The report herewith submitted is for the calendar year 1967 and is theTwentieth Annual Report upon conditions of the Coal and Clay mineswithin the State.
The reports from the various mining operators throughout the State showthp tonnage to be as follows:
COAL AND CLAY PRODUCTION
Strip Mine 881,242.44Deep Mine 392,854.19Auger Mine 45,221.00
Total 1,319,317.63
COAL PRODUCTION
Allegany County: During the calendar year 1967, the Allegany Countymines employed 60 laborers and 65 outside employees, making a total of125 men. The production of coal for 1967 was 304,166.90 net tons. Thisshows a production of 2,433 net tons per man employed during this period
Garrett County: During the calendar year 1967, the Garrett Countymines employed 104 laborers and 99 outside employees, making a total of203 men. The production of coal for 1967 was 1,008,056.73 net tons. Thisshvzs a production of 4,965 net tons per man employed during this period.
FIRE CLAY PRODUCTION
Allegany County: During the calendar year 1967, the fire clay mines inAllegany County employed 8 men. The production of fire clay during19'7 was 7,394 net tons and shows a production of 887 net tons per man.
Garrett County: There was no clay production in Garrett Countyin 1967.

STRIP MININGThe Strip Mining Laws of the State of Maryland were revised in 1966
and approved by Governor Tawes, the Board of Natural Resources, Mary-land Geological Survey, Maryland Bureau of Mines, the Coal Owners andOperators Association, and the Maryland Commission on Mining Laws,passed by the General Assembly in 1967 and became effective June 1, 1967.
Supplementing the Strip Mining Laws, Rules and Regulations wereprepared. A Public Hearing was held in the Maryland Bureau of MinesOffice, August 28, 1967, and then became effective October 1, 1967.

These were also approved by the Maryland Commission on Mining Laws.All forms pertaining to Strip Mining and Auger Mining have been
approved by the Attorney General's Office and are available from the Mary-land Bureau of Mines Office to anyone wanting to Strip or Auger minecoal in Maryland.
In the new Strip Mining Law, Section 660, a provision was made fora Land Reclamation Advisory Committee composed of nine members asFollows: "The Director of the Maryland Geological Survey, who shallact as Chairman; two (2) representatives from the mining industry; two(2) Soil Conservation District Supervisors from the Soil ConservationDistricts of Allegany and Garrett Counties; and three (3) representativesfrom the Board of Natural Resources representing the Departments ofGame and Inland Fish, Forests and Parks, and Water Resources; andone (1) individual representing the Bureau of Mines. All members of theCommittee except the Chairman shall be appointed by the MarylandGeological Survey Commission for an indefinite term. Vacancies shall befilled by the Commission as in original appointments."

KITZMILLER MINE RESCUE TEAMThe Kitzmiller Mine Rescue Team is still active. Mr. Chester L. Evans,
District Mine Inspector, supervised the practice sessions.The members of the team during 1967 were: Claude D. Boyce, Jesse R.
Reel, Andrew S. Bruckey, Ronald R. Evans, Clarence W. Tasker, JamesC. Brady, Lewis F. Paugh, Daniel Milavec and James E. Droppleman. Allof the members of this team resided in the vicinity of Kitzmiller, Maryland.
The Mine Rescue Team and the Maryland Bureau of Mines cooperatewith the Maryland Civil Defense Agency to provide adequate rescue servicefor all cases of emergency.
SAFETY ORDERSThere were no Safety Orders issued during the year 1967.
PROSECUTIONSDuring the calendar year 1967, it was necessary to obtain a warrant
against one Mine Foreman, due to violations of the Maryland Mining Laws.The warrant was obtained and the foreman charged with:
1. Failure to notify the Maryland Bureau of Mines of a seriousaccident.
2. Failure to get approval of Maryland Bureau of Mines to hire anon-licensed Foreman.
The accused pleaded guilty and was fined $100.00 on each count. Finewas suspended provided he obey the Law in the future. Costs of $3.75were paid.
ACTIVITIES OF FUEL COMBUSTION ADVISORFor the Year 1967
From January 1, 1967 thru June 9, 1967, Mr. Robert D. Ewing, FuelCombustion Advisor, spent 34 days in the office and laboratory at Western-port and 14 days at State Institutions. A total of 57 days were spent inthe field collecting samples, advising on coal preparation, etc. Mr. Ewingprocessed 77 coal samples in the coal testing laboratory.

STATE MINE XAMIN BOARDThe forty-sixth examination for mine oreman was conducted on August
30 and 31, 1967 at the office of the Maryland Bureau of Mines in Western-port. Five candidates took the examination for Mine Foreman and two forFire Boss.
On June 27, 1967, Mrs. Lillian A. Frankhouser, Cresaptown, resignedfrom State service after having been employed as a Senior Typist for16 years.
On July 28, 1967, Miss Beverly J. Barnard, Barton, began her employ-ment with the State of Maryland as a Stenographer with this Bureau.

ROBERT 13. EWING
On July 8, 1967, Mr. Robert D. Ewing, Fuel Combustion Adviser forthe Bureau, died in Memorial Hospital, Cumberland, Maryland after abrief illness.
Mr. Ewing worked in this capacity for the Bureau since September 4, 1957.He was born in the Frostburg area and was active in coal mining and
related occupations all of his life.Mr. Ewing began his career in the coal mining industry by digging coal
in various mines in the George's Creek area, later becoming a Mine Fore-man, Superintendent and part-owner of a local Coal Company. In addition,he instructed Vocational Night Mining Classes from 1929 thru 1942 inAllegany and Garrett Counties. During World War II, Mr. Ewing workedas an Explosives Engineer for the U. S. Bureau of Mines.
Mr. Ewing was active in Mine Rescue and First Aid and a member ofthe Mine Inspector's Institute of America, the National Mine RescueAssociation, and the Coal Mining Institute of America.
Mr. Ewing was very dedicated to his work and his contributions to hisassociates were many.
FATALITIES
During the year 1967, one (1) fatal accident occurred in the coal minesof Maryland.
A roof-fall accident at Buffalo No. 1 Mine, Buffalo Coal Company, Inc.,Table Rock, Garrett County, Maryland, that occurred about 8:15 a.m.,Thursday, March 30, 1967, at the intersection of the third crosscut beingdriven right of the 1 right main entry off left mains, resulted in thedeath of Arthur C. Burgess, section foreman. He was 47 years of ageand had 30 years of mining experience, 10 years as a foreman of which 5months were at this mine. He is survived by his widow.
At the completion of the coal-producing shift on the day prior to theaccident, the third crosscut of 1 right off left mains had been advanced 35feet. The coal-producing crew of five workmen and Arthur C. Burgess,section foreman, arrived on this section shortly before 8 a.m., Thursday,March 30, 1967. Edward J. Kovach, continuous-miner operator whoaccompanied Burgess while he made the examination of the area and work-ing place, stated that Burgess tested the roof from the entrance of thecrosscut to the face and remarked that the area was well timbered andsafe to work. Kovach also stated that he did not notice any abnormalroof conditions as he entered the working place and he too consideredthe area adequately timbered. Burgess remained in the working placewhile the continuous miner completed two cuts across the face of thecrosscut which advanced the face about 3 feet. As the third cut wasstarted, Burgess took the hoist rope from the discharge end of the piggy-back conveyor and connected it to the main chain-conveyor line at theintersection. The continuous miner made this cut across the face to within4 feet of the left rib when suddenly the roof fall occurred across the inter-section of the crosscut and 32 feet outby the face. men who were near the face knowing that Burgess was somewhere in thearea went looking for him and found him under the fall. Joseph H. Bava,Sr., utilityman, working along the chain-conveyor line about 150 feetoutby, heard the roof fall and, upon learning that Burgess was under thefall, contacted W. E. White, superintendent, arranged to have an am-bulance at the mine portal, and returned with a stretcher. Using a liftingjack, the workmen freed Burgess. No sign of life was discernable. Hewas placed on a stretcher and taken to the surface and then transportedby ambulance to a funeral home in Oakland, Maryland, where he waspronounced dead by Dr. James H. Feaster, Garrett County MedicalExaminer.
The fallen material which broke into many pieces was 26 feet long, 22feet wide, and 13 to 15 inches thick. One hidden clay seam 35 feet inlength extended from the main chain-conveyor line to about 8 feet intothe crosscut, and another one extended from near the right side of thecrosscut diagonally across the intersection.
This accident was caused by a sudden collapse of inadequately supportedroof which contained two separate hidden clay veins. Contributory theretowas the failure to properly evaluate the existing roof conditions and tomaintain sufficient roof sunports in the exposed roof area.
RECOMMENDATIONS: 1. The minimum standards for roof supportshould be revised to include setting of crossbars where maneuvering ofeauiprnent requires exposure of broad soans of roof, or considerationshould be given to the use of roof bolts. 2. Officials and employeesshould make a more careful and thorough evaluation of existing roofconditions.
An investigation of the accident was conducted at the mine on March31, 1967 by Chester L. Evans, Inspector in charge of the district, HarryB. Buckley, Director, and Inspectors Thomas B. Powell and Melvin K.DeShong, all of the Maryland Bureau of Mines; along with Maurice S.Childers, William Harsanyi, and Joseph Marshalek of the United StatesBureau of Mines.
