But for the Supreme Court, Aruna, the victim of a sexfiend, would have died of kindness that egged her friend topetition the court nearer to the heavenly one to withdrawher lease on this beautiful earth which she had beenenjoying for 37 years from the hospital bed, prone, silentand effortless since her defilement by the human beastwhen she, a pretty nurse, was 25.

The Supreme Court Judges in private must haveshed buckets of tears at their helplessness to end hermisery, because Macaulay had dehumanised the IndianPenal Code drafted by him, preventing the luxury ofpainless exit from life by assisted termination of life ofhuman vegetables. He brought such attempts punish-able under section 309 I.P.C. So, thanks to Macaulay,Aruna is condemned by law to a permanent settlementin her hospital bed until the Supreme power that un-leashed the human beast on her decides to cancel herlease suo motu. This is a golden opportunity for LawMinister Moily to go hammer and tongs to forge a beau-tiful amendment to the I.P.C. by abolishing Sec.309/I.P.C as suggested by eminent jurist V. R. Krishna Iyerwho headed the Law Reforms Commission set up by theKerala Government, whose recommendation sent 2 yearsago, is still asleep. He has opined that euthanasia couldbe considered in cases where death is the only salvationand preservation of life would be medically impossibleand visited with insufferable physical or mental pain.

Iyer is never wrong. Fali Nariman, eminent lawyer, inhis book ‘Before Memory Fades’, has divided the legalhistory of independent India into two phases: Chief Jus-tice K. Subba Rao and Justice V. R. Krishna Iyer.

Rao is gone. We are fortunate that, at 95, V .R .KrishnaIyer is with us to give sane advice, one of which islegalizing Euthanasia.
