RES.#B98/12 - HEART LAKE CONSERVATION AREADesign/Build Services for the Construction of a Workshop and Administrative Centre, Contract RSD12-94. Award of Contract RSD12-94 for the supply and installation of a replacement storage, workshop and administrative facility at Heart Lake Conservation Area, City of Brampton.

THAT Contract RSD12-94 to supply all labour, equipment and materials necessary to design and construct a replacement storage, workshop and administrative facility at Heart Lake Conservation Area, be awarded to Ameresco Canada Inc. for a total cost not to exceed $826,908.25, plus a contingency amount of 20% to be expended as authorized by Toronto and Region Conservation Authority (TRCA) staff, plus HST, it being the lowest bid meeting TRCA staff cost estimates and specifications;

THAT award of tender be subject to terms and conditions satisfactory to TRCA staff and legal advisers (if necessary), including but not limited to determination of the final contract cost not to exceed the approved amount;

THAT should staff be unable to negotiate a mutually acceptable tender agreement with the above-mentioned contractor, staff be authorized to enter into contract negotiations with other contractors, beginning with the next lowest bidder meeting TRCA specifications;

AND FURTHER THAT authorized officials be directed to take the necessary action to implement the contract including the signing and execution of documents.

CARRIEDBACKGROUNDThe Heart Lake Conservation Area (HLCA) is located at 10818 Heart Lake Road in the City of Brampton, approximately 3 km north of Regional Road 7. As part of the Heart Lake Conservation Area Master Plan, the development of an administration/workshop building was proposed to replace the aging existing workshop structure that is no longer sufficient to support the Heart Lake Conservation Area daily operations. The proposed new building will act as an administrative and operations centre to coordinate the Heart Lake Conservation Area Master Plan vision to restore valuable ecological functions of the site, while guiding the current and potential future public uses of the area.

In general, the scope of work consists of supplying all engineering services, labour, equipment and materials necessary for the detailed design and installation of a pre-engineered building system, including all approvals and permits required for the scope of work. All construction shall be in accordance with the Ontario Building Code and the City of Brampton Standards and Specifications. An important goal of TRCA is to develop an environmentally responsible building on the site that can serve as a model in the region and elsewhere. TRCA’s policy is to implement financially feasible, technologically sound strategies to conserve energy and reduce TRCA's ecological footprint. Technologies such as geothermal, radiant floor heating and recycled rainwater systems will be explored, along with green building materials where feasible. TRCA staff will guide the design process to meet The Living City objectives and to design all new buildings with emphasis on sustainability and green building design guidelines.

The purpose of this design/build project is to identify the most qualified design/build team, through a structured, open and competitive process, to work with TRCA, its staff and external consultants. TRCA requires the services of a qualified contractor to design and construct a replacement storage, workshop and administrative facility at Heart Lake Conservation Area. Efficiencies will be made to ensure the building's ecological footprint is sized accordingly to the needs of TRCA staff, municipal partners and park users.

RATIONALERequest for Pre-Qualification (RFPQ) for general contractors to perform the design build was advertised on-line with Biddingo.com on July 2, 2012 and closed on July 11, 2012. The work includes, but is not necessarily limited to, the supply of labour, material, supervision and equipment required to complete the scope of work for the project. The general contractor will coordinate all construction activities in support of the new building construction.

Interested general contractors in pre-qualifying were advised that the criteria for evaluation will include the following in order to receive a tender package:

CCDC 11 (Canadian Construction Documents Committee) requirements and completion;

past experience in the construction of buildings of similar size;

past experience with similar buildings;

experience of suggested personnel for this project;

project record over the past five years;

ability to meet construction schedule milestones;

ability to coordinate work by others;

experience dealing with projects with construction budgets of $750,000.00 to

$1,000,000.00;references focusing on firms history of project control and experience.

All interested general contractors are required to provide a bid bond of 10% of the contract price at the time of the tender submission. Pre-qualification information was submitted by the following 11 firms:

Ameresco Canada Inc.;

Aveiro Constructors Limited;

Dineen Construction Corporation;

The pre-qualifying documents were reviewed by the selection committee made up of TRCA staff whose evaluation was based on the previously defined criteria and reference checks for past completed projects.

Based on the evaluation process, Request for Proposal documents were made available to the following 10 general contractors:

Proposals closed on July 26, 2012 at 12:00pm and were opened by the Tender Opening Committee on July 27, 2012 with the following results:

Having previously pre-qualified the bidders ability to perform the specified scope of work for the project, TRCA staff evaluated the proposals on the bid prices and the ability to complete the project as specified in the design/build documents. Restoration Services staff (James Dickie and Aaron D'Souza) reviewed the bids against its own cost estimates and has determined that the bids are of reasonable value. Post Farms Structures Inc. was subsequently disqualified from the bidding process for providing an incomplete bid submission. Based on the evaluation of the bids received, staff recommends that Contract RSD12-94 be awarded to Ameresco Canada Inc. for the total cost not to exceed $826,908.25 plus a 20% contingency, plus HST, as they are the lowest bidder that meets TRCA staff specifications.

FINANCIAL DETAILSAt Authority Meeting #10/11, held on November 25, 2011, Resolution #A245/11 was approved, in part, as follows:

...THAT the Executive Committee be designated the powers of the Authority during the month of August, 2012, as defined in Section 2.10 of the Rules of Conduct;...

The value of the contract normally requires Authority approval, but due to construction timing, TRCA staff is requesting the approval of the Executive Committee to award the contract in the absence of an Authority meeting in August, as per above-noted Resolution #A245/11.

Funds are available in the Heart Lake Conservation Area Master Plan Implementation budget within account 440-49 from the Region of Peel.

THAT Contract RSD12-77 for the implementation of erosion control and slope stabilization works at the rear of Nos. 30 – 48 Royal Rouge Trail in the City of Toronto be awarded to TBG Landscape Inc. at a base cost not to exceed $422,807.11, plus an optional $95,000.00 for final landscaping and restoration, plus a 30% contingency to be expended as authorized by Toronto and Region Conservation Authority (TRCA) officials, plus HST, it being the lowest bid meeting TRCA staff cost estimates and specifications;

AND FURTHER THAT authorized officials be directed to take the necessary action to implement the contract including the signing and execution of documents.

CARRIEDBACKGROUNDTRCA is proposing to carry out remedial works for a section of valley slope along the Rouge Valley corridor behind the properties at Nos. 30 – 48 Royal Rouge Trail, where slope instability and ongoing erosion are creating a risk to public safety and property.

In 2007, TRCA retained Terraprobe Inc. to conduct a slope stability analysis and erosion risk assessment for the aforementioned properties. The results of the Terraprobe report indicated that there was a significant risk to the properties located within the study area over the long-term and recommended that remedial works be undertaken. Based on the results of the geotechnical and slope stability assessment, the Royal Rouge Trail site was identified by staff as a priority area for remedial works, and subsequently approved to commence as a remedial works project under the Class Environmental Assessment for Remedial Flood and Erosion Control Projects (Class EA) process at Authority Meeting #1/09, held on February 27, 2009 under Resolution #A3/09.

In February 2009, TRCA initiated the Class EA to determine the preferred solution for the affected area, and retained Terraprobe Inc. to provide technical support during the Class EA including the development of detailed design drawings of the preferred solution. Through the Class EA process, extensive Community Liaison Committee (CLC) meetings and input from Terraprobe Inc., the preferred solution was determined to be slope re-grading and stabilization with intensive plantings for Nos. 30, 32, 34, 36, 38 and 40 Royal Rouge Trail, and a Mechanically Stabilized Earth (MSE) Wall for Nos. 42, 44, 46 and 48 Royal Rouge Trail, where re-grading was not possible due to the existing slope geometry and presence of existing structures such as in-ground pools.

The MSE wall, as designed by Terraprobe Inc., will be constructed using a proprietary product called SierraScape® manufactured by Nilex Civil Environmental Group. SierraScape® is a retaining wall system constructed of wire baskets connected to geogrid reinforcement to contain and support engineered fill and vegetation. The baskets are installed and connected to one another individually, working well in situations where the minimizing changes to the existing slope geometry are required or desirable.

Tender RSD12-77 provides for a licensed contractor experienced with the SierraScape® system to complete the installation of the MSE wall and slope re-grading.

RATIONALEA Request for Pre-Qualification (RFPQ) for general contractors for the slope re-grading and installation of the MSE wall was advertised on-line with Biddingo.com on June 7, 2012 and closed on June 15, 2012. The contract generally includes, but is not necessarily limited to, the supply of labour, material, supervision and equipment required to complete the scope of work for the project. The contract includes basic site restoration such as the removal of temporary access, topsoiling and installation of sod, however it excludes all final landscaping, such as the re-instatement of patios, gardens and plantings.

Interested general contractors in pre-qualifying were advised that in order to receive a tender package, potential bidders would need to provide the following:

completed CCDC 11 - Contractor's Qualification Statement (Canadian Construction

Documents Committee);past experience in the construction of retaining walls of similar size;

past experience with similar projects;

experience of suggested personnel for this project;

project record over the past five years;

ability to meet construction schedule milestones;

Dynex Construction;

JMJ Construction;

Metric Contracting;

Ontario Construction; and

TBG Landscape;

On July 6, 2012, TRCA issued an Invitation to Tender to the pre-qualified firms and invited them to a mandatory site meeting on July 12, 2012. All the invited firms with the exception of JMJ Construction attended the mandatory site meeting.

Tenders closed on July 26, 2012 at 12:00pm and were opened by the Tender Opening Committee on July 27, 2012 with the following results:

Having previously pre-qualified the bidders qualifications, TRCA staff evaluated the tenders on the bid prices and the ability to complete the project as specified in the tender documents.

TRCA staff and Terraprobe estimated the contract value to be approximately $500,000 to $800,000.

TRCA staff acknowledge the range in bids and offer the following explanation based on experience tendering contracts of a similar nature. The bid by Metric Contracting Services Corp. (Metric) is higher than the estimated value as expected, given that Metric is typically involved in large, multi-million dollar contracts that carry higher overhead costs and a greater profit margin. The low bid by TBG Landscape Inc. (TBG) is slightly lower than estimated, however this may be attributed to TBG's extensive experience installing Sierrascape®, which may result in a shorter duration to complete the work, reducing staff and equipment costs.The bid by Cedar Springs Landscape Group Ltd. is within the estimated range.

Based on evaluation of the bids received, receipt of recommendation from Nilex Civil Environmental Group, and the result of subsequent discussions with TBG to ensure that the scope of work is completely understood, TRCA staff recommend that Contract RSD12-77 be awarded to TBG Landscape Inc. at a total cost not to exceed $422,807.11, plus an optional $95,000.00 to complete final landscaping and restoration, plus a 30% contingency, plus HST, it being the lowest bid meeting TRCA’s specifications. As previously noted the current contract does not include final landscaping and restoration, however given TBG's extensive landscaping experience, the option to add this item to the existing contract may result in additional cost savings to the project through the elimination of a separate tendering process and mobilization/demobilization fees. It is noted that the option to add the landscaping component to the contract would be determined based on the satisfactory performance of the contractor at an appropriate point during construction. A 30% contingency is also recommended should additional excavation and materials be required to install the bottom course of the MSE wall on firm subgrade, which can only be determined during construction when the subsurface soils are exposed.

Under the Clean Water Act, 2006, water budgets are completed in a staged approach beginning with a conceptual water budget report, followed by more detailed assessments (i.e., Tier 1, 2 and 3), where required. AquaResource Inc., a division of Matrix Solutions Inc., has worked with both Credit Valley Conservation and MNR for more than five years to develop numerical surface water and groundwater models for the Credit Valley jurisdiction, including the Orangeville area. The final output of this work, a Tier 3 Water Budget, was approved by MNR in 2011. To date, this is the only Tier 3 Water Budget that has received final provincial approval.

MNR has contracted with TRCA to complete additional analysis based on the approved Orangeville Tier 3 Water Budget numerical models and develop updated Guidance Modules for other source protection authorities across the province. Specifically, the province requires:

testing of climate change data sets;

ranking of significant drinking water threats identified through the existing Tier 3 Water

Budget work;assessment of the effectiveness of possible risk management measures; and

development of guidance modules and training materials.

TRCA has been requested to oversee this work because of our ongoing work with the province on the Risk Management Measures Catalogue and climate change adaptation training materials. In addition, TRCA is the lead conservation authority for the CTC Source Protection Region, which includes the Orangeville water supplies.

AquaResource Inc. has unique qualifications and experience with respect to this project. Over the past five years, they have:

completed all of the water budget numerical modelling to date for the Orangeville area;

been the lead consultant in the preparation of the "Guide for Assessment of Hydrologic

Effects of Climate Change in Ontario";prepared the "Water Budget and Water Quantity Risk Assessment Guide" for MOE and

MNR; worked with TRCA in the development of Climate Change Adaptation training materials;

anddeveloped the geodatabase used to store water budget information for the province.

RATIONALEThe Tier 3 Water Budget developed by Matrix Solutions will be used extensively in this assessment. TRCA staff require a consultant to utilize the hydrologic and hydrogeologic framework developed through the Orangeville Tier 3 Water Budget project as a basis for assessing a variety of future climate scenarios and risk management measures. Because of the knowledge and expertise gained by Matrix Solutions through the development and calibration of the Orangeville models, they are uniquely qualified to undertake this additional modelling work. The cost of retaining another firm to complete this work would be much higher and the process would take significantly longer, since there would be a substantial learning curve for another consultant to understand the hydrologic and hydrogeologic model construction and numerical model parameter estimation process as well as the climate change requirements. Staff therefore recommend award of the contract on a sole source basis as per Section 1.14.5 of TRCA's Purchasing Policy as follows:

BACKGROUNDThe Canadian Arsenal Lands property is located at 1352 Lakeshore Road East. The property has been retained as a local landmark and a reminder of the significance of this site and its contribution to both World War I and World War II. In World War I, Canada's first aerodrome and flying school was established on the Arsenal Lands by the Curtis Aeroplane Company. Between 1917 and 1919, the area was used as a training centre for the Cadet Wing of the Royal Flying Corps. In World War II, Small Arms Limited occupied the Arsenal Lands and operated the Canadian Small Arms School, a rifle range and an ammunition plant. More recently, Hydro One and the Police Cadet Training School occupied this administrative building for numerous years, and the semi-underground rifle range is still used by private gun clubs. Now primarily a park and open space, the Arsenal Lands is associated with both the natural environment and with significant historical developments on these lands. The warehouse/administrative building and water tower are the last visible remnants of the former ammunitions plant that occupied this site.

The contractor will coordinate all construction activities which comprise of the replacement of an existing flat roof system, including felt paper, gravel stop/curb, fascia, metal flashings and the removal off-site of the existing flat roof down to the wood decking, to repair 21 broken glass panels on existing skylights. The roof repairs will closely match the existing aesthetics of the building to meet the heritage building provisions. With the receipt of all necessary approvals and funding, the main goal for the roof rehabilitation is to stop further deterioration of this historic building.

RATIONALERequest for Pre-Qualification (RFPQ) for contractors was advertised on-line with Biddingo.com on July 2, 2012 and closed on July 11, 2012. The work includes, but is not necessarily limited to, the supply of labour, material, supervision and equipment required to complete the scope of work for the project.

Interested general contractors in pre-qualifying were advised that the criteria for evaluation will include the following in order to receive a tender package:

CCDC 11 (Canadian Construction Documents Committee) requirements and completion;

past experience in the construction of buildings of similar size;

past experience with similar buildings;

experience of suggested personnel for this project;

project record over the past five years;

ability to meet construction schedule milestones;

ability to coordinate work by others;

experience dealing with designated hazardous substances;

experience dealing with projects with construction budgets of $100,000.00 to $200,000.00;

references focusing on firms history of project control and experience.

All interested general contractors are required to submit a bid bond of 10% of the contract price at the time of the tender submission. Pre-qualification information was submitted by the following 12 firms:

CARRIEDBACKGROUNDIn 1989, the Durham District School Board (DDSB) requested permission to construct an outdoor education centre facility on TRCA-owned lands for the purpose of providing outdoor education programs to DDSB students. The DDSB indicated that their objective was to provide a facility to accommodate both residential and day programs; however, given the economic situation of the day, the Board wished to proceed with a portable, day-use facility only within the first five year term of the lease. TRCA considered this use compatible with the Claremont Conservation Area (where TRCA owns and operates its own residential education field centre) and in July 1989, directed staff to prepare the necessary agreement document to allow for the construction of a portable structure by the School Board.

At the request of the School Board, in 1994, 1999 and 2005 TRCA approved the renewal of the lease, for a further term of five years each, based on the continued use and operation by the Board of their nonpermanent portable structure. The last term ended on August 31, 2009.

RATIONALEStaff from TRCA and DDSB formally meet on an regular basis to review the operation and renegotiate the licence agreement. The School Board advised that they wish to renew the licence agreement for a further five years; however, their operation would be dependant upon the replacement of the current program equipment storage facility and two bridges over Mitchell Creek.

The current program equipment storage facility is an old building remaining from when the Claremont Conservation Area was operating in the 1970s and is no longer suitable for use due to issues with mould and the need for expensive structural repairs. The DDSB is proposing to replace this building with a nonpermanent, portable classroom that can be better maintained and will meet the needs of visiting students. Replacement of this structure is proposed for late August 2012. TRCA Planning and Development staff has reviewed this request and has no objection to the construction of the new equipment storage facility subject to the establishment of sediment fencing/tree hoarding.

The replacement of the two bridges consists of removal of four temporary bridges that do not meet current TRCA standards with two permanent bridges that meet all regulatory and safety standards. TRCA Planning and Ecology staff have reviewed the engineering, site plans and restoration plans and have requested additional information from the DDSB. Replacement of these bridges is proposed to take place in 2013, pending final plan review approval from TRCA and MNR staff. DDSB will be responsible for all costs associated with the construction and maintenance of these bridges for the duration of the lease.

The DDSB facility is very well maintained and has been subject to regular improvements both inside and outside. The working relationship with DDSB over the last 22 years has also been excellent in both quality of programming and personnel. The centre is well attended by DDSB students (just over 4,400 students attended in 2011) which greatly enhances the delivery of conservation education within the region. In addition, TRCA's working relationship with the DDSB extends beyond this licence agreement as the DDSB is the primary user of TRCA's Claremont Field Centre which provides students with a residential education experience. TRCA staff recommend that the lease be renewed.

FINANCIAL DETAILSThe lease cost for the 2012 calendar year is $12,200 plus HST and a 15% administrative service charge. Provision to increase the basic rent each year based on the Consumer Price Index of the preceding year is incorporated.

Additionally, DDSB will continue to pay for shared services related to road maintenance with Claremont Conservation Area and any joint development/maintenance projects of mutual benefit to TRCA and the DDSB.
