Ref: e-Tender Notification of even No., and Date. PREAMBLE: The Karnataka State Department of Agriculture has invited tenders through Govt. of Karnataka e-procurement vide Government of Karnataka e-Procurement Portal reference cited above, to source the Bio fertilizers (Carrier based), Bio fertilizers (Liquid based), VAM -Bio fertilizer, Green Manure Seeds (Diancha & Sunhemp), Gypsum, Zinc Sulphate, Borax, Ferrous Sulphate, Micronutrient mixtures, Agricultural Lime, Dolomite, Vermi compost and City compost.

The e-Tender under reference is governed by the following approved terms and conditions set out under different heads as under. I. PROCEDURE FOR SUBMISSION OF TENDER : As per e-procurement portal

1) The tender shall be submitted in two parts namely; a) Technical bid: The Technical bid shall be submitted for each product separately as per

Annexure-II. This contains details of organization, production/product profile etc. b) Commercial Bid: The commercial bid contains the details as indicated in the e-Procurement

Annexure-IV. The tenderer shall quote the product-wise supply rate (inclusive of all taxes, freight, loading & unloading charges etc.) against specifications in Rupees. Commercial bid shall be submitted for each product separately. Further costing sheet should be submitted along with commercial bid form for each product separately without fail.

2) Tender documents may be downloaded from Government of Karnataka e-Procurement website https://eproc.karnataka.gov.in under login for bidders/suppliers. Aspiring Bidders/ Suppliers who have not registered in e-procurement should register before participating through the website https://eproc.karnataka.gov.in

3) Manufacturers / Authorized Distributors can access tender documents on the website, fill them with all relevant information and submit the completed tender document into electronic tender on the website https://eproc.karnataka.gov.in/ after submitting the EMD and tender processing fee in the form of e-payment. The documents that are uploaded should be Legible and Readable. A hard copy of the filled Tender Document with the relevant attachments that have been uploaded online only should be submitted one day before the date of Technical bid opening without fail. (Hard copy submitted will be consider red only for cross verification of the documents submitted on online, if needed.)

4) a) The tenders shall be signed only by the Proprietor, if it is a Proprietary concern in support of which affidavit of ownership and a copy of the certificate of Registration has to be submitted to know the person authorized to sign the document.

b) If it is a Partnership firm , one of the Partners or a person authorized by the partners shall sign the tender. Copy of the Partnership Deed shall be submitted to know the person authorized to sign the document. c) If it is a Public or Private limited company, the Chief Executive of the company or a person authorized in support of which necessary authorization letter with seal and signature shall be submitted.

5) Earnest Money Deposit (EMD) and Tender Processing Fee: An Earnest Money Deposit

(E.M.D.) of Rs.1,00,000 (Rupees one lakh only) per product is to be deposited. Tenders must be accompanied by Earnest Money Deposit, which should be paid online through e-Procurement portal using any of the following payment modes: Online payments:

i. Credit Card – Visa or Master card ii. Debit card – Visa or Master card

iii. Internet Banking

6) Tenders should be uploaded through e-procurement portal on or before 22.02.2014 with in 04:00 P.M.

7) In respect of successful tenderer whose supplies are as per the accepted conditions, EMD will be refunded after the validity period of the tender contract. EMD in respect of the unsuccessful tenderers will be refunded immediately.

8) Validity of Tender contract : The rates accepted would be valid upto 31-03-2015. 9) The Department will not entertain any price revision during the validity period of the tender or

extended period thereof, during the tenure of the continuous period of contract including any revision of existing tax structure or introduction of any new taxes, levis, duties etc.

10) If any information provided by the tenderer in both Technical bids and Commercial bids is found to be factually false or misleading, such tenders will be summarily rejected at any time during the validity of the tender and liable for criminal and civil action against such firm or company.

11) If any companies are black listed by any State Government or agency, such tenderers are liable for rejection at any time during the validity of the tender and supplies will be terminated.

12) The tenders are liable for rejection due to the following reasons i. Incomplete/non-submission of any of the documents sought for ii. For any disqualification made by the Department. iii. Default in the previous transaction and supplies.. iv. Incomplete technical and commercial bid documents.

II. OPENING OF TENDERS & TENDERS SCRUTINY:

14) Opening of Technical bids will be done in the presence of the tenderers or their authorized representatives and the Tender Scrutinizing Committee will conduct preliminary scrutiny of EMD. Later on, a detailed scrutiny will be taken up and those found to be in order will only be accepted.

15) Eligible Commercial Bids in respect of those tenderers whose technical bids are qualified will be opened in the presence of the tenderers by the Tender Scrutinizing Committee constituted by the Tender Accepting Authority.

16) After the opening of the commercial bids, the rate and terms will be negotiated with those tenderers whose rate is the lowest after evaluation by the competent authority for the finalization of the rates on the date fixed. Therefore, the presence of those tenderers is required without fail and they are required to attend at their cost.

III. PRODUCTS SPECIFICATIONS:

17) Bio-fertilizers (Carrier based), Bio fertilizers (Liquid based), VAM -Bio fertilizer, Green Manure Seeds (Diancha & Sunhemp), Gypsum, Zinc Sulphate, Borax, Ferrous Sulphate, Micronutrient mixtures, Agricultural Lime, Dolomite , Vermi compost and City compost supplied shall be in conformity with the standards / specification indicated in Annexure-I of the tender document.

18) The suppliers shall print / affix a permanent sticker on the container stating that "ONLY FOR DISTRIBUTION UNDER SUBSIDY THROUGH DEPARTMENTAL SCHEMES" in bold letters.

IV. TENDERED RATES & QUOTED QUANTITY

19) The quantity quoted by the Tenderer should be atleast 25% of the Total Tendered quantity in case of Bio fertilizers (Carrier based), Bio fertilizers (Liquid based), VAM -Bio fertilizer, Vermi compost ,City compost and Micronutrient Mixtures. The minimum quantity that is to be quoted in case of Gypsum-25,000 MT, Zinc Sulphate-3000 MT, Borax- 3000MT, Ferrous Sulphate- 500 MT, Agriculture Lime- 3000 MT, Dolomite- 2000 MT and Green Manure Seeds-5000 Quintals(.i.e.Sunhemp seeds 2500 quintols and Diancha seeds-2500 quintols)

20) The rates quoted by the tenderer shall be most competitive since it involves sizeable quantity. The rates quoted should be inclusive of all taxes, duties, cess, insurance, freight including loading and unloading charges at the destinations etc., for supply. The rates quoted should be for the required packing sizes prescribed at Annexure –IV.

21) The successful tenderers whose tenders are accepted shall not sell the quoted products to the farmers in Karnataka through any agency at the rates lesser than those quoted to the Department under this tender.

22) The tender accepting authority shall have the right to alter the quantity finally ordered to the extent of 25% either way of requirement indicated in the tender document.

23) Costing work sheet indicating cost of raw materials including production, transportation cost etc. shall be submitted along with the commercial bid of the tender document.

24) After the approval from the competent authority, the finalized list of rate offered will be intimated to the District Joint Directors of Agriculture / Taluka Assistant Directors of Agriculture who in turn place the supply orders according to their requirement.

V. ELIGIBILITY CRITERIA FOR THE TENDERERS:

25) Registration certificate / manufacturing license and the whole sale Marketing license along with Form-O, (which should be attested by the concerned licensing authority) for Bio fertilizers (Carrier based), Bio fertilizers (Liquid based), VAM -Bio fertilizer, Zinc Sulphate, Borax, Ferrous Sulphate, Micronutrient mixtures, Vermi compost and City compost as per Fertilizer Control Order (FCO) 1985, since these products are included under the above act and attested copies should be enclosed.

26) In addition to the clause (24), other state manufacturers and authorized distributors should submit the wholesale marketing license obtained from the concerned district Joint Directors of Agriculture in Karnataka state for marketing their products which are included under Fertilizer Control Order, 1985 along with the Form-O issued by the Concerned Manufacture/source firm and which should be attested by the concerned licensing authority in addition to the Marketing License of their state (Copies should be preferably in English) .The manufacturer and authorized distributor are equally held responsible for supplies and quality of the products.

27) All the authorized distributors should compulsorily submit manufacturing license and whole sale marketing license as per FCO,1985 along with the O-form of their source firm for the products included under FCO,1985 which should be certified by the concerned Licencing authority.

28) Whole sale marketing license obtained in Form-A2 as per FCO,1985 should include Form-O indicating source of material, name of the product and validity date, which should be certified by the concerned licencing authority.

29) For Green manure seeds (Diancha and Sunhemp) Seed license as per Seed Act, 1966 and Seed Rules,1968 should be uploaded.

30) Quality test reports obtained only from Notified laboratories / Govt. institutions which must tally the specifications given in ANNEXURE-I and should be enclosed to the technical bid. Quality analysis report should be with in three months before the date of issue of this notification.

31) The manufacturers/authorized distributors who are participating in the tender should submit latest performance certificate regarding the supplies and supply of quality product to the farmers from the respective State Department of Agriculture / competent authority (format is given along with this tender document)

32) If the tenderer is sourcing the material from other sources for procurement and supply, then letter obtained from each firm / firms declaring to supply the product and quantity agreed upon to supply as per specifications, as per packing size & as per the schedule should be enclosed along with technical bid document.

33) If the tenderer is a distributor, then a letter of appointment from source firm / firms declaring to supply the product and quantity agreed upon to supply as per specifications, as per packing size & as per the schedule should be enclosed along with technical bid document without fail.

34) The manufacturer who himself participates in this tender process should not issue authorization letter to more than two distributor for supply to Department. Those manufacturer issuing authorization for more than two distributor Firms their Tender will not be considered.

35) If the Tenderer/ authorized distributor is sourcing the material from the other sources, he can have Only two Source Firms for supply to the Department. Those tenderers showing More Than two Source Firms their Tender will be rejected

36) Those Tenderers who quote less than the prescribed quantity given in Clause 19 of the Tender Document will be liable for rejection.

VI. ISSUE OF SUPPLY ORDERS & EXECUTION OF SUPPLIES & PAYMENTS:

37) The Commissioner for Agriculture, Tender Accepting Authority may accept more than one supplier at L1 rate or more than one tenderer whoever agrees to supply at L1 rate in order to ensure multiple supply sources. The Tender Accepting Authority also reserves the right to fix up the level of subsidy as well as the rates of various agricultural inputs based on existing guidelines of different schemes.

38) Valid Registration Certificate and Sales tax clearance certificate up to March 2013 issued by the concerned Sales Tax Department.

39) Agricultural activities are season bound and required inputs should be supplied during the peak requirement months without fail. If accepted tenderer/s does not supply the required quantity during the period of requirement, then alternate succeeding tenderer/s will be considered for supply who have accepted to supply at L1 rates.

40) The required Bio fertilizers (Carrier based), Bio fertilizers (Liquid based), VAM -Bio fertilizer, Green Manure Seeds (Diancha & Sunhemp), Gypsum, Zinc Sulphate, Borax, Ferrous Sulphate, Micronutrients mixtures, Agricultural Lime, Dolomite, Vermi compost and City compost shall be supplied on consignment basis and on a firm indent placed by the Taluk Assistant Directors of Agriculture / District Joint Directors of Agriculture to the designated Raitha Samparka Kendras or office of the Assistant Director of Agriculture or any other sale point identified by the department.

41) The successful tenderer should not indulge in sub contracting the supply order. 42) The supplies should be made within the time limit specified by the indenting authority. 43) The successful tenderer should supply the required quantities for Kharif season (in the month of

May, June, July), Rabi season (August, September and October) and summer season (December, January) as specified product wise in Annexure-IV.

44) The supply bill / invoice should be in the name of tenderer only. 45) The supplier shall compulsorily mention the respective Batch No./ Lot number/ TIN

number/CST number in the bill and should submit the quality analysis report of the same. 46) The supplier receiving the D.D. towards the farmer’s share shall bear the D.D. Commission

charges. 47) The Department will not have any liability for any damages to the products at any time during

the currency of the tender contract.

VII. QUALITY RESPONSIBILITIES:

48) The supplier shall have the sole responsibility of ensuring quality of Bio fertilizers (Carrier based), Bio fertilizers (Liquid based), VAM -Bio fertilizer, Green Manure Seeds (Diancha & Sunhemp),Gypsum, Zinc Sulphate, Borax, Ferrous Sulphate, Micronutrient mixtures, Agricultural Lime, Dolomite, Vermi compost and City compost as per the specifications mentioned in Annexure-I.

49) All the successful tenders who are agreed to participate in the tender should invariably sign the form No.J of Fertilizer Control Order 1985 enabling the fertilizer inspectors to draw the sample for ascertaining quality as per the technical specification

50) The Production unit of the respective manufacturer will be inspected by the department officials to ascertain the authenticity of the production details of the respective inputs.

VIII. PENALTIES FOR NON-COMPLIANCES,VIOLATIONS & NON-PERFORMANCE.

51) On placement of the supply order, if the supplier does not perform his obligations as per the order and within the time limit specified by the indenting authority, such supplier will be blacklisted and department shall reserve all rights to make alternative arrangements to procure the products and the difference of higher cost and other related expenses paid if any will be recovered from the defaulting supplier through appropriate legal action in addition to forfeiting of EMD.

52) Any delay in relation to delivery schedule; the Department shall have the right to reject the late supplies.

53) Violation of any of the terms and conditions of the Tender by the supplier is liable for stringent actions like forfeiting of EMD amount, subsidy claims and disqualification for departmental supplies for a period of three years or any other punishment as deemed fit in the opinion and judgment of the tender accepting authority depending on the nature of violation.

IX. LEGAL TERMS & COMPLIANCES: 54) The successful tenderer shall execute an agreement immediately after receiving the rate

contract circular from the department covering the terms and conditions of supply order on Rs.200/- Non-Judicial stamp paper or as per the existing procedure at his cost at the time of acceptance of tender or within fifteen days from the date of accepting the tender.

55) In respect of any dispute arising out of implementation of this tender the decision of the Commissioner for Agriculture shall be final.

56) For any legal remedies the Courts at Bangalore city shall only have the jurisdiction.

X. RIGHTS RESERVED: 57) The Tender Accepting Authority reserves the right to reject the tender even after opening of

Technical bid or commercial bid without assigning any reason whatsoever. Sd/-

4. The Manufacturers/Distributors shall have the sole responsibility of quality and quantity of the product supplied under this tender and consequent supply order. The organization / firm is responsible to the Department and also to the farmers for supply and who use the substandard product to compensate them to the extent of claims made by them towards losses and damages suffered on account of purchasing and use of Non-standard Bio fertilizers (Carrier based), Biofertilizers (Liquid based), VAM -Biofertilizer,Green manure seeds (Diancha & Sunhemp), Gypsum, Zinc Sulphate, Ferrous Sulphate, Borax, Micronutrient mixtures, Agricultural Lime, Dolomite, Vermi Compost and City Compost.

5. The supplier shall supply the Bio fertilizers (Carrier based), Biofertilizers (Liquid based), VAM Bio-fertilizer, Green manure seeds (Diancha & Sunhemp), Gypsum, Zinc Sulphate, Ferrous Sulphate, Borax, Micronutrient Mixtures, Agricultural Lime, Dolomite, Vermi Compost and City Compost to the Taluk Assistant Directors of Agriculture within 10 days from the date of placing the Order and any delay in relation to delivery schedule, department shall have the right to reject the late supplies.

6. The required Bio fertilizers (Carrier based), Biofertilizers (Liquid based), VAM Bio-fertilizer, Green manure seeds (Diancha & Sunhemp), Gypsum, Zinc Sulphate, Ferrous Sulphate, Borax,

Micronutrient Mixtures, Agricultural Lime, Dolomite, Vermi Compost and City Compost) shall be supplied on consignment basis and on a firm indent placed by the Taluk Assistant Directors of Agriculture / District Joint Directors of Agriculture to the designated Raitha Samparka Kendras or office of the Assistant Director of Agriculture or any other sale point identified by the department.

7. The Department will not entertain any price revision during the validity period of tender or extended period there of, during the tenure of the continuous period of contract including any revision of existing tax structure or introduction of any new taxes, levis, duties etc.

8. Validity of Tender: The rates Accepted should be valid till 31.03.2015.

9. For breach of the terms of the contract, the KSDA will be at liberty to impose the following penalties as mentioned in the Tender Document: (a) On placement of the supply order, if the supplier does not perform his obligations as per the

order and within the time limit specified by the indenting authority, such supplier will be blacklisted and department shall reserve all rights to make alternative arrangements to procure the products and the difference of higher cost and other related expenses paid if any will be recovered from the defaulting supplier through appropriate legal action in addition to forfeiting of EMD.

b) Any delay in relation to delivery schedule; the Department shall have the right to reject the late supplies.

c) Violation of any of the terms and conditions of the Tender by the supplier is liable for stringent actions like forfeiting of EMD amount, subsidy claims and disqualification for departmental supplies for a period of three years or any other punishment as deemed fit in the opinion and judgment of the tender accepting authority depending on the nature of violation.

The respective Taluk ADA/ Joint Director's of Agriculture are responsible to pay farmers share amount to the respective supplying agency. Payments in respect of farmers share wherever applicable will be released in the form of Demand draft to the suppliers in conformity with the standards within 30 days after the sales.

10. The KSDA has right to accord due importance to qualitative aspects. The KSDA will not accept goods which do not measure up to qualitative requirements.

11. In respect of any disputes, the decision of the Commissioner for Agriculture shall be final. However, the tenderer / contracting party will receive a statement or reasons governing the decision of the Government (Director of Agriculture) to convince that there is no need to arbitrariness in the decision.
