I. INTRODUCTION
Defendant Zillow, Inc. moves for an order shortening time to hear its concurrently
filed Objection and Motion to Strike Plaintiffs’ Notice of Supplemental Support (the
“Motion to Strike”). Plaintiffs seek to introduce this “Supplemental Support” for two
pending motions before this Court: (1) Plaintiffs’ Motion to Revise the Special Master’s
Order Quashing Key Portions of the Document Subpoena to Trulia, and (2) Plaintiffs’
Motion to Revise the Special Master’s Order re Subpoenas to Goldman Sachs and J.P.
Morgan (collectively “Motions to Revise Subpoenas”). Zillow’s Motion to Strike
respectfully requests the Court disregard Plaintiffs’ Notice of Supplemental Support and the
supporting declaration from its consideration of the two pending Motions to Revise
Subpoenas.
Given Plaintiffs’ improper procedural maneuvers, without an order granting this
motion to shorten time, Zillow would be left without a remedy. Under a regular motion
calendar, the soonest Zillow’s Motion to Strike could be heard is April 21. But the two
motions Plaintiffs’ seek to bolster with this irrelevant and inflammatory material, the
Motions to Revise Subpoenas, are both noted to be considered the day before on April 20.
(Plaintiffs did not note their “Notice;” instead they mark it as noted for the same date as the
Motions to Revise Subpoenas.) Zillow respectfully requests that the Court shorten the
motion calendar to timely resolve Zillow’s Objection and Motion to Strike.
II. RELIEF REQUESTED
Zillow requests the Court shorten the time for Plaintiffs to respond to Zillow’s
Motion to Strike and hear the motion on the same day as the related motions are being
heard, April 20th, 2015.

III. EVIDENCE RELIED UPON
Zillow relies on the concurrently filed Declaration of Mary P. Gaston in Support of
Motion to Strike (“Gaston Decl.”), the Motion to Strike and its supporting documentation,
and the records in this matter.
IV. STATEMENT OF FACTS
On April 6, 2015, Plaintiffs filed two motions to reverse decisions made by the
Special Master, Judge Bruce Hilyer (Retired), appointed earlier in this case to govern and
control discovery regarding the trade secrets of two powerful competitors. These motions
are noted to be heard on April 20, 2015. The first motion challenged the Special Master’s
decision to revise one topic of eight in Plaintiffs’ subpoena to third-party Trulia, Inc. (also a
competitor of Plaintiffs) in a Motion to Revise the Special Master’s Order Quashing Key
Portions of Trulia Subpoena (“Motion to Revise Trulia Subpoena”).
Plaintiffs filed the Motion to Revise Trulia Subpoena under seal, Dkt. No. 524D, and
Defendants promptly filed a joinder and supported the sealing of the motion, Dkt. No. 533
(filed April 8, 2015). The second of Plaintiffs’ motions challenged the Special Master’s
revisions to Plaintiffs’ subpoenas to third-parties J.P. Morgan and Goldman Sachs, the
investment advisors to Trulia and Zillow, respectively, during the recently closed, $3.5
billion merger between the two companies. See Plaintiffs’ Motion to Revise the Special
Master’s Order Re Subpoenas to Goldman Sachs and J.P. Morgan. Plaintiffs also moved to
seal this motion and its supporting materials, Dkt. No. 524B and again, Defendants joined to
support the protection of the confidential materials cited and discussed in these pleadings,
Dkt. No. 534 (filed April 8, 2015).
On Friday, April 10, with no warning to Defendants, Plaintiffs filed a “Notice of
Supplemental Support” in open court and included a declaration attaching a letter received

by Plaintiffs’ counsel David Singer. The letter purports to be a “treasure map” for Plaintiffs’
counsel to uncover alleged wrongdoing by the Defendants. It is not an sworn statement
submitted under penalty of perjury; its author does not even identify him or herself, let alone
sign the document, and it was sent without a return address. And it contains blatant
inaccuracies. See Declaration of Erin Coningsby ¶¶ 3-6 (filed April 13, 2015).
On Saturday, April 11, 2015, Zillow provided opposing counsel notice of its
Objection and Motion to Strike and its intent to move for a shortened calendar. See Gaston
Decl., at Ex. D.
V. ARGUMENT AND AUTHORITY
The King County Superior Court Local Rules require a motion to be noted six court
days before the date the party wishes the motion to be considered. KCLCR 7(b)(4)(A). But
for good cause shown, the Court may also shorten the time for notice and hearing of a
motion. KCLCR 7(b)(10)(A). The moving party must provide as much notice as possible to
the other parties. KCLCR 7(b)(10)(C). In exercising its discretion to grant a motion to
shorten time and impose such conditions as may be needed, the Court may also consider
whether the opposing party will have time to prepare for the motion and have an opportunity
to submit legal authority or provide a countervailing argument. See State ex rel. Citizens
Against Tolls (CAT) v. Murphy, 151 Wn.2d 226, 237, 88 P.3d 375 (2004).
Here, good cause exists to allow Zillow to present its Motion to Strike on a shortened
Calendar. The current motions for revisions are noted for April 20, a day before the earliest
Zillow’s Motion to Strike could be heard. Without granting this Motion to Shorten Time,
Zillow will be left without any effective remedy should the Court agree with its Motion to
Strike and find the materials were improperly submitted to the Court’s consideration.

On Saturday, April 11, 2015, Zillow provided opposing counsel notice of the Motion
to Strike and Zillow’s intent to move for a shortened calendar. See Gaston Decl., Ex. D.
Finally, if there is any prejudice to the non-moving party, such prejudice would be
negligible. Plaintiffs have fully briefed their underlying Motions to Revise Subpoenas. The
Motion to Strike does not detract from Plaintiffs’ original motions at all; indeed, the Motion
to Strike only seeks to place the parties in the positions they would have been had Plaintiffs
followed the stipulated protocol established by court order governing motions for revision
rather than submitting, under the guise of a “Notice to Supplemental Support,” three
additional pages of argument and an anonymous, inadmissible, and wholly irrelevant letter.
Nor would an opposition require research and analysis of a complex or subtle legal issue; the
question whether the Court should consider Plaintiffs’ supplemental filings rests on
procedure and justice.
In short, good cause exists to shorten the motion calendar and schedule its Motion to
Strike to be heard on Monday, April 20, prior to the Court considering the Motions to
Revise Subpoenas.1
VI. CONCLUSION
Zillow requests the Court grant this motion to shorten time and note the Motion to
Strike Plaintiffs’ Notice of Supplemental Support and Declaration of David Singer for April
20, 2015.
1 Under such a schedule, Plaintiffs’ opposition to the Motion to Seal would be due at noon
on Thursday, April 16, and Zillow’s reply thereto at noon on Friday, April 17.
