producers. Commissioner Vandiver thanked him for being at the meeting and looks forward to working with him. He also thanked Commissioner Glen Cope for all his work and time of service, and he will be missed.

Commissioner Vandiver extended thanks to the University of Missouri Forage Systems Research Center for hosting us. He introduced Rick Tate, who is the farm manager of the Research Center, and is filling in for the Superintendent, Dave Davis for the welcome. Mr. Tate said the farm is approximately 1,200 acres; 1,000 acres of pasture, 200 acres of timber ground, and has about 280 head of beef cows. The farm has been involved in many beef cattle and forage research projects and also partnered with NRCS on water quality projects. This facility's claim to fame is that it is the founding place of the Management Intensive Grazing School that started in 1990. People came from all over the United States to learn proper rotational grazing techniques, with over 20,000 people since 1990. They currently host Teach the Teachers Grazing School, in the classroom and on the farm, then return to their districts and teach what they have learned. The farm was donated by the Cornett Family in 1965 and later parts of the farm were donated by other families. The Cornett Family furniture is located on the campus.

B. MINUTES FROM THE AUGUST 14, 2019 MEETING A motion was made by Commissioner Ralph Gaw to approve the August 14, 2019 minutes. Commissioner Kenny Lovelace seconded that motion. The motion passed with all in favor.

C. REPORTS AND UPDATES 1. DEPARTMENT OF NATURAL RESOURCES

Mr. Kurt Boeckmann provided updates from the Department. Mr. Dru Buntin, Deputy Director, is out on the road today. On behalf of Deputy Director Buntin the Department would like to welcome Mr. Keith Stevens to the Commission and thank Mr. Glen Cope for his years of service as a Commissioner.

There are continuous efforts of the flood recovery advisory work group; the next meeting is October 17, 2019. The committee continues to work on different aspects of both the Missouri and the Mississippi Rivers. By the end of December, the work group will be reporting to the Governor's Office on short and long term remedies suggested for the rivers. Also, the four states (Iowa, Missouri, Kansas and Nebraska) are working to identify some of the different options for the Missouri River. The Army Corps of Engineers (ACE) continues to run water at 80,000 cubic feet per second out of Gavins Point Dam, which is a tremendous amount of water. That amount of water is a result of high snowmelt and rain and is needed to be released to maintain levels in the dam. Next spring does not look good regarding flooding. There are over 100 levee breaches in the Missouri and Mississippi River basins that the ACE is working hard to get fixed.

The Department has been working with the partners and plans to apply for an extension for our current Regional Conservation Partnership Program (RCPP) Project that focuses on targeted conservation in different watersheds across the state.

2. SOIL AND WATER CONSERVATION PROGRAM DIRECTOR'S COMMENTS Ms. Colleen Meredith welcomed Commissioner Stevens and appreciates his being here and having a full complement on the Commission. The Department is working with NRCS on a Memorandum of Agreement for the Commission, the Department, NRCS and Districts and is hoping to have it signed at the Training Conference to go out for final signatures by the districts. NRCS sent copies to all the districts and asked for their comments to be sent back in by September 13, 2019. Mr. JR Flores added that NRCS has a deadline to have it signed, sealed and approved by December 30, 2019, and said this Memorandum of Agreement is to facilitate working together and enables having partners working in their offices.

a. Missouri Association of Soil and Water Conservation Districts (MASWCD) 2018 Resolutions Response Letter Ms. Colleen Meredith reported that the Missouri Association of Soil and Water Conservation Districts (MASWCD) 2018 Resolutions response draft letter is with the Commissioner's information at the table. This letter is in reply to the resolutions that were passed at the MASWCD 2018 Annual Meeting to show what the Commission actions were in response to the resolutions. She will sign the letter and send it to MASWCD so that they will have a record of this for the upcoming Training Conference.

b. Streambank Before and After Photographs of Sites Mr. Jake Wilson presented the before and after photographs from the streambank site tour in association with the October 11 , 2017 Commission meeting, and other sites association with the Natural Resources Damages projects. This was requested by Commissioner Gaw at a previous meeting. These photos were pictures of the stream bank avulsion on Big River in Potosi, bank erosion on Brocks Branch, Potosi, bank erosion on the Black River, Annapolis, bank erosion on the West Fork of the Black River, in Centerville, and bank erosion on Center Creek in Jasper County. There was some discussion on the various sites in the photos. The sites looked good and the vegetation on all of these projects has done really well. Marty Comstock, NRCS State Engineer, was asked some questions on the details on some of the engineering work that took place on one of the sites they saw on the tour. The Commission thanked the program for the follow up of the stream bank projects.

c. Volkswagen Trust Funding Opportunities Ms. Emily Wilber, Planning Section of the Air Pollution Control Program, Missouri Department of Natural Resources, gave a report on Volkswagen Settlement Funding Opportunities in Missouri. The Air Program's job is to make sure they develop and implement strategies that will bring the air quality into compliance with the National Ambient Air Quality Standards. She discussed some background information on the Volkswagen Settlement and explained Missouri's Beneficiary Mitigation Plan. She also reviewed the use of FY 2019 funds and then talked about the plans for FY 2020. Missouri will participate in EPA FYl 9 Diesel Emissions Reduction Act (DERA) grant program. She went over some of the projects that fall under one of the eligible diesels emission reduction solutions which may include, but are not limited to nonroad engines, equipment or vehicles used in agriculture.

3. FY19 Cost-Share Update Mr. Bill Wilson provided a report on cost-share for FY20 as of October 7, 2019. Approximately $50.88 million is allocated and approximately $26.25 million obligated, with $18. 7 million obligated in Sheet and Rill/Gully being the highest. There are currently 6,788 contracts with approximately $1.7 million in contract payments.

He then presented the FY20 total supplemental allocations provided to districts as of October 3, 2019, which was about $17.5 million in 91 counties.

D. NEW BUSINESS REQUEST 1. Program Delivery and District Operations Committee Update

Mr. Jim Boschert reported that the Committee met on July 11 and 12, 2019. He presented the agenda they had for that meeting and reported that there was a lot of good discussion. At the May 7, 2019 Commission meeting a slide on how to address common audit findings was presented to the Commission; they had several concerns with this agenda item, and asked that they take this list to the Program Delivery and District Operations Committee for recommendations. Mr. Boschert sh.owed the maps showing the audit findings per SWCD. Some of the findings were: bank reconciliation not done, no documentation of board reconciliation done, payroll calculations were incorrect, or payroll check issued for the wrong amount. Mr. Boschert went over other items that were discussed at the Committee meeting and provided recommendations from the committee for the Commission to consider. There was discussion, comments and questions from the Commission. Commissioner Ralph Gaw asked if the Program is asking for the development of the list into policies, or asking to approve these as policies and do the regulations later. Mr. Boschert explained that the program is asking the Commission's concurrence with these items and then the program will start putting draft policies together for items such as the credit card use by the district. Commissioner Gaw

commented that he would like to see that whoever has the credit card is covered by a surety bond. Mr. Boschert said that he and Ms. Meredith have a meeting scheduled next week with the Office of Administration in regards to surety bonds.

Commissioner Vandiver commented that he appreciates that this has been discussed in the Program Delivery and District Operations Committee and members have had a chance to share their comments and work together for adequate policies. Commissioner Lovelace expressed that he feels that these discussions have come a long way since the first time presented to the Commission. Mr. Boschert also shared that this was discussed at the Area Meetings as well and there were no major concern brought up with these items.

Ms. Meredith asked the Commission if they could act on an organization resolution from UMB Bank who is the state provider of credit cards which will allow districts to get credit cards through UMB as well. Commissioner Ralph Gaw made a motion to pass the organization resolution and agreement authorizing credit card usage by the districts as set forth in the agreement which is part of the Commission's official records. Commissioner Keith Stevens seconded the motion; the motion passed with all in favor.

Commissioner Gaw made a motion that we do not allow debit cards to be used by the districts or ourselves for program business after the implementation of the credit card resolution. Commissioner Kenny Lovelace seconded the motion; motion passed with all in favor.

2. Andrew County SWCD Request for Reconstruction of a DWP-03 Sod Waterway Practice that was Damaged by a Storm Mr. Jeremy Redden reported that the Andrew County Soil and Water Conservation District is requesting to approve a contract for reshaping and reseeding of an existing DWP-03 Sod Waterway for contract SGE 109-19-0064 that is currently under a maintenance agreement. The Reconstruction Assistance can be found in the Cost-Share Handbook Section V page 6, which states: Reconstruction assistance is available for practices that failed during the maintenance life of the practice. Districts must request cost-share if a single storm event causes widespread failure of state cost-shared structural practices. The request to provide assistance for reconstruction must be approved by the Commission before the board approves the contract.

The background of this contract and the Commission authority was reviewed. The Board approved original contract payment on 11/06/2018. Payment of $5,524.20 was made on November 26, 2018 for the 2.4 acre waterway practice. On May 31 , 2019, a seven-inch rain created ditches in the newly built waterway before the grass could be established. The area impacted from the rain event that needs repair is 1.2 acres, and the area that needs to be reseeded is 1.6 acres. The

district is asking for components of medium grading and shaping for 1.2 acres and reseeding of 1.6 acres to bring the waterway back NRCS standard and specifications. The total cost of the waterway reconstruction contract will be $2,192.98.

Commissioner Kenny Lovelace made a motion to approve the Andrew SWCD board's request allowing reconstruction in the amount of $2,192.98 on contract SGE 109-19-0064 DWP-03 Sod Waterway that was damaged from a rain event. Commissioner Keith Stevens seconded the motion; the motion passed with all in favor.

3. Chariton County SWCD Request for Reconstruction of a DSL-05 Diversion Practice That is Currently Under Maintenance Ms. Kelsey Kempker presented the Chariton County Soil and Water Conservation District request for a variance to approve a new DWP-1 Water and Sediment Control Basin with an underground outlet to replace the DSL-44 practice, contract SGE 079-1 7-0026 that was installed in 2017 and is causing erosion issues due to technical design error. The Commission authority and background of the project was reviewed. The board approved the original contract payment SGE 079-1 7-0026 on May 17, 2017. Payment of $1,818 was made on June 6, 2017. The practice was planned to prevent runoff from flowing into a planned terrace downslope on a neighboring property. The practice was designed by a previous district employee with job approval authority. October 9, 2018, the operator expressed concern about the erosion in the channel of the terrace/diversion. On July 9, 2019, NRCS and the district specialist visited the site and found a "considerable gully" in the channel of the terrace and outlet. NRCS recommendation is to remove a portion of the diversion and use the remaining portion of the diversion to build a DWP-01 Water and Sediment Control Structure by installing 1, 100 feet of 6" underground tile discharging in the main ditch at property line. The total cost estimate is $5,648.

Commissioner Ralph Gaw made a motion to approve the Chariton SWCD Board's request by providing a variance allowing them to develop a new DWP-01 Water and Sediment Control Basin contract for approximately $5,648, and releasing the maintenance requirement on contract SGE 019-17-0026. Commissioner Keith Stevens seconded the motion; motion passed with all in favor.

4. Ray County SWCD Request for a Variance from Required Crop Rotation in the N340 cover Crop Practice Mr. Cody Tebbenkamp reported that the Ray County Soil and Water Conservation District is seeking a policy change to the N340 Cover Crop practice to allow the practice to be installed in fields where there is not a two production crop rotation as required by current policy.

The SWCD would like to be able to provide cost-share assistance to cooperators who have continuous beans or continuous com for silage. The N340 Cover Crop Practice policy was reviewed from Cost-share Manual page V-34. Policies: 2. Contracted acres must currently be in a minimum of a 2 species production crop rotation. The purpose of the 2 production crop rotation policy is to increase the diversification in the fields for soil health benefits and has been in policy since the inception of the practice. The Commission policy is more stringent than NRCS standard and specifications for production crop rotation requirements.

Commissioner Ralph Gaw made a motion due to the district' request to change the Commission's policy for the N340 Cover Crop practice, refer this issue to the Current Conservation Practices Committee for a recommendation. Commissioner Kenny Lovelace seconded the motion; motion passed with all in favor.

5. Schuyler County Variance Request to N340 Cover Crop Practice Tillage Requirements for Planting Cover Crops Ms. Kelsey Kempker reported that Schuyler County Soil and Water Conservation District is seeking a variance to the N340 Cover Crop practice to: allow tillage above the STIR value of 20, and also the 25% tillage to repair/smooth ruts caused by heavy equipment on land with ephemeral gullies due to excessive rainfall. The Commission Policy and background was reviewed.

Schuyler SWCD received excessive moisture March-July 2019 causing ephemeral gullies. March-July 2019 was 140% above normal rainfall, May 2019 brought 14.55 inches ofrain which was 259% above normal, and May-June 2019 brought 21.25 inches of rain.

Mr. Ed Barry, Chair of the Schuyler County Soil and Water, stated their request is for at least a temporary variance due to the adverse weather conditions. There were no pictures because there were no crops harvested hardly at all due to the weather in their area. It is still really muddy. They could not get a good picture of the erosion. A lot of the crops that were rio-tilled last spring were no-tilled over the rills, the rills turned into gullies that none of us want. He suggested increasing the seeding rate of cover crops.

Chairman Vandiver asked some questions to better understand. There was a question on minimum tillage and doubling the seeding rate. Commissioners had some discussion. The Commission does appreciate photos of the damage before making a decision.

Mr. Derrick Steen shared some comments regarding serious issues that farmers are going to deal with this fall due to the rainfall. If they signed up for a cover crop and if they are not allowed to put the cover crop on because of the tillage then they are probably not going to put cover crop down

Commissioner Ralph Gaw made a motion to provide authority to the Soil and Water Conservation Program until November 15, 2019 to approve variances for Schuyler SWCD on a case by case basis to repair ephemeral gullies with sufficient documentation (photos, site visit etc.) for their request. Commissioner Kenny Lovelace seconded the motion; motion passed with all in favor.

6. Pettis SWCD Request to Allow Payment of a DSP 3.1 Grazing System Water Development Practice Started Prior to Board Approval of a Contract Mr. Cody Tebbenkamp reported that Pettis SWCD is requesting to approve two DSP 3 .1 Grazing System Water Development contracts where the practices were started prior to board approval of contracts GM 098-20-0012 for $6,299.84 and Contract GM 098-20-0009 for $5,985.89, both totaling $12,285.73.

Both contracts were submitted for contract review on August 15, 2019 and were originally denied because the producer had not attended a grazing school as required by policy. The producer attended a grazing school later that month in a neighboring county. The contract information was reviewed. The Pettis SWCD is requesting to make payment on the contracts as this is the first time the cooperator has participated in the cost-share program and there was a misunderstanding of the process. The Commission Authority 10 CSR 70-5.060 (3) was reviewed.

The landowner from Pettis County stated that the wells have been installed and are adequate. They had too many irons in the fire and it slipped his mind that he needed to have the grazing school completed first before they would issue a contract. It was no one's fault but their own, but unfortunately they got their wires crossed but wells are in and up to specs. This is the first cost-share program they have ever done.

Commissioner Kenny Lovelace made a motion to support the Pettis SWCD board's request by providing a variance to policy allowing the board to approve DSP 3.1 Grazing System Water Development contracts GM 098-20-0009 and GM 098-20-0012 that were started prior to board approval of the contracts. Commissioner Ralph Gaw seconded the motion; motion passed with all in favor.

7. Polk County SWCD Request Regarding a Maintenance Violation on a DSP-02 Permanent Vegetative Cover Enhancement Practice (The Commission deferred this agenda item until the December 2, 2019 Commission meeting.)

8. 4Rs Nutrient Management Pilot Practice Policy Mr. Jim Plassmeyer reported that there were previous meetings that were held to discuss the 4R plans for MO. The draft policy was reviewed. The practice is to

demonstrate the environmental, economic and agronomical benefits of the 4R nutrient stewardship program and to utilize established retail nutrient programs that meet 4R principles and certifications guidelines. There will be a $12/acre incentive payment with $10,000 lifetime maximum_. A Missouri Fertilizer Control Board representative will certify the practice meets Commission and 4R policies and sign the cost-share documents.

Commissioner Keith Stevens made a motion to approve a 4R Nutrient Management Pilot Program based on the policies submitted. The pilot will cover four to six districts for up to 3 years. Commissioner Ralph Gaw seconded the motion; motion passed with all in favor.

9. Soil and Water Conservation District (SWCD) Supervisor Appointments There were no appointments to discuss.

E. APPEALS AND VARIAN CE REQUESTS 1. Chariton County Landowner Appeal to a Denial of Cost-Share for a

DWC-01 Water Impoundment Reservoir Practice Ms. Kelsey Kempker reported that Mr. John Bell is requesting an appeal to the program office denial of site eligibility for his DWC-01 Water Impoundment Reservoir. On July 29, 2019 the district submitted the site for eligibility review. Policy was reviewed. On August 2, 2019 program office staff went out to the site for an eligibility review. During the site visit, staff found part of the area was already cleared and unable to determine the actual amount of tree canopy covering the proposed site. The landowner's letter indicates the area was covered with small hedge, cedar and honey locust trees. Based on the latest aerial imagery and the site visit seeing that the site had already been cleared, the program office denied the location following Commission policy and previous actions by the Commission for similar appeals. The Commission consideration is to maintain Commission policy, which denies Mr. John Bell's appeal on the site eligibility determination for a DWC-01 Impoundment Reservoir.

There were questions from the Commissioners. Ms. Kempker mentioned that the landowner is not present but members of the Chariton County Soil and Water Conservation District Board are present. The Commission reviewed the pictures and had some discussion. Mr. Kenny Reichert, SWCD Board Chairman stated that this has been a difficult issue for the board. There are policies to be followed but he also knows that there may be a variance allowed. The board left this for a Commission decision. Commissioner Vandiver reminded everyone that the policy states that the program do not build ponds in wooded areas even though the farmer is trying to do the right thing. The farmer could be eligible for assistance in possibly another program such as grazing system water development.

Commissioner Ralph Gaw made a motion to maintain Commission policy, which denies Mr. John Bell's appeal on the site eligibility determination for a DWC-01 Impoundment Reservoir. Commissioner Kenny Lovelace seconded the motion. Commissioner Keith Stevens made a comment that maybe the landowner could apply this to another program to get assistance. The motion passed with all in favor.

F. PARTNERREPORTS 1. NRCS

Mr. J. R. Flores, thanked the Commission for the invitation to be at this meeting. He reported that this year was a record year for NRCS with dollar obligations and also getting conservation on the land, but would report more on that at the December meeting. National Headquarters is currently developing the FY20 Program Interim Rules so the program sign-ups will be announced soon. A Federal Disaster Declaration for flooding was amended September 30, 2019, to include 14 more counties for Public Assistance; the current number is at 83 counties, which makes the Emergency Watershed Program (EWP) available in those counties. Sponsors have until October 31, 2019 to request EWP assistance. There have been many applications received, the Damage Survey Report (DSR) teams are fighting the weather to get their damage survey reports completed.

The launch of the updated Regional Conservation Partnership Program (RCPP) was announced September 3, 2019 .. Potential partners are encouraged to submit proposals that will improve the nation's water quality, combat drought, enhance soil health, support wildlife habitat and protect agricultural viability. Up to $300 million is being made available for RCPP projects for FY 2020. Proposals are due December 3, 2019. The details on how to apply can be found on NRCS website.

Mr. Flores expressed appreciation for comments on the Memorandum of Agreement for the local Soil and Water Conservation Districts (SWCD), the Missouri Soil and Water Districts Commission, and Missouri Department of Resources and NRCS.

A new MDNR and NRCS Contribution Agreement supporting technical assistance to the SWCDs has been signed. This new agreement supports the partnership effort for another five years. NRCS completed 29 new contribution agreements with partners in FYI 9 and modified 28 existing agreements. NRCS has obligated $13 million this past year. With all the agreements and grants with partners, NRCS has $64 million outstanding at this time. There is a lot of work going on and many positions delivering conservation assistance, and are very happy to have this great partnership. Several of the partners are present here at this meeting.

A Conservation Planning Part 2 course is scheduled this week in Columbia for 29 . new conservation Planners, 15 of which are soil water conservation district

employees, which is great. NRCS is moving forward with New Pathways Student Opportunities. They will be advertising for 24 Pathway positions later this month. These are the college students that are hired for the summer months.

2. University of Missouri Ms. Valerie Tate, Agronomy Specialist for the University of Missouri Extension is headquartered in Linn County at the Extension Office in Linneus and is taking the place of Dr. Rob Kallenbach, who is unable to attend today. She expanded on what Mr. Rick Tate said this morning when he provided the welcome and overview of the facility. This site is the birthplace of the Missouri Management Intensive Grazing Schools. They started in 1990 when Jim Gerrish was Superintendent, Ron Morrow was the MU Beef Production Professor, and Maurice Davis was a Grazing Land Specialist with what was then the Soil Conservation Service. They wanted to provide a three day educational experience for landowners, who could come to this location, and not only learn some of the science behind the grazing systems, but also some of the mechanics. Then they took part in some of the field exercises, and made a visit to landowners in the area that were implementing some management intensive grazing systems. Those workshops became so popular that after a few years, there was a wait list to get in.

In 1993, Regional Grazing Schools began. Now they hold about 30 of these a year at numerous locations around the state. They no longer hold grazing schools open to the public here. They hosted a Train the Trainer Session where the Coordinators from the nineiegions, which includes one University of Missouri Coordinator and one Natural Resources Conservation Service (NRCS) Coordinator, met here along with staff from the University of Missouri and NRCS, who were interested in teaching the workshops. They helped fine tune the curriculum so that all the grazing schools around the state are being instructed the same way and landowners are receiving a similar experience, regardless of where it is held in the state.

There was an Economic Impact Study done about a year ago by the University of Missouri, and she had a few copies with her, if anyone wanted to see one. It was determined that each year, the impact of the Management Intensive Grazing School is $125 million to Missouri's economy. This is a tremendous tribute to the work that the University of Missouri and NRCS do with the educational part through the Grazing Schools and the cost-share practices through NRCS and the state cost-share program that help with implementing these grazing systems. She thanked everyone for this opportunity.

3. Department of Conservation No representative present.

4. MASWCD Mr. Ron Willis is representing Mr. Ryan Britt, Missouri Association Soil and Water Conservation Districts, who was unable to attend this meeting because of harvesting com. Mr. Willis is 1st Vice President of the association. He said that harvest conditions were not good in his area and he was glad to represent MASWCD at the meeting. The MASWCD is planning the Training Conference at Margaritaville Lake Resort, previously known as Tan Tar A, at the Lake of the Ozarks, December 2-4, 2019. The MASWCD feels it is a very good conference and hopes for good attendance from soil and water conservation districts and partners.

5. Department of Agriculture Mr. Chris Klenklen is representing Ms. Chris Chinn, Director of the Department of Agriculture, who could not attend this meeting. He reported that the Department is co-chairing the flood recovery work group along with the Department of Natural Resources, which is an on-going process since weather is not cooperating. He has worked with numerous flood and drought events in Missouri, but this one seems to be one that is impacting two growing seasons. Generally, there is one season that is affected and then things get fixed and back to business the next year. He can see some real :financial struggles for some communities that are along the river this year, resulting in serious :financial problems if crops aren't planted.

He mentioned that Dr. Kallenbach has talked about the changes coming to the pesticide training rules. This is an issue that the Department of Agriculture is working on with the University of Missouri. Commercial applicators and farmers that apply pesticides will be required to attend some new pesticide training. This _is not a Department requirement but an EPA requirement.

The Department of Agriculture submitted their Industrial Hemp rules this week to the Secretary of State. They hope to see these published by November 1, 2019. They also know that the USDA will have changes for their hemp rules, hopefully later this month. The Department.wants to stay compliant with the Federal Government.
