1. Call to Order

The meeting was called to order by the Secretary of the National

Constitutional Conference (NCC) at 09 00 hours, followed by the

singing of the National Anthem and prayer by Reverend Foston

Sakala.

2. Introduction of Secretary and Deputy Secretaries

Honourable George Kunda, SC, MP, Minister of Justice, the Convenor

of the first meeting of the Conference, proceeded to introduce the

Secretary and the three (3) Deputy Secretaries of the NCC as follows:

Mr. Russell Mulele, Secretary, Mrs. Thandiwe Daka Oteng, Deputy

Secretary, Mrs. Margaret Bwanga, Deputy Secretary and Mr. Newton

Ng’uni, Deputy Secretary.

The Convenor informed the meeting that the above would be

responsible for steering the Conference and attending to the welfare of

the members of the Conference.

3. Convenor’s Opening Remarks

The Convenor, in his opening remarks, welcomed all the members

present to the first meeting of the NCC. He stated that the meeting was

dedicated to the introduction of members of the Secretariat and the

Conference and to allow the President of the Republic of Zambia, Mr.

Levy Patrick Mwanawasa, SC, to address the Conference.

The Convenor stated that the Conference was meeting as one family of

Zambians conscious of the fact it was expected to produce a better

Constitution.

He, subsequently, called upon His Excellency the President of the

Republic of Zambia, Dr. Levy Patrick Mwanawasa to impart to the

Conference words of wisdom before it embarked on the mammoth

task.

4. Address by the President of the Republic of Zambia

His Excellency the President of the Republic of Zambia, Dr. Levy

Patrick Mwanawasa, SC, in his address stated that he felt honoured to

be afforded an opportunity to address the men and women who were

carefully chosen to represent the Zambian people to discuss and adopt

a draft Republican Constitution.

He stated that this was a solemn and privileged responsibility, which

must be discharged in a responsible, objective, non-partisan and

patriotic manner, bearing in mind that the interests of Zambia were

paramount.

He urged the Conference to produce a document, which would stand

the test of time, which any Government or President would find

acceptable to work with and a useful guide in the discharge of national

duty and a document which would protect the rights of the people,

individually and severally.

the Conference.

5. Brief on the Role of the National Constitutional Conference

The Convenor, thereafter, proceeded to give a brief on the role of the

Conference. He stated that the Conference was established by the

National Constitution Conference Act No. 19 of 2007 as a forum to

examine, debate and adopt proposals for the alteration of the

Constitution.

He further stated that the Act gave the Conference powers to consider

and deliberate the provisions of the Mung’omba Constitution Review

Commission (CRC) Report and Draft Constitution dated 29th

December, 2005. The powers given to the Conference by the Act also

included the powers to add, subtract, vary, remove or confirm

provisions of the Draft Constitution.

The Convenor stated that in the exercise of its powers, the Conference

was required to be accountable to the people of Zambia, recognising

the importance of confidence building and engendering trust and

developing a national consensus for the adoption process. The

Conference was expected to ensure the observance of the principles set

out in the NCC Act, which state that the process should provide the

members with an opportunity to actively, freely and meaningfully

participate in generating and debating proposals to change the

Constitution.

The Convenor urged the Conference to ensure that the final outcome of

the adoption process should faithfully reflect the wishes of the people

of Zambia.

6. Brief on the Election for the Positions of Chairperson, Vice-Chairpersons and Spokesperson of the National Constitutional Conference

After the above brief, the Convenor introduced officials from the

Electoral Commission of Zambia (ECZ) who would be responsible for

conducting elections for the positions of Chairperson, Vice-

Chairpersons and Spokesperson of the National Constitutional

Conference.

Thereafter, the officials from ECZ on request from the Convenor

proceeded to brief the Conference on the guidelines and procedures to

be followed in the election of the Chairperson, Vice-Chairpersons and

Spokesperson.

7. Nominations for the Positions of the Chairperson of the National Constitutional Conference

Nominations for the position of Chairperson and Spokesperson of the

Conference were conducted.

At the end of the nominations, Mrs. Mwangala Zaloumis emerged

unopposed as Spokesperson while two other members, namely,

Honourable Chifumu Banda, SC, MP and Dr. Patrick Matibini

successfully filed in their nominations for the position of Chairperson.

The meeting was called to order at 14 00 hours followed by the singing of the

National Anthem and Prayer.

2. Elections for the Position of Chairperson of the NCC

Elections for the position of Chairperson were conducted and Honourable

Chifumu Banda, SC, MP, emerged winner of the election with 320 votes.

Dr. Patrick Matibini received 106 votes.

3. Nominations for the Positions of Vice-Chairpersons and Spokesperson of

the NCC

On the same date, nominations for positions of the three Vice-

Chairpersons, two of whom were to be women and one man, were

conducted. Honourable Faustina Sinyangwe, MP, Honourable Regina

Musokotwane, MP and Mrs. Nelly Mutti successfully filed in their

nominations for the female positions. Mr. Leonard Hikaumba and Mr.

Sage Samuwika successfully filed in their nominations for the male

position.

The meeting was called to order at 09 00 hours followed by the singing

of the National Anthem and Prayer.

2. Elections for the Positions of the Vice-Chairpersons of the NCC

Elections for the positions of the Vice-Chairpersons of the Conference

were conducted. Honourable Regina Musokotwane, Honourable

Faustina Sinyangwe and Mr. Leonard Hikaumba were elected with

322, 347 and 373 votes, respectively. Mrs. Nelly Mutti received 132

votes while Mr. Sage Samuwika received 50 votes.

3. Chairperson’s Inaugural Speech

In accepting the position of Chairperson, Hon. Banda assured the

members that he and his colleagues, the Vice-Chairpersons of the

Conference, would discharge their duties in a manner that would give

their best in producing a Constitution that all Zambians would be

proud of.

Hon. Banda urged the members to remain focussed on their function to

debate and adopt the draft Constitution before submitting it to

Parliament for enactment.

He further stated that the diverse backgrounds of the members of the

Conference should not hinder but enrich their full and honest

participation in the Conference.

1. Establishment of an Interim Committee on the Rules and Regulations of the National Constitutional Conference

The Chairperson then proceeded to propose to the Conference the

establishment of a 15-member interim committee to formulate the rules

and regulations that would guide the proceedings of the Conference

and to set up the committees of the Conference. This Committee was

expected to submit the draft rules and regulations at the next meeting

of the Conference set for 8th to 10th January, 2007.

Dr. Patrick Matibini was proposed to be Chairperson of this Committee

while Dr. Frida Kazembe was proposed to be Vice-Chairperson.

The Conference approved the establishment of the proposed

Committee.
