The minutes of 31st meeting of State Expert Appraisal

Committee held on 24/10/2009 were circulated to all the members vide letter no.

36173-81 dated 5/11/2009.

No observation has been received from any member.

31.1 Re-consideration of Old Proposals for Environmental Clearance.

31.1.1 71 Application for environmental clearance for residential colony namely “AKME Polis” to be developed by M/s AKME Projects Ltd. at Vill. Jandiali, Ludhiana-Chandigarh Road, Distt. Ludhiana.

The Committee decided that the proposed sited be visited by SEAC to visualize the status of industries falling in the radius of 100 m / 500 m from the periphery of proposed project. Therefore, the case was deferred. Accordingly, the site is likely to be visited by Committee on 28/11/09.

31.1.2 137 Application for grant of environmental clearance for development of M/s Bharti Realty Pvt. Ltd., Plot No. 47, Udyog Vihar, Phase-IV, Gurgaon at Ludhiana.

The Committee decided that the above said data be matched with the ambient air quality monitoring data of Punjab Pollution Control Board for the same period. Accordingly, data has been obtained from PPCB on 13/11/2009 and further action to process the case is being taken.

31.1.3 12 Application for grant of Environmental clearance for "PDA City" a Residential Colony Project to be developed by M/s Omaxe Ltd. at Vill. Baran, Sirhind Road, Distt. Patiala.

The promoter has been requested vide no. 37515 dated 17/11/2009 to submit revised 500 m radius map and simultaneously, PPCB has been requested vide no. 37514 dated 17/11/2009 to submit report recommendation in view of some orders passed by Hon'ble Punjab & Haryana High Court.

31.1.4 55 Application for grant of environmental clearance of M/s Action Batteries (Unit-II), D-79, Focal Point (Extn.), Jalandhar for production of Lead Ingot @ 10 MT/day.

The industry was requested vide letter no. 37040 dated 12/11/2009 to submit the desired details / data w.r.t. observations of the Committee.

The project proponent was requested vide letter no. 37038 dated 12/11/2009 to submit the desired details / data w.r.t. observations of the Committee.

31.2 Consideration of New Proposals for Environmental Clearance.

31.2.1 165 Application for grant of environmental clearance for expansion of its existing unit by M/s Sharu Steels Pvt. Ltd. at Plot No. B-48, Focal Point, Phase-VII, Ludhiana.

33.2.1 172 Application for grant of environmental clearance for

its Township Project namely “Golf Links” Sector-114, Mohali by M/s Ansal Properties & Infrastructure Ltd.

The project proponent M/s Ansal Properties and

Infrastructure Ltd. has applied for environmental clearance for establishment of a

Township Project namely ‘Golf Links’ at Sector-114, Mohali. The project

proponent have earlier obtained environmental clearance from MoEF vide no. 21-

510/2007-IA.III dated 29/2/2008 for 168.09 acres. Now, the project proponent

has submitted revised application for an area of 227.30 acres. The project is

covered under screening category 8 (a) of the schedule attached to EIA

notification dated 14/9/2006.

As per application submitted by the project proponent, the

details of the proposed project are as under:

1. The total plot area of the proposed project is 227.30 acres (9,19,850.46

sqm).

2. The expected cost of the project is Rs.431 crore.

3. The total water required for the project is 2580 Kl/day and the fresh water

required is 2064 Kl/day, which will be met through tubewells.

4. The project proponent proposed to install STP and the treated sewage will

be used for flushing and horticulture purposes. The industry proposes to

install STP of capacity 250 KLD, 3 x 500 KLD and 314 KLD in phases.

5. Solid waste @ 7758 Kg/day (approx.) will be generated from the proposed

project.

6. The project will require approx. 24 MW of electricity and will be supplied by

the PSEB authorities. The project proponent will provide D.G. sets for

power back up in case of electricity failure, wherever it is required, which

will provided on acoustic enclosure.

7. As per details of surrounding features within 500 m mentioned by the

project proponent, there is an industrial unit namely Swaraj Combine

Division exists at a distance of 70 m.

8. The other details of the project have been given in the Form 1 & 1-A

submitted by the promoter (Copy enclosed as Annexure - I).

33.2.2 149 Application for environmental clearance for Residential Group Housing Project namely “Palm Garden” to be developed at Vill. Sahnewal Khurd, Bilga Mazara, Distt. Ludhiana by M/s Malhotra Land Developers & Colonizers Pvt. Ltd.

The project proponent M/s Malhotra Land Developers &

Colonizers Pvt. Ltd. has applied for grant of environmental clearance for

establishment of a Residential Group Housing project namely “Palm Garden” at

Vill. Sahnewal Khurd, Bilga Mazara, Distt. Ludhiana.

The total plot area of the proposed project is 165.8 acres.

The expected cost of the project is Rs.255.50 crore. The project includes 998

residential plots, 2 group housing and 2 no. multiplexes. The total fresh water

requirement for the project is 14.198 MLD. For this purpose, 3 no. tubewells will

be installed. The wastewater @ 11,358.4 Kl/day will be generated and will be

treated in sewage treatment plant. The treated wastewater will meet prescribed

norms before it discharge to nallah or reused in colony for irrigation / gardening.

One sewage treatment plant with suitable capacity & design shall be constructed

in three phases. Solid waste @ 215.8 ton/month will be generated from the

proposed project and 7194 Kg/day sludge will be generated. It will be reused as

soil conditioner in horticulture in side the project site. The project will require

approx. 6100 KVA of electricity and will be supplied by the PSEB authorities. The

project proponent has proposed to provide D.G. sets for power back up in case of

electricity failure, wherever it is required, The project will cover under screening

category 8 (a) of the schedule attached to EIA notification dated 14/9/2006.

The other details of the project have been given in the Form

1 & 1-A submitted by the promoter

The incompletions were conveyed to the promoter vide letter

no. 33974 dated 14/10/2009. Now the project proponent vide letter dated

22/10/2009 has submitted the reply / documents with regard to incompletions

conveyed to him vide letter no. 33974 dated 14/10/2009.

33.2.3 137 Application for grant of environmental clearance

for development of Retail / Commercial complex at Ludhiana by M/s Bharti Realty Pvt. Ltd.

The project proponent has applied for environmental

clearance for establishment of a Retail / Commercial Project at Ludhiana by M/s

Bharti Realty Pvt. Ltd. The project will cover under screening category 8 (a) of the

schedule attached to EIA notification dated 14/9/2006.

The case was considered by the Committee in its 31st

meeting held on 24/10/2009 and it observed that the conc. of SPM varies from

220 µg/m3 to 274 µg/m3 (as per ambient air sampling carried out in the month of

March, 2009) which is more than the permissible limit of 200 µg/m3, prescribed in

the National Ambient Air Quality Standards by Central Pollution Control Board.

The Committee decided that the above said data should be matched with the

ambient air quality monitoring data of Punjab Pollution Control Board for the same

period.

33.2.4 47 Application for grant of environmental clearance

for Multiplex & Shopping Mall namely “Omaxe Mall” to be developed by M/s Omaxe Ltd. at G.T. Road, Jalandhar Bye-pass, Ludhiana.

M/s Omaxe Ltd. has applied for grant of environmental

clearance for Multiplex & Shopping Mall namely “Omaxe Mall” to be developed at

G.T. Road, Jalandhar Bye-pass, Ludhiana.

The case was placed before the State Expert Appraisal

Committee for consideration in its 17th meeting held on 17/1/2009. During

meeting, Committee noted that the project proponent had continued with the

construction, although he was asked to stop the construction work, to submit an

affidavit with an undertaking not to execute works without obtaining

environmental clearance from the Govt. of India, Ministry of Environment &

Forests vide letter no. 21-622/2007-IA.III dated 14/1/2008. The project

proponent had submitted an affidavit to Ministry of Environment & Forests that it

had stopped the construction work of its project at Jalandhar Bye-pass, G.T.

Road, Ludhiana. Further, the project proponent had submitted its application to

SEIAA, Punjab for grant of environmental clearance on 7/4/2008, whereas, a

parallel proposal of the project proponent for grant of environmental clearance

was under consideration in the Ministry of Environment & Forests at that time and

the project proponent had concealed this information from SEIAA. As such, it was

decided by the Committee to recommend the project to SEIAA for refusal of

environmental clearance due to the following reasons:-

i) The project proponent had concealed the information from SEIAA, Punjab

that its application was also under process with the Ministry of

Environment & Forests, Govt. of India, when it applied to SEIAA, Punjab

for grant of environmental clearance on 7/4/2008.

ii) The conc. of SPM and RSPM at site as per the air quality monitoring data is

beyond the prescribed standards.

iii) The project proponent had failed to stop construction at the project site,

although the project proponent had submitted an affidavit with the Ministry

of Environment & Forests, Govt. of India to stop the construction work.

iv) As per the decision taken in the 10th meeting of SEAC held on 9/8/2008,

the promoter was requested vide letter no. 33640 dated 5/9/2008 to

submit revised layout plan with at least 2 no. additional recharge pits for

rainwater harvesting. However, as per the revised layout plan submitted by

the project proponent vide its letter dated 13/10/2008, the number of

rainwater harvesting pits is still the same i.e. 5 no. pits. This indicated the

casual approach of the promoter, while submitting the reply to the

observations of SEAC.

Subsequently, the case was considered by State Environment

Impact Assessment Authority (SEIAA) in its 15th meeting held on 5/3/2009,

wherein the representative of the company submitted that the company has

earlier submitted application to the MOEF for grant of environmental clearance

which was considered by EAC, however, as soon as the State Authority was

constituted the company submitted a fresh application to the State authority. The

observations made by the EAC were considered by the company while submitting

the application to the state authority but the failure of the company to intimate

about the observations of EAC was a mistake on their part for which he tended an

unconditional apology on behalf of the company. He further submitted that the

public hearing of the project was also conducted by PPCB, wherein, the

participants of the public hearing have not raised any objection for establishment

of the project. After detailed deliberation on the matter the authority requested

the representative of the company to submit a comprehensive detailed written

justification in the matter for its consideration.

Now, the project proponent vide letter dated 14/10/2009 had

submitted the reply and the same has been considered by the Authority in its 22nd

meeting held on 19/10/2009, wherein the Authority decided that the case be

forwarded to State Expert Appraisal Committee to reexamine in the matter in view

of the representation submitted by the project proponent.

Accordingly, the case is placed before the Committee for

reconsideration.

33.2.5 48 Application for grant of environmental clearance for Multiplex & Shopping Mall namely “Omaxe Terminal” to be developed by M/s Omaxe Ltd. at Airport Road, Amritsar.

M/s Omaxe Ltd. has applied for grant of environmental

clearance for Multiplex & Shopping Mall namely “Omaxe Terminal” to be

developed at Airport Road, Amritsar.

The case was considered in the 17th meeting of State Expert

Appraisal Committee held on 3/1/2009.

During meeting, the members noted with concern that the

project proponent had submitted its application to SEIAA, Punjab for grant of

environmental clearance on 7/4/2008, whereas, a parallel proposal of the project

proponent for grant of environmental clearance was under consideration in the

Ministry of Environment & Forests at that time and the project proponent had

concealed this information from SEIAA.

Thus, it was decided to recommend the project to SEIAA for

refusal of environmental clearance due to the following reasons:-

i) The project proponent had concealed the information from SEIAA, Punjab

that its application was also under process with the Ministry of Environment

& Forests, Govt. of India, when it applied to SEIAA, Punjab for grant of

environmental clearance on 7/4/2008.

ii) The conc. of SPM and RSPM at site as per the air quality monitoring data is

beyond the prescribed standards.

Subsequently, the case was considered by State Environment

Impact Assessment Authority (SEIAA) in its 15th meeting held on 5/3/2009,

wherein the representative of the company submitted that the company has

earlier submitted application to the MOEF for grant of environmental clearance

which was considered by EAC, however, as soon as the State Authority was

constituted the company submitted a fresh application to the State authority. The

observations made by the EAC were considered by the company while submitting

the application to the state authority but the failure of the company to intimate

about the observations of EAC was a mistake on their part for which he tended an

unconditional apology on behalf of the company. He further submitted that the

public hearing of the project was also conducted by PPCB, wherein, the

participants of the public hearing have not raised any objection for establishment

of the project.

After detailed deliberation on the matter, the authority

requested the representative of the company to submit a comprehensive detailed

written justification in the matter for its consideration.

The reply submitted by the project proponent vide letter

dated 14/10/2009 was considered by the Authority in its 22nd meeting held on

19/10/2009 and decided to forward the case to State Expert Appraisal Committee

to re-examine the matter in view of reply dated 14/10/2009.

Accordingly, the case is placed before the Committee for

reconsideration.

33.2.6 166 Application for grant of environmental clearance for

expansion of its existing unit by M/s Shri Markanda Steel Rolling Mills, R.G. Mill Road, Sirhind Side, Mandi Gobindgarh, Distt. Fatehgarh Sahib.

M/s Shri Markanda Steel Rolling Mills has applied for

obtaining environmental clearance for expansion of its existing unit at R.G. Mill

Road, Mandi Gobindgarh, Distt. Fatehgarh Sahib to enhance its production of MS

Rods, Flats and other Re-rolled products from 80 MT/day to 250 MT/day. The

project is covered under category 3A (Category-B) of the Schedule appended with

the EIA Notification dated 14/9/2006.

The case of the industry was placed before the Committee in

its 32nd meeting held on 14/11/2009, wherein, Sh. Yash Pal Jain, Environmental

Consultant of the industry stated that the industry has got its project delisted

from the list of pending cases with Ministry of Environment & Forests, as the

competency to apprise such projects lies with State Expert Appraisal Committee.

However, the State Expert Appraisal Committee observed that as the industry is

located in critically polluted area, therefore, State Environment Impact

Assessment Authority be requested to get the clarification from Ministry of

Environment & Forests as to whether the jurisdiction to apprise such cases lies

with Ministry of Environment & Forests or State Expert Appraisal Committee.

Accordingly, the case was deferred.

Now, Ministry of Environment & Forests vide no. F.No. J-

11011/485/2009-IA.II(I) dated 13/11/2009 (addressed to the industry) [Copy

enclosed as Annexure - III] has informed the industry that all the rolling mills

are listed at Sr. No. 3(a) under Secondary Metallurgy Industries under Category –

B and general conditions are not applicable for the rolling mills. MoEF has

requested the industry to submit application directly to State Environment Impact

Assessment Authority / State Expert Appraisal Committee for further consideration

for TORs / environmental clearance. The proposal is delisted from the Ministry’s

web site.

Accordingly, the case is placed before the Committee for

reconsideration.

33.2.7 84 Application for environmental clearance for Integrated Industrial Park to be established by M/s Chandigarh Infotech Pvt. Ltd. at Vill. Nagla, Bhankarpur, Shatabhgarh, Bakarpur, Singhpura and Chat, Distt. Mohali.

The project proponent has submitted application for grant of

environmental clearance for proposed Integrated Industrial Park to be developed

at Vill. Nagla, Bhankarpur, Shatabhgarh, Bakarpur, Singhpura and Chat, Distt.

Mohali.

The case of the project proponent was placed in the 13th &

15th meeting of SEAC held on 11/10/2008 & 15/11/2008, respectively. But, no

representative of the project proponent attended the said meetings. The project

proponent was requested vide this office letter no. 42035 dated 27/11/2008 to

clarify whether the project proponent wants to pursue its case or not, so as to

enable this office to take further action on your application for grant of

environmental clearance.

The project proponent vide letter dated 5/12/2008 intimated

that due to some changes in the development norms and new guidelines issued

by the Govt., the overall master plan is required to be modified and would take

two months to finalize the same. The project proponent had thus requested to

grant two months for submission of the modified plan and report. Therefore, the

project proponent was requested vide no. 287 dated 3/1/2009 and subsequent

reminder no. 33970 dated 14/10/2009 to submit the requisite details / documents

as desired by the Committee.

Now, the project proponent vide letter dated 28/10/2009

(received on 18/11/2009) has intimated that they would no longer be executing

the said project and wish to withdraw their application for environmental

clearance. They will file a fresh application for environmental clearance at the

appropriate time.

Accordingly, the case is placed before the Committee for

consideration.

33.3.1 171 Application for environmental clearance for

development of Integrated Check Post at Atari along Indo-Pakistan Border by Deptt. of Border Management, Ministry of Home Affairs (Govt. of India).

The Ministry of Home Affairs (Govt. of India) proposes for

development of Integrated Check Post at Atari along Indo-Pakistan Border about

25 Km from Amritsar City on NH-1 between Amritsar and Lahore. The growing

trade and passenger movement indicate the need of Integrated Check Post of JCP

Atari and the likely date of commissioning is December, 1, 2010. The ICP is falling

in Zone-3 of Seismic Zoning Map of India. The area of the project is 53.185

hectare. The area which has already been acquired is purely agricultural land. The

expected cost is 89.60 crores. The daily water requirement for the ICP will be

96.5 Kl/day which will be meet through 2 nos. tubewells. In addition, 648 Kl will

be kept for fire services. About 87 Kl/day of sewage will be generated from the

project, which will be treated through the sewage treatment plant. The treated

wastewater will be used for horticulture and flushing toilets. The solid waste @

110 Kg/day will be generated. Total requirement of electricity will be 1.608 KW.

The consultant of the Ministry of Home Affairs have submitted Form-I, Detailed

project report and Environment Impact Assessment Report (Copy enclosed as

Annexure - IV).

Accordingly, the case is placed before the Committee for

consideration.

33.3.2 169 Application for grant of environmental clearance for construction of emerging technologies complex for Sri Guru Granth Sahib World University, Fatehgarh Sahib.

M/s Sri Guru Granth Sahib World University, Fatehgarh Sahib

has applied for obtaining environmental clearance in respect of construction of

Emerging Technologies Complex at Fatehgarh Sahib.

As per Form-1 and Form-1 A (Copy enclosed as Annexure

- V) submitted by the project proponent, the brief details of the project are as

under :-

• Sri Guru Granth Sahib World University, Fatehgarh Sahib has established at

Fatehgarh Sahib in the year 2008 by State Legislature by passing Sri Guru

Granth Sahib World University, Fatehgarh Sahib (Punjab) Act No. 20 of

2008.

• The project is covered under category B, item no. 8 A of the schedule

appended with the EIA Notification dated 2006.

• The built up area of the project is 29,162 sqm.

• The expected cost of the project is Rs. 43.52 crores.

• The selected site falls under the jurisdiction of Municipal Council, Fatehgarh

Sahib opposite to the Gurudwara Jyoti Sarup Sahib on Fatehgarh Sahib-

Chandigarh main road.

• The nearest Railway Station of Sirhind is situated at approximately 3 km.

from the proposed site.

• The site of the Emerging Technologies Complex will be developed as per

the Master Plan of the University Campus.

• The ground water will be drawn through borewell to meet the water

requirement. The total water consumption will be calculated and submitted

later on.

• The sewage treatment plant will be arranged for the treatment of

wastewater to be generated from the complex and 90% of the treated

water will be re-cycled for agricultural purposes and green area land.

• Suitable RWH pits will be proposed for the project.

• The solid waste to be generated from the proposed project will be

segregated. The recyclable waste will be sold to the recyclers and organic

waste will be subjected to vermi-composting.

• The power requirement for the proposed project will be submitted later on.

• 2 no. DG sets of capacity 0.125 MBA and 0.325 MBA will be installed as

back up during power failure.

• The area of Fatehgarh Sahib does not fall under areas notified by Central

Ground Water Board.

• The certain incompletions were observed in the application of the

promoter, which were conveyed to the promoter vide letter no. 33657

dated 13/10/2009.

• Now, the project proponent vide letter no. 1800 dated 5/11/2009 has

submitted the reply / documents with regard to incompletions conveyed to

him vide letter no. 33657 dated 13/10/2009.
