OCEAN RIDGE

BEAUTIFICATION ORDINANCE

The primary purpose of the Declaration ofRlghts, Restrictions, Affirmative Obligations and Conditions Applicable to all Property Owners in Ocean Ridge formerly Oristo Subdivision on Edisto Beach, SC and the foremost consideration in the origin of same, has been the creation of a community which is aesthetically pleasing and functionally convenient.

As Ocean Ridge continues to grow through the development of additional parcels of land, we feel the need to set forth more specifically the property owner's obligations and responsibilities, as well as those ofthe property owner's association. These are obligations as they pertain to maintaining an "aesthetically pleasing" community.

Article III, paragraph 4 states. "It shall be the responsibility of each owner to prevent the development of any unclean, unsightly, or unkempt conditions of building or ground on such lot, which tend to substantially decrease the· beauty of the neighborhood as a whole, or the specific area."

Whole ownership owners and condominium, villa and timeshare associations will be responsible for correcting the following conditions within thirty (30) days of the initial violation notification.

OCEAN RIDGE PROPERTY OWNERS ASSOCIATION REPORTABLE VIOLATIONS

1. Architectural Review Board Violations of the Policy Guidelines as set forth in the ARB Manual.

2. Grounds Yards and undeveloped lots not in natural state and common and limited common must be maintained in an eye-pleasing condition.

A. Pick up palm fronds, limbs, litter and all other debris. B. Mow grass on undeveloped lots as needed unless in their natural state. C. Control weeds by manual and/or chemical means. D. Replace pine straw or mulch as needed when used as landscaping aid.

3. Buildings A. Buildings in need of painting or pressure washing i.e., faded, peeling mold or mildew. B. Torn or missing screens. C. Rotted or missing siding. D. Visible damage-broken windows, missing shingles or shakes. E. Garbage receptacles visible for the street. F. Clothes lines visible from the street. G. Clothing, towels, swimsuits hanging from porches in any association.

The condition listed above, under Grounds and Buildings are not all inclusive. If there are other conditions that affect the aesthetics of the resort, they will be added to the above guidelines and treated as violations.

4. Traffic Any and all violations of speed limits and traffic signs by any motorized vehicle or bicycle.

5. Vehicle Violations A Overnight parking of trailers, campers, R V' s and trucks (longer than pickups) parked in restricted areas, i.e., common and limited common grounds, undeveloped lots, streets and property belonging to other owners.

B. Overnight parking of boats not conforming with established rules.

C. Motorcycles, mopeds, motorbikes, ATV'[s (all terrain vehicles) and similar motorized vehicles are not permitted, unless the Property Owners' Association has issued a special permit.

D. Wrecked, junked or vehicles being repaired are not permitted.

E. All vehicles are subject to furnishing proof of registration and insurance. If one or neither can be provided, the vehicle will be removed from the property at the owner's expense.

6. Firearms and Fireworks The Town ofEdisto Beach has ordinances prohibiting the discharge of firearms for any reason, as well as the discharge or ignition or fireworks.

7. Disturbing the Peace The Town of Edisto Beach has a noise ordinance and the Resort's Covenants and. Restrictions prohibit any owner or renter, or their family or friends, employees, agents or visitors from making or permitting any disturbing noises at any time, that will interfere with the rights, comfort or convenience of other owners and guests.

8. Pets Pets will not be permitted to interfere with the rights, comfort or convenience of other owners and guests. Dogs are required to be on a leash at all times. Lot and homeowners may have pets unleashed within their property boundaries. No pet owner shall permit it to relieve itself on any other owner's property. In the event that said situation does occur, the pet's owner is responsible for cleanup. Any attempt to domesticate wild or stray animals by any method will be considered a violation.

9. Use ofResidence as a Place of Business The owner(s) would be considered in violation if any ofthe circumstances listed below can be substantiated. A Employees reporting on a regular basis. B. Excessive delivery trucks , C. Accumulation of materials and supplies visible to others. D. Excessive number of vehicles visiting the site. E. Any type of external advertising. F. Any other obvious indication that a business is being operated on the premises.

All Other Violations The violation of all other rules and regulations not specifically addressed above, such as those in regards to: The beach cabana, the pool, littering, burning, charcoal grilling (where prohibited), and the feeding or disturbing or alligators.

VIOLATIONS OF THE ARCHITECTURAL REVIEW BOARD MANUAL POLICY GUIDELINES

PENALTIES TO BE ASSESSED

The following penalty guidelines are to assist the ARB in consistent enforcement of the policies. The following are keyed to the manual dated November 17, 1999. Paragraph number shown as a number only indicate the first, second, etc. paragraph of a page. If a period follows the paragraph number, the reference is to a numbered paragraph. When the ARB imposed fine reaches $1,000 a lien will automatically be placed on the property in question.

Description and Penalty COMMERCE CONSTRUCTION WITHOUI' ARB APPROVAL

Stop construction until ARB approval is received. If construction continues after notice to stop is received. $50.00 per day penalty against the Contractor until construction is stopped. If penalty exceeds 50% of security deposit, the penalty must be paid in full before construction can be reswned.

CONSTRUCTION NOT SUBSTANTIALLY COMPLETE WITillN NINE MONTHS AFTER RECEIVING ARB BUILDING PERMIT.

The ARB may approve an extension for an additional three months. Notification of impending expiration will be sent to the Contractor with a copy to the Owner. If an extension request is not received in the Property Management Office within seven (7) days after the date of the _letter, a

minimum of 10% of the contractor's deposit will be deducted. If construction is not completed within three (3) months after the renewal approval and a second renewal is requested, the contractor's deposit will be forfeited and a second deposit will be required. If at the end of the 12 months, construction is still not complete, a fine of $100 per day will be put into place until construction is completed and final approval is granted.

PENALTY: Request variance or remove within one week of violation. If approval is rejected, remove within one week of notice to do so. $50.00 per week or part of the week until removed.

PENALTY: Stop construction, except to remove structure or materials in violation. FIRST OFFENSE: Warning. SUBSEQUENT OFFENSE: To be determined by extent ofviolation.

8 8 7 OCCUPANCY WITHOUT PROPER SEWER CONNECTION

PENALTY: Discontinue occupancy immediately. FIRST OFFENSE: Warning. After 1 day, or subsequent reoccupancy; $25.00 per day fine.

9 8 8 INSTALLATION OF EXTERIOR LIGIITING WITHOUT ARB APPROVAL

PENALTY: Remove or request approval. Remove within 1 week, if not approve. FffiST OFFENSE: Warning; $10.00 per day after the first week. SUBSEQUENT OFFENSES: $10.00 per occurrence, plus $10.00 per week after 1 week.

10 8 9 DRILLING ETC. EQUIPMENT OR OPERATIONS

PENALTY: Remove immediately. Warning to remove within 1 week $500.00 after the first week and $100.00 per week from notices to remove until removal.

11 8 10 WA1ER WELL FOR HUMAN CONSUMPTION

PENALTY: Discontinue piping and use for human consumption immediately.

12 8 11 EXTERNAL ATENNA, RECEIVER DISH. ETC. (UNLESS APPROVED).

PENALTY: Remove within 1 week. FIRST OFFENSE: Warning $10.00 per week after 1 week until removed. SUBSEQUENT OFFENSES: $20.00 plus $20.00 per week until removed.

13 9 12 UNAPPROVED PLACEMENT OF CLOTHES LINES. GARBAGE RECEPTACLES. FUEL TANKS OR OTHER STORAGE RECEPTACLES.

PENALTY: Remove, or obtain ARB approval for location and/or screening. WARNING: $10.00 per week after 1 week if not removed or approval requested. If approval is not given, $10.00 per week if not removed within 1 week.

14 9 13 DESTROYED BUILDING NOT REMOVED AND LOT NOT RESTORED WITHIN 6 MONTHS

PENALTY: Warning After 1 month $1 00.00 per week. Extensions of 1 month periods may be granted for insurance settlement or other valid reasons.

15 9 14 ELEVATION CHANGE CAUSING DRAINAGE ONTO SURROUNDING LOT

PENALTY: Warning. Failure to correct after 1 month; $50.00 per week.

16 9 15 UNAPPROVED MAIL RECEPTACLE

PENALTY: Warning. Ifnot removed, replaced or relocated within 2 weeks, $10.00 per week.

PENALTY: Warning. $25.00 per day until you notify the Property Management Office that you are in compliance. A site inspection will be made.

VIOLATION FINE SCHEDULE

This schedule establishes fines for violations of most of the established rules and regulations pertaining to the Ocean Ridge Resort. The fines are subject to change, without notice, at the discretion of the Ocean Ridge Property Owners Association Board of Directors.

The authority for enforcing the covenants may be found in the Declaration of Rights. Restrictions, Affrrmative Obligations. and Conditions Applicable to all Property Owners in the Oristo Subdivision, Article III, Article ill Additional Restrictions, and Articles IV and V.

Fines will be initiated and collected by Ocean Ridge Property Owners Association at the direction of the Board of Directors and the Architectural Review Board Through whatever means necessary, including placing a lien on property.

GOLF CART RULES AND REGULATIONS AND FINES

The following are tlte rules and regulations concerning golf carts on the resort. These rules and regulations are set and strictly enforced by the :rv,t:aster Property Owners Association. We as the Management Company have to enforce these rules and regulations set forth by the Master Property Owner's Association Board of Directors.

1. Operators of golf carts must have a valid Driver's License. This is South Carolina Law.

2. All golf carts must have a South Carolina State Permit sticker.

3. All golf cart owners must furnish the Property Management Office proof of insurance and a valid driver's license.

4. All golf carts must have a current Resort Golf Sticker.

5. Operators of a golf cart must follow all So~th Carolina Laws regarding golf carts.

6. Timeshare and Rental guest are not allowed to register or bring golf carts on the Resort.

7. You must be a full time (year around) property owner in Ocean Ridge Resort to register a golf cart with Property Management.

To operate a golf cart within the Resort the same rules and regulations apply within the Resort that apply on the highway.

Fines for golf carts operated by unlicensed drivers and non-compliance of rules and regulations are as follows:

a.) First Offense: Owner fined $100.00 b.) Second Offense: Owner fined $250.00 and the Ocean Ridge sticker is suspended for (1) year. c.) Third Offense: Golf cart owner will be fined $500.00 if golf sticker has been suspended or

reinstated.

The first time a cart is stopped by security or any employee of Ocean Ridge Resort for a non-licensed driver, the cart will be parked and the parents will be called to pick up the cart and the driver. The second time the police will be called.

As stated above these regulations have been set by the Master Property Q,wers' Association Board of Directors and are· enforced by the Association and the Property Management Office. We do have Board Members that live on site and they will stop a golf cart if they are in violations of any of the above regulations. Security will also stop anyone in violation of the regulations and ask the person involved to park the cart.
