District visitsOn 07 April 2009, the President visited Oecussi for his public outreach activities with

the community.

Diplomatic accreditations

On 14 April 2009, the President received Credential letters from Palestinian AuthorityAmbassador for Timor-Leste, H.E. Mr. Izzat Salah Abdal Hadi, Ambassador ofRepublic of Cyprus for Timor-Leste, H.E. Mr. Yannis Lavcovou both based in Jakartaand from the Ambassador for Sahrawi Arab Democratic Republic, H.E. Mr. KamalFadel Mohamed based in Australia.

Others

On 21 April 2009, the President has a meeting with people from various sectors inHotel Timor to discuss issues concerning land ownership and property.

On 23 April 2009, the President met with about 100 NGO's at the CSO- PresidentMeeting at NGO Forum.This meeting was to discuss policies: 1) to create zone ofpeace in national and districts levels, 2) to reduce poverty, 3) Government's plans totake over state properties; and 4) inauguration of the NGO Forum Computer TrainingCenter which will provide computer training and internet service to NGO members.

Others activities and observations

In April 2009, the National Parliament had 6 out of 8 plenary sessions (6, 7,14, 20, 27, and 28 April 2009)2.

o On 07 April 2009, the NP did not approve any legislation due to lackof quorum, as some members had to leave the Parliament for overseasvisits or other activities within the country.

o On 13 April 2009, the NP did not have any plenary session due toabsence of agenda.

o On 14 and 20 April 2009, the NP did not have plenary session on theafternoon due to lack of quorum.

o On 21 April 2009, no plenary session was held due to problems withthe sound system iniciated on the afternoon of the previous day andlack of quorum.

Committee A held public hearings from 15 to 30 April 2009 in Dili and in thedistricts of Ermera, Liquia, Aileu, Baucau and Covalima on decentralization,

local governance, territorial division, municipal and suco council electionlaws.

On 20 April 2009, Ms. Aicha B. Uamar Bassarewan assumed the seat of Ms.Ana Pessoa from FRETILIN political party.

On 25 April, Committee C members left for Brazil on a three week visit forcomparative studies on their relative ares of Economy, Finance and Anti-Corruption.

Among other issues discussed in the Plenary in April, were the following:- Enquiry into the role of the members of Parliament and its lack of quorum.

- Fretilin political statement on the purchase and sale of rice by the AMPand calls on investigation.

- Dark oil affecting population water in Lequidoe, Aileu District- Request for invitigation on: the recruitment of an interim director, alleged

falsification of electoral cards for pension for the elders, environmentalimpact of the heavy oil Generator, Governments lacking of transparencywith international contract companies, unbalanced distribution of tractorsin Oecussi, on the removal of manganese (minerals) in Vemasse andurgency to investigate the incidents of 11/2/2008 and to follow up on theCOI recommendations on 2006 crisis.

- Request to suspend PNTL Commissioner, Mr. Longuinhos Monteiro dueto court case against him.

- Request to include in the agenda of discussion the CAVRrecommendations

- Request for a law on the Fisheries and preservation of Timor sea.- Lack of infraestructure- Allegation of corruption against Minister of Justice.

The word law can be used with three different meanings, according to the intended scope. In thebroadest sense, law is every legal rule, written or not, and covers the habits and all rules formallyproduced by the State. In a broad sense, law is the written legal rule, excluding legal habit. In a strictsense, it means the normative act by excellence, issued from the National Parliament.

LAW-MAKINGScience that studies the ways of designing and writing normative acts. In colloquial terms, law-makingis the art of drafting laws well, in the sense that it consubstantiates a set of rules law-making rules the purpose of which is to contribute to a good drafting of laws.

LEGAL PROCEDURESSet of legal requirements for starting a process.

LEGISLATIONSet of legal precepts regulating a certain matter.

LEGISLATIVE ACT

Manifestation of the will with strength of law and meant to produce law effects. It is one of the threesovereign powers of the State, responsible for the drafting of laws.

LEGISLATIVE COMPETENCELegal capacity for drafting laws, decree-laws, regulations and decrees.

LEGISLATIVE POWERPower to legislate, create and sanction laws. The goal is to draft law rules with general or individualscope that are applied to all society, in view of satisfying the needs of the pressure groups; publicadministration; society. The legislative power elementary functions include that of overseeing theexecutive power and voting on budget laws.

NATIONAL PARLIAMENTAssembly of representatives elected by the citizens in democratic regimes, normally holding legislative

power.

ORGANIC LAWLaw on the organization and operation of the Government and respective Ministries. It covers thegeneral dispositions and sets up the main functions and actuation instruments.

PUBLIC ADMINISTRATIONIn organic or subjective sense, Public Administration is the set of State bodies, services and agents, aswell as the further public legal persons, which ensures the satisfying of various collective needs, suchas security, culture, health and the wellbeing of the populations. A person employed by PublicAdministration is called a civil servant. It can also be defined objectively as the concrete andimmediate activity that States develop for ensuring collective interests, and subjectively as the set oflegal bodies and persons to which the Law attributes the exercise of the administrative function of theState.Under the operational aspect, Public Administration is the perennial and systematic, legal andtechnical development of the services belonging to the State, benefiting the whole.

PROMULGATIONInternal legal act by which the President of the Republic attests the existence of a duly ratified law,Decree-Law, treaty, etc., and order its execution within the territory. It is important to highlight thedifference, in practical terms, between the effects of ratification and those of promulgation. If a Stateratifies a treaty but does not promulgate it (and if its constitutional law requires promulgation), the

conventional text is mandatory in the international sphere but not in the internal one. In this case, theState in question may be asked by other Contracting Parts to fulfil some of its conventional obligations,but one of its internal bodies may refuse to do so because of lack of promulgation. The faulty State thenincurs in a situation of international accountability.

REVALIDATIONReposition in force of a previously revoked law (or legal precept).

A sovereign State is characterized by the saying"One government, one people, one territory".

Planning instrument that expresses Government Programs monetarily, in order for a financial exercise,discriminating the objectives and goals to be achieved by the Public Administration.

UNCONSTITUTIONALITYContrariety of the law or normative act (resolution, decrees) regarding the Constitution. Thisincompatibility can be formal (lack of observance of the necessary rules for the process of legislativedrafting or edition) and / or material (concerning the very content of the law or the normative act, andits conformity with the constitutional principles and rules).
