Goodwill Greetings!

The birth of the Guidance and Counseling Law of 2004 created havoc to all concerned whowere adversely affected by its lack of proper and massive information disseminationregarding its mandates. A number of its stringent provisions espoused crucial and alarmingproblems to all unsuspecting guidance teacher-coordinators, advocates, community guidanceand counseling practitioners that practically lead to mass displacement and unemployment tomany dismissed teachers especially in the private schools. The human right to live withdecency and integrity was practically deprived by the birth of the said law. Pursuing itsadvocacy therefore to bridge appropriate resolutions to address the situation, the True NorthTraining Services (TNTS) with its guidance and counseling training and education partnersprogrammed to conduct series of guidance related seminar-workshops, the latest of whichwas on February 21-23, 2016 at CCT, Tagaytay City attended by elementary, secondary,tertiary school guidance-teachers., advocates and coordinators, nationwide. Majority of theparticipants disclosed their deep sentiments and fears for the status of their livelihood.Inspiring to note was the magnanimous leadership exemplified by the DECS RegionalOfficer and Schools Division Superintendent of La Union by sending letters to PRBGC-PRCChairmen requesting support to immediately address the plight of their teaching forceadversely affected by the law. Apparent there are similar demoralizing situations silentlyhappening in other DECS Regional Schools, nationwide. We cannot leave this very criticalissue to bloat in silence until it results to anarchy against a profession that is supposed todisplay GMRC and professional ethics above other professions. The most adversely affectedare the rural ALS, elementary and secondary guidance teachers, advocates and coordinators.

The seminar will be conducted on October 12-14,2016 at the Community TransformationCenter (CCT), Barangay Sungay East, Kaykulot Road, Tagaytay City (adjacent to thePicnic Grove) aimed to educate the participants on the mandate of the Guidance andCounseling Law of 2004 and identify the stringent provisions that alarmed the TEACHERParty List Representative of the House of Congress who reviewed the Guidance Law 2004and discovered some major discrepancies that shall adversely affect the performance andfuture of the majority of the school guidance teachers, advocates, coordinators and otherallied guidance and counseling practitioners (clergies and pastors, tri-media, human resource

officers inclusive of the city-municipal ami provincial local government units' barangaylupong tagapamayapa officers, treatment-rehabilition and probation officers, and family andyouth welfare agencies) doing counseling integral to their respective job description anddesignation. DR. LUZVBVflNDA S GUZMAN, EdJX, RGC, Chairman, ProfessionalRegulatory Board on Guidance and Counseling, Professional Regulation Commission(PRBGC-PRC) will be the Principal Resource Speaker. Invited to be the Opening ProgramGuest of Honor is HON. VILMA SANTOS-RECTO, Batangas City Representative.

The finale activity during the workshop shall be the Signing of the Final Draft of theProposed Magna Carta for Guidance and Counseling Practitioners and Advocateswhich main proposal is the Extcntion of the Grand Fathers' Clause Eligibility Processfor those direct service personnel doing guidance and counseling for the last eight (8) yearsonward.

Participants will Co-Author the Final Draft of the Magna Carta for Guidance andCounseling Practitioners and Advocates of the Philippines and automatically becomeRegular Members of the recently organized Association of Guidance Advocates,Practitioners and Educators, Inc. (AGAPE).

In connection with the above, we humbly request for PECS REGIONAL ADVISORY forthe active participation of all concerned school guidance teachers, advocates, coordinators.Participants arc strongly requested to prepare their respective position papers on theissue of guidance eligibility extension for submission to the House of Congress for dynamiclobby purposes.

A Registration Fee of THREE THOUSAND FIVE HUNDRED (P 3, 500.00) perparticipant will defray payments for room accommodation complete meals and snacks,seminar kits and certificates. WHEREAS, to further respond to the psychological needs of the Filipino people, RepublicAct Numbered 9258, otherwise knows as the "Guidance and Counseling Act of 2004**, mas approvedby the Congress of the Philippines on March 2, 2004, with fee fundamental purpose ofprofessionalizing the practice of guidance and counseling in the Philippines;

KA person who possesses the pertinent qualifications required for admissionin the examination for registration as guidance counselor pursuant to the provisionsof this Act may be registered without examination: Provided, That the applicant fileswith the Board within two (2) years after its creation, an application for registrationand issuance of a Certificate of Registration and Professional Identification Card bysubmitting credentials showing that the applicant before the effectivity of this Act

(a) Had been doctoral and roasters degree holders in Guidance and Counseling withat least three (3) years of teaching Guidance and Counseling courses and/or full-timecounseling practice for the same period;

(b) Mad passed at least eighteen (18) units of Master's level courses in Guidance andCounseling such as Counseling Techmques/Theories, Organization or Administrationof Guidance Services, Test and Measurements, Group Process/Counseling and CareerGuidance/Counseling; and have at least seven (?) years of experience in counselingwork; and

(c) Has completed academic requirements for a master's degree in guidance andcounseling and hawe five (5) years experience as fall-time guidance counselors.71

WHEREAS, through the implementation of RA 9258, it is envisioned that the quality of theGuidance and Counseling Profession in the Philippines shall be at par with the standards of theguidance and counseling professions in other countries (Le. Hong Kong and District of Columbiarequire their guidance counselors to have a Master's Degree in counseling or counsel ing-related field)by requiring a master's degree in Guidance and Counseling from an institution hi the Philippines orabroad recognized by CHED and a license from passingthe board examination;

WHEREAS, the Commission OB Higper Education (CHEDX issued Memorandum Order No.21, Series of 2006, which prescribed a ratio of (1) Guidance Counselor per 1,000 students. Takinginto consideration the number of students attending University Courses all over the Philippfioes, thereexists a need for 22,214 Guidance Counselors to £31 the i<fcal ratio, as requir^ the Comrnission onHigher Education (CHED);

WHEREAS^ at present there are only two thousand seven hundred nineteen (2,719) guidancecounselors in the country licensed or registered by the Professional Regulation Commission, onethousand six hundred ninety-two (1,692) of whom are qualified under the grandfather's clause, and1 .027 guidance counselors who passed the Itceasure examination from 2008 to 20 14;

WHEREAS, the total number of Baste Education Students is 23.9 million asof S.Y2014with 21 million enrolled in public schools and 2.9 million enrolled in private schools;

WHEREAS* if the mimouan pte&dibed ratio of one (1) Guidance Counselor is to 500students (1-500) in the Basic Education sector and one (1) Guidance Counselor is to 1000 in HigherEducation (1:1000) wfll be complied with, the total nambw of Guklance Counselors needed in BasicEducation shall be 47,800 and hi Higher Education it shall be 3000; hence, the total number ofGuidance Counselors needed m Basic and H^h^EducatKHiui both pubik; and piivate is 50,800;

WHEREAS, the total number of educational institutions hi the country is around 50,000puMicaiKl private efcmearta^Institutions (HEIs).

If one (1) Guidance Counselor for each of these educational institutions shall be compliedwith, the mmhBum cumber of GuktaceCoun^^number of 2,719 Guidance Counselor only.

Hence, the present number of 2,719 Guidance Counselors is dismally inadequate to meet therequired number as mandated by Law;

WHEREAS, major Guidance and Counseling groups and the Guidance and CounselingAssociation (GCA) have stated that such actual number of Registered Guidance Counselors cannotsufficiently cater to the needs of all students from our public and private schools, excluding otherinstitutions, industries, corainunities* lehahiiiteikm c»^a guidance counselor. They further lamented that the mil implementation of RA 9258 will only resultto furtha-depletion of this number;

WHEREAS* the set cut-off date of Maix&2009fwtheGrandfelfa^hundreds of school counselors from practicing their profession, including those who had beenworking for 10, 20 or even 30 years because they have yet to complete the required 18 units of theGuidance and Counseling courses as required by Law;

WHEREAS* it is the general view that ft is the effect of RA 9258 mat tenured guidancecounselors who were not able to conform to the set standards as specified in Section 14 of the Lawshall be removed fhwo their poshlen of employment;

WHEREAS, to cope with me changing needs and demands of learning, existing bachelor'sdegree courses as well as masteral courses of some Higher Educational Institutions hi Guidance andCounseling have evolved into more extensive courses and grven appropriate course tftSes. Thesenewcourses are not being recognized in the same level as existing Guidance and Counseling coursesalthough they are more comprehensive and embody essential content and subject matter needed inexercising the Guidance and Counseling profession;

WHEREAS, under section 12.C of RA 9258, Guidance and Counseling is the only professionrequiring Master's Degree m Guidance and Counseling before the Licensure Examination can betaken; thus making it discouraging to many-students who want to become professional GuidanceCounselors;

Reference is made to the enactment of Republic Act No- 9258, orthe Guidance and Counseling Act of 2OO4, Section 27 (a) of said Actprovides that no person shall engage in the practice of guidance andcounseling without a valid Certificate of Registration and the validProfessional Identification Card or a special permit. While it is true thatRA 9258 mandates the professionalization of the guidance counselingservices in the country, the same law is about to displace GuidanceCoordinators in the entire DepEd Region I and other government agencieswhose appointments are temporary in nature.

As a general rule, prior to the fruition of RA 9258, temporary statusof appointment may be given to an appointee who does not have therequired eligibility if he/she meets all the other qualifications for theposition and a fully qualified eligible is not actually available.

Protected properly has been deemed to include vested rights suchas one's employment, the right to earn a living, the right to work or anexercise and/or practice of a profession or calling. In a plethora ofjurisprudence it has been asserted that state worker's security of tenuremust be protected which in a sense is analogous to property. Thus, theprecise object of more intensive and extensive government regulation is tomake its beneficent purpose equitably available to all, in fact, theprotection of a livelihood is the primary object of the sopial compact and

that the absence of such protection could well lead to anarchy andtyranny. Shylock was right when he said: "You take my life, when you dotake the means whereby I Hue*. Moreover, experience does teach a veryclear lesson that one's employment is an instrument for the preservationand enhancement of personal dignity.

For the reasons adverted to above, undersigned comes to the honorof your office to seek succor for the suspension of Section 27(a) of theGuidance and Counseling Act of 2O04 (RA 9258) until such time thatincumbents whose appointments are temporary will become eligibleand/or to issue special permit to registered psychometrician/psychologistto perform the duties and responsibilities of guidance coordinators.

Greetings!

Undersigned finds it necessary to seek for your assistance regarding our need to hireguidance counselors for our secondary schools throughout the province. There are guidancecounselor positions that remained unfilled due to lack of licensed guidance counselors. Wewere able to hire Guidance Counselors on temporary status since 2008 but unfortunatelywere not able to renew appointment this year 2016 based oft CSC Decision No. 150541 datedJuly 21, 2015.

As a result thereof, secondary schools with more than 500 learners are already beingserved by teachers designated as Guidance Counselor. It is for the best interest of ourlearners if guidance and counseling services are being provided by someone who iseducationally prepared for the job and who is already experienced guidance counselor formore than eight (8) years.

it is believed that our temporary guidance counselors, whose appointments will notbe renewed this year, are the most qualified and competent guidance counselors to work forour secondary school learners. They are all taking up Master of Arts in Guidance andCounseling and almost about to take their licensure exam for guidance counselors.

It is for the above reasons that 1, as the Head of Agency, seek for your intercession inmaking it possible the issuance of a special permit for our non-licensed guidance counselorsto continuously serve our learners until a licensed guidance counselor in the province isavailable.
