Lake Dallas facilitya new place to play

Although Alan and Jodi Biekehad to wait until the LewisvilleLake Toll Bridge opened beforethey could begin buildingSwisher Courts, the indoorsports facility is now open.

The facility, which opened inNovember, has indoor basket-ball and volleyball courts as wellas a restaurant and banquet hallfor anything from birthday par-ties to fundraisers.

“It’s a big space,” Alan Biekesaid. “We can pretty much doanything if they want to set itup.”

Besides sports, the facilityoffers a place for church lock-ins, casino nights, retreats andother events not directly linkedto sports. And while athleticsare a big percentage of the busi-ness, it’s those after-hoursevents that help build the busi-ness, he said.

Besides the courts, the facilityhas a restaurant that offers hotdogs, hamburgers and salads aswell as beer, wine and margari-tas.

The couple has plans to put ina weight room and possiblyexpand by adding beach volley-ball courts behind the facility.

Although it’s been open foronly about two months, severalclub sports groups are already

meeting at Swisher Courts, including the DC Broncos bas-ketball program, Kung Fu forChrist Academy, Lake CitiesBootcamp and Touchdown forTots.

“A great investment opportu-nity occurs when a marvelousbusiness encounters a one-timehuge, but solvable problem.”

— Warren Buffett

Do you remember NewCoke? What a disaster. For more than 100

years, the simple pleasures asso-ciated with a sugary soda were atouchstone for billions of con-sumers worldwide. Yet, on April23, 1985, the brain trust atCoca-Cola thought the worldneeded an updated version ofthe timeless classic.

A little background: Shortlyafter World War II, Coca-Colaboasted close to 60 percent mar-

ket share of the cola market. Buteventually the “Cola Wars”between Pepsi and Coke tooktheir toll, and by the early ’80s,Coke’s market share had beenwhittled down to nearly 20 per-cent. New Coke was believed tobe the answer, but it turned outto be a colossal failure.

Shortly after the New Cokelaunch, company headquartersin Atlanta started receiving let-ters expressing anger or deepdisappointment. According toreports, more than 400,000calls and letters were received bythe company, including one let-ter delivered to the CEO,addressed to “Chief Dodo, TheCoca-Cola Company.” The com-pany hotline, 1-800-GET-COKE, received 1,500 calls a daycompared to 400 before thechange. A psychiatrist Cokehired to listen in on calls toldexecutives some people soundedas if they were discussing thedeath of a family member.

Coca-Cola executives an-

nounced the return of the origi-nal formula on July 10, less thanthree months after New Coke’sintroduction. Interestingly, bythe end of the year, Coke Classicwas substantially outselling bothNew Coke and Pepsi. Six monthsafter the rollout, Coke’s salesincreased more than twice as fastas Pepsi’s. Some point to this asevidence the whole scheme was aback-door marketing ploy, butmany Coke executives admitthey weren’t that smart.

The whole debacle was aninteresting lesson on how astrong business with entrenchedproducts can survive missteps —if corrected quickly and decisive-ly.

Let’s look at another example.Did you know American Expresswas once in the salad oil busi-ness?

In the early ’60s, a small-timecompany in New Jersey, led by aNew York-based commoditiestrader, discovered that it couldobtain loans based upon theinventory of its salad oil. Thisnefarious trader invited bankexecs into his warehouse forthem to inspect his huge vats ofsalad oil, proving the inventorybeing unloaded from the ship-ping docks was real and quicklyfungible in the commoditiesmarkets. What these loan offi-cers failed to understand wasthese vats of oil were mostlyfilled with water, having only asmall layer of oil sitting on top.Since the oil floated on top ofthe water, it appeared to inspec-tors that the warehouse was full

The Denton City Councilvoted unanimously Tuesday toimpose a moratorium on newgas drilling and production per-mits, giving the city somebreathing room to finish anongoing ordinance overhaul.

The moratorium will last for120 days, although the councilcould extend it if necessary.During that time, city staffmembers are supposed to com-plete their review of currentdrilling regulations and offerrecommended changes.

A task force is meeting weeklyto review new regulations, andstaff members have said theyhope to get a draft ordinance tothe council in March.

The moratorium applies tonew oil and gas well permits aswell as applications for specific-use permits, site plans, develop-ment plans and plats that relateto mineral production. I-35E wideninggets key clearance

The northernmost section ofthe Interstate 35E expansionproject received environmentalclearance, moving the projectpast one of its major hurdles.

Environmental clearance is “afederal process that is a hugemilestone in the ultimate devel-opment of the road,” said CountyCommissioner Andy Eads.

County officials began working on clearance for thefinal portion, between FM2181and U.S. Highway 380, in late2009.

The three key issues were airquality, environmental impactand the effect of the toll rate inthe area, to make sure that driv-ers weren’t trapped into paying

to get from one road to another. The middle section, from the

Bush Turnpike to FM2181, gotenvironmental clearance inOctober 2010. The southern sec-tion, from the Bush Turnpike toInterstate 635, received approvalin December 2011.

Currently, I-35E has four tosix regular lanes and four lanesof frontage roads. The expansionproject would widen the high-way to eight regular lanes, fourtolled HOV lanes and four to sixfrontage lanes, depending on theneed. The project’s current esti-mated cost is $3.3 billion in con-struction, $1.2 billion to pur-chase right of way and $800million for operations.

Financial concerns have aris-en as the project cost hasexceeded the county’s $600 mil-lion contribution.

with oil — great collateral onwhich they would happilyextend loans.

Once the scandal wasexposed, American Express —having been eager to extend thecompany credit — was one ofthe biggest casualties. The priceof its stock was quickly cut inhalf. But the core traveler’s checkand high-end consumer/corpo-rate credit card business wasjust fine. This was just anotherexample of a strong businesswith a dominant franchise mak-ing a stupid, one-time blunder.

What an opportunity forthose who could look past themedia headlines of the day. Notsurprisingly, Buffett was eager tostep into the fray. At one point,Buffett bought so muchAmerican Express stock it repre-sented 40 percent of his invest-ment partnership’s portfolio.

It’s amazing how often high-quality, world-dominating busi-nesses are “hiding” in plain

sight. Just in the past 12 months, companies such as Walmart,Cisco Systems, Johnson & John-son and Microsoft have beenlabeled at one time or anotherwith various derogatory epithets.

“Walmart had lost its mojoand will be forever squeezed byTarget and Dollar General.”

“Cisco Systems is old and fatand cannot compete with keyrivals like Juniper or upstartslike Riverbed and F5.”

“Johnson & Johnson has per-petual manufacturing blunders, and Children’s Tylenol andMotrin would never regain theironce dominate shelf space.”

As for Microsoft — did youever use Vista? My gosh, how far

could a company fall? Let alonethe hyperbole that “Apple’s iPadwould kill the future existence ofPCs!”

Yet, while each of these busi-nesses continue to pound outtremendous amounts of cash, over the last year each waspriced at one point or another asif they would never, ever growagain. In fact significant valuedestruction was priced into each(see WMT at $48/share, CSCOat $14/share, JNJ at $57/shareor MSFT at $23/share).

This was silly. Let’s drill intojust one of these as an example.Take Cisco, which has close to $9per share in cash sitting on itsbalance sheet. So, at $14 per

share, you could have bought Cis-co’s entire world-dominatingbusiness for just $5 per share —less than 4 times earnings. Thisimplied the 800-pound gorilla innetworking communications gearwould be dead in about five years.

Crazy! In our own investment part-

nership, my business partnerand I look for hidden gems thatare under-followed or misunder-stood. But sometimes, the bestopportunities are the ones hid-ing in plain sight. We were con-fident these great businesseswould get past each of their one-time, solvable issues. As of theend of February, the stock pricesof each of these are up 25 per-

cent to 50 percent from thosecited above.

WMT, CSCO, JNJ, MSFT —each of the companies behindthese stock names presentedwonderful opportunities for theinvestor who understood theywere high-quality businesses withvery solvable problems. The keyis to spend enough time under-standing the true characteristicsof a business so you can be confi-dent in ignoring the pundits whohave to fill the 24-hour news net-works with some kind of drivel.

As Buffett said about hisinvestment in The WashingtonPost Co., “Everyone knew it wascheap. I just didn’t worry aboutit.” Sometimes they’re just star-ing you in the face.

A stroke occurs in the United States every four seconds, which means that by the time you finish reading this article, four people will have experienced thispotentially life-changing event.

A stroke, also known as a brain attack, occurs when blood flow to the brain stops. Within minutes, brain cells begin to die if proper treatment isn’t taken. “Strokes are a leading cause of serious, long-term disabilities,” says Mitchel Kruger, M.D., F.A.C.C., cardiologist on the medical staff at Texas Health Presbyterian Hospital Denton. “With strokes, seconds matter. The more people who learn the warning signs and simple tests for stroke, the greater the chances are that we can reduce the num-ber of people who suffer the worst stroke impairments.”

If you suspect that someone is having a stroke, try following The National Stroke Association’s FAST steps:

Face. Ask the person to smile to reveal muscle weakness in the face. Arms. Ask the person to raise both arms to check for muscle weakness. Speech. Ask the person to repeat a sentence and listen for slurred words or the inability to fin-ish the sentence. Time. If the person shows any of these symptoms, call 911 immedi-ately. Look at the clock and remember what time the symptoms started. Share the time symptoms started with a physician, as that can affect treatment options.

Time is BrainTexas Health Denton recognizes the importance of timely and effec-tive care close to home for stroke victims. The hospital earned The Joint Commission’s Gold Seal of Approval™ for certification as a Primary Stroke Center. The only

hospital in Denton County to earn this award, Texas Health Denton was recognized for demonstrating compliance with nationally devel-oped standards for stroke care. The hospital has also received designa-tion from the Texas Department of State Health Services as a Primary Stroke Center. “In stroke care, time is brain,” says Jean E. Range, M.S., R.N.,

C.P.H.Q., executive director of Disease-Specific Care Certification at The Joint Commission. “By achieving certification as a Primary Stroke Center, Texas Health Denton has demonstrated the ability to provide effective, timely care to stroke victims and can signifi-cantly improve outcomes for stroke patients.”

Annual meetingkicks off newchamber yearThe 103rd annual meet-

ing of the DentonChamber of Commerce

is scheduled for the evening ofThursday, March 29, at theUniversity of North TexasGateway Center.

The meeting represents thesymbolic start of the 2012-13chamber year, which officiallybegins April 1. Edward C.“Chuck” Fremaux will take overas chairman of the board, thechamber’s chief voluntary offi-cer.

Fremaux, owner of Fremaux’sMetropolitan Catering, has com-pleted two terms on the cham-ber board and has served aschairman of the chamber’sConvention & Visitors BureauAdvisory Board for the past fiveyears.

He has been directly involvedin the chamber’s strategic plan-ning process during the currentprogram year and will elaborateon his 12-month priorities dur-ing the annual meeting.

Much of this plan has beendriven by location and facilityneeds. We don’t know thatwe’ll have all of the final rec-ommendations by the annualmeeting, but we’re closelymonitoring a couple of perti-nent items.

First is the currentLeadership Denton class gradu-ation project, which is toresearch and prepare a pro-posed business plan for a newoff-site visitor information cen-ter, including a store for sellingall things Denton. The existingchamber office is, and willalways be, considered the frontdoor to the community. Ourhope, however, is to expand theservices offered, perhaps at a

more convenient location, withadditional space for Denton-oriented merchandise andmemorabilia.

The Leadership Dentonclass will present its finalreport and specific findings onApril 12 at the Courtyard byMarriott.

Second is the tentativeplans and negotiations going onbetween O’Reilly HospitalityManagement LLC, the city ofDenton and UNT regarding apotential new hotel and120,000-square-foot conventioncenter.

The chamber has contractedwith the city continuously since1976 to administer hotel occu-pancy tax funds to staff andhouse the Convention & VisitorsBureau. If and how this agree-ment between the chamber andcity may be extended could nat-urally impact CVB sales staff, and where they might be locatedin the future.

Tickets to the annual meetingwill be available at the chamberoffice, 414 Parkway St., or atwww.denton-chamber.org.

The Denton Chamber ofCommerce, city ofDenton and its residents

are becoming increasingly envi-ronmentally conscious. Becauseof this new focus, one of thecity’s target businesses forrecruitment is the renewable/alternative energy industry.

A few years ago, we workedwith an ethanol fuel productioncompany that was consideringrelocation to Denton. We wereimpressed by the company’sphilosophy that it’s wrong totake from the human food sup-ply (corn) to make fuel. This inmind, the company developed anew process that used sugarfrom other sources such aswhiskey, beer, soda and fruitjuice. The discharge water pro-duced at the end of this processwould go into a plot of wet-

lands; the sugar from the plantsgrown there would then go backinto the process to be convertedto ethanol.

In 2007, Congress passed theEnergy Independence andSecurity Act, which includesprovisions for a Renewable FuelStandard to increase the supplyof alternative fuel sources byrequiring fuel producers to useat least 36 billion gallons of bio-fuel by 2022. The fuel standard

provision establishes a level of15 billion gallons of convention-al ethanol by 2015 and at least21 billion gallons of cellulosic(non-cornstarch) ethanol andadvanced biofuels (includingethanol from sugarcane andbiodiesel) by 2022. This willcreate new market opportuni-ties for American agriculture inan area called industrial crops. An industrial crop is grown toserve the production sector, instead of becoming food.Industrial crops are an impor-tant tool in lessening ourreliance on imports.

Today, a tremendous amountof research and development isgoing into advanced cellulosicbiofuels (fuels made from feed-stocks such as switchgrass, soy-bean oil, corn oil, crop residues, woody biomass and other indus-

trial crops) that also reducegreenhouse gas emissions by atleast 60 percent relative to gaso-line.

Another promising feedstockis algae. According to ScienceDaily, algae are tiny biologicalfactories that use photosynthesisto transform carbon dioxide andsunlight into energy so efficient-ly that they can double theirweight several times a day. Aspart of the photosynthesisprocess, algae produce oil andcan generate 15 times more oilper acre than other plants usedfor biofuels, such as corn andswitchgrass. Harvested algae, like fossil fuel, release carbondioxide when burnt. However, unlike fossil fuel, the carbondioxide is taken out of theatmosphere by the growingalgae. Algae can grow in salt

water, freshwater or even con-taminated water, at sea or inponds, and on land unsuitablefor food production.

With its high oil content, algae is being considered a suit-able alternative for productionof diesel and jet fuel as well asother bioproducts. Algae is alsobiodegradable.

The University of NorthTexas is currently researchingrenewable energy through thePACCAR Technology Institute,Zero Energy ResearchLaboratory and the Office ofSustainability.

As a result of the work beingdone both here and nationwide, the city will continue to pursuecompanies and entities engagedin renewable and alternativeenergy.

Company gets incentiveto reconsider move

The City Council today con-sidered an incentive agreementdesigned to keep aerospaceparts company MaydayManufacturing from leavingDenton as part of a plannedexpansion.

Mayday, which operates withsister company Hi-Tech MetalFinishing inside a plant at 1500Interstate 35W, is looking toexpand and is considering buy-ing and renovating a vacantbuilding at 3100 Jim ChristalRoad in Denton, according to areport prepared for the council.

At the same time, a neighbor-ing city is courting the companyand has offered incentives toleave Denton, said Linda Ratliff, the city’s economic developmentdirector.

In response, the DentonEconomic Development

Partnership Board proposed agrant to encourage the companyto relocate to the Jim ChristalRoad site. The grant would beworth about $388,000 over 10years, which equals 75 percentof the increased tax revenues thecity expects to receive on thebuilding and business personalproperty during that time.

Land purchase mullednear North Lakes Park

The Denton City Council con-sidered buying 26 acres border-ing North Lakes Park to buildfour new soccer fields and createa tree preserve.

The proposal from the cityparks department would tap amix of funding, including$250,000 from fees paid bydevelopers to cut down trees, tocover the $1 million land acqui-sition.

Revenue from natural gasdrilling under city parks wouldcover another $500,000, withthe rest of the money comingfrom the city’s 2005 bond elec-tion, which authorized the soc-cer fields.

Several problems havedelayed the project, includingrising costs and public opposi-tion to the loss of trees in thearea.

Farmer Jim Blalock thinks hemight have better luck in Vegas.

The 81-year-old calls it a“guessing game.” Last year, hesold half his cattle so he didn’thave to buy hay. Now he can’tafford to buy them back becauseof the basic rules of supply anddemand: more farmers are buy-

ing than selling.“One of the problems we have

is restocking,” Blalock said.

FACING THE ODDSMany farmers sold their cattle

last year because the droughtmade it difficult to feed them, not only because of the high hay

prices but because their landcouldn’t sustain all the cattlewithout rain.

The drought reduced thenumber of cattle in Texas bymore than 1 million, with mostbeing processed or shipped outof state, said Eddie Baggs,Denton County extension agent

with the Texas AgriLifeExtension. The number of cattlemoved across state lines was287,000 more than in 2010, hesaid.

The breeding stock alone wasreduced by more than 600,000cows, Baggs said.

“That’s the smallest the cattleherd has been since 1960,” hesaid.

Farmers are ready to buy backtheir cattle after receiving ade-quate rainfall during the firstcouple months of 2012, butfewer cattle in the state meanshigher prices, which many can’t

afford. Blalock called it a mixedblessing; the farmers who heldonto their cattle are beingrewarded, but the farmers tryingto buy cattle back are paying forit. He and other farmers arewaiting for the market to drop. But it may not be as easy aswaiting out the market. Thedepleted pastureland and haycrop will take time to re-estab-lish.

“The drought’s not just a one-year deal,” Baggs said. “We’regoing to feel the effects of the2011 drought for the next fiveyears.”

LUCK OF THE DRAWCattle farmers Jack and Mary

Lynn Beaty are still recoveringfrom the 2005-06 drought, which Jack Beaty said was worsethan last year’s.

Nick Hampshire, a meteorol-ogist with the National WeatherService, said the North Texasregion actually received morerain in 2011 than in 2006.

Back then, the region was stillrecovering from 2005’s stagger-ingly low 18.97 inches of rain, which made it a two-yeardrought, he said.

Average annual rainfall forNorth Texas is 36.14 inches.

Although the 2005-06drought was worse in DentonCounty, the 2011 drought wasmore widespread, affecting mostof the state, Hampshire said.

Traveling around the Beatys’800-acre Aubrey farm in earlyMarch, it’s hard to imaginethere’s been a recent drought.

The grass is green, stockponds are filled to the brim, andthere are even extra bales of hayscattered around.

But at the end of last year, those stock ponds were basicallydried up and the hay supply was

depleting, Jack Beaty said.Even so, the couple was “a little

better prepared” last year than in2006, Mary Lynn Beaty said.

The Beatys had set aside 150bales of hay in case of drought

or some other unforeseen cir-cumstance.

The rain came just “at theright time to save us,” Jack Beatysaid.

Normally, when the land is

getting the necessary rain, theBeatys sell hay, which is grownon 387 acres of their land.

But in the past several years, they’ve had just enough for theircattle, Mary Lynn said.

In a normal year, the farmersget 3 tons of hay per acre. In2011, they got 1 ton of hay peracre.

The couple also had to sellsome of their cattle because ofthe drought.

Tommy Calvert, who has 50head of cattle on 300 acres inDenton, was lucky he didn’t haveto reduce his herd despite thedrought. He grew enough hay toget by.

“The cost of hay that produc-ers had to buy this winter wereastronomical, and the supplywas nonexistent,” Calvert said.

Many farmers had to get theirhay from out of state, going as faraway as Illinois and Nebraska, causing the price to go up, hesaid.

And because farmers couldn’tafford the jump in the price —from around $45 a bale to some-thing closer to $200 — manyended up selling their cattle.

potatoes and peas. Last year, helet his father’s cattle eat most ofhis watermelon and cantaloupe

crop because they got overripe

in the heat, Brian Blalock said. “It wasn’t only the lack of

water but the extreme heat,” hesaid. “When it gets that hot itburns everything up.”

For Blalock, who works as asergeant at the Denton PoliceDepartment, farming is a part-time gig. And it keeps him busy.Last year, he did his watering atnight between the hours of 8p.m. and 5 a.m. to try to con-serve and get as much out of thewater as he could. He also triedto keep his small vegetablesshaded during the day, he said.

Because of the heat anddrought, very few people soldproduce at the Denton CountyFarmer’s Market, said Blalock, who is the current president.

“It’s very challenging times,”Blalock said. “We’ve definitely hadbetter years than we did last year.”

He’s hoping this year will bedifferent.

UNCERTAIN ODDS“You’re dealing with the

weather,” Brian Blalock said.“You have to take what you canget sometimes.”

Hampshire, the meteorolo-gist, said the rainfall of the pastfew months certainly helps, butonly in the short term.

“We just need to hope this con-tinues,” he said, “and we need tohope we don’t see a dry summer.”

The National Weather Serviceis predicting near-normal rain-fall over the next few months,Hampshire said.

Baggs cautions farmers to beaware of adding back the cattlethey sold off the previous year, because another dry spring andsummer could cause overgraz-ing of their pastures.

Pastures have been “stressedout from the drought,” he said, and they need rest.

“There’s no bigger gamblerthan the farmer,” Baggs said.“Really, what can you do to pre-pare? You can’t store water.”
