QUESTIONS WITHOUT NOTICE FROM COUNCILLORS Cr Bastone asked the following question without notice: Is there a possibility that Council would allow Kingston Rotary Club to use inside the old gymnasium at Kingston Park to hold their Sunday market. They have their own insurance and they are happy to do minor repairs such as replacing the locks to the broken bathrooms and providing porta loos outside. With the poor weather on Sunday they feel that if they were able to use the gymnasium for the Mega Market it would have been a more successful event. Response: Officer: Gary Arnold – General Manager I will have to take this question on notice because my recollection is that the building currently does not have an occupancy permit attached to the building. Cr Bury asked the following question: This question relates to a letter the General Manger circulated to us all which details a speech or presentation from the Chairman of Taswater and the contents although there is some mention it is actually in closed session of the detail but I just wondered if the General Manager could comment it seemed to me that some of the details in that presentation that the Chairperson had significant implications for Local Government. Response: Officer Gary Arnold – General Manager You would be aware from recent media reports so what I can say is that the Board of Taswater made a decision to reduce the dividends available to owner Councils effective from 1 July 2018 and as a result of that decision the impact on Kingborough Council will be a loss of $600,000 projected revenue and that will of course impact our long term financial plan. As a result of the Taswater decision the impact for various Councils differs depending on the percentage of ownership of Taswater. Following up it seems to me the detail in the Chairmans presentation indicates that this wasn’t likely to be a short term loss of income for Councils Councillors I think it is fair to say that whilst the Taswater Board decision in effect refers to a period for the next decade, there were no guarantees given past that there would be a return to what has previously been the norm and that period of time is obviously a long time out to predict accurately anyway. I think the bottom line is that all Councils in the state will need to plan for their future with an expectation of reducing dividends from Taswater. Cr Atkinson asked the following Question: Until recently there was an informal sign on Leslie Road near the corner of Roba Court warning drivers about to drive carefully because there is wildlife on the road and I noticed this sign has been removed I wanted to know if Council has been involved in that removal and what plans there were to replace it with a more formal sign.

Response: Gary Arnold – General Manager I will have to take that question on notice. Cr Chatterton asked the following questions without notice: 1. We receive an email on a fortnightly basis with a list of Agenda items. I fail to see the

necessity in creating additional work time seeing that email arrives at the same time as we can go into our Dropbox and I see no purpose in it. My question to the General Manager is would it be ideal to remove that to save some valuable staff time. Response: Gary Arnold – General Manager It is merely provided to give Councillors some indication of probable reports and Agenda items prior to the Agenda becoming available. The difficultly always is the timing because often it is not up until we are almost ready to go to print that we have had certainty of reports that will comprise the Agenda but the impost of workload is minimal and it is something that I am happy to continue to provide if Councillors see benefit in it.

2. When Council decided to go to away from having committee meetings and going to two

Council and workshops was it agreed that Council would meet twice a month and the other two Mondays be workshops. Response: Gary Arnold- General Manager That is my recollection and the intention has been to endeavour to keep workshops to Monday evenings wherever possible given the trial arrangement and a report will be coming back to Council in December for Council consideration on whether to continue with that arrangement.

Cr Wriedt asked the following question: Given that we have now been advised that Kingborough Council was not successful in obtaining some of the regional funding grant to advance the develop Kingston Park. I am interested in what if any response the Mayor or General Manager has provided to our Federal members of Parliament particular those who are in Government what are the next steps in trying to secure funding for the project Response: Cr Wass – Mayor There will be a response in particular to the Federal Government Senators and a follow up as to meetings with the idea of what they are able to do to assist us. Once that has happened obviously all Councillors will be informed.

DA-2016-286 - DEVELOPMENT APPLICATION FOR THREE UNITS AT 29 THORNBILL STREET, KINGSTON FOR J IBBOTT

That in accordance with Council Policy 1.1 – Delegated Authority Policy, the Planning Authority resolves that the report of the Acting Manager Development Services be received and that the development application for three units at 29 Thornbill Street, Kingston for J Ibbott be approved subject to the following conditions: 1. Except as otherwise required by this Permit, use and development of the land must be

substantially in accordance with Development Application No. DA-2016-286 and Council Plan Reference No. P1 submitted on 19 July, 2016 and P2 submitted on 19 September, 2016. This Permit relates to the use of land or buildings irrespective of the applicant or subsequent occupants, and whoever acts on it must comply with all conditions in this Permit. Any amendment, variation or extension of this Permit requires further planning consent of Council.

2. Details of the proposed front fence shown on P2 submitted on 19 September, 2016 must be

amended and submitted with the Building Application to demonstrate compliance with the acceptable solution of Clause 10.4.7 – front fences. In particular, any part of the fence above 1.2 metres in height must include openings which provide a uniform transparency of not less than 30% (excluding any posts or uprights).

3. A drainage design plan in accordance with the Director of Building Control Specified List, Schedule 2, at a scale of 1:200, designed by a qualified hydraulic engineer, showing the location of the proposed sewer and stormwater house connection drains; including the pipe sizes, pits and driveway drainage, must be submitted with the application for Building Permit.

4. All waste material generated by the development or from other sources must be contained

in appropriate building waste containers for periodic removal to a licensed disposal site. The receptacle must be of a size to adequately contain the amount of waste generated and must be appropriately located on the subject site and must not impede residential traffic or parking at any time.

5. The design and construction works must be generally in accordance with the submitted

proposal plan “P2” and to the satisfaction and approval of the Executive Manager - Engineering Services and as follows:

(a) Complies with Tasmanian Standard construction drawings. (b) The engineering plans shall include but not be limited to adequately detailed internal

vehicular and pedestrian access, carparking, manoeuvring areas, water reticulation, drainage services and must include compliant cross and long sections.

(c) No Parking/keep clear signage must be installed for the turning bay so as to remain clear of vehicle at all times.

(d) Visitor carparking signs must be installed for the one (1) visitor carparking space. (e) Signage noting extra residential parking for each unit must be installed for three (3) of

the carparking spaces and allocated to the relevant unit. (f) Parking and vehicle circulation roadways and pedestrian paths must be provided with

bollard lighting. (g) Stormwater discharge from all new impervious areas must be must be disposed of by

gravity to public stormwater infrastructure. (h) A new 225mm diameter PVC stormwater lot connection point is to be provided by

Council at the developer’s cost. (i) Onsite stormwater detention must be installed and supporting documentation with

associated hydraulic calculation and details how the onsite detention will be serviced to prevent blockages while maintaining its capacity must be submitted with engineering plan.

(j) Stormwater design must incorporate water sensitive urban design principles and achieve Acceptable Stormwater Quality and Quantity Targets that are required in Table E7.1 of Kingborough Interim Planning Scheme 2015. Supporting documentation with associated hydraulic calculation and details how it would be serviced must be submitted with engineering plans.

(k) The engineering plans and specifications shall be prepared and certified by an accredited professional Civil Engineer to the approval of the Executive Manager - Engineering Services.

(l) Approval of the plans and specifications is required prior to the issue of a Building Permit.

8. The stormwater runoff and overflows from all new impervious areas must be disposed of by

gravity to Council’s reticulated stormwater system to the satisfaction of the Executive Manager - Engineering Services. Stormwater runoff must be no greater than pre-existing runoff from the site and onsite detention to cater for 5% AEP storm event is required for new impervious areas.

9. Prior to the commencement of site works a soil and water management plan must be

submitted to Council and implemented. The plan must be in accordance with NRM South Soil and Water Management of Construction Sites – Guidelines and Tasmanian Standard Drawings (TSD-SW28). A site inspection by the Council’s Development Inspector must be satisfactorily undertaken prior to the commencement of any work on site.

10. The conditions as determined by TasWater, and set out in the attached Appendix A, form part of this permit.

ADVICE

A. In accordance with section 53(5) of the Land Use Planning and Approvals Act 1993 this permit lapses after a period of two years from the date on which it is granted if the use or development in respect of which it is granted is not substantially commenced within that period.

B. This Permit does not constitute building approval. The developer should obtain a Building

Permit for the development prior to commencing construction.

C. The Developer should not allocate any property address numbers for the proposed units. New property addresses have been allocated as follows:

substantially in accordance with Development Application No. DA-2016-343 and Council Plan Reference No. P1 submitted on 2 September 2016. This Permit relates to the use of land or buildings irrespective of the applicant or subsequent occupants, and whoever acts on it must comply with all conditions in this Permit. Any amendment, variation or extension of this Permit requires further planning consent of Council.

2. The stormwater runoff from all concrete, paved, or otherwise sealed areas must be

collected and contained within the property or discharged to a council approved discharge point. All works in relation to the discharge of stormwater is to be completed to the satisfaction of the Executive Manager - Engineering Services.

3. Erosion/siltation infiltration control measures are to be applied during construction works to

the satisfaction of the Executive Manager - Engineering Services. 4. No felling, lopping, ringbarking or otherwise injuring or destroying of native vegetation or

individual trees is to take place without further written approval of Council. Prior to commencement of works, any native trees within the vicinity of construction

must be protected by installation of a visible barrier around its Tree Protection Zone (calculated as 12 x trunk diameter at 1.4m above ground in accordance with AS 4970-2009) to exclude:

(a) Storing of building materials; (b) Vehicular traffic; (c) Placement of fill; and (d) Excavation works.

5. To reduce the spread of weeds or pathogens and maintain the weed free status of the property, all machinery must take appropriate hygiene measures prior to entering and leaving the site as per the Tasmanian Washdown Guidelines for Weed and Disease Control produced by the Department of Primary Industries, Parks, Water and Environment.

Any imported fill materials must be sourced from quarries able to provide documentation as

to the weeds present on the source site in order to minimise introduction of new weeds and pathogens to the area.

C. With consideration to the number of habitable rooms in the dwelling and the capacity of the existing onsite wastewater management system, the maximum number of occupants must not exceed 7 persons at any time, in accordance with the Special Plumbing Permit dated 7 April 2016.

D. If potentially hazardous foods are to be provided for guests, the business must be

registered as a food business in accordance with the Food Act 2003. E. No signage is approved as part of this application. Any signage proposed would need to

either comply with an exemption contained within the relevant Scheme, or alternatively, an application made to Council.

c) Council approves a change of name for the awards to be “Kingborough Awards”.

d) Policy 4.2 Kingborough Australia Day Awards be updated to reflect the above changes.

(a) Council is not prepared to agree to the request on the basis that the Stormwater Rate funds essential infrastructure for the management of stormwater for all properties throughout the municipality; and

(b) All residents benefit from improved stormwater infrastructure and the collection of rainwater in domestic water tanks does not in itself provide a reason to exempt some properties from having to contribute to the costs associated with essential stormwater upgrades.
