MINUTES OF THE ORDINARY MEETING OF BADBY PARISH COUNCILHELD IN THE VILLAGE HALL AT 7.30 P.M.

THE FOLLOWING WERE PRESENT:

e. To update re Parish Council election for 7th May 2015PC confirmed that 9 nominations had been received, all of whom were duly elected. Thanks for their contributions went to KM and GB, who have not stood in the election.

f. To update re Annual Parish Meeting to be held on 17th April 2015Arrangements are now in place for the meeting. All were encouraged to attend.

g. To arrange review of policy documents, Standing Orders and Transparency CodeA meeting will be held on Monday 20th April at 10.00am.

002/04/15 Matters arising from the minutes (for information only)a. PC and KM will be unable to attend the Town & Parish Councils Meeting due to take

place in June. Alternatives and questions to be raised to be agreed at the next meeting.

b. It was reported that the recent planning application for Badby Lodge Farm will not be going to committee. Discussion took place regarding the need for updated information on the application to be re-submitted to the Parish Council for consideration and comment where planning policies can be quoted. A specific request should be made for the application to go before the planning committee.

b. The CPRE Planning Roadshow on 4 June was bought to the attention of the Parish Council.

To receive a report on meeting with DDC on Housing Land Supply and subsequent publication of 5 Year Housing Land Availability as at 01.04.15Parish Councillors had met DDC to discuss Housing Land Supply which has now been updated and shows DDC having adequate provision. However, this is open to challenge by developers which, in the absence of DDC's Local Plan, makes a Neighbourhood Plan essential. It had been indicated that the Local Plan might not be in place for 2 years.Due to restraints on resources, the planned Conservation Area Review will not be taking place in the near future.

d. To receive a report from the Vision for Badby Group on the production of a Neighbourhood PlanA meeting has taken place and sub-committees created. Progress is ongoing.

e. To report on meeting with Steven Merricks of Whetherdays nurseryFollowing a meeting, it was noted that Mr Merricks is in the process of clearing the site of rubble as agreed with DDC and there was no suggestion that the land is being prepared for development. The nursery is currently only open at weekends with a view to opening more days in the future.

f. To consider DDH proposal for ex-garages site on Pound LaneDue to illness, Dyane Pike of DDH had been unable to attend the meeting. The matter was therefore deferred to May.

g. To receive update on planning issues at Tall Trees, BadbyThis matter is to be further monitored and so was deferred to the May meeting.

h. To consider appeals receivedNone.

006/04/15 Ongoing businessa. Cemetery

The working party had done a lot of work and thanks went to those who had taken part. The gate will be cleaned and a noticeboard erected for the notices.MR reported that the mowing of the churchyard has now been arranged for this year.

b. Provision of defibrillatorKM reported that the grant has been approved. KM will look into what container is required.

c. GreensTo receive report on objection to village green registration on StonewayPC has received a response from NCC on the definition of the area of the Green which he will discuss with the resident concerned.To consider proposed works on The Green in relation to Empowerment Grant FundingPC will progress the matter.To consider replacement of storm damaged bus shelterQuotes will be available for the May meeting.To consider repair of vehicular damage caused to The GreenIt was agreed that the damage would be repaired by a Parish Council working party.

To agree quote for cutting of football pitchA quote of £50 per cut had been received. It was agreed that 4 cuts in total for the season be requested.

To include request to use Playing Field as car park for Bluebell Teas on 3rd and 4th May 2015The use of the playing field was agreed and will be manned at all times.

PC had received notification that some local roads will be closed on 3 May for an athletics race.

f. Rights of WayKA reported that work on the steps at the back of the cemetery was in progress and kissing gates are being installed.

g. Roads and safetyTo receive report on flooding at Pinfold Green/A361 junctionNothing to report.To include correspondence from residents adjacent to the Church regarding deposits on the public highway and possible erection of wooden postsA meeting with Ian Boyes of NCC had taken place. The Clerk was asked to contact residents to ascertain what action, if any, they would wish to take place.To include recent damage to verge and posts on Bunkers HillIan Boyes had advised that the cost of widening the verge would be in the region of £30,000 and that a one-way system would not be feasible.To include request from resident for 'No through road' sign at StonewayDDC are investigating providing a strap-around “No through road” sign. To include consideration of Community Enhancement GangsAW has submitted a list for consideration. Agreed to add work on the bank of Bunkers Hill.

j. TreesTo include works following recent tree inspection report and report on Brookside Lane treesMuch of the work has now been carried out. The contractor had advised that he would charge £100 for the removal of the root stump on Chapel Lane and would donate a new tree for planting. The Clerk will pass the matter to Lara Inglott.To include request for tree planting on Pound Lane, BadbyThe appropriate permission has now been received. PC will progress the matter with residents.

k. Village HallNew doors have been installed. It was noted that new terms and conditions have been drawn up but there is little legal difference to the set recently signed by the Parish Council.

m. To receive an update on Vodafone enhanced 3G rural coveragePC has offered a meeting with governors at Badby school to discuss any concerns raised.

It was agreed that permission be granted on the basis that the appropriate insurance be in place and that the area is returned to a proper condition afterwards.

n. Report on Clerk’s annual appraisalPC reported that he and KA had met with the Clerk. The appraisal form is currently in draft but will be finalised over the next few weeks. During the appraisal, the Clerk had been thanked for her support of the Parish Council over the last year.

o. To approve the minutes of the ordinary meeting held on 13th April 2015The draft minutes had been circulated prior to the meeting. Proposal: To sign the minutes as a true and accurate record of the meeting.Proposed by MW, seconded by MR. 6 for, 2 abstained. Carried.

p. To report on Annual Parish Meeting held on 17th April 2015 and consider actions arisingIt was agreed that the experimental format of the social evening had been successful with a welcoming and inclusive meeting having been held. Thanks went to the Clerk for the original suggestion. Notes are to be submitted from the groups who attended which the Clerk will collate and produce. The Parish Council will also need to record and consider matters raised with Councillors on the evening. The format will be reviewed in 2016 but the basic model retained.

003/05/15 Public Participation (1)a. District Councillor Gilford was congratulated on holding her seat in the recent election.

She reported that, due to the elections, no DDC meeting has been held.

b. County Councillor Brown apologised for not being able to attend the APM. He had, however, supplied his Annual Report. It was noted that, over the last 4 years, funding of local authorities has decreased by 45% which along with an increase in demand for services is leading authorities to become more innovative and NCC will be looking to use their assets to raise income.RB reported that £7,000 Empowerment Grant Funding is available and the Parish Council should consider making an application. The Parish Council recognised that RB has been very generous in past years and will indeed consider making an application.

d. Presentation of internal audit report for 2014/2015 accountsPC reported that the Council had received a clean internal audit report although additional information was requested on the Assets register.

e. To review 2015/16 budget and 4-year forecastPC had circulated updated figures taking into account working on an accruals accounting basis which will provide a more accurate picture going forward. New budget figures for 2015/16, incorporating sums accrued from 2014/15, were noted.

f. Report of changes in Deemed Contract rates by EONThe Clerk reported that NCALC are currently working on trying to get a better rate but have stated the EON had not raised the charges for some years and the new charges are not altogether excessive although the impact on the Parish Council's budget will be considerable.

g. To consider request from Badby PCC for funding towards costs of repairing church clockFollowing a request, Badby PCC had confirmed that it does meet the criteria under the Parish Council's Grant Awarding Policy. Discussion took place with regards to possibly using some of the last financial year's underspent funds.Proposal: to make a donation of £250 which equates to approximately 5% of the required funding.Proposed by MR, seconded by KA. All in favour. Carried.

It was noted that the grant application the Group intends to make will have to be paid into the Parish Council's bank account. PC and AW to discuss how this will be managed.

d. To consider DDH proposal for ex-garages site on Pound Lane – Deferred to June meetingDiscussion took place and it was agreed that it is imperative that DDH attend the June meeting. If that date is not convenient, a separate, public meeting should be held. The draft plan as provided raised several serious concerns.

e. To receive update on planning issues at Tall Trees, BadbyThe matter is currently being monitored. Deferred to next month.

f. To receive update on planning issues at Badby Lodge FarmDistrict Councillor Patchett has raised the matter with DDC. It was noted that although the Parish Council has commented, it has not formally objected to the application. The Clerk was tasked with making a formal objection.

RP will check with the grass contractor that he will be continuing the mowing this year.

GreensTo receive report on objection to village green registration on StonewayPC reported that a site meeting has been requested with NCC in view of the fact that the Parish Council and the resident have concerns over the boundaries as notified by NCC.To consider proposed works on The Green in relation to Empowerment Grant FundingPC will progress the matter and draw up a plan for the drainage work.To consider replacement of storm damaged bus shelterMW was asked to supply his quote to the Clerk who will compare it to others already received. A final decision will be made at the June meeting. To consider access across village green from Courtyard LaneFollowing a comment made at last months' meeting, the Clerk was tasked with writing to the resident concerned re-stating the position set out in the Parish Council's letter in 2009 that the resident does not have a right of access. It is prudent for the Parish Council to restate its position at intervals.

d. NewsletterVarious issues were raised. A draft will be produced for consideration at the June meeting.

e. Playing FieldTo include update on inspectionIt was noted that a monthly visual inspection should also be made. The formal inspection will take place in the next few weeks. The fence at the Chapel Lane end of the playing field is in need of repair. A working party will inspect and carry out appropriate repairs.

Discussion took place during which it was noted that the Parish Council needs to continually look at options for dealing with the issues of parking and heavy vehicular traffic in the village, these being the major concerns expressed by parishioners. The Clerk was tasked with having the matter put onto the agenda for the next Parish & Town Councils' Meeting.

Discussion took place with regards to the location of the defibrillator. It was agreed that the most relevant position at this time would be the village hall. Discussion would take place with the VHMC with regards to working together to put together the required planning application.

To consider request to erect a marquee on The GreenA request to erect a marquee in July 2016 for a village wedding had been received. It was noted that some conditions would need to be in place and some queries were raised. The Clerk reported that she had written to the resident at The Old School House with regards to the village green as requested at last month's meeting.

To include letters from Badby Allotment Association and M Freeman re mowingA letter had been received from the mowing contractor stating that the grass on the football pitch is now too long to be mown and could be offered for hay/silage. The Clerk will contact P Groves and D Fennell to see whether they would be willing to undertake the work.The letter from the Allotment Association requested that the area used for parking between the allotments and the cricket pitch be included in the mowing contract. The Clerk noted that previous arrangements for mowing had only been for the BMX track and the football pitch. Discussion took place and it was noted that the Parish Council should consider the extra cost of cutting the area.The letter also mentioned recent spraying of the BMX track with weed killer. It was noted that this is in line with the mowing contract.

Advice had been taken and it had been suggested that the Badby Parish Neighbourhood Plan Group should be constituted as a Working Group of the Parish Council to prepare the Plan. The Working Group would consist of Andy Witcomb, Ken Morris, Chris Nelson, Gill Nelson and Clare Crouch. It was agreed that the members of the Working Group should sign a Declaration of Interests. All payments and receipts would pass through the Parish Council accounts. Payment requests would require the signature of 2 members of the Working Group with authority delegated to the Clerk to make payments of less than £200. Consideration of request to erect a marquee on The GreenA request had been received to erect a marquee on The Green on 30th July 2016 to be used as an additional venue to the village hall for a wedding. PC and the Clerk had met with the family. An afternoon tea would be held in the marquee with the village hall also being used, particularly in the evening. PC had circulated a list of suggested points to act as the basis for a policy to be used for this and future requests. Various queries were raised and responded to.Proposal: to agree to the erection of a marquee on The Green for a wedding event on 30th July 2016. PC and S Weeks would meet with the organising company later to discuss further. The Parish Council was asked to consider what charity it might support.

Following some investigation, it was noted that 3 bikes had been using the motox track between 10am and 2pm one Sunday. The Noise Abatement Order issue a few years ago prohibits any practice events taking place. Mention was also made of track bikes being used on Tall Trees land. The situation would be monitored.

A resident had photographic evidence and the Clerk will seek to recover costs from those concerned.

Badby Parish Neighbourhood Plan

In February, the Parish Council received approval from DDC for the creation of a Neighbourhood Plan. Recognising the achievements of the Vision for Badby project, the Parish Council agreed to ask that group to take responsibility for the preparation of the Plan. The group reformed itself, with additional membership, as the Badby Neighbourhood Plan (BPNP) Group.

It was always stressed that the work of the Vision for Badby Group, and implicitly the preparation of a Badby Neighbourhood Plan, must be driven by and reflective of the concerns of the parish as a whole. The Parish Council was facilitator and supporter of the Vision for Badby work but at no point influenced the direction or work of the Group. This ‘arms-length’ approach needs to continue with the preparation of the Neighbourhood Plan. Nonetheless, in order for both the Parish Council and the BPNP Group to operate safely in this manner, we are advised that the BPNP Group should have the formal status of a Working Group the Parish Council. In particular:

1. The authority to produce a Neighbourhood Plan was given to the Parish Council and thus the Parish Council is ultimately responsible for ensuring it is done in accordance with the Localism Act 2011.

2. The Grant that BPNP has obtained from Locality can only be made to the Parish Council (because of 1). The Parish Council is not legally allowed to delegate financial decisions, thus it must approve all expenditure from the Locality grant.

3. The BPNP needs to be covered by appropriate public liability insurance; the Parish Council’s insurance policy provides this for groups and people operating on its behalf.

4. Were the Parish Council or BPNP to be found to have acted improperly in the preparation of the Neighbourhood Plan it could put the Plan at risk from challenges, not least by developers, or in the examination phase.

For full transparency, it is important for the Parish Council to agree the remit of the BPNP Group, so that it, the Parish Council and the public know what it is that the Group may do and the extent of its powers.

The Parish Council is asked to consider the following terms of reference:

“To prepare a Neighbourhood Plan for Badby in accordance with the Parish Council’s application (letter 7 July 2014) approved by DDC – recognising the need (a) for the Plan to be drawn from and reflect the interests and concerns of the whole parish of Badby, (b) to consult all appropriate authorities, – reporting as appropriate to the Parish Council and bringing a final Neighbourhood Plan back to the Parish Council after the appropriate examination and referendum stages.”

As a Working Group of the Parish Council, the BPNP Group is still subject to the Standing Orders and Financial Regulations of the Parish Council but is not bound by the same rules regarding calling meetings, quorum, etc. However, it may not make decisions that are the responsibility of the Parish Council, make binding financial decisions nor have a budget devolved to it. Thus the Parish Council will be making payments on behalf of the BPNP Group, so it must have appropriate procedures in place for approving expenditure and making payments. The BPNP Group has established a process to ensure that all costs are approved as falling within the approved budget and within the terms of the grant, before being incurred.

After getting advice from the Parish Council’s auditor and NCALC, it is proposed that:

(i) the Parish Council sees and records its approval of the BPNP budgets (Annex A),

(ii) the budgets and accounts of the Parish Council include a new line for Badby Neighbourhood Plan showing the expected income and expenditure of BPNP,

(iii) the Parish Council delegates to its Responsible Financial Officer (the Clerk) the authority to make payments up to £200 in respect of the Badby Neighbourhood Plan

(iv) the Parish Council reports all payments in its usual way on each Parish Council agenda.

The Parish Council is invited to consider, and if in agreement, approve these procedures.

005/08/{5 a. Background Note to the Registration of Village Green on Stoneway

1. This item relates to the Village Green on Stoneway, on the right where the road curves left to thenewer houses, with a distinctive and attractive willow tree. ln 1980 ownership of the Green wasgiven to the Badby Parish Council by the Commons Commissioner, but general advice from theDepartment for Food and Rural Affairs (Defra) to parish councils in the early 2000s was that thesuch decisions were not sufficient and that the ownership of town and village greens should beformally registered with the Land Registry.

2. The Parish Council believes that ownership of the Village Greens in Badby by the Parish Counciloffers the best means of protecting them in the long term for the good of residents and public,against damage, incursion or adverse possession. Areas defined as village greens are legallyprotected from damage and must be freely accessible for "lavuful sports and pastimes" includinginformal recreational activity and access by anybody across it. Therefore, in 2012 the ParishCouncil started the process of formal registration of ownership with the Land Registry of all eightregistered Village Greens in Badby.

3. During the consultation process a parishioner pointed out several deficiencies in the applicationrelating to the Stoneway village Green. These were: (a) the area being registered was wronglyshown, (b) the application did not recognise that the land had been maintained by adjoininghouseholds, not the Parish Council, and (c) the application did not take account of and protect theexistence of certain features on the land of importance to adjoining properties.

4. The application in respect of the Stoneway Village Green was withdrawn while these matters wereinvestigated. The process of registering the other Greens proceeded and was completed in 2014.

5. On point (a), the matter is complicated by the fact that the original area defined as the VillageGreen was amended in February 1977 to allow for the reconstruction and widening of Stone.wayto give access to the new houses that were being built there. This affected both the boundary andalso access to existing properties, including the construction by NCC of a supporting wall anddriveway. lt was clear, however, that the area the Parish Council had identified when starting theprocess of registering ownership was wrong.

6. Close examination of the Greens Registration Map (held by NCC) and other documents still leftuncertainties as to what constituted the legally-defined boundaries of the Village Green. A sitemeeting was arranged with Mr Phil Watson of NCC, who has responsibility for the registeredvillage greens in Northamptonshire, to clarify matters. This meeting concluded that the legally-defined Green comprises the area bounded in red on the attached map. (The south-east edge isshown along the edge of the pavement along Stoneway, as the implication of the RegistrationMap is that the original Green was truncated along there when the new road and pavement werebuilt. However, measurements taken during the site meeting from the scaled Registration Map donot appear to come allthe way to the pavement.)

7. On point (b), it is accepted that residents of the neighbouring properties have carried out generalmaintenance of the land including mowing the grass and trimming the willow tree which stands onit. lndeed, the 1980 Decision of the Commons Commissioner noted that the land "is a small area,not used for any specific purposes, but ornamental, and is largely maintained by adjoininghouseholders", and the Parish Council has seen photographic evidence that such maintenance ofthe land can be traced back at least 50 years.

B. Such attention by neighbours of greens and roadside verges abutting their homes is seenelsewhere within Badby and this is a valuable and typical attribute of village life, for which theParish Council is grateful. That said, it is a matter of record that the Parish Council has onoccasions at its Meetings addressed the matter of the care and preservation of the Village Greenon Stoneway and the willow tree situated on it.

9. On point (c), at some time in the past, even before the 1980 decision, cables and pipelines forutilities and wall buttresses had been installed on and beneath the village green. The area is usedto enable access to neighbouring properties, as indeed it is the right of anyone to cross a villagegreen (see para. 2 above). We have assured adjoining householders that in seeking formalownership of the area the Parish Council has no intentions of varying the rights of any individual inrelation to the use of the utility services or wall buttresses. Nor would it (nor could it, as the land isa Registered Village Green) limit the rights of any individual to traverse the area, including toaccess neighbouring properties. The Parish Councilwill ensure and protect its continued use aF a

Registered Village Green for such purposes by any person.

10. As regards taking matters forward, I suggest that it would be possible and advisable for the ParishCouncil to go ahead and apply for ownership of the area marked in green, i.e. the grass-coveredarea of the village green. This would leave the area marked in orange, which constitutes thetarmacked driveway leading to Marriotts House. As that latter area would continue to be aregistered village green, it retains the protections, limitations and obligations described in para.2in any case.

Luckily, photographic evidence had been supplied by a keen-eyed resident. The Clerk had spoken to the police and had been advised to contact the company direct. It was noted that the pole is now tilted and the light has been twisted around and so needs repairing, the cost of which should be obtained from the haulage company.

KA mentioned that a resident of The Glebe had noted that some of the works had been carried out following last year's inspection but not all. PC will speak to James Burton to find out what is still to be completed.

m. WebsiteThe Clerk and Denis Wilson had met for some training. It was agreed that credit card details required for the WordPress account need to be either those of the Parish Council (if available) or the Clerk. The Clerk will discuss with HSBC.

n. Vodafone enhanced 3G rural coverageAs agreed at the last meeting, the Clerk had notified Vodafone that Badby would be unable to proceed with the installation. However, Vodafone had responded that the Windmill had been in direct contact and were willing to go ahead. Vodafone is now considering installing one unit and will advise.

To include minor works to churchyard wallThe Clerk and RP have drafted a notice for the cemetery noticeboard. It was noted that a number of vases have been broken, presumably by the lawn mower. The Clerk will raise the matter with the contractor. MR thanks those who had helped in the recent working party at the churchyard.With regards to minor works to the churchyard wall, the Clerk is in the process of obtaining quotes for work which will be presented to the November meeting.

b. Provision of defibrillatorIt is currently unclear as to whether a planning application is required in addition to listed building consent. Once clarified, PC will make the appropriate application in the name of the Parish Council, as agreed with the chair of the Village Hall Management Committee. It was agreed that training should not yet be done but an update item should be lodged in the upcoming newsletter.

c. GreensTo receive report on registration of village green on StonewayPC has submitted papers to the solicitor to register the village green on Stoneway.

i. Street LightingTo update with regards to two incidents of damage to lamp postsIt was noted that the marking of some street lamps needs redoing. The streetlight in Stoneway has now been repaired. Some discussion took place as to whether the resident concerned should pay all costs. The Clerk was asked to find out from Western Power what the final costs will be and what protection had been on the post when it was damaged. Following further discussion on the required inspection of street lights, it was agreed that cleaning of each light be added to the inspection.Proposal: To add cleaning of each light to the inspection requirement at a cost £3.60 per light.Proposed by PC, seconded by KA. f. To receive update re DA/2015/0662 (Badby Lodge Farm)DDC have confirmed that the property is considered a Band E residential property and so does not pay business rates. It was agreed that no action be taken until such time as any appeal is dealt with. It was reported that another company was also operating from the site.

To include minor works to churchyard wallRP had looked into the issue of the broken vases. Nothing further to report.

b. Provision of defibrillatorThe VHMC has agreed to storage of defibrillator training aids. PC reported that agreement has been reached with DDC regarding the style of the sign to be erected onto the village hall and Listed Building Consent obtained. PC and SC to take forward with the VHMC.

c. GreensTo receive report on registration of village green on StonewayThe solicitor has drafted a Statutory Declaration to be signed. A few amendments have been suggested before further consultation with the householder and subsequent signing.

To consider proposed works on The Green in relation to Empowerment Grant FundingPC to progress.

It was noted that a number of vehicles had been parked on Church Green over the weekend. It is hoped that this is a one-off event. PC has erected a No parking notice on Church Green.

PC has also replaced a broken post on Church Green and requested permission to purchase a post rammer at a cost of £45. This was agreed.

It was noted that the water marker sign on The Green has still not been repaired. The Clerk was asked to chase.

d. Neighbourhood PlanAW reported that an open public meeting will be taking place on 28th February 2016. It was noted that over 200 households had responded to the recent door to door visits. Comments are now being combined for report at the next meeting due to take place on 13th January 2016.

e. NewsletterThe draft had been circulated and was discussed. Some additions will be made.

f. Playing FieldTo include request to make reparations to the BMX trackNo progress at the moment.KA reported that the bin has not been emptied for the last 2 weeks. The Clerk will contact Enterprise.

g. Rights of WayNothing to report.

h. Roads and safetyTo include damage to verge and posts on Bunkers Hill and Church Green.The post on Church Green has been replaced. The posts on Bunkers Hill are still to do.

To include report on meeting with Northants Highways re A361/Pinfold Green junctionDuring the meeting, it was agreed that vehicles could make a less dangerous exit from the village by using the left hand fork at Pinfold Green. This will be publicised in the newsletter.

It was also agreed that a request be made to NCC for 40mph roundels on the A361 and yellow lines on the exit from the A361 into the village (as proposed by Ian Boyes in his email of 26th November). NCC will make an annual county-wide application late in 2016.

To include discussion with Challis' re movement of large continental vehiclesPC and AW had attended a meeting at Challis’ and had been advised that the current increase in continental lorries is due to a current contract and is not a permanent move. Challis’ have provided clear instructions on how to access their yard but these are not always passed on to drivers. Challis’ would prefer not to advertise where they are by more signage for security reasons.

i. Street LightingTo update with regards to two incidents of damage to lamp postsThe Clerk had received a letter of thanks from the resident involved in the incident on Stoneway.

To include update on inspection and cleaningThe Clerk had requested confirmation of when the inspection will be taking place.

j. TrainingNothing to report.

k. TreesTo include report on works to trees on boundary of graveyard and Highfield, Vicarage HillA site visit had been made. Two trees on the recent report are within the resident’s garden (not the churchyard). The resident had kindly agreed to cover the cost of the tree works. However, a third tree is within the boundary of the churchyard and will be added to the Parish Council list. PC was tasked with asking ask James Burton to remove the ivy from this tree and add it to the Parish Council invoice.

To include consideration of monitoring of trees T5 and T6 on The GreenQuotes had been received.Proposal: To appoint Bruce Hatton to carry out a picus test and produce a written report on both trees at a total cost of £340.Proposed by PC, seconded by PJ. All in favour. Carried.

To include report on discussion with parishioner re a memorial treeA meeting had taken place with the resident, PC, KA and the Clerk. Since the meeting, the Clerk had contacted three companies (suggested by James Burton) but were able to supply a tree at a reasonable cost due to high delivery charges. The Clerk had, however, obtained a quote for a 6 foot tree at £50 inc VAT or a 9 foot tree at £75 inc VAT from a local nursery. It was agreed that the Clerk should speak to the resident concerned and then order the larger of the two. The Clerk had also been trying to contact M Venton at DDC to get agreement that the new tree replace the one recently removed from in front of The Old School House.

l. Village HallThe recent Race Night had raised £700. There is due to be a Jazz Night in the new year.

attend as many meetings recently as he would like which is due to other commitments within the County Council. He then went on to explain the reasoning behind providing the Empowering Councillors Funding as well as the current consultation on NCC’s draft budget resulting from continuing cuts. PC thanked him for attending when he can and also for the grants which the Parish has received in recent years.

b. A member of the public noted that there has been no progress on the Pound Lane planning application since mid-November.

b. Provision of defibrillatorPlanning consent has now been received. A member of the public suggested obtaining sponsorship for the ongoing costs, e.g. batteries and defibrillator pads.

c. GreensTo receive report on registration of village green on StonewayPC reported that registration is now progressing. A draft submission has been prepared by the solicitor.

To consider proposed works on The Green in relation to Empowerment Grant FundingNo progress to report due to the weather conditions.

d. Neighbourhood PlanAW had submitted a report. A meeting of the Group will be held at The Windmill on 13.01.16 with a formal consultation to the village on 28.02.16 in the village hall. It was also noted that a number of cheques will be requested for payments to be made by 31.01.16. These payments will be in line with the procedure previously agreed and the appropriate paperwork being submitted to the Clerk.In response to a question from the public, it was agreed that continuing dialogue between all parties – the Parish Council, the Group, the parishioners of Badby and the planning authorities – was essential to achieve a satisfactory outcome beneficial to the parish.

e. NewsletterThe newsletter had been published at the end of December. Thanks were passed to the Clerk.

f. Playing FieldTo include request to make reparations to the BMX trackNothing to report.A member of the public requested that consideration be given to having a litter pick this year.KA reported that the bin had been emptied when put out.

g. Rights of WayAn overhanging dead branch was reported on the footpath between the 2 stiles above the cemetery. This will be dealt with.

h. Roads and safetyTo include damage to verge and posts on Bunkers Hill and Church Green.A working party will be arranged to make appropriate repairs. AW reported that he had requested clearing of the drain by Pinfold Green which had overflowed again during recent storms.The Clerk was asked to find out when the Daventry ring road is likely to open again and whether more appropriate diversion signage can be erected quickly to avoid heavy vehicles ending up in the village.

b. District Councillor Gilford addressed the meeting with regards to a new consultation due out on the frequency and format of waste and recycling collections under the next DDC contract in 2018. It was agreed that all members of the community should be encouraged to comment.

RP reported that the contractor will not be able to continue mowing the cemetery this year. RP and the Clerk were tasked with obtaining quotes for consideration at the next meeting.

RP reported that Les Finn had kindly laid down a very old gravestone for no charge. He will repair another very old gravestone for which the Parish Council has no contact details for £30 at the Parish Council's cost. There is one other gravestone which is not dangerous but has some movement. The Clerk was asked to write to the family concerned quoting £20 to have the work done.

To include correspondence re condition of access and request for bird boxesIt was noted that the area of land outside the cemetery gate is not the property of the Parish Council but it was felt appropriate to purchase a bag of gravel to improve the condition of the ground. Discussion took place regarding recent flooding. SC noted that the culvert on Brookside Lane needs clearing out. A member of the public also reported that the pipes over The Nene by Bridge House were actually carrying electric, telephone and probably gas lines. The pipes are damaged and so the Clerk was asked to contact the appropriate authority to get repairs carried out.

NCC has requested applications for Community Engagement Gangs. Councillors were asked to forward suggestions to NS and the Clerk to enable NS to submit an application.
