EXCL EXPANDS TO BECOME THIRD LARGEST SPANISH GROUP . . . EXCL Communications, Inc. is snapping up the Embarcadero Media group for an undisclosed amount. The purchase will add eight stations to EXCL's collection in Portland, OR; Sacramento, CA; and Riverside -San Bernardino, CA. The stations are progressive /jazz KINK and talk KOTK, Portland, OR; regional Mexican KCAL, Redlands, CA; Spanish AC KSZZ, Santa Barbara, CA; Spanish AC KVAR, Redlands, CA; regional Mexican KRCX, Roseville, CA; and sports KMYC and Spanish AC KSXX, both Marysville, CA. EXCL is owned by Latin Communications Group, which also owns Spanish - language television stations and newspapers in major markets.
SALEM TRADES UP IN DALLAS. . . CBS /Infinity and Salem are swapping stations in Dallas. Salem is giving up its religious AM KDFX, Dallas plus other consideration in exchange for Infinity's news FM, KEWS, Arlington. The swap will bring Infinity into compliance with the ownership limits for FM, but put them over the top cn the AM side. In order to comply, it will sell adult standards KDMM, Highland Park, TX (Dallas) to an undisclosed buyer.

WASHINGTON THIS WEEK Hometown Media, Inc.'s WAYB, Waynesboro, VA has been granted their license renewal subject to resumption of operations by 1/15/97. It's been silent since May, 1995.
L. T. and Raymond Simes' KZOT(AM), Marianna, AR is designated for hearing by the Commission due to its silent status. KZOT has been off the air since February 20, 1989 when the previous licensee suspended operations pursuant to a bankruptcy proceeding. The station was transferred from its trustee to Simes, conditioned upon the resumption of station operations within 60 days of the transaction which was consummated, in March, 1993. The station has 20 days to file a written appearance stating an intention to appear on the date fixed for hearing to present evidence.
Also ordered to file a written appearance within 30 days, to show cause why the stations license should not be revoked, is Group Communications, Inc.'s KRGQ(AM), West Valley City, UT. The station suspended operations on January 31, 1995 when the station was evicted from its transmitter site. Group informed the Commission of the problem and was granted permission to remain silent through May 13, 1995. Several additional extensions have been granted. However, no application has been filed in the last five months, the station is not authorized to remain silent and has not demonstrated that causes beyond its control prevented the expeditious resumption of broadcast operations.
The renewal of license for WKZF -FM, Inc.'s WKZF(FM), Bayboro, NC has been denied by the Commission which concluded that absent a modification of facilities, WKZF cannot return the station to air and it is the Commission's policy not to process modification applications of silent stations that have been designated for hearing. WKZF has been off the air since July 24, 1993 when the previous licensee, Carolina Community Broadcasting, Inc. suspended operations for financial reasons. The station was then assigned to Sunbelt Media, Inc. and then to WKZF- FM, Inc. On August 14, WKZF -FM, Inc. filed its renewal application reporting that the station was still off the air and their intent to apply for the C3 allocation. No application implementing the C3 upgrade had been filed by any of the approved licenses since the Commission's action in August, 1992 and WKZF -FM neither notified the Commission that it resumed broadcast operations nor indicated that it had made any progress in implementing the C3 allocation. To no avail, WKZF -FM claimed that it was prepared to have the station back on the air within 60 -90 days of the Commission's pending modification application and that it had held the license for only 16 months and should not be responsible for the failures of the previous licensees. To do so would cause innocent creditors to loose their entire investment. WKZF also claims it had no representation by an attorney at that time
The Commission granted license renewals for KWKH(AM) /KWKH -FM, Shreveport, LA, concluding that there was no evidence of employment discrimination and that the renewal grants would serve the public interest. However, the stations are subject to reporting conditions and a forfeiture in the amount of $16,500 for not contacting outside sources for 15 of 27 full -time positions from May 1, 1993 to May 1, 1996.

WASHINGTON THIS WEEK (cont'd) Saddleback Community College, licensee of noncommercial station KSBR(FM), Mission Viejo, CA was denied review by the Commission of a returned application to increase its ERP from 500 watts ND to 1800 watts DA, at a HAAT of 590 ft. The application created two prohibited areas of overlap with first -adjacent channel station KSPC(FM), Claremont, CA and second -adjacent channel KUCI(FM), Irvine, CA. Opposition was filed by California State University's KCSN(FM), Northridge CA. Saddleback contends that the letter the FCC wrote with the returned application contained several errors. It claimed that Saddleback had failed to provide the population gained within its proposed 60 dBu contour and it was not given notice of the Commission's standards for waiving the section. According to Saddleback, the Commission didn't demonstrate why it would not be appropriate to hold a hearing to determine where the public interest lies. The Commission claims a hearing is not appropriate for an amendment found unacceptable for filing.
Stephen E. Powell's petition for reconsideration of cancellation of the construction permit and deletion of WRHF(FM), Farmington, NH was denied. The Commission denied the petition because Powell failed to file his second request for extension of time to construct within the thirty -day period required by statute and that Powell has not demonstrated that his failure to do so was due to extraordinary circumstances. Powell claims he did not receive a June letter requesting more information and first learned of the action when he read about it in the M Street Journal on July 19, 1995, two days after the deadline for filing a petition.
The Commission denied Kin Shaw Wong's application for extension of the CP for unbuilt station KPTO (AM), Citrus Heights, CA, modification of its facilities, and assignment of the CP to Rene de la Rosa. The CP was cancelled and call sign deleted. Royce International Broadcasting, licensee of station KWOD(AM), Sacramento, CA challenged Wong's requests. Wong argues that zoning problems and interference protection requirements precluded him from building the station and that the Commission is ignoring the substantial financial investment he made in securing the CP site and the Commission's commitment to fostering increased minority ownership of radio stations. The Bureau found that Wong had not made substantial progress toward constructing the station, his financial outlay was primarily for a site and he was refunded deposits that he made for equipment and failure to complete the station was not due to circumstances beyond his control. The Commission claims that a permittee's minority status has no relevance to justify an extension of time to construct which must meet the following three criteria: (1) construction is complete and testing underway, (2) substantial progress has been made; or (3) no progress has been made for reasons clearly beyond the control of the permittee and steps have been taken to resolve the problem and proceed with construction.
Granite Broadcasting Corp. has been granted a waiver of the Commission's one -to -a- market rule in the Peoria -Bloomington DMA, and is seeking to acquire WIVR(FM), Eureka, IL, from Illinois Valley Broadcasters. WIVR(FM) is a Class A station operating on 98.5 MHz with 3000 watts at 328 ft. HAAT. Granite already owns WEEK - TV there. Granite successfully argued that joint operation will result in considerable annual savings and will be used to improve WIVR's facilities and enhance public service and news programming. Granite also said since it is minority -owned and controlled, the proposed combination will promote diversity in programming sources and viewpoints and the proposed combination will not create any concentration of ownership or control of the broadcast media in the market. The sale may not be consummated until such time as the Commission has acted upon the pending renewal application for WIVR.
The Commission denied submission under seal a letter from counsel for the Southern Region of the National Rainbow Coalition questioning compliance with EEO Rules against Sandab Communications Limited Partnership II's WTTB(AM) & WGYL(FM), Vero Beach, FL. Rainbow motioned to vacate grant of the renewals, which were granted on July 22, 1996, and hold in abeyance the assignment of licenses to Fairbanks Communications, Inc. The letter requests that the Commission receive and review without disclosure to the public or parties to the applications a further letter and ten exhibits which Rainbow alleges contain pertinent information. Rainbow claims "public disclosure of the matters would compromise a pending federal criminal inquiry." After reviewing the evidence, the Commission found that Rainbow failed to establish by a preponderance of the evidence that confidentiality is justified.

WASHINGTON THIS WEEK (cont'd) On February 8, 1996, the Commission adopted an Order and Notice of Proposed Rule Making which vacated the Commission's EEO Forfeiture Policy Statement and requested comments on proposals for amending the EEO Rule and policies. On April 12, twenty organizations, including the Minority Media and Telecommunications Council filed a Motion for Extension of Time to file comments in response to the proceeding. The Commission has since granted several requests for extension of time due to various difficulties that have delayed completion of comments and ordered a further extension to October 25 for filing comments on the matter.
ELSEWHERE Odyssey Communications is giving up one of its Los Angeles market stations. It will sell brokered KWIZ -FM, Santa Ana to Liberman Broadcasting for $11.2 million. Liberman also owns Spanish -programmed KWIZ (AM), Santa Ana; KKHJ, L.A.; KBUE, Long Beach; all in the L.A. market. Odyssey retains its "Southern California's Modern Rock" network of KLYY, Arcadia (serving L.A.); KSYY, Fallbrook (serving San Diego north county); and KVYY, Oxnard, (serving Oxnard- Ventura). All of the stations are on 107.1 MHz. Elliot Evers of Media Venture Partners brokered the deal. This sale is reuniting KWIZ (AM) and KWIZ -FM.
Pinnacle Broadcasting is buying another combo in the Myrtle Beach market -- country WYAK, Surfside Beach and 70's oldies WMYB, Socastee --from Multi- Market Radio for $5.125 million. Pinnacle owns classic rocker WYAV, Conway and talker WRNN, Murrell's Inlet. Country WVCO, Loris, SC, presently in an LMA with WYAK and WMYB, was not mentioned in the deal. Paul Leonard of Star Media Group brokered the deal.
Hemisphere Broadcasting is doubling up in the Bakersfield market with the purchase of contemporary Christian combo KHIS -AM & FM for $2.65 million from International Church of the Foursquare Gospel, Inc. Hemisphere owns dance KKXX -FM, Delano, CA and rocker KRAB, Green Acres, CA as well as stations in Fresno, San Luis Obispo, and Santa Maria.
Lou Mercatanti's Nassau Broadcasting Partners is buying another New Jersey combo. It's picking up Great Scott Broadcasting's news /talk WTTM and religion WCHR, both Trenton for $20 million. Nassau already owns CHR -new rock WPST, Trenton, and soft AC WHWH, Princeton. Dan Gammon of Americom brokered the deal.
Children's Broadcasting Corp. is suing ABC Radio Networks and its parent, the Walt Disney Company, after the two companies parted ways. ABC Radio was providing marketing and sales support for Chris Dahl's children's network since 1995. The lawsuit, filed in U.S. District Court in Minneapolis, seeks damages for ". . .alleged deliberate attempts to misappropriate CBC's unique radio programming format and force CBC out of the children's radio market." CBC claims that ABC used their relationship to pick up confidential information to start their own network.
Bob Sillerman is having to up the ante in his bid to take over majority control of Multi- Market Radio. Sillerman's company, SFX Broadcasting, will guarantee a minimum of $12.50 per share to MMR shareholders, as long as SFX class A common stock trades between $32.00 and $44.00 per share. Sillerman hopes to settle a lawsuit filed by MMR shareholders over the valuation of the stock with this action.
CNNRadio has introduced two new services, Newsource and GuestSource. Newsource provides affiliates with custom reports on everything from politics in Washington, DC to natural disasters. The reports feature news veterans, John Bisney, Dale Willman and Gary Baumgarten. GuestSource gives affiliates the opportunity to talk with experts on the day's top stories, and newsmakers.
Interep Research released its analysis on the hottest industries for national radio advertising. The largest dollar growth category projected for 1996 vs. 1995 is Travel, Hotels & Resorts at $49.0 million followed by Business & Consumer Services at $40.2 million. Toiletries & Cosmetics is third with $37.8 million and led the list of percentage growth over 1995 at 98 %. Travel, Hotels & Resorts was second in percentage growth with 56 %. Chuck Harder is suing Reform Party VP candidate Pat Choate's former company, United Broadcasting Network, after he claims the purchase failed to meet closing deadlines. Harder claims UBN drove him off the air, fired employees, and failed to close twice on the $3.5 million purchase of his People's Network. Harder is suing for control of the network and his on -air slot after he took an extended vacation in September and has not been back on the air since. Harder claims the deal was to be financed by the pension fund of the United Auto Workers union. UBN claims it has planned to close on the purchase all along.
WE'LL BE SLEEPING BETTER TONIGHT. . . The Commission announced it has complied with Clinton's plan to eliminate at least half of all internal regulations in the Executive Branch of the government. Executive Order #12861 directed each executive department and agency to eliminate 50% of its civilian internal management regulations that are not required by law within three years. After review, as of September 11, 1996, the Commission has eliminated 77 directives (67 %) and revised 10 others resulting in a reduction of 1,773 pages (57 %). Examples of the reduction include converting the "Time, Leave and Attendance Manual" to a simple handout and eliminating "Performance of Commercial Activities" because it duplicated other publications.

WASHINGTON THIS WEEK
The Commission is looking for comments on eliminating the newspaper /broadcast cross -ownership rule as it applies to radio. The rule, adopted in 1975, prohibits common ownership of the two if the station encompasses the entire community in which the newspaper is published. Most cases that existed before 1975 were grandfathered, and the rule was created to prevent new combos to maintain a diversity of media voices.
Anticipating that there would be situations where a waiver may be justified, the Commission decided to adopt standards to analyze each request. First, the Commission stated that inability to sell the station would constitute a basis for a waiver. Second, proof that the only sale possible would be at an artificially depressed price; third, proof that the separate ownership and operation could not be supported in the locality and finally, proof that the purposes of the rule would be disserved by its application. Only a few requests have been granted; most have been temporary.
The Commission wanted to revise the rule, but has been precluded from doing so because Congress wouldn't spend the money necessary to reconsider the rules. However, since the Telecommunications Act of 1996, the FCC now has the authority to reconsider the rule, but is looking for comment on which issues should be looked at. Some issues are whether the waiver should be based on number of voices and market size? Should both radio and television station be included as voices? Should only commercial radio stations be counted as voices as contained in the radio duopoly rule? Should geographic areas be redefined? How will the service affect suburban communities? Should radio metro markets be used instead of Television DMA's? Does a station completely have to cover the market or are signal contour overlaps considered in any portion of the relevant market? How will the change affect competition?

The Supreme Court set aside a ruling that upheld as constitutional a federal law barring the broadcast of radio and television advertisements for casino gambling. The law prohibits advertising for any "lottery, gift enterprise or similar scheme offering prizes dependent ... upon lot or chance." The law had been challenged by a number of TV and radio stations in New Orleans.

Arbitron is adding questions to the diaries that will allow it to offer a new qualitative service profiling lifestyles and media behavior of a station's audience. Billing it as a service to "small market" broadcasters, the research service will be available to stations in 128 markets with the Spring, 1997 survey. Most of the markets are ranked below #100. The questions to be added are a direct result of a survey of station owners in markets smaller than #100, asking for more qualitative information. The complete qualitative database will be delivered through Maximiser.
Western Cities Broadcasting's dance KQKS, Longmont, CO (Denver) will sell to Jefferson -Pilot for an undisclosed price. Jeff -Pilot now owns three FM's and two AM's there, including sports KKFN; classic country KYGO (AM), Lakewood; country KYGO -FM, Denver; and CHR KHHT, Lakewood, CO. The LMA begins immediately.
Clear Channel is buying another combo in Pennsylvania. In the Lancaster market, Peoples Broadcasting will sell standards WLAN and hot AC WLAN -FM for $7 million cash. Clear Channel owns standards WRAW and rocker WRFY -FM in nearby Redding, as well as the CBS affiliate for Harrisburg, WHP -TV.
Saga now has a sixth FM in Des Moines with the purchase of Bunce Bcstg.'s soft AC KEZT for $3.2 million. Saga owns oldies combo KIOA -AM & FM, standards and talk KRNT, and hot AC KSTZ. Saga is also an LMA -to -buy with rocker KAZR, Pella, IA.
Pioneer Broadcasting is maxing out in the Anchorage market. It's buying up Alaska Broadcast Communications' standards KHAR and country KBRJ, along with their SMA partner, Tom Ingstad's oldies outlet KEAG. Pioneer owns rocker KWHL, and AC's KMXS and KFQD. Ingstad will retain classic rocker KKRO, but it will begin an SMA with the new entity immediately. LMA's on the rest also begin now.
Commodore Media is filling out in the Ft. Pierce /Vero Beach, FL area by purchasing Indian River Shores Partners' standards -formatted WOSN, Indian River Shores. The purchase will give Commodore five FM's in that market. Terms weren't disclosed. It also owns rocker WZZR, Stuart; oldies WQOL, standards WAXE, and country WAVW, all Vero Beach; and hot AC WBBE, Gifford, FL. Commodore is also currently in an SMA with country WPAW, Vero Beach.
Westinghouse and Infinity Broadcasting will put their merger to the vote of the shareholders on Tuesday, December 10. The meeting will take place in New York. The companies will determine those shareholders who will be entitled to vote by October 15.
Interep will continue to rep the Westinghouse stations. Westinghouse has entered into an agreement with Interep providing for an undetermined extension of their contract effective Jan. 1, 1997. Under the terms of the contract, Interep will continue to represent 16 of the former Group W Stations as they have for the past 10 years.
The Arbitron Company announced that their customer service team will be available to clients on a 24- hour -a -day, seven - day -a -week basis. The number is (800) 543- 7300. Arbitron also announced that it is adding Austin, TX; Las Vegas, NV; Orlando, FL; San Jose, CA; and Sacramento, CA to its Hispanic Radio Market service and will now issue all of its Hispanic Radio Market data twice each year. This brings the total number of Hispanic -rated markets to 24.

Research Director, Inc. has just released new information about radio listening behavior from a study of 285,000 Arbitron diarykeepers. The study shows that
oldies and news /talk have the highest percentage of total listening in a car.
Successful AC stations typically get 46% of their quarter -hour listening at work,
classic rock is 41 %, AOR 40 %. Exclusive diarykeepers, those that listen only to
one station in a week, only account for 8% of diarykeepers overall, but they are
significant to urban contemporary, easy listening & country formats. The study
also compared quarter -hour median age by format.

ABC Radio Networks is set to debut "Radio Disney ", a 24 -hour children's format, this November for a six month trial run. The launch of the network has been kept quiet, except that the company issued a press release this week announcing Kimberly Morgan has been named National Promotion Director for the new web. Morgan will be responsible for on -air promotions, market events and merchandise, as well as, outdoor, print, database and direct mail advertising.
Jones Satellite Networks' announced the name change of FM Lite to NAC. The change represents a culmination of the gradual move to a pure NAC format since the beginning of the year when Operations Manager Steve Hibbard joined the network.

(Richmond), WVGO, has been hit with a Notice of Apparent Liability of $10,000 for
comments Howard Stern made on his Infinity - syndicated show. At the time of the
complaint, the station was using the call letters WBZU. The alleged violations
include descriptions of Stern having sex with his wife, which was broadcast on
October 23, 1995. WVGO flipped call letters and swapped formats with its sister
station WBZU after the alleged violations took place. Benchmark no longer carries
Stern.

WASHINGTON THIS WEEK
The Southern Region of the National Rainbow Coalition filed opposition to the license renewal for Downs Satellite Broadcasting of South Carolina, Inc.'s WJXY AM & FM in Conway, SC. Rainbow alleges that the licensee violated EEO rules and policies. The licensee denies Rainbow's allegations and claims documentation with respect to its recruitment efforts for the 20 positions filled between Mar. 1,
1993 and Dec. 27, 1994 was destroyed by a flood on Dec. 23, 1994. Although the Commission concluded that Downs contacted recruitment sources, including minority and female organizations, and hired minorities and females, they cautioned the licensee to assess its EEO program to address the absence of minorities in its
applicant pools.
Radio stations in Louisiana are breathing a little easier after the Supreme Court set aside a ban on casino advertising in that state. Inside Radio reports the ruling came after the Court considered its ruling on a state - imposed ban on liquor advertising in Rhode Island, which it declared to be unconstitutional. Stations still can't air the spots, however, because the Supreme Court sent the decision back to the U.S. Fifth Circuit court for a ruling. Gaming states of Nevada and New Jersey are eying the ruling closely. Gaming ads are legal there, but a ruling is pending in California regarding the constitutionality of ads in Nevada.
Southern Skies Corporation's renewal of license for KSSN(FM) in Little Rock and KMVK(FM) in Benton, AR, was granted despite allegations by the Rainbow Coalition that a promised improvement in the EEO program had not been implemented. Southern Skies proved to the Commission that they recruited from approximately 13 sources, including the NAACP and, had in fact, made improvements to their EEO program.

Jacor Communications spent another $170 million of its acquisition war chest to go back to its roots. The 20 station group of Regent Communications will become part of Jacor in exchange for 3.55 million shares of Jacor stock, as well as warrants to purchase an additional 500,000 shares. Jacor will also assume $64 million of Regent debt. Regent's President, Terry Jacobs, was one of the founders of Jacor. The deal gives Jacor a new duopoly in Kansas City as they own country WDAF and rocker KYYS which will combo with Regent's soft AC KUDL and CHR KMXV. In Salt Lake City, Regent turns over country KKAT, Ogden; oldies KODJ and talk KALL, Salt Lake; rocker KUTQ, Bountiful; and dance KZHT, Provo. In Las Vegas, soft AC KSNE -FM, oldies KBGO, and country KFMS -FM, Las Vegas; and country KWNR, Henderson. In Louisville, hot AC WDJX, soft AC WVEZ, jazz WSJW, and religion WFIA, all Louisville; and 70's oldies Corydon, IN. In Charleston, SC, country WEZL and oldies WXLY, N. Charleston. Regent also has an SMA with country KBKK, Spanish Fork, UT (Salt Lake) which will be assumed by Jacor.
Jacor didn't stop there. It bought Palmer Broadcasting's legendary Iowa AM's, news -talk WHO, Des Moines, and AC /talk WMT, Cedar Rapids, as well as their AC sister's KLYF and WMT -FM, for $52.5 million. The purchase brings Jacor's station count to 96. Kalil & Co. brokered the transaction.

Apogee Communications returns to radio ownership by purchasing Max Media's classic rocker KKLZ, Las Vegas for an undisclosed amount. Apogee sold is Tucson and Portland, OR properties last year. The company is owned by Roy P. Disney. Max Media still has stations in Norfolk and Greensboro. Apogee also has an application for a new station in Sun Valley, NV in the Reno market.
Infinity Broadcasting announced it will sell Dallas station, adult standards KDMM, Highland Park, to Marcos Rodriguez for an undisclosed amount. The deal will create a new combo there as Rodriguez owns a controlling interest in contemporary Christian KLTY, Ft. Worth. The sale brings Infinity into compliance with FCC's ownership rules for that market after its merger with CBS /Westinghouse.
Cincinnati -based Blue Chip Broadcasting is buying another Ohio radio station. This time it's urban WCKX, London, OH serving the Columbus market. Blue Chip is paying $4.4 million to Sunrise Broadcasting to couple the new purchase with cross- town urban rival WJZA, of which it is a partial owner. Blue Chip owns three other urban - formatted stations in Cincinnati and Louisville.
Journal Broadcast Group is picking up a third FM in Omaha. Inside Radio reports Nebraska Broadcasting Corp. will sell jazz KOSJ, Nebraska City, NE for an undisclosed amount. Journal already owns rocker KEZO -FM, classic rock KKCD, and sports KOSR, all Omaha. The two are holding off on the LMA until next year.
Gulfstar is extending its reach in its newest market. It's buying talk /sports KWHN and country KMAG, Ft. Smith, AR from Al Germond and David Baugher. Terms weren't disclosed. Gulfstar has a purchase pending of AC KEZA, Fayetteville, AR, which also serves the Ft. Smith market. Charles Giddens and George Otwell of Media Venture Partners brokered the deal.
In Indianapolis, Weiss Broadcasting is taking over the operation of urban -oldies WGLD, Noblesville, IN after its planned sale to Panache Broadcasting fell through. Weiss was to get $4 million for the station, but Panache is backing out because it didn't reach the audience levels they expected. The station will switch back to satellite -delivered jazz. Panache owns gospel /urban WTLC and urban WTLC -FM, both Indianapolis.
Children's Broadcasting Corp. is buying another AM to broadcast its Radio Aahs format. Nelson Broadcasting will sell oldies WAUR, Sandwich, IL for an undisclosed amount. WAUR covers part of the Chicago area. The deal gives Radio Aahs at least partial coverage of seven of the top ten markets.
Dame Media is doubling up in the Harrisburg market with the purchase of Barnstable's oldies WWKL, talk WCMB, and gold -based AC WYMJ. Dame will pay $11 million for the trombo and will couple it with news /talk WHP, news WKBO, and classic rocker WRVV. Barnstable plans to put the money toward a soon- to -be- announced station purchase. After the deal, Dame will have 21 stations.
Guaranty Broadcasting racks up its fourth FM in the Baton Rouge market with the purchase of BEBE -F Broadcasting's "women's" AC formatted WBBU, Baker, LA. The sale price is $1.75 million. Guaranty owns classic rock WGGZ and country WTGE -FM, both Baton Rouge, as well as country WHMD, Hammond, which also reaches the market.
Financial talk show host Sonny Bloch pleaded guilty to seven counts of tax fraud and perjury and was sentenced to 21 months in federal prison. He'll also serve 750 hours of community service and three years of probation. Inside Radio reports Bloch's response as to why he did it was, "The answer is greed and stupidity."
ABC Radio Networks has signed a new multi -year contract with Owens Broadcasting LLC, a Buck Owens Company, to continue syndication of the traditional country music -based format, Real Country, which debuted in 1990.
ABC Radio also announced an agreement with Radio Today to add four broadcast services to its syndicated products. Goldmine, set to debut in Nov., offers production services to oldies stations. Rock Slides, is suitable for classic rock and album rock stations; Ambush, for news /talk, sports, full- service or AM stations; and HitSlides, aimed at contemporary and top 40 stations will begin December 30.

SFX Broadcasting Inc. announced that it plans to acquire privately -owned Delsener /Slater Enterprises, Ltd. for an undisclosed sum. Based in New York City and founded in 1996, Delsener /Slater is a promoter of contemporary music concerts and concert production. SFX is buying the company to produce concerts and specials and do other promotions in conjunction with the company's stations. Delsener /Slater will retain its current name, management and corporate location.

Westwood One Entertainment has launched "Ask the Handyman with Glenn Haege." The two -hour call -in show, fed live on Saturdays from loam to 12noon, includes tips from home improvement industry leaders. The show originates from Detroit's WXYT.
Charlie Tuna is the new host of Entertainment Radio Networks' "The Weekly Top Thirty." The show, which began in 1989, will continue to feature top country hits and country music news.
Children's Broadcasting Corporation, Radio Aahs, announced a programming and promotions agreement with Universal Studios. The agreement includes weekly live broadcasts on Saturdays from Universal Studios, Hollywood, hosted by Bruce Barker and on Sundays at Universal Studios, Florida, hosted by Jammin' Jo Jo. Both shows air between 1 and 3pm. Aahs has planned quarterly vacation giveaways to both locations.
Radio Aahs also announced its format is up and running on the 24- hour -a -day, 7- day -a -week Internet -only radio network, NetRadio Network. The web address is http: / /www.netradio.net. "NetRadio Aahs" will be developed by Minneapolis -based Precision Tapes Inc., a creator, manufacturer and distributor of interactive games and computer software for kids. Precision is developing an entire Aahs neighborhood and retail mall on -line with value -added incentives - like online couponing according to Christopher Dahl, CBC's CEO. Aahs will have 8 minutes of advertising to sell in addition to the two minutes heard via the radio network. Aahs will allow users to register through its Net Companion software which will give them the capability of targeting specifically by demographic profile.
SW Networks announced the promotion of Rich Vestuto to Director, Adult Programming and the appointment of John Loscalzo as Director of Rock Programming. Vestuto has been with SW since 1995. Loscalzo has rejoined SW from Billboard Rock Airplay Monitor, where he was Managing Editor.

FCC AND DOJ SPELL TROUBLE FOR LMA'S The FCC and the Department of Justice are getting tough on LMA's. Rasa Communications Corp.'s KIXA -FM, Victorville, CA, received a Notice of Apparent Liability for a Forfeiture of $10,000 for not keeping an operating identity or independent presence while in a Program Service Agreement with Tom Gammon's Topaz Broadcasting, Inc., which owns KZXY -AM & FM, Apple Valley, CA, from May 27, 1992 to Jan. 9, 1995. The Commission said the programming agreement "exceeded the boundaries" of an LMA. Under the agreement, Topaz provided the studio, STL, and eight hours of programming per week. Topaz also corrected facilities violations and supervised construction of the stations, which Rasa should have done. Rasa also started program tests before notifying the Commission. Rasa was originally fined $20,000 for the violations. However, it was determined that Rasa voluntarily disclosed and corrected those deviations in faclilities applications, so the fine was lowered to $7,500. A $2,000 forfeiture was levied for violation of the main studio and local public inspection file provision. Rasa failed to maintain a local or toll -free telephone number for the first three months of operation, the public file was missing from its designated location and the station failed to include the Program Services agreement in the public file. Rasa has 30 days to pay or show, in writing, why the penalties should not be imposed. The DOJ is taking a real close look at future LMA's. See page seven for details.

Jacor, hot off the recent purchase of KIIS -AM & FM, Los Angeles, adds a regional flair to its radio coverage by announcing the purchase of Clear Channel Radio's country KTWO and AC KMGW, Casper, WY, along with the Wyoming Radio Network. KTWO is a clear -channel signal on 1030 KHz. Wyoming Radio Net. feeds news, sports, and ag news to stations in Wyoming, Montana, and Colorado. Clear Channel Radio is not related to Lowry May's Clear Channel Communications. Casper is Arbitron's smallest regularly- measured market. Jacor's also picked up six more stations in San Diego. The Commission denied Max Pearson's petition for reconsideration and motion to stay against the assignment of the licenses and sell the assets of stations KDEW AM & FM in DeWitt, AR to Pearson. Several times, Quadras, Inc. filed apps to transfer the licenses to Pearson which the Commission granted over the objections of First National Bank and other creditors of Quadras. Subsequently, The Chancery Court of Arkansas County appointed First National receiver. First National filed instant applications, as well as, a petition to deny the AM application and a petition for reconsideration of the grant of the FM application. The FM assignment was consummated on June 17, 1994. On June 22, 1995, the Commission granted First National's petition, rescinded the FM grant to Pearson and dismissed the AM app. Pearson claims the Commission action has caused him irreparable harm and the loss threatens the very existence of the business in question to the extent that he was forced to terminate its operation and business activities on Sept. 16, 1995. The station remains silent. In it's ruling, the Commission held that it would not generally question the appointment of a bankruptcy trustee or receiver where a court is seeking to protect the creditors of a financially disabled licensee. The Commission did impose conditions on the grant. The stations' licenses will expire automatically at 12:01 am on Feb. 9, 1997 unless they resume broadcast operations.
The College of Southern Idaho, licensee of KEZJ(AM) in Twin Falls, was designated for hearing to show cause why its license should not be revoked. The station has been off the air since Dec. 16, 1993. The station was an unexpected gift by B & B
Broadcasting and required approval from an Educational Communications Program at the College and the Idaho State Board of Education for the implementation of a
Mass Communications Program. The station resumed operations on Sept. 5, 1996 and argued that the resumption took longer due to problems in the installation of the remote control equipment, the calibration of the transmitter power meters and sporadic problems in the transmitter. The Commission found that the college committed no deliberate violations and resolved the matter in favor of the college.
The Commission has rescinded a $7,500 Notice of Apparant Liability against Furniture City Broadcasting Corp.'s WFUR AM & FM in Grand Rapids, MI. The reporting conditions and fine were assessed as a result of a petition to deny the renewal of licenses, filed by the Michigan State Conference of Branches of the NAACP. Furniture City argued that the fine was based on activities which last occurred on May 20, 1989 -- more than three years prior to the release of the Notice. The NAACP had also requested early renewal filings for co -owned stations and a market -wide investigation of the EEO practices, which were denied.

Stations who have been silent for more than a year that went silent on or before Feb. 8, 1996 will expire at 12:01 a.m. on Feb. 9, 1997. To resume operations, some stations may require prior Commission action. Licensees of these stations may request expedited processing and should submit applications no later than Nov. 1. Such applications should be marked "REQUEST TO EXPEDITE APPLICATION OF SILENT STATION." Each letter should include call sign, city and state, type of application, a brief explanation of why action on the application is necessary to return to air and the date the license will expire if it remains off the air. For applications already on file, the same letter should be sent. FM letters should be sent to Glenn Griesman, Mail Stop 1800B3, Room 332 and AM letters should be sent to Sharlene Lofty, Mail Stop 1800B2, Room 344 at the FCC's Audio Services Division, 1919 M Street, NW, Washington DC, 20554.

The Department of Justice is turning up the heat on LMA's and SMA's, but may let by -gones be by- gones. According to Inside Radio, Deputy Assistant Attorney General Lawrence Fullerton stated at a meeting that the DOJ doesn't intend to seek civil penalties against owners who have done LMA's as part of a purchase agreement. But, future LMA's as part of transfer agreements will be closely scrutinized -- including demographic or format concentrations. Jacor Communications has already been through the microscope regarding the domination of key demos in Cincinnati, which is why they had to spin off CHR WKRQ there. The DOJ has recently opened almost 20 radio anti -trust investigations.
Capstar is buying up five stations in three separate transactions in the Treasure Coast area of Florida to form a super duopoly there. From EZY Com, it'll get standards WMYM and AC WLRQ -FM, Cocoa, FL. From City Broadcasting, standards /talk WMMB and oldies WGGD -FM, Melbourne, FL. Finally, from Roper Broadcasting, country WHKR, Rockledge, FL. Capstar has a purchase pending of Commodore Media, which owns rocker WZZR, Stuart; hot AC WBBE, Gifford; and oldies WQOL, standards WAXE, and country WAVW, Vero Beach, FL. There's also an SMA with country WPAW, Vero Beach. None of the terms were disclosed. This new super -duopoly covers the entire stretch of coast from Titusville to Ft. Pierce.
The face of the radio landscape in Sacramento and San Diego will change quickly with the announcement of several deals. ARS currently has an LMA -to- purchase with Brown Broadcasting's oldies KXOA, classic hits, KXOA -FM, and new rock KQPT, but will spin KXOA -FM to Entercom for $27.5 million. Entercom will combine the new purchase with Jacor's rocker KRXQ, Roseville and classic rock KSEG, which it has also announced it will buy for $45 million. Jacor will use the proceeds of the deal to purchase four stations in San Diego from Par Broadcasting for $72 million - -talk KOGO and KCBQ, hot AC KKLQ -FM, and rocker KIOZ. At press time, Jacor and Nationwide were announcing station swaps in San Diego, which we'll have next week. When all is done, ARS will have ten stations in or near Sacramento --it owns five, is buying three from EZ Communications, plus the two it keeps from Brown. Jacor will operate nine in San Diego, as it already owns dance KHTS, El Cajon. It's also buying Gannett's news /talk KSDO and soft AC KKBH and LMA's sports XETRA and new rock XETRA -FM across the border in Tijuana. Kalil & Company brokered the ARS /Entercom deal in Sacramento.
Triathlon is picking up two more stations in the Omaha market. American Radio Systems is selling news -talk KFAB and oldies KGOR for $39 million. Triathlon already owns modern AC KTNP, Bennington and country KXKT, Atlanta, both serving Omaha.
Regional Radio Corp. is giving up its Lansing properties to 62nd Street Broadcasting for $15 million. The stations are country WBHR and rocker WJXQ, Jackson and new rock WWDX, St. Johns. The principals of 62nd own rocker WKQZ, Midland, and classic rock simulcasters WMJK, Pinconning, and WMJA, Saginaw.

TV HAS "C.O.D.S." SHOULD RADIO FOLLOW WITH "TALES FROM JUSTICE " ?. . . Steve
Dodge's first battle with the Justice Department is over, but it has left his
American Radio Systems a little bloodied in Rochester. ARS will have to spin off
news -talk WHAM and news -talk -sports WHTK, as well as terminate its sales agreement with new rock WNVE, South Bristol, NY and assign its purchase option of that
station to a third party. ARS currently owns soft AC WRMM -FM and sports WCMF and
rocker WCMF -FM, but it is donating the AM to St. John Fisher College. In
February, it agreed to buy AC WVOR -FM, CHR WPXY -FM, WHAM and WHTK from The Lincoln Group. Then in September, it announced it would buy Brighton Broadcasting's construction permit, WAQB, Brighton, NY. Under the terms of the settlement with
the DOJ, ARS will be allowed to close on its pending purchase of WAQB. The ruling marks the first time the DOJ has ruled on a sales agreement. Dodge was quick to
point out that he disagrees with the DOJ theory that radio is its own unique market within all advertising choices and that his pending deals in the market were all approved by the FCC.
CANADA YEARS AHEAD OF U.S. IN DIGITAL. . . Canada will have digital broadcasting in place next year. A cooperative effort among the nation's public and private broadcasters gives Toronto listeners DAB broadcasts that will start in mid -1997. 15 Toronto stations plan to establish digital transmitters on Toronto's CN tower.
Initially, the programming of the 15 stations will be simulcast in both analog and digital using the Eureka L -Band system. Toronto consumers will be able to buy
receivers in the Fall of next year.

WASHINGTON THIS WEEK The Commission denied an application for review filed by Orion Communications which rescinded Orion Communications, Ltd. construction permit and operating authority for station WZLS(FM) in Biltmore Forest, NC. The Commission claims that Orion constructed the station months after its permit grant was overturned and granted a joint interim arrangement to a non -profit corporation made up of four other applicants for the facility during the comparative hearing -- Biltmore Forest Broadcasting FM, Inc.; Liberty Productions LP; Skyland Broadcasting Company; and Willsyr Communications LP. Orion elected not to participate as a party to the application for interim operating authority.
The Commission granted the assignment of KUUY(AM) and KKAZ(FM) in Cheyenne, WY from James T. Dineen, Trustee in Bankruptcy to Magic City Media, Inc. after a
hearing to establish whether previous unauthorized assignments of the station's licenses, involving entities controlled by Paul Lowrey were intended to deceive the Commission concerning the ownership. The Commission found no proof of deceit.
The transfer of KOLA, San Bernardino to receiver Ray M. Stanfield survived a
challenge by Joseph D. Jones this week. The subsequent transfer for Inland Empire Broadcasting Corporation also survived. The station changed hands in early 1992 when licensee Frederick Cote was indicted on five felony charges in the State of California which resulted in a conviction on four counts, including murder. While he awaited trial, Cote and Inland negotiated a purchase of KOLA resulting in a
sales agreement. The parties also entered into a loan agreement of $500,000, ultimately used to pay Cote's defense costs, taking back a promissory note secured by KOLA's assets. KOLA defaulted on its obligations and Inland foreclosed. The CA Superior Court appointed Ray Stanfield as receiver. Jones claims Cote and Inland "colluded" to obtain the appointment of the receiver to "perfect" Inland's security interest. The Commission found no basis in Jones' allegations that Inland took premature control of the station or filed fraudulent EEO reports.
Renewal booklets will be mailed near the middle of November for stations in

ELSEWHERE (cont'd) In San Diego, Jacor is filling out its full complement of stations by swapping its Phoenix stations for adult standards KPOP and classic rock KGB -FM, both San Diego, which Nationwide Communications is in the process of buying from Brown Broadcasting. Nationwide picks up Jacor's only stations in Phoenix, classic rock combo KSLX -AM & FM. Nationwide plans to spin the newly- acquired Jacor combo to Sandusky Radio. In order to comply with ownership caps, Jacor will spin talk KCBQ (AM) to EXCL Communications for an undisclosed amount. The deal gives Jacor eight stations in San Diego along with a management agreement with Mexican sports station XETRA (AM) and new rock XETRA -FM, both Tijuana. Look for KCBQ to flip to Spanish programming when EXCL takes it over.
SFX Broadcasting is expanding its presence in Hartford with the purchase of country WWYZ, Waterbury from The Gilmore Family for $25.25 million. SFX has new rock WWRQ, Waterbury; classic rock WHCN and news /talk WPOP, both Hartford; and is
buying CHR WKSS, Meriden through its purchase of Multi- Market Radio. Gilmore will keep talker WATR, Waterbury.
In Houston, SFX has renegotiated its deal to buy news -talk KNUZ and standards KQUE for $38 million plus "additional consideration" from Texas Coast Broadcasters. SFX tried to buy the stations several months ago, but couldn't work out the details. This time, SFX is buying the stations through Multi- Market Radio, which it is in the process of buying. SFX will have three FM's and an AM in the market. It already owns soft AC KODA and is about to close on classic rock KKRW.
Dame Media has snatched up another Albany, NY station. It's buying Regal Media's jazz WHRL for $2,632,500 to combo with news -talk WGY and classic hits WRVE, both Schenectady. Dick Kozacko of Kozacko Media Services was the broker.

The Country Radio Broadcasters, Inc.'s annual Country Radio Seminar is scheduled for March 5 -8, 1997 at Nashville's Opryland Hotel and Convention Center with a
theme of "Winning Through Learning: How to Keep Country Strong." The opening session keynote speaker will be Lou Holtz, head football coach for Notre Dame and author of the New York Times bestseller "The Fighting Spirit." Other highlights include the attendee welcome reception, artist taping session, Super Faces and New Faces shows. The CRB also announced that it has made a two -year commitment to present its annual Country Radio Seminar in downtown Nashville beginning in 1998.
A national sporting magazine radio show, Outdoor Life Radio, was announced this week. The 1 -1/2 minute daily show is the result of a new partnership between host -producer Scott Linden and Times -Mirror Corp.'s Outdoor Life magazine. The program covers a broad range of subjects such as fishing, hunting, camping, rafting and skiing, among others.
