be taken to properly implement the provisions ofexisting laws as well as the recommendations of the Justice VermaCommittee so as to prevent recurrence of such incidents,

6. To recommend welfare measures for improving the working condition ofthe real foot soldiers in the law enforcing agencies, and

7. To address any other issue/s that the Commission may find relevantduring the course of its inquiry.

Having regard to the nature of inquiry to be made by the Commission andother circumstances of the case, all the provisions of sub-section-(2), sub-section-(3), sub-section-(4), sub-section-S of the said Commissions of InquiryAct, 1952 (60 of 1952) should be applicable to the Commission, and theGovernment of National Capital Territory of Delhi, in exercise of the powersconferred under sub-section-a of section-5 of the Commissions of Inquiry Act,1952 hereby directs that all provisions of the sub-section-(2), (3), (4), (5) ofthat section and section 5 Ashall apply to the Commission.

The tenure of the Commission shall be for the period of two years fromthe date of notification.

The Commission shall submit its report on every three month from thedate of its first sitting.

wholly authorized to enlarge the scope of inquiry to be conducted bythe Commission thus constituted, if the circumstances so warrant."

The text of the Resolution is being forwarded for further necessaryaction, as mandated under section 3 of the Commission of Inquiry Act 1952.

Further, under Rule 106 (2) of the Rules of Procedure and Conduct ofBusiness, the Hon'ble Minister has to inform the status of the Resolution inthe next session. The Hon'ble Minister may be accordingly informed please.
