    Plaintiff CoUegeNET, Inc. ("CoUegeNET") respectfully moves for entry of an orderauthorizing expedited discovery in aid of a Motionfor Preliminary Injunction that CoUegeNETintends to file against Defendant Google, Inc. ("Google"). Counsel for CoUegeNET hasattempted to meet and confer by telephone with Google's in-house counsel pursuant to LR 7-1(a). Google hasnotyetappeared in the action, butaccording to press reports hasa large staffofover 100 in-house attorneys covering a variety of disciplines. CoUegeNET left a voicemailwith

    the in-house trademark counsel, Christine Hsieh, who had responded to CollegeNET's initialeffort to resolve the matter without litigation. If Google responds to CollegeNET's meet andconfer efforts and consents to themotion, CoUegeNET willpromptly inform theCourt.

    CoUegeNET files this motion, and seeks anexpedited hearing, for the following reasons:1. Google has filed an "intent-to-use" trademark application for the mark

    "SPEEDBOOK," amark that is registered toCoUegeNET. In the application, Google stated thatit had a bona fide intention to use the mark in commerce in the U.S.

    2. Numerous onlinereports statethat Google is expectedto use SPEEDBOOK astheproduct namefor tabletcomputeror similarproduct, to be launched onNovember 26,2010.

    3. In an email communication from Google's trademark counsel, Ms. Hseih, datedOctober 1,2010, Googledid not denythese onlinereports, and in fact, confirmedan intentto usethemark, although withoutspecifying the identify of theproductor the launchdate.

    4. CoUegeNET seeks limited and narrowly targeted expedited discovery in order toconfirm Google's plans, andthe impact onCollegeNET's trademark rights.

    5. Such information is needed on an expedited basis inaid ofCollegeNET's intendedpreliminary injunction motion, seeking to prevent Google from launching a product using theproduct name "SPEEDBOOK," which according to reports is expected to be available forpurchase as early as November 26,2010.

    CoUegeNET, therefore, asks theCourtto orderthatCoUegeNET be permitted to servethedocument requests and deposition notice attached to the accompanying papers, that Google berequired to respond to the document requests and produce responsive documents within 5calendar days of the Court's orderandto provide a witness for deposition within 5 calendar daysof such document production.
