Agenda Item No.1 Confirmation of the minutes of 117th meeting of Executive Committee held on 17.6.2003 at New Delhi.

It was noted that the minutes of 117th meeting of Executive Committee held on 17th June 2003 at New Delhi were circulated to all the members of Executive Committee vide this office letter No.5-1/2003-EC(117th) dated 4.7.2003 with the request to suggest addition/deletion if any within 21 days from the date of issue of the same.

It was further noted that in response to the same Vaidya Raghunandan Sharma, Member, Executive Committee vide his letter dated 18.7.2003 submitted his comments as under:-

The comments of Vaidya Raghunandan Sharma were discussed by the Committee and decided that since President is not present in the meeting, therefore, matter be placed/discussed before the President, CCIM in the next meeting of Executive Committee.

The remaining minutes of 117th meeting of Executive Committee were confirmed.

Agenda Item No.2 Ratification of action taken by the President on remaining verification/visitation/Compliance reports of Ayurved colleges.

It was noted that as visitation report of all colleges (except four colleges) visited during this year were placed before the Education Committee (Ayurved) in its meeting held on 16-17th

June 2003 and subsequently were placed before the Executive Committee in its meeting held on 17th June 2003 alongwith the recommendations of the Education Committee (Ayurved).

It was also noted that action was taken by the office accordingly. After that clarification/compliance report/visitation report were received from time to time and President has taken decision on these reports/requests. The decisions taken by the President were considered in the meeting of the Education Committee (Ayurved) in its meeting held on today in the morning.

The Executive Committee considered the following decisions taken by the President and ratification made by Education Committee (Ayurved) on these decisions.

Education Committee while ratify the action taken of President, CCIM noted that several complaints of students have been received in the office in regard to this college. It was decided that this should be taken up as a separate item of agenda.

3. Veena Vadini Ayurved After receipt of affiliation of the University Mahavidyalaya, Bhopal alongwith other clarification. President agreed to

grant permission for admission of 50 students as per previous year.

4. Rani Dullaiya Ayurved After receipt of affiliation of the University College, Bhopal alongwith other clarification President agreed to

grant permission for admission of 50 students as per previous year.

5. Om Ayurved College, Betul After satisfying with the compliance report submitted by the college. President agreed to grant permission for admission of forty students as per previous year.

6. Rajiv Gandhi Ayurved After satisfying with the compliance PresidentCollege, Durg, Chhatisgarh agreed to grant permission for admission of fifty

students as per previous year.

7. Bapuji Ayurved College,Challakere After satisfying with the compliance, President agreed to grant permission for admission of forty students as per previous year.

8. Pt. Shiv Shaktilal Sharma Ayurved After satisfying with information, President Mahavidyalaya, Ratlam agreed to grant permission for admission of

forty students as per previous year.

9. Shubh Deep Ayurved Medical After receipt of affiliation of the University College, Indore alongwith other clarificaton. President agreed to

grant permission for admission of 50 students as previous year.

10. SGV Ayurved College, Bailhongal After receipt of compliance report President,CCIM on 3.8.03 directed as “Please send a letter regarding appointment of at least 05 more teachers with PG qualification, then the same will be considered. Accordingly a letter was sent. The college vide their letter No.SGV/AMC/1876/2003-04 dated 9.8.2003 has informed that five more teachers with PG qualification have been appointed. Self appraisal and bio-data of teachers was also submitted.

After satisfying with the compliance, President agreed to grant permission for admission of 40 students as per previous year.

While ratifying the action taken of President , the Committee decided that the college be visited in next year i.e. 2004-2005 also.

11. Shri JGCH Society’s Ayurvedic After satisfying with the compliance, PresidentCollege, Ghatprabha agreed to grant permission for admission of 40

students as per previous year.

12. Dhule Charitable Ayurved The President did not agree with the Compliance Mahavidyalaya, Dhule and decided for verification. The verification

was conducted on 16.8.2003. On the basis of verification report, President agreed to grant permission for admission of forty students as per previous year.

13. Jupiter Ayurved Medical College After receipt of the Compliance, President Nagpur agreed to grant permission for admission of

40 students as per previous year.

14. Mayurbhanj Ayurved Mahavidyalaya, After receipt of compliance, President agreed to Baripada grant permission for admission for 30 students

as per previous year.

15. Guru Nanak Ayurved College, After receipt of affidavit as well as self appraisal Gopalpur, Ludhiana bio-data of teachers, President agreed to grant

permission of admission for 50 students as per previous year.

It was also noted that in pursuance of decision of Education Committee (Ayurved) in its meeting held on 16th & 17th June 2003 under Agenda Item No.1, the following visitation reports were considered by President, CCIM and President agreed to grant permission as follows:-_________________________________________________________ Name of the College Decision of President

3. Shri Nrusinghnath Ayurved College & 30 permitted Research Institute, Nursinghnath, with strict warning for improvement Paikmal, Sambalpur

4. Govt. Ayurved College, Bolangir 30 permittedwith strict warning for improvement

In this connection, Vaidya Raghunandan Sharma, Dr. PK Jain and Dr. Sivanandam, member of the Executive Committee submitted a dissent note describing that President was not authorized to take such decisions.

After great deliberations on this question the Executive Committee approved the decisions taken by the President and ratified by the Education Committee (Ayurved) and decided that the dissent note submitted by the members should be appended with the minutes.

The Executive Committee also considered the Agenda Item No.3 regarding Acharya Gyan Ayurved College, Indore and ratified the following decision of Education Committee (Ayurved):-

“The Committee was informed that the Council has received complaints regarding this college from students and main points of those complaints are as follows:-

1. There are only three teachers out of them two are not qualified as per CCIM norms.

2. More fees are charged without required teaching facilities.

3. Teachers are not appointed on regular basis and leave the institution after few months.

4. Other required teaching facilities are also not available.

5. Dr. GC Jain and his son Anurag Jain is misbehaving with students.

6. Students belonging to SC and ST group are being humiliated with abusive words.

The members belonging to state of MP also confirmed aforesaid state of affair in the college and informed that these complaints are also being enquired by Government of MP seriously.

After detailed discussion on the subject, Committee decided to withdraw the permission for admission of students during 2003-2004 immediately. It was also decided that State Government and concerned university should be informed about this decision without delay.”

The Executive Committee authorized the President to constitute an Enquiry Committee in respect of this college to investigate the complaint.

The Executive Committee also ratified the following decisions taken by Education Committee (Ayurved) at agenda item No.8 and additional agenda item No.2.

Consideration of visitation report of Ayurved College, Gaya and representations received from other institutions.

It was noted that Secretary to the Government of Bihar informed about shortcomings existing in Ayurved College, Gaya. In response of the same, the college was visited on 1.9.2003 by the visitors of the Central Council.

Considering lack of facilities of teaching and practical training as per visitation report, Committee did not agree to grant permission for the session 2003-2004.

1. SBS Ayurved College, Mundargi Committee did not agree to grant permission for admission to admit students for the session 2003-2004.

2. Govt. Ayurved College, Burhanpur Committee decided to grant permission for admission of 40 students for the session 2003-2004. The Committee also decided that college should be visited in next year also i.e. 2004-2005.

3. Institute of PG Ay. Education & Committee did not agree to increase the intake Research Centre, at Shyamadas capacity and it should be as per decision of the

Vaidya Shastrapeeth, Kolkatta previous meeting.

Representation of Zakaria Ayurved College, Gulbarga.

It was noted that society of Zakaria Ayurved College, Gulbarga i.e. Islamia Education Trust has submitted the compliance report and has consented to withdraw the case filed in the Hon’ble Court of Karnataka at Bangalore for legal justice.

In this regard following facts were placed below:-

1. 1997-98

College was visited and not permitted.

2. 1998-99

College was visited and permitted for 25 students.

3. 1999-2000

College was visited but not permitted.

4. 2000-2001

College was visited but affiliation of the university was asked (date of meeting 7.8.2000).

The college submitted the affiliation of the University on 8.10.2001 after lapse of about one year. The University granted affiliation for the session 2000-2001. Since the college submitted Status of affiliation during mid session to the Central Council. No visitation was carried out. So nothing could be done for the session 2001-2002. However, college made admission of 15 students for the session 2001-2002 without the permission of the Central Council.

6. 2002-2003

College was visited but not permitted. The clarifications was also asked that why admission for the session 2001-2002 were made whereas Central Council did not grant permission for the session 2001-2002. The clarification with the facts were placed before the Joint meeting of members of Education Committee (Ay.) and member of Executive Committee. The Committee did not agree to grant permission for the session 2002-2003.

2003-2004

College filed a case in the High Court. Affidavit has also been filed by the office. As matter is sub-judice. Hence college was not proposed for visitation 2003-2004.

However matter placed before Education Committee as per instruction of the President.

Education Committee decided that if college withdraw the case then matter may be considered by the Committee of President, CCIM Chairman, Ayurved Committee and Chairman, Education Committee (Ayurved).

Agenda Item No.3 Regarding Bapuji Ayurvedic Medical College, Shimoga.

After going through the Compliance, Committee agreed to grant permission of forty students for the session 2003-2004.

It was noted that following Unani colleges were visited by the visitors of the Central Council after the meeting of Education Committee (Unani) held on 17.6.2003. These were initially considered and decided by the Vice-President (Unani), Chairman, Education Committee (Unani) and the President of CCIM. These decisions were considered by Education Committee (Unani) in its meeting held today in the morning and ratified as under:-

9. Faculty of Medicine, Jamia 50 admission in UG Course Permitted Hamdard University, Delhi

It was also noted that representation received from following were also considered by Education Committee (Unani) held on 26.9.2003 and decided as under:-

1. Hakim Abdul Hameed Unani Medical Committee agree to grant permission with College, Dewas admission of 40 students.

2. Taj Tibbia College & Rasheedia Committee did not agree to grant Hospital, Nagpur permission to admit the students.

The Executive Committee ratified these decisions.

Agenda Item No.5 Ratification of minutes of Sub-Committee held on 18.3.2002 at New Delhi.

It was noted that Dr. VK Behal DDG (ID) dated 21.8.2003 has asked to suggest the duration of training of USG/image scanning of various discipline i.e. Ayurveda, Siddha and Unani Tibb to place before the Hon’ble Minister for Health & Family Welfare in a meeting of the Central Supervising Board constituted under the Pre-natal Diagnostic Techniques (Regulates Prevention of misuse) of Act, 1994.

It was also noted that some practitioners of Ayurved Unani practicing in Uttar Pradesh, Haryana met President on 13.3.2002 to discuss the problems of practitioners of ISM being

faced by them imposing the various orders of the State Government regarding uses of diagnostic appliance like x-ray, Ultra-sonography in their clinical practice.

President, CCIM desired that three members namely Vaidya SK Mishra, Chairman, Education Committee (Ayurved), Vaidya GL Chanana, Chairman, Finance Committee and Dr. MS Gupta Chairman, Education Committee (Unani) to examine the matter in the detail on 18.3.2002.

After going through the syllabus of Ayurvedacharya Course it is observed that Syllabus of Rogavigyan Vikiriti Vigyan reads as under:-

“The qualification holders of Ayurvedacharya (BAMS) and Kamil-e-Tib-o-Jarahat (BUMS) and previous equivalent qualifications included in Second Schedule of IMCC Act, 1970 are trained to halndle and use modern technological innovation like Radiology ultra sonography, ECG etc. in their Clinical practice.”

Executive Committee discussed the issue at great length and accepted the recommendations of Sub-Committee and further decided to keep the duration of training similar to the MBBS.

Agenda Item No.6 Approval of Annual Report and Audited Accounts of the CCIM for the year 2002-2003.

It was noted by the Committee that the draft Annual Report of the Central Council was submitted to the President, CCIM. As per instructions of the President, the draft Annual Report was submitted to Chairman, Education Committee (Ayurved), Chairman, Education Committee (Unani) and Chairman, Finance Committee for perusal and further action.

The Executive Committee considered and approved the Annual Report for the year 2002-2003 to be laid down on the table of both the Houses of Parliament as usual.

It was further noted that the audit of accounts of the Central Council for the year 2002-2003 was conducted by the auditor of DGACR from 28th August to 10th September 2003. Audit report awaited, the same will be placed before the Committee as and when received from DGACR.

Agenda Item No.7 Consideration of minutes of Sub-committee to finalise the Recruitment Rules for the employees of CCIM.

It was noted that in compliance of decision of 117th Meeting of Executive Committee held on 17.6.2003 the meetings of the sub-committee consisting following members were held on 6.8.2003 and 28.8.2003 for finalizing the Recruitment Rules to send the same to the Government of India for sanction.

It was also noted that since the Central Council requested the Ministry to grant ex-post-facto sanction to the pay scale and a change of designation of Asstt. Registrar (Ayurved & Unani) and Asstt. Secretary (Reg. & Admn.) and the reply of the same is awaited. Therefore, keeping in view of the same, the issue to draft recruitment rules for the post of Technical Officer (Ayurved & Unani) and Asstt. Secretary (Admn & Regn) were kept pending.

The Executive Committee considered and approved the minutes and Recruitment Rules finalized by the Sub-Committee for remaining posts which is appended as annexure B..

to Central Council under Plan for the year 2003-04.

It was noted that Budget Estimate amounting to Rs.81.00 lakh for the year 2003-04 was submitted to the Ministry for sanction for 12 schemes (copy enclosed). Ministry of Health & Family Welfare, Deptt. of ISM&H allocated only Rs.12.00 lakh against Rs.81.00 lakh proposed by the Council.

In this connection, it is further noted that 12 schemes were submitted by the Council to be implemented in the Tenth Five Year Plan. Besides as per decision of 32nd meeting of Registration Committee held on 21.3.2003 meetings are to be held with the State Boards.

As per instructions of President, the issue was discussed with the Chairman, Finance Committee, Chairman Education Committee (Ay. and Unani). After deliberation, it was decided to allocate the Fund under Plan for the following scheme:-

4. Meeting with State Government authorities and Chairman/ 00.50 lakh Registrar, Kerala

5. Purchase of Software for office of CCIM 00. 50 lakhTotal 12.00 lakh

Executive Committee agreed to the above.

It was noted that Central Council has not granted permission to admit student in Post-graduate Course of Unani Tibb in the subject of Moalijat to Ayurved & Unani Tibbia College, Karol Bagh, New Delhi, therefore, admission of the students in Post-graduate course in Unani in the subject of Moalijat by Ayurved and Unani Tibbia College, Karol Bagh, New Delhi without permission of the Central Council is violation of the Regulation prescribed by CCIM. Necessary action need be taken expeditiously.

Executive Committee decided that since Central Council has not granted permission to admit students in Moalijat in Post-graduate Course to College, further action in this regard be initiated as per legal/administrative opinion.

Addl. Agenda Item No.3 Power of restoration of intake capacity of previous years.

It was noted that as per discussion held on 03/8/2003 regarding power of restoration of intake capacity of previous years. A letter was sent to Government of India for clarification. In this regard Government of India vide their letter No.R.11011/07/2003-EP dated 01.9.2003 has asked to provide specific detail and justification of the case(s) pertaining to restoration of intake capacity of the colleges by the CCIM.

The Executive Committee decided that legal opinion be obtained for further consideration.

Addl. Agenda Item No.4 Transfer of Societies/Trust/Colleges by

one management to another management

It was noted that some societies transfer/sell/lease basis transfer their college to other society for the one or other reasons and therefore, some disputes arise. A few of them are mentioned as under:-

1. Venkataramana Ayurved College, Chennai

2. Rural Education Trust Ayurved Medical College, Koppal

3. Guru Valmiki Ayurved College, Jaglur Town

4. Ayurved College, Coimbatore

When it comes to the notice of Central Council then Council issued letters to the institution in regard to the followings:-

1. The teaching of students (theory & practical) should not be disturbed and should remain smooth as before.

2. The students, teachers and other employees may not face any difficulty or inconveniences in transfer.

3. Transfer of college should be approved by State Government as well as by University.

4. Terms and conditions of the service of employees as well as students should not be changed.

5. Transfer should not effect adversely in any way.

Overall it has been felt that transferring of the management effects the teaching and practical training of students as well lurch the future of the admitted students.

It was also noted that in this regard legal opinion was obtained from the retainer of the Council. The advocate was of considered opinion that the Society/Management should be strictly directed not to transfer/shift the trust and change the management once visitation is conducted and permission has been granted by the Central Council. A specific contract is formed between the management and the students as soon as the student is admitted in the college and during the pendency of the course, the college cannot leave the student in lurch by changing the college or teaching faculty, campus or management is absolutely unjustified and improper and the same may be strongly discouraged.

The Executive Committee decided that individual cases be decided as per legal opinion and merit.

It was noted that Deptt. of ISM&H, New Delhi vide their letter No.H.11018/7/2001 P&C dated 02.05.2003 enclosed a copy of OM of even number dated 25.03.2003 & RS 12(5)

99-Com.I dated 13.03.2003 of Parliament of India, Rajya Sabha Secretariate instructed the Council to follow the statutory orders laid on the table of Rajya Sabha during the 192nd

session for implementing of 135th Report of the Committee on subordinate legislation which is reproduced hereunder:-

“The Committee would like to take this opportunity to recommend that Ministries as part of their governance initiative, put all subordinate legislation on their websites, preferably bilingually. The Committee further recommends that the Ministry of Information Technology immediately develop a standard application software with an Internet interface for use in all Ministries, which will provide a searchable database of subordinate legislation linked to the principal Acts administered by the respective Ministry. Seeing the relative simplicity of the software, the Committee hopes that this will be completed within a period of 6 months, and all Ministries will submit Action Taken replies in this regard within this period.”

These instructions were followed by two reminders dated 3.6.2003 & 11.7.2003 and was instructed to complete the work of website latest by 8.8.2003. After taking the order of the President, CCIM the website of the Central Council has been launched.

Executive Committee approved/noted the same.

Addl. Agenda Item No.6. Legal Notice of Dhanwantri Ayurved College, Nipani

It was noted that legal notice has been received from Syed Kalamuddin, Advocate on behalf of Shree Chhatrapati Education Society, Dharwar regarding permission of Dhanwantri Ayurved Mahavidyalaya, Nipani. In this regard, it is submitted that:

1. As per pre-requisite of the Central Council Government of Karnataka issued Essentiality Certificate on 23.11.2002.

2. Rajiv Gandhi University of Health Sciences, Bangalore issued consent for affiliation on 25.11.2002.

3. College deposited fee of Rs. One lakh on 9.12.2003.

4. College was visited on 11th & 13th December 2003.

5. The visitation report was considered in the Joint meeting held on 19.12.2002. The Committee did not agree to grant permission accordingly shortcomings were informed. College was asked to fulfil the shortcomings by 31st January 2003.

6. College submitted the compliance letter dated 8.4.2003.

7. (a) In the meantime, Government of India vide their letter No.V.26011/1/99-P&C dated 12.12.2003 informed that as per Amended Act, permission of Central Government would be required to new college and Council was asked not to consider any such proposal with immediate effect till further decision from Department in this regard.

(b) Further, Government of India vide their letter No.12013/84/02-Ay.Desk dated 31.12.2003 informed that amended Act has been published in the Gazette of India Extra Ordinary Part II Section 1 dated 9th December 2002. Since Act has been amended allowing for starting new college/PG Course/increase intake capacity requires prior permission of the Central Government.

(c) Lastly, Government of India vide notification No.79 dated 28.1.2003 enforced the amended Act.

Accordingly college was asked to approach to the Government of India.

Executive Committee decided that proper reply may be sent through advocate as per legal procedure and further clarification be asked from Government of India.

Addl. Agenda Item No.7. Resolution of Vaidya Raghunandan Sharma, Member, EC seconded by 47 members.

It was noted that Vaidya Raghunan Sharma seconded by 47 members submitted a proposal for the amendment of provision 55 of Standing Order of the CCIM. Comparative statement of proposal are as under:-

“Proposal for the Amendment of CCIM Standing Orders

Ministry of Health and Family Welfare, Government of India, New Delhi vide orders No.V.26012/82-AE dated 10.3.86 (F.8-4/85 ACT) issued ‘standing order of CCIM. According to provision No.3 of the standing order the power of interpretation, changing and amending has been given to CCIM. In accordance to the above provisions, I am submitting a proposal for the amendment of provision No.55 of the standing orders.

The employee of the Central Council of Indian Medicine shall be entitled to leave salary, Travelling and all other allowances as applicable to the Central Government employees of Non Official/Official members & employees of CCIM will be regulated as under:-1. Non-Official

Those who are not in whole time employment under Central or State Government. The non-official members of the Central Council shall be treated at part with the Central Government. Servant of the first grade for purposes of TA Rules. The payment of TA etc. for attending the work of the Council will be made in accordance with supplementary rules 190 read with appendix 10.

2. OFFICIAL

Those who are whole time employment under Central or State Government. They will be paid TA etc. as applicable to them under Supplementary rules of Government of India.

3. EMPLOYEES

The employees of Central Council will be paid TA etc. as per supplementary rules of the Government of India as amended from time to time.

4. AIR TRAVEL

The traveling allowance to non-official/official members and employees of CCIM will be regulated as under:-

1. NON-OFFICIAL MEMBERS:-

Those nominated members of CCIM who are not in whole time employment under Central or State Government or elected members of CCIM will be treated as non-official members. The non-official members of Central Council shall be treated at par with Central Government. Servant of the first gradefor purposes of TA rules & other allowances for attending CCIM meeting and other works.

2. OFFICIAL MEMBERS

Nominated and special invitee members who are in whole time Employment under Central or State Government will be treated as official membersthey will be paid TA etc as per Central or State Government TA Rules.

3. EMPLOYEES

The employees of the CCIM shall be entitled to leave salary, Travelling and other allowances as applicable to Central Government employees from time to time. The employees of CCIM will be paid TA and other allowances according Central Government TA Rules. The employees of Central Council will be paid TA etc as per supplementary rules of the Government of India as amended from time to time.

President, Vice-President of the Council will be Entitled to travel by air at their own discretion in connection with work of the Council.

In case of others, the President of the Council can permit them to travel by air in accordance with the guidelines laid down by the Ministry of finance.

President, Vice-President, non official members & Official members (who are authorized in TA rule) of the Council will be Entitled to travel by air at their own discretion in connection with work of the Council.

It the Council work is so emergent that there is no alternative except air travel then the President can permit any member/employee to travel by air.

5. OTHERS

(a) Those members who are traveling by their own car/taxi should be given full road mileage according to the prescribed rate of Central Government TA Rules.

(b) If the member get sick, while attending the meeting or during the journey for the meeting or for college visit all the treatment charges will be paid by the CCIM.

Executive Committee agreed in principle and deferred further consideration in next meeting of Central Council.

Addl. Agenda Item No.8. Resolution of Dr. MS Gupta, Chairman, Education Committee (Unani)

Dr. Madan Sarup Gupta moved a resolution reads as under while EC ratifying the action taken of the President pertaining to SGV Ayurved College, Bailhongal:-

“In view of acceptance of SGV Bailhongal, compliance repot it is established that visitor misreported about the college. It is resolved therefore, that the concerned visitors be blacklisted for a period of two years.”

Executive Committee deferred the consideration to next meeting of Executive Committee.
