The Town Plan Commission will be holding a public hearing on April 26, 2021. The Town Board will be reviewing this same proposal on April 26, 2021. We are expecting the Town of Greenville to convey their recommendation in advance of Zoning Committee Consideration on April 27. As part of their review, Town Staff found this proposed rezoning to be consistent with the Town of Greenville Comprehensive Plan, per the attached staff memo (Exhibit 2). The Town of Greenville has exercised village powers and has adopted General Town Zoning; as such, the County is not statutorily obligated to document consistency with the County Comprehensive Plan, pursuant to Sec. 66.1001(3).

Background & Analysis:

A Town Rezoning request was received from the Town of Greenville to rezone 10 acres from AGD

General Agriculture to RR Rural Residential, as depicted on the Rezoning Map (Exhibit 1). The property

However, we do concur that this proposed rezoning is compatible with the County’s Comprehensive

Plan, as the County’s Future Land Use Map shows this site being designated within the “Agriculture and

Open Land” future land use category, which allows for residences on a limited basis. Planning staff also

finds that this request is consistent with the following plan goals:

Land Use Goal 4: Provide an adequate amount of land for a variety of housing choices throughout the County.

Staff Recommendation:

Scenario 1: Should the Greenville Town Board Approve the Rezoning, based on our review and the

above analysis of this proposed Rezoning - Town, County Planning Staff recommends the following:

To approve rezoning parcel # 110101200 from AGD General Agriculture District to RR Rural

Residential District, as requested.

**LOCK IN REQUEST** due to a pending building permit related to this rezoning, we request that this

rezoning be locked in at the first County Board meeting where it is considered.

Scenario 2: Should the Greenville Town Board deny the Rezoning, no action is required, as the rezoning

would die at the Town level.

Scenario 3: Should the Greenville Town Board and/or Plan Commission not take final action on April 26,

staff recommends the Zoning Committee hold this item until such time the Town takes final action.

Scenario 4: The Town of Greenville is also considering a text amendment to their zoning ordinance that

would eliminate the requirement for these properties to be rezoned. The Town Board will consider this

text amendment at their April 26 meeting. If the Town Board approves the text amendment, the Town

may request this rezone be put on “hold” until such time the County Zoning Committee and Board take

action on the text amendment, or the Town may withdraw their request to rezone this property. The

separate text amendment would then come before the County Zoning Committee on May 11th for

consideration.

NOTE: County staff will know how the Town acted prior to the April 27 County Zoning Committee

meeting, and will provide an updated to what staff’s final recommendation is.

WHEREAS, a rezoning request has been applied for to rezone the following properties:

ACTION TYPE: This item is for possible Planning Commission and Village/Town Board Approval/Denial. BACKGROUND & SUMMARY: In 2020 Greenville updated its Zoning Ordinance. As part of the update a number of new Zoning Districts were created and uses were updated accordingly. Greenville has undertaken a comprehensive rezoning process to rezone properties that have inconsistent land uses and zoning which have made properties legal non-conforming. These properties may continue as is until Greenville rezones them. There are a number of properties that wish to pull permits to do various construction project. Greenville is not able to issue them permits because they are considered legal non-conforming and must first be rezoned to the appropriate zoning district. The following list of properties fall into this category and have requested to be rezoned accordingly. A public participation letter was sent out in compliance with Chapter 99 to property owners within 500 feet of the subject property. A public hearing notice was published in the Post Crescent on April 12 and 19, 2021. PROPERTIES FOR REZONING:
