    Italy takes action against piratesby Mark Dezzani

    MILAN -After almost two years of inac-tion, the Italian government is takingpositive steps to crack down on piracy.

    Just prior to its summer recess, thegovernment implemented an emer-gency decree to penalise vendors ofpirate recordings.

    U.S. trade regulatory body USTRplaced Italy on its priority watch list onpiracy in June-a move which, accord-ing to Enzo Mazza, president of Italy'sFPM (Federation against MusicPiracy), put the country "on a par withmany Third World countries in terms ofthe volume of pirate product sold."

    The USTR listing followed a num-ber of delays in ratifying new laws tofight audiovisual piracy in Italy. IFPIestimates put the pirate market inItaly at 20 percent of the official mar-ket in terms of units. Overall, IFPI val-ues the legal Italian market at $593m.

    The draft legislation, first proposedin October 1996, was approved by theItalian parliament, but the senate com-mission which had to approve the newlaw rejected it on the grounds that pro-posals to raise maximum prison sen-tences from three to five years were tootough. Mazza, who is also secretarygeneral of IFPI-recognised majorlabels' body FIMI, says: "Oppositionfrom elements within the coalition gov-

    ernment's own majority rejected theinitial penalties."

    The conimission then proposed amaximum four year jail sentence forthose involved in "higher level piracy"such as production and distribution,with a. maximum sentence of threeyears for "lower levels," such as retail-ing illegal product. However, insistsMazza, "We are dealing with the sameorganised crime groups [as] in drugtrafficking, and too low penalties willnot do anything to deter them."

    In an attempt to compensate forhis own government's vacillation overthe legislation, Italian prime ministerRomano Prodi used his power ofdecree to implement sanctionsagainst retailers of pirated product atthe end of July.

    The power of decree, aimed pri-marily at unlicensed street traders incities throughout Italy, has to berenewed every six months until it isratified or rejected by parliament andsenate. It allows fines of L5 million-L30m ($2,850-$17,140) to be levied onretailers selling unlicensed audiovisu-al product. The decree also sanctionsthe confiscation of product, furnish-ings and equipment.

    Luciano Daffarra, Secretary Generalof FAPAV (Audiovisual Anti -piracyFederation) says: "The decree is animportant measure to fight the phe-

    nomenon of illegal product sales whichpervades the streets of certain cities,and against which little has been doneuntil now."

    Concludes Mazza: "It is now up tothe local and regional authorities toimplement this decree withoutany delay."

    Underlining Mazza's commentsabout organised crime and music pira-cy, IFPI this week announced that it isoffering a $10,000 reward for informa-tion leading to the arrest and convictionof armed assailants who hospitalisedSony Music's licensee in Romania.

    The day after he filed a complaintwith the Romanian Copyright Officeabout the sale of pirate cassettes ofSony's World Cup 1998 album (Allez!Ola! Ole!), licensee Sorin Golea wasbeaten and threatened with a gun bytwo attackers. Golea's nose was brokenand he lost two teeth during the attack.

    lain Grant, IFPI's London -basedhead of enforcement, says: "This attackis clearly linked to Sorin Golea's com-plaint against music piracy" However,he insists it will not deter IFPI in itsfight against pirates: "Our message toanyone producing music illegally inRomania is that we are now watchingmore closely than ever."     Ryko in Blackwell's Palmby Emmanuel Legrand

    LONDON - Island Records founderChris Blackwell's return tothe music industry has con-tinued with his acquisition ofU.S.-based company Ryko.

    On August 7, PalmPictures, the entertainmentdivision of Blackwell's newumbrella companyIslandlife, paid areported $25 million forRyko's assets, whichinclude record labelRykodisc, its U.S. dis-tribution arm RykoDistribution Partnersand music publishingcompany Rykomusic.

    In a statement,Blackwell says: "I amvery excited about thisopportunity to re-enterthe record business withsuch a quality indepen-dent company. I truly believe that anindependent such as Ryko can offer aviable alternative to the majors forany artists."

    Under the agreement, Rykodiscwill continue to be managed by co-founders Don Rose and Arthur Mann,and will distribute Palm Pictures'music product around the world. InEurope, Ryko has a network of distrib-utors and licensees which include Vitalin the U.K., Harmonia Mundi inFrance, Rough Trade in Germany andMunich Records in the Benelux coun-

    tries. According to Palm Picturesspokesman Gerry Lyseight, its musicreleases will be distributed through

    Ryko, except in France, wherePalm is licensed to Virgin."We plan to use Ryko's exist-ing network. It's a very goodset up," he explains.

    At Ryko's European head-quarters in London, directorof sales and marketing AndyChilds notes that: "In effect,

    our relationshiphad already start-ed with PalmPictures, as theirfirst two releases[Baaba Maal'sNomad Soul andErnest Ranglin'sIn Search Of The

    Childs says "no changes areplanned" in the foreseeablefuture for Ryko's European

    operations-outside distribution/ware-housing, the Ryko and Palm Picturesoffices in London will operate indepen-dently. "But," he adds, "we will proba-bly work closer on marketing and pro-motion to a certain extent."

    Rykodisc, based in Salem,Massachusetts, has offices inPhiladelphia, London and lbronto. Itscatalogue includes Mickey Hart,Morphine, Bruce Cockburn, BobMould/Sugar and the complete worksof Frank Zappa; it's also home to theHannibal Records label.

    COPENHAGEN - U.S. media giantClear Channel Communications' latestshopping trip to Europe has yielded amajority 51 percent stake inCopenhagen hot AC station RadioUptown and its sister national cableoutlet, the soft AC Radio 2.

    The purchases were made throughClear's Danish affiliate, More GroupDanmark. "We are extremely pleasedwith the accord we have reached withour new owners," says Radio 2/Uptownmanaging director Glenn Lau Rentius,who will continue in that role as well asretaining the remaining 49 percent ofthe stations' shares. "This is ClearChannel's first [radio] acquisition inScandinavia, and it will use it as a plat-form for further developments inScandinavian markets."

    Clear Channel operates 177 radiostations in its domestic U.S. market, aswell as 76 overseas-in Australia, NewZealand, the Czech Republic and China.It also owns 18 TV stations in 11 differ-ent markets.

    According to Radio 2/Uptown salesand marketing manager Jim Receveur,the Danish stations' formats willremain basically the same: "Uptownwill be harder AC, while Radio 2 will besoft AC-but since Radio 2 is national, itwill be playing a bit more Danishmusic," he reveals. "[The take-over] willgive us the push we needed to becomeserious players in the radio business."

    Five years after launchingas a German -languagealternative to MTV, Viva isnow established as thatcountry's most popularmusic channel. Here,Gorny, "the man behindViva" talks to M&M

    about the future of musicTV in Germany.

    Q: How did Viva attain its pre-emi-nent position in the German ratings?A: From the beginning, Viva tried to cre-ate really original programming, with aplaylist that truly reflected the situationin the German market, as regards bothtalent and hits; from the beginning,German kids could better identify withthis. Just seven or eight months afterViva started, at the end of 1993, we hada complete turnover of the audience,from MTV to Viva, and since then we'vean unchanged situation in the GermanTV market. Viva continues to performbetter [than MTV].

    Q: You're planning a revamp ofViva 2's programming. What'sbehind that?A: After talking with the record indus-try, I got the feeling [that] it's a bigopportunity; it's a huge market -let'sgo in this direction and try to fill theplace MTV occupied some years before.Programme Viva 2 as an MTV competi-tor -more adult, without dance -andrepeat the Viva success. Now, MTV hasno choice but to be a mixture betweenmass market and credibility, while wehave two "pure" formats.

    Q: Viva has just launched a newmagazine, Comet. How will that suc-ceed where MTV's German musicmagazine, Xtreme, failed?A: MTV always said "we are MTV andwe can do everything," but I believe insynergies, so for Comet we went to the[German] market leader in youth pub-lishing -the Bravo group -and said"let's try and do something." Viva'slicensing is much more market -orientedand geared to make a profit.

    Q: At the moment Germany has fivemusic TV channels -Viva, Viva 2,MTV, VH-1 and ONYX. Can themarket support such a choice?A: No. It's too much. One problem isthat in Germany we don't have theexperience of 30 years handling popculture, as they have in America orEngland where there is, consequently,more acceptance for a format suchas VH-1.

    The other problem has to do withcable penetration. If ONYX is in 5-6 mil-lion households, and VH-1 in 9-10 mil-lion, it's not enough in a situation wherethe market is full of channels. I believethat within two years, we'll be down tothree channels: two Vivas and one MTV.

    LONDON - Commercial radio's record51.1 percent share of the U.K's radiomarket during the second quarter ofthis year (M&M, August 15) is largelythanks to strong performances by localand regional services.

    Many of those stations have beenpart of the industry's consolidationinto major national groups during thepast 18 months. A group -by -group lookat the performance of their servicesreveals a surge in audience loyaltycompared to figures for the fourthquarter of '97, the last time the resultsfor all local services were published: The GWR Group posted its best everRAJAR; the share of its AM networkClassic Gold increased from 5.2 to 5.9percent, and national station ClassicFM had its best ever figures (see table}.Total share for GWR's local FM serviceswas up from 18.8 to 20.3 percent. Capital Radio's Hampshire stationsOcean FM (AC) and Power FM (CHR)boosted their combined audience shareto just under 30 percent from 23.5 per-cent in the previous survey. The Chrysalis Radio Group'smainstream dance brand Galaxyachieved considerable audience growth.In Yorkshire, for example, Galaxy105's market share jumped to 6.9 per-cent from 4.9 percent. The company'sAC brand, Heart, continues to gainground in both Birmingham andLondon, where Heart 106.2 is nowclearly ahead of both 1548AM CapitalGold and Virgin 105.8 FM (rock). Scottish Radio Holdings' RadioClyde continued to dominate theGlasgow radio market, taking a com-bined share of 42.6 percent with

    NEW YORK - Strauss Zelnick hasmade his first major move since becom-ing president and chief executive ofBMG Entertainment (M&M, August 8).

    Zelnick has promoted current seniorvice president marketing of BMGEntertainment North America KevinConroy to the newly created position ofsenior VP, worldwide marketing.

    In addition to continuing to overseeBMG's marketing initiatives in NorthAmerica, Conroy will be in charge ofthe company's global marketingefforts, "working closely with BMGEntertainment International's mar-keting team, led by Gary Dale, seniorVP of international marketing,"according to a company statement.Conroy is based in New York andreports to Zelnick. Dale, who wasappointed in July, will continue toreport to BMG EntertainmentInternational CEO Rudi Gaselier.

    Conroy, who will work closely withDale, says his new title was created inan attempt to form "one cohesiveworldwide strategy for marketingartists." In the past, the internationaland the North American divisions ofBMG have traditionally operated

    Scots -born Nick (real nameMalcolm Charlton) has spent 10 yearsat Radio Montecarlo Italy presentingMonte Carlo Nights, an evening mix-ture of New Age, world music, ambientand modern jazz. His replacement atRadio Montecarlo is his former co -pre-senter on. Monte Carlo Nights, NewYorker Jonny Angel.

    Since the L'Espresso publishing

    group acquired RadioCapital in January 1997, ithas expanded to achievecomplete nationwide cover-age and has signed a stringof established presenters.Luca Sacchi, assistant toRadio Capital's programmedirector Linus, says NickThe Nightfly "will be anintegral part of our new pro-gramme line-up."

    Radio Capital hopes that its newschedule, supported by extensive pro-motion in L'Espresso's newspapers andmagazines, will improve its currentdaily audience reach of 636,000.

    Meanwhile, L'Espresso has beengiven clearance from Italy's anti-trustauthority to complete its acquisition ofthe Rome -based news/talk networkItalia Radio from the RosabellaPublishing Group.

    VIENNA - The first quarterlyratings since the nationwideroll -out of commercial radio inAustria on April 1 have giventhe new stations a combinedreach of 18.1 percent.

    The figures, compiled by mar-ket research institute Fessel Gfkfor public broadcaster ORF (froma survey of 6,000 listeners overthe age of 10) show ORF'snational CHR station 03 com-fortably maintaining its spot asthe most popular station in mostof the country. It ranked first inseven of Austria's nine provinces,with an overall national reach of36.3 percent.

    The strongest performancesfrom the commercial broadcast-ers came from CHR stationAntenne Steiermark (in theprovince of Styria), with a 24.3percent share, and AC -format-ted Radio Melody/Salzburg(recently purchased by theU.K.'s GWR Group), whichscored an 18.2 percent reach.However, both those stationshad head -starts over their coun-terparts, as they were the onlycommercial stations to go on -airduring Austria's abortive launchof commercial radio in 1995.

    In Vienna, the country'slargest radio market, 03's 31.3percent reach easily outstrippedits new rivals. AC/gold regionalstation 88.6, backed by newspa-per Kronen Zeitung, came in sec-ond with 17.5 percent, beatingboth ORFs local oldies -and -talkpublic station 02 Vienna and itslocal Blue Danube/FM4 services.

    Despite an intensivemarketing campaign,new commercial sta-tion Antenne Wien fin-ished fifth in Vienna.

    Of the other newcommercial outlets inthe capital, NRJ'sCHR-formatted RadioEnergy achieved a 2.5percent reach, whileCLT-UFA's 92.9 RTLlanguished with 1.2percent.     BERNE - Radio Forderbandhas been serving up someunusual lunchtime program-ming to its listeners in Bernethis summer.

    The CHR broadcaster in theSwiss capital asked hundredsof stations from around theworld to send it an hour of theirmusic programming, and hasbeen broadcasting the tapesunedited-in their original lan-guages-on its 13.00-14.00lunchtime show.

    Radio Forderband pro-gramme director Thomas Eber-hard reports: "Listeners havegone absolute crazy about it.They have even been calling into ask what station's program-ming is being broadcast the fol-lowing time. Maybe they like itbecause of the international feelof Berne. So many languagesare spoken here: Italian, Frenchand German."

    U.K. BUSINESS FACES 'DEMOGRAPHIC' PROBLEMSLONDON - Retail consultancy Verdict Research is warningthe U.K record industry that it must adapt to demograph-ic changes if it is to maintain its share of retail spending inBritain. Verdict predicts that music sales will grow by justunder 3 percent this year, compared to 4 percent last yearand an estimated 3.8 percent rise in U.K. retail spending asa whole for 1998. Verdict bases its projections on govern-ment figures showing that the number of 25-29 year -olds isto fall by 17.4 percent, or 771,000, over the next five years-the biggest decline of any age group. "If the record industryis going to be successful, it has to make a fundamental com-mitment to encourage older people to buy records," saysVerdict chairman Richard Hyman.

    RAI TRAFFIC NEWS MONOPOLY ENDSMILAN - National CHR networkRTL 102.5 Hit Radio has becomethe first commercial broadcaster inItaly to utilise the traffic news ser-vice provided by the country's motor-way operating companies. "Previous-ly only [public broadcaster] RAI had access tothis information," says RTL 102.5 programme directorLuca Viscardi. "But our nationwide single frequencymakes us an ideal provider of this service." The RAI willcontinue to run Isoradio, which broadcasts a mixture oftraffic updates, news and AC music, from transmitters sit-uated alongside Italy's main motorways.

    SAINTS, MARTIN MINE MORE PLATINUMLONDON - The Interna-tional Federation of thePhonographic Industry(IFPI) has announcedthe latest recipients ofits Platinum Europeawards. All Saints' self -titled debut album on PolyGram has moved to doubleplatinum status, while Ricky Martin's Vuelve (SonyMusic Europe) receives its first Platinum Europe award,recognising one million sales across Europe.

    GINGER COMBINES TV, RADIO OPERATIONSLONDON - Chris Evans' Ginger Media Group (GMC) isbringing together all of its operations under one roof follow-ing the relocation of Ginger Iblevision Productions to VirginRadio's London headquarters. Chief financial officer AndyMollett says the move "gives us all the opportunity to inte-grate our cultures and move forward as a single group."GMC acquired Virgin Radio from Richard Branson inDecember last year.     BMG SELLS RICORDI HQMILAN - BMG Ricordi, BMG's Italian affiliate, hasannounced the sale of its historic Milan offices. Located inVia Berchet 2 in Milan, the offices were home to the Ricordilabel and publishing group prior to its acquisition by BMGin August 1994. The building has been sold to a financialholdings company, although BMG has signed a contract toretain three floors of the offices until June 30, 2004.

    FREE RANGING EGGSwapping the situationist techno of inaugural releaseAlbumen for a warmer, altogether more organic music ontheir second album Travelator (Indochina/U.K), Britain'sThe Egg have hit on a sound which combines 1960's film -theme grooves with a dash of nu jazz, some progressive rockmoments, a hint of house, lots of wah-wah guitar and aclutch of memorable tunes.

    This veritable bouillabaisse of an album was produced byAmerican Tim Holmes, one of dance music's most soughtafter names. Apart from producing the Chemical Brothersand Primal Scream, Holmes is one half of Death In Vegas;his influence is evident in the depth and breadth of thesound and the tough, highly ordered instrumentation.

    On Willo, tight, funky breakbeats combine with sampledcello, acoustic guitar and pipe organ (sampled from ThePenguin Cafe Orchestra's Rosasolis) in support of a delight-ful, wheezing melody while Getting Away With It is a twist-ed, filtered Traffic-meets-Radiohead jam.

    With gigs lined up around Europe throughout the sum-mer it should be interesting to see how The Egg, who are'rapidly gaining a reputation as a hot live ticket, reproducethe sound on stage.

    How do you celebrate 31 yearsof making highly acclaimedrecords as a leading Europeansinger/songwriter?

    Release a new album with 31songs, of course. And to make ita little different, why not record15 of the songs in your own lan-guage-in this case Spanish-and 16 in English.

    That's the tack which Spain'sbins Eduardo Aute has takenwith his double CD Aire 1 Invisible on VirginRecords Espana. The album has alreadynotched up sales of 42,000 copies in Aute's homemarket, and the release of the second single -5Minutos backed by Human Alien-at the end ofthis month is likely to push album sales pastthe gold mark (50,000 copies sold).

    Virgin Spain's international exploitationmanager Gema Ventosa says the label is goingto work the album for a comparatively longperiod, at leat "until Christmas." She expectsAire [invisible to be "a classic slow mover" butthat it will continue to sell for a long time.

    Up to the release of Aire 1 Invisible, only afew of Aute's most loyal fans knew that the 55 -year -old was actually born in the Philippines toa Catalonian father and a Filipino mother. "Iwent to an English -language school," herecalls, "and didn't start speaking Spanishuntil I moved to Madrid when I was 12." Inspite of this early grounding, Aute had actual -

    ly never recorded a song in English until hebegan to work on material for the new album.

    "I've always written better in English than Ican speak it," he says. "In fact, my first poemswere written in English and I still read a lot inthat language." All songs on the new set werewritten by Aute, except for two whose Englishlyrics are by the great, late Portuguese poetFernando Pessoa. For Aute, the words of onehave a particularly special meaning:"Fernando wrote the words to What Matters IsJust You eight days before dying."

    Aute says thet making Aire 1 Invisible wasvery rewarding for from an artistic point ofview. "Writing and recording in English wasan adventure, and it gave me the sensation ofdoing something new," recalls Aute. "The oddthing is that now I listen more to the songswith English lyrics than to the CD with theSpanish material. It's like listening to some-body else's songs."

    Runga's long-distance Driveby Nigel Williamson

    An album of acousticsketches from the otherend of the world is beinghotly -tipped as a con-tender for the Europeanalbum charts this summer.

    Drive, the debut set by21 -year old New Zealand -based singer/songwriterBic Runga on Sony Music'sColumbia label (except forthe U.K., where it will beon Epic), will be releasedacross Europe on August24 after topping the chartsat home. Runga also sweptthe board at the 1998 NewZealand Music Awardsearlier this year picking up awards for BestAlbum, Female Vocalist and as SongwriterOf The Year.

    "Trends take so long to reach us back homethat we can't jump on bandwagons," saysRunga. This perhaps explains the freshness ofDrive, written and produced by the artist her-self, based on demos which got her signed toColumbia in New Zealand two years ago.Guided by U.S. producer Peter Asher, Rungare-recorded 11 tracks for the album in NewZealand with musicians from Auckland, hometo an internationally renowned alternativerock scene based around local label FlyingNun, before flying to Los Angeles to suprvisethe final mixdown by Matt Wallace (Faith NoMore, Replacements, John Hiatt).

    Influenced by bands such as the Smithsand Crowded House, Runga started writing

    songs at the age of 16. "Iprefer to play acoustic,"she says. "I don't belongin rock bands. I can'tbring anything new to it.The [essence of the] songsis what's most importantto me."

    The U.K, with its largecontingent of NZ expatri-ates, is Runga's passage-way to Europe. Epic U.Kproduct manager AilsaRobinson says Runga has"total support form everydepartment of the label. Wethink she has the potentialto become a huge main-stream artist [in the U.K.]."A regional radio campaign

    and major college promotion are scheduled forSeptember. Current single Sway has beenplaylisted at AC -leaning MOR network BBCRadio 2, for whom Runga recorded a session forDJ Johnnie Walker's drivetime show.

    Studio time to record the follow-up album isalready tentatively booked. "I'm going to recordit in the middle of next year," says Runga, "but --I don't know if I'll produce it myself. The stakesare higher now. I never expected the firstalbum to get an international release."

    In July, Runga played a sell-out date atLondon's venue Dingwalls and there areplans to secure a support slot on a major tourthis autumn and start building her reputa-tion on the continent. "It's great playing to aload of homesick New Zealanders-but that'snot the point of the exercise," she adds. "Icame to Europe to reach a new audience."

    KEILERKOPFKEILERKOPFUniversalG/S/A release date: October 5It may be tempting to dismiss German trio Keil-erkopf as the first act to try and jump on theRammstein bandwaggon-afterall, they're similarly loud, con-frontational and teutonic-butin truth, they're a completelydifferent breed. WhereasRammstein's sound is built on'70s rock, Keilerkopf come out ofthe eclectic, DJ -driven '90s anddeliver their own cut'n'paste re-interpretation of hip hop. Bothbands use hard rock riffs, butonce you delve beneath thescreeching guitars at the top ofthe mix, the differences becomeobvious. The tracks on Keil-erkopfs debut are dense but fluent-organic yettight as a drum head. The beats are "phat" and theband's knack for structuring sounds and layeringrhythms makes for repeated listening. Keilerkopf ismuch more clever and sophisticated than its car-toon iconography might suggest at first glance.What spices up the mixture is the continuous dia-logue between Keilerkopfs sheer force and the cool

    approach of Vienna -based production team Beat 4Feet, a.k.a. Martin Gellner and Werner Stranka.Additional remixes come courtesy of fellow Vien-nese producers Thomas Rabitsch-whose creden-tials include work for the late Falco-and DietzTienhof.
