Renewable legislation
Renewable legislation being discussedin Congress. Highlights of Proposalinclude the following:
Ministry of Energy must elaborate andcoordinate a nationwide Program topromote renewables with mandatorygoals and specific dates to reachthese goals
Ministry of Energy must establish a Government Trust to manage severalfunds
“Green Fund” will provide incentives to promote grid connected electricitygeneration
“Emerging Technology Fund” to supportthe development of technologies not yetcommercially competitive but that may help industrial development or energysources diversification
“Rural Electrification Fund” to promoteprojects aimed at supplying electricityto isolated or low income communities; Government Utilities may participate.
“Biofuels Fund” to provide incentives for biofuels marketing“R&D Fund” for technologies that may be specially suitable for Mexico in thefuture
“Renewable Energy General Fund” forthe development of technologies otherthan the generation of electricity
Renewable legislation
The Ministry of Energy shall publishan electricity generation projectevaluation methodology that mustinclude aspects such as the benefitsof long term generating cost stability
CRE would have legal powers to issuestandards, methodologies, modelcontracts and any other administrativeorder for the generation of electricitywith renewable energy
The Finance Ministry shall providefiscal incentives for renewable projectsThe Economy Ministry shall issuepolicies to promote that local industryenter into the production of renewableenergy equipment.
The national program to promoterenewable energy shall set goals forthe use of biofuels in gasoline

Main features:System operator should takerenewable energy unless system is atstakeAncillary services charges ( voltageand frequency regulation) multiply by plant factorEnergy supplied to the system duringemergencies paid at 1.5 times publicservice rates

Wind projects
In order to foster wind projects in thearea of Oaxaca Open Season processeshave been carried out to builttransmission capacity in the area
As a result of the open season, some2500 MW of transmission capacityfacilities will be built and entercommercial operation by the end of 2009.Private participants have alreadysubmitted initial guarantees for 1911 MW. On top of this capacity the GovernmentUtility shall probably reserve transmission capacity for its ownprojects.
Other projects
• CRE has issued 78 permits toinstall 1,925 MW of generatingcapacity based on renewableenergy.
• 60 permits already in operation, for a total of 534 MW.
• Most new projects are windpower projects

Future regulation
Promotion of small renewable energyprojects (1-10 kW).New net metering (1:1) regulation isexpected to foster electricity generationin homes and small businesses.First 230 homes already generatingsolar power in Baja California
Proposal for renewable energy projectsregulation under study. All energyproduction (up to 30 MW) to be supplied to Government Utility under a long term contract. Avoided cost basedpayment
