F.No.89-179/2012 Appeal/6th Meeting-2012 NATIONAL COUNCIL FOR TEACHER EDUCATION Hans Bhawan, Wing II, 1, Bahadurshah Zafar Marg, New Delhi - 110 002 17/07/2012 O R D E R WHEREAS the appeal of Alhaj Abdul Hafeez D.El.Ed College, Buldhana, Maharashtra dated 07/04/2012 is against the Order No. WRC/WRCAPP1125/156/2011/84226 dated 20/11/2011 of the Western Regional Committee, refusing recognition for conducting D.El.Ed course on the ground, “The institution has not submitted reply to the show cause notice.” AND WHEREAS the Correspondent, Alhaj Abdul Hafeez D.El.Ed College (hereinafter referred to as the appellant), preferred an appeal dated 13/04/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS the above appeal of the institution was not preferred within the stipulated period of 60 days as per Appeal Rules and it was late by 2 months and 25days. NCTE issued notices to the appellant requesting them to appear before the Council on 26-05- 2012 and also on 25.06.2012 and explain the reasons of delay. AND WHEREAS Dr. S.K. Md. Haneef, President and Shri Sanjay G. Kokate, nominated member, Alhaj Abdul Hafeez D.El.Ed College, Buldhana, Maharashtra presented the case of the appellant institution on 25.06.2012. In the appeal and during personal presentation it was submitted that (a) WRC issued show cause notice on 05.07.2011, and a reply to this notice was sent vide their letter dated 20.07.2011 by speed post. Therefore the refusal ground was invalid. (b) The appellant with regard to the show cause notice grounds submitted that the State Government in their resolution dated 19-11-2011 mentioning that there are many untrained primary teachers appointed in Municipal Council and Municipal Corporation schools, granted extension upto 31-05-2015 to these untrained teachers to get trained. This Govt. resolution clearly proves that there is a need of D.Ed. colleges for untrained primary teachers, and therefore the negative recommendation from MSCERT is non-existent & baseless; the land documents with their compliance letter dated 13-05-2011 were submitted to the WRC; and he also submitted the notarized CLU and all other documents demanded by WRC vide WRC’s letter dated 18-03- 2011. He did not make any submission regarding reasons for delay in filing the appeal. AND WHEREAS the Council noted that WRC vide their show cause notice dated 05.07.2011 informed the appellant to make representation within 15 days of issue of notice. As per WRC’s records the appellant did not submit the reply within the stipulated time period and it was sent by speed post on 22.11.2011 to the WRC (this date is evident on the postal stamp of the envelope available in WRC’s file). The appellant has not shown any proof of his having sent a reply on 20-07-2011. The reply was, therefore, submitted after almost 5 months of issue of the

O R D E R WHEREAS the appeal of Alhaj Abdul Hafeez D.El.Ed College, Buldhana, Maharashtra dated 07/04/2012 is against the Order No. WRC/WRCAPP1125/156/2011/84226 dated 20/11/2011 of the Western Regional Committee, refusing recognition for conducting D.El.Ed course on the ground, “The institution has not submitted reply to the show cause notice.” AND WHEREAS the Correspondent, Alhaj Abdul Hafeez D.El.Ed College (hereinafter referred to as the appellant), preferred an appeal dated 13/04/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS the above appeal of the institution was not preferred within the stipulated period of 60 days as per Appeal Rules and it was late by 2 months and 25days. This Govt. resolution clearly proves that there is a need of D.Ed. colleges for untrained primary teachers, and therefore the negative recommendation from MSCERT is non-existent & baseless; the land documents with their compliance letter dated 13-05-2011 were submitted to the WRC; and he also submitted the notarized CLU and all other documents demanded by WRC vide WRC’s letter dated 18-03-2011. notice, and by then WRC had already taken decision in their 150th meeting held on 11-12th November, 2011 to refuse recognition. It was further observed that the appellant preferred the appeal after a delay of 2 months and 25 days and no reason was furnished for the delay. the Council, therefore, concluded that there was no justification to accept the appeal.

AND WHEREAS with regard to the contention of the appellant that there is a need for more D.Ed. colleges because of large number of untrained teachers in Government/Municipal schools, it is observed that training of in-service untrained teachers requires a separate strategy. Such training is to be conducted in an open distance learning mode, and not on a face-to-face mode in training colleges, since in-service teachers cannot be withdrawn from the schools to undergo face-to-face training. Accordingly, the arrangement for opening more D.Ed. colleges, as contended, by the appellant, is not feasible. AND WHEREAS after perusal of the documents, memorandum of appeal, affidavit, and after considering oral arguments advanced during the hearing, the Council concluded that there was no ground to accept the appeal. Accordingly, the appeal is rejected and WRC’s order dated 20-11-2011 is confirmed. NOW THEREFORE, the Council hereby confirms the Order appealed against.

O R D E R WHEREAS the appeal of Bethany D.Ed College, East Godavari, Andhra Pradesh dated 23/04/2012 is against the Order No. SRCAPP604/D.EL.ED/2012-13/Return/AP/2011-12/31255 dated 18/10/2011 of the Southern Regional Committee, refusing recognition for conducting D.El.Ed course on the grounds “There is discrepancy in the DD number given in online form and photo copy with application. The application submitted by them does not possess DD or Challan. Xerox copy of DD was submitted which is not acceptable.” AND WHEREAS the Correspondent, Bethany D.Ed College (hereinafter referred to as the appellant), preferred an appeal dated 24/04/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS the above appeal of the institution was not submitted within the stipulated period of 60 days as per Appeal Rules and it was late by 4 months and 06 days. The appellant submitted the reasons for delay stating that SRC’s rejection letter dated 18.10.2011 did not mention about the appeal remedy available u/s 18 of the NCTE Act. So, after receiving the rejection letter, they resubmitted the application in SRC office on 28.10.2011 explaining the reason for variation in DD No. SRC informed them that the recognition status would be changed after verification. When SRC did not change the status of their application, they made a representation to NCTE Hqrs., which advised them to file an appeal u/s 18 of the NCTE Act. the Council considering the submission made by the appellant decided to condone the delay and examine the matter on merit. AND WHEREAS Shri G. Surya Rao, Chairman and Shri V Y Udukondalu, A.O., Bethany D.Ed College, East Godavari, Andhra Pradesh presented the case of the appellant institution on 25-06-2012. In the appeal and during personal presentation it was submitted that at the time of registration of ‘online’ application, the payment was made through the DD No. 341255 for Rs. 40,050/- in favour of Member Secretary, NCTE, payable at Bangalore. After entering the DD number in the online application form, they cancelled the DD and took the pay order No. 341261 for Rs. 40,050/- in favour of Member Secretary, NCTE, payable at Rajahmundry for immediate transfer of the processing fee into NCTE’s account. While forwarding the hard copy of online application they enclosed the original challan of pay order.. AND WHEREAS the Council noted that payment of the processing fee made by pay order No. 341261 through SBI, has already been received by NCTE Hqrs. as per ICICI Bank’s

‘MIS’ information dated 26.09.2011. The Council, therefore, concluded that there was adequate justification in accepting the appeal and remand the matter to SRC for further processing of the application on merit as per Regulations. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, and after considering oral arguments advanced during the hearing, the Council concluded that there was adequate ground to remand the case to the SRC for further processing of the application on merit as per Regulations. NOW THEREFORE, the Council hereby remands back the case of Bethany D.Ed College, East Godavari, Andhra Pradesh to the SRC, NCTE, for necessary action as indicated above.

O R D E R WHEREAS the appeal of Dharmambal Teacher Training Institute, Thanjavur, Tamilnadu dated 04/04/2012 is against the Order No. APS01322/D.T.ED/TN/2011-12/37295 dated 10/02/2012 of the Southern Regional Committee, withdrawing recognition for conducting D.T.Ed course on the grounds “1) On perusal of the report the institute is functioning in asbestos roofed building. 2) The plinth area of the building is only 5760 sq.ft. 3) Three years period has already lapsed. 4)The management of the institute is not ready to shift to its own building. 5) The Principal post has not been filled up by the management till date. 6) Staff modification proposals has not been submitted to the Principal, DIET, Aduthurai, Thanjavur District. 7) The management of the institute has violated the Regulation, norms and standards of the NCTE”. AND WHEREAS the Correspondent, Dharmambal Teacher Training Institute, (hereinafter referred to as the appellant), preferred an appeal dated 12/04/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri S. Manickavel Pandian, A.O., Dharmambal Teacher Training Institute, Thanjavur, Tamilnadu presented the case of the appellant institution on 25-06-2012. In the appeal and during personal presentation it was submitted that (a) the institution had been functioning from a building with asbestos roof since beginning. The entire asbestos would be replaced with RCC roof before June, 2012; (b) the plinth area of the building was 5700 sq.ft. but they were having 2 buildings with more than 10,000 sq. ft. of area; (c) they accept that 3 years period granted to run in temporary premises is over and they are taking all efforts to convert the building with RCC roof. They had already commenced construction which would be completed before June, 2012; (d) they posted Mr. Shanmugam as Principal in the beginning who worked nearly for 5 years and died in service. After him Chinnaiyan was appointed as Principal and after his retirement they appointed a suitable person for imparting proper education and his appointment was referred to DIET Adhuthurai for approval; (f) the relevant land documents were submitted to the SRC; (g) subsequent to the inspection they placed order for more books. AND WHEREAS the Council noted that (a)SRC vide order dated 12.01.05 granted recognition to the institution for D.Ed. course in temporary premises with a condition to shift to own premises within 3 years. (b) the institution vide their letter dated 09.10.2007 submitted proposal for shifting of the premises alongwith D.D. of Rs. 40,000/- towards inspection fee (c) Inspection of the institution was caused on 30.05.2011. On the basis of inspection report and also the deficiencies as informed by DTERT vide their letter dated 08.07.2011 show cause notice was issued to the institution on 28.09.2011. After considering the reply to this notice SRC decided to withdraw recognition of the institution vide order dated 01.02.2012.

AND WHEREAS the Council further noted with regard to withdrawal grounds that the appellant admitted that the institution has not shifted to permanent premises with pucca RCC building within the stipulated period of 3 years from the date of recognition i.e. by January, 2008. As on date of appeal consideration also the institution has been functioning in a building with asbestos roof and this is contrary to the NCTE Regulations. As per Clause 8(10) of NCTE Regulation ‘ No temporary structure or asbestos roofing shall be allowed in the institution, even if it is in addition to the prescribed buildup area’. Further the present premises is not in accordance with the NCTE Norms (b) the appellant did not show any document relating to previous principal’s appointment, Selection Committee minutes and letter sent to DTERT for approval of recently appointed Principal. The Council considering all the aspects concluded that there was no justification to accept the appeal. AND WHEREAS after perusal of the documents, memorandum of appeal, affidavit, VT report and after considering the oral arguments advanced during the hearing, the Council concluded that there was no ground to accept the appeal. Accordingly, the appeal is rejected and SRC order dated 10-02-2012 is confirmed. NOW THEREFORE, the Council hereby confirms the Order appealed against.

O R D E R WHEREAS the appeal of GSR D.El.Ed College, Kurnool, Andhra Pradesh dated 23/04/2012 is against the Order No. SRCAPP1068 (2012-13)/D.EL.ED/AP/2011-12/35954 dated 13/01/2012 of the Southern Regional Committee, refusing recognition for conducting D.El.Ed course on the grounds “Not submitted processing fee of Rs. 40,000/- as per Regulation 2009.” AND WHEREAS the Correspondent, GSR D.El.Ed College (hereinafter referred to as the appellant), preferred an appeal dated 27/04/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS the above appeal of the institution was not preferred within the stipulated period of 60 days as per Appeal Rules and it was late by 1 month and 15 days. The appellant explained the reason of delay stating that after receiving the rejection letter they made a representation to NCTE, New Delhi on 20.01.2012 and NCTE Hqrs. vide letter dated 26.03.2012 directed the appellant to file appeal u/s 18 of the NCTE Act and accordingly appeal was submitted. The Council considering the submission made by the appellant decided to condone the delay and examine the matter on merit. AND WHEREAS Shri K.V. Subba Reddy, Secretary and Shri V.R. Paul, A.O., GSR D.El.Ed College, Kurnool, Andhra Pradesh presented the case of the appellant institution on 25-06-2012. In the appeal and during personal presentation it was submitted that the appellant alongwith the hard copy of the ‘online’ application submitted D.D. of Rs. 40,000/- dated 21.09.2011 drawn at ICICI Bank, Sanjeev Nagar in favour of Member Secretary, SRC, NCTE, Bangalore. After knowing from SRC that demand draft was missing, the appellant resubmitted duplicate copy of the demand draft and a letter dated 07.12.2011 of ICICI Bank mentioning that D.D. No. 2374 dated 21.09.2011 for Rs. 40,000/- was issued by them, and it has not been en-cashed so far. AND WHEREAS the Council considering the submission made by the appellant and further noting that both original D.D. as well as its duplicate copy issued by ICICI Bank are available in SRC’s file, concluded that there was adequate justification to accept the appeal and remand the matter to SRC with a direction to deposit the DD of Rs. 40,000/- in NCTE’s account and process the application on merit as per Regulations. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, and after considering oral arguments advanced during the hearing, the Council concluded that there was

O R D E R WHEREAS the appeal of Karunya College of Education, Nalgonda, Andhra Pradesh dated 25/03/2012 is against the Order No. SRCAPP1689/B.ED/AP/2012-13/38717 dated 01/03/2012 of the Southern Regional Committee, refusing recognition for conducting B.Ed course on the grounds “The SRC in its 216th meeting held on 11th-12th January, 2012 considered the matter and decided to summarily to reject the application for not establishing proof of dispatch within 7 days.” AND WHEREAS the Correspondent, Karunya College of Education (hereinafter referred to as the appellant), preferred an appeal dated 16/04/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri A. Paul, Karunya College of Education, Nalgonda, Andhra Pradesh presented the case of the appellant institution on 25-06-2012. In the appeal and during personal presentation it was submitted that the appellant institution registered ‘online’ application on 01.10.2011, within the prescribed time limit. Hard Copy of the ‘online’ application was dispatched by Speed Post on 17.10.2011, which was received by the SRC on 18.10.2011. The institution is in Telangana region. At the time of hard copy submission, there was agitation for separate Telangana State. Due to this Telangana movement named as ‘Sakala Janula Samme’ for 42 days, postal services, courier services and transport services etc. were totally paralysed. So, there was delay in submission of hard copy. In proof of dispatch of hard copy on 17-10-2011, the appellant produced a copy of the postal receipt. AND WHEREAS the Council noted that the appellant dispatched the hard copy of the online application only on 17.10.2011 and it could not be submitted within the prescribed time limit of seven days, on account of circumstances beyond his control. In the circumstances, the Council came to the conclusion that the appeal deserved to be accepted and the matter remanded to SRC for further processing of the application on merit as per Regulations.

O R D E R WHEREAS the appeal of Radhe Shyam Teachers Training College, Supaul, Bihar is against the Order No. ERC/7-130.6/(iii).4/2012/11061 dated 09/04/2012 of the Eastern Regional Committee, refusing recognition for conducting D.El.Ed course on the grounds “1) As the built-up area is less as per NCTE Norms. 2) The building plan is not signed by the Competent Govt. Authority.” AND WHEREAS the Correspondent, Radhe Shyam Teachers Training College (hereinafter referred to as the appellant), preferred an appeal dated 14/02/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri Radhey Shyam Yadav, Teacher, Radhe Shyam Teachers Training College, Supaul, Bihar presented the case of the appellant institution on 25-06-2012. In the appeal and during personal presentation it was submitted that (a) a copy of the new building plan( inclusive of second floor) showing 1580 sq. mt. of built up area is produced in the appeal. At the time of submission of application second floor of the building was under construction and with the completion of second floor, the total built-up area of the building is 1580 sq. mt. A building completion certificate dated 07.09.2010 is also produced in the appeal; (b) the institution is situated at the periphery of District town of Supaul and it falls under rural area and not under the Municipal Area Therefore, the building plan signed by the competent authority of the rural area was submitted to the ERC on 13-11-2011. AND WHEREAS the Council noted that (a) the building plan submitted by the appellant to the ERC is approved by the competent Government Authority. However, it showed only 1487 sq. mt. of built up area on ground, first and second floors of the building. So, the built up area mentioned in the building plan is less than that prescribed in the norms; (b) the appellant in the appeal submitted a building plan mentioning 1580 sq. mt. of built up area including 186 sq. mt of area on second floor. The building completion certificate dated 07-09-2010 produced in the appeal stated that second floor was under construction and the appellant did not submit any other building completion certificate showing that construction of the building was completed with an area of atleast 1500 sq.mt. as required under NCTE norms. The Council, therefore, concluded that there was no justification to accept the appeal.

O R D E R WHEREAS the appeal of Sri Ram Educational and Welfare Society, Kakinada, Andhra Pradesh dated 07/04/2012 is against the Order No. SRCAPP1516(2012-13)/D.E.C.ED/AP/2011-12/36911 dated 13/01/2012 of the Southern Regional Committee, refusing recognition for conducting D.E.C.Ed course on the ground “Hard copy of application submitted after the stipulated period of 7 days from the date of online application submission.” AND WHEREAS the Correspondent, Sri Ram Educational and Welfare Society, (hereinafter referred to as the appellant), preferred an appeal dated 13/04/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS the above appeal of the institution was not submitted within stipulated period of 60 days as per Appeal Rules and it was late by 1month and 1 day. The appellant submitted the reasons for delay saying that they were not aware of appeal procedures and SRC in their rejection letter dated 13-01-2012 did not mention about the appeal remedy available U/s 18 of the NCTE Act. The Council taking into consideration the submission made by the appellant decided to condone the delay and examine the matter on merit. AND WHEREAS Shri P. Bharath Kumar, Member, Sri Ram Educational and Welfare Society, Kakinada, Andhra Pradesh presented the case of the appellant institution on 25-06-2012. In the appeal and during personal presentation it was submitted that (a) the appellant society-Sri Ram Educational and Welfare Society, Kakinada, Andhra Pradesh registered `online’ application on 29-09-2011, for grant of recognition of Sanjeev D.El.Ed. college. The appellant inadvertently clicked on `D.E.C.Ed. course while entering the course applied for. (b) They sent a person on 5th October 2011 for submission of hard copy of the application . Unfortunately the vehicle in which the person was travelling had been stopped by mob of `Sakala Janula Samme’, who continued their agitation for 40 days.. Later the appellant submitted hard copy of the online application in the office of SRC on 18-10-2011. AND WHEREAS the Council noted that the appellant could not submit the hard copy of the application within the prescribed time limit on account of circumstances beyond his control. In the circumstances the Council came to the conclusion that the appeal deserved to be accepted and the matter be remanded to SRC for further processing of the application on merit as per Regulations

O R D E R WHEREAS the appeal of Eram College, Lucknow, Uttar Pradesh dated 02/05/2012 is against the Order No. NRC/NCTE/NRCAPP-1035/194th Meeting/2012/18982 dated 02/04/2012 of the Northern Regional Committee, refusing recognition for conducting D.El.Ed course on the ground “The institution did not complete three academic sessions of B.Ed. course as required under clause 8(3) of NCTE Regulations, 2009, on the date of submission of application for D.El.Ed. course.” AND WHEREAS the Correspondent, Eram College (hereinafter referred to as the appellant), preferred an appeal dated 02/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri K.S. Faizi Yunus, Director and Shri Munavvar Hassan, Assistant Administrator, Eram College, Lucknow, Uttar Pradesh presented the case of the appellant institution on 25-06-2012. In the appeal and during personal presentation it was submitted that (a) Eram College, Sheikhpur, Habibpur is a new college and that no B.Ed. course has ever been applied by this institution nor any such course is being run; (b) the confusion had cropped up due to similarity of word ‘Eram’ preceding the name of every institute of Eram Education Society. The society has been running 3 institutions namely (i) Eram College, Meluraiganj, Barabanki, (ii) Eram College, Kursi Road, Lucknow, (iii) Eram Girls Degree College, C-Block, Indira Nagar, Lucknow; (c) that the recognition for B.Ed. course was granted by the NRC for some other college i.e. ‘Eram Girls Degree College’ and not for Eram College, Shikhpur-Habibpur. AND WHEREAS the Council taking into consideration the submission made by the appellant decided to remand the matter to NRC for reconsideration in the light of records/documents available with them and to take decision thereafter as per NCTE Regulations.

O R D E R WHEREAS the appeal of Haragopal College of Education, Srikakulam, Andhra Pradesh dated 07/05/2012 is against the Order No. SRO/NCTE/2009-2010/17290 dated 05/01/2010 of the Southern Regional Committee, refusing recognition for conducting B.Ed course on the grounds “1) As per the VT report, the Management is conducting Viswha Bharathi Public School in the building proposed for B.Ed. course. As per para 8(7) of NCTE Regulations, `No institution shall be granted recognition under the regulations unless it is in possession of required land on the date of application. As per records, the institution has not submitted the exclusive land and building documents for the proposed course. 2) The proposed building for running the B.Ed. course is with asbestos roofing which is against the NCTE regulations, standards and norms. 3) The VT report indicate that the furniture is not suitable for the proposed programme, because it is meant for school children. 4) Equipment are not provided for Education Technology lab. 5) The infrastructural and instructional facilities are inadequate to the extent as indicated above.” AND WHEREAS the Correspondent, Haragopal College of Education (hereinafter referred to as the appellant), preferred an appeal dated 14/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS the above appeal of the institution was not preferred within the stipulated period of 60 days as per Appeal Rules and it was late by 2 years, 2 months and 9 days. NCTE issued a notice to the appellant requesting them to appear before the Council on 25.06.2012 and explain the reason of delay. AND WHEREAS Shri D. Chandra Sekhar, Additional Director and Shri Venkatesware Sahu, Honorary President, Haragopal College of Education, Srikakulam, Andhra Pradesh appeared before the Council on 25-06-2012 and explained the reasons for delay stating that the appellant had filed a writ petition No. 27704 of 2009 on 17/12/2009 immediately after the decision of the 185th Meeting of SRC dt. 26/27-11-2009 was published in the Website, challenging the same as arbitrary, violative of principles of natural justice etc. It was only after more than one month of the said website publication of the decision of SRC and almost one month of filing the W.P. before the Hon’ble High Court the SRC sent a detailed order dt. 05/01/2010. Since the matter was pending before the Hon’ble High Court, no alternative remedy could be pursued for the same or similar relief. Thus, the Appellant could not approach this Appellate Authority well within the prescribed time limit of 60 days. Now since the Ed.Cet-2012 for the current academic year had been announced, with the fear of losing one more academic year the Appellant had withdrawn the above mentioned pending W.P. on 26/04/2012 to seek the

alternative remedy of Appeal u/S 18 of the NCTE Act. Thus, there was delay in filing the Appeal. AND WHEREAS the Council noted that a) SRC caused inspection of the institution on 09.06.2009 in compliance with the Hon’ble High Court of Andhra Pradesh direction dated 15.04.2009 passed in W.P. No. 7462/2009. Thereafter SRC, refused recognition vide order dated 05.06.2009 considering the recommendation of State Govt. of Andhra Pradesh not to grant recognition to any teacher training institution for the year 2009-10; (b) the appellant preferred appeal against the SRC’s refusal order and Appellate Authority vide order dated 07.08.2009 remanded the matter to SRC for processing of the case on merit and passing appropriate orders in compliance with the court directions; (c) subsequently, SRC caused re-inspection of the institution on 11.09.2009, issued show cause notice, after considering the reply to the notice SRC in their meeting held on 26-27th November 2009 decided to withdraw recognition of the institution and accordingly vide order dated 05.01.2010 withdrew recognition of the institution on the grounds as stated in para 1 above. AND WHEREAS the Council further noted that aggrieved by the decision of SRC, the appellant again approached Hon’ble High Court in W.P. No. 27704/2009. SRC in their refusal order dated 05.01.2010 specifically mentioned that if the institution is not satisfied by the order they can prefer an appeal to the Council u/s 18 of the NCTE Act, 1993. The appellant did not file any appeal against SRC’s order dated 05.01.2010 within the stipulated period of 60 days. He filed appeal after 2 years of issue of the refusal order. The reason cited in the appeal for the delay was that he was pursuing the matter in W.P. No. 27704/2009 and withdrew the petition on 26.04.2012 with the fear of losing one more academic session is not acceptable. The appellant acting according to his wishes filed petition as well as withdrew it. The appellant did not produce Court order for final disposal of the petition. AND WHEREAS in view of the above, the Council, concluded that the reasons adduced by the appellant for condonation of 2 year, 2 month and 9 days were not acceptable and hence it decided not to condone the delay and admit the appeal. NOW THEREFORE, The Council hereby decides not to condone the delay and admit the appeal.

O R D E R WHEREAS the appeal of Kautilya Shiksha Mahavidyalay, Janjgir, Chhatisgarh dated 23/04/2012 is against the Order No. WRCAPP1405/158/2012/87313 dated 06/03/2012 of the Western Regional Committee, refusing recognition for conducting B.Ed course on the ground “Certified copy of registered land documents not submitted”. AND WHEREAS the Correspondent, Kautilya Shiksha Mahavidyalay (hereinafter referred to as the appellant), preferred an appeal dated 01/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Alok Shukla, Secretary and Shri Manoj Pandey, Secretary, Kautilya Shiksha Mahavidyalay, Janjgir, Chhatisgarh presented the case of the appellant institution on 25-06-2012. In the appeal and during personal presentation it was submitted that WRC vide show cause notice dated 04.11.2011 inter-alia informed the institution to furnish certified copy of the registered land documents in favour of the appellant society/institution. The appellant in reply submitted to the WRC certified copy of Khasra document issued by the office of Tehsildar. Therefore refusal ground of WRC was not valid. AND WHEREAS the Council perused the WRC’s file and noted that the appellant in reply to the show cause notice submitted ‘khasra’ land document ( Form ‘B’ of the land document) in proof of having land as per NCTE Regulations. This document mentioned that the land was in favour of ‘B.D. Mahant Higher Secondary School.” Therefore, the land was neither in the name of the appellant society-‘Shiksha Vikas Samiti’ nor in the name of the institution-‘Kautilya Shiksha Mahavidyalaya’. As per Clause 7(1)(A) of Regulation, 2009, land should be either in the name of the applicant society or institution. The appellant in the appeal also did not produce any registered land document in favour of the institution or society. The Council, therefore, concluded that there was no justification to accept the appeal

O R D E R WHEREAS the appeal of R P PG College Meerganj Bareilly, Bareilly, Uttar Pradesh dated 19/04/2012 is against the Order No. NRC/NCTE/NRCAPP-642/194TH MEETING/2011/19575 dated 12/04/2012 of the Northern Regional Committee, refusing recognition for conducting M.Ed course on the ground “ The institution did not complete three academic sessions of existing course as required under clause 8(3) of NCTE Regulations, 2009, on the date of submission of application for D.El.Ed. course”. AND WHEREAS the Correspondent, R P PG College Meerganj Bareilly (hereinafter referred to as the appellant), preferred an appeal dated 23/04/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri Mohit Sharma, Lecturer, R P PG College Meerganj Bareilly, Bareilly, Uttar Pradesh presented the case of the appellant institution on 25-06-2012. In the appeal and during personal presentation it was submitted that at the time of submission of application for M.Ed. course on 22.09.2010, the institution did not complete 3 academic sessions of B.P.Ed. course for which recognition was granted vide NRC’s order dated 12-08-08. By then it had completed 2 academic sessions of B.P.Ed. course i.e. 2008-09 and 2009-10 and 3rd academic session 2010-11 was running. But on the date when NRC took decision to refuse recognition for B.P.Ed. course, the third academic session result was also declared. Therefore, the appeal may be accepted. AND WHEREAS the Council noted that the institution was granted recognition for B.P.Ed. course by the NRC vide order dated 12.08.2008. As admitted by the appellant, the institution had completed only 2 academic sessions (2008-09 and 2009-10) on the date of submission of application for M.Ed. course (i.e. on 22.09.2010) The third academic session 2010-11 was in progress. The Council observed that Clause 8(3) of Regulation 2009 inter-alia stipulates that an institution can apply for one basic unit of additional course after completion of 3 academic sessions of a recognized course. As per the provision of these Regulations, the institution had not completed 3 academic sessions of B.P.Ed. course for submitting application on 22.09.2010 for additional course of M.Ed., U/s 15 of the NCTE Act. the Council, therefore, concluded that there was no justification to accept the appeal.

AND WHEREAS Shri Sharad S. Karamore, Secretary and Shri Tushar D. Radhe, Co-Secretary, Saraswati Adhyapak Vidyalaya, Nagpur, Maharashtra presented the case of the appellant institution on 25-06-2012. In the appeal and during personal presentation it was submitted that the appointments of Lecturer in Fine Arts and Lecturer in Physical Education on part time basis were permissible and contemplated under the NCTE Regulations 2007. Therefore the appellant had made those two appointments on part time basis. It is after coming into force revised NCTE Regulations, the said two appointments are required to be full time appointments. Therefore the Regional Committee was expected to direct the appellant to convert those two appointments on full time basis and ought to have granted recognition for starting D.Ed. course subject to that condition. However, the action of rejection of proposal on that ground is arbitrary and hence the appellant is entitled for the reliefs claimed in this appeal. The appellant now appointed the part time lecturers on full time regular basis on 16.04.2012. AND WHEREAS the Council noted that lecturer in Fine Arts Ku. Sumita Shamrao Thakre and the lecturer in Physical Education, Shri Sheshra Ramchandraji Karause are qualified as per NCTE norms and now they have been appointed on regular basis as per NCTE norms. The appellant also submitted copies of orders dated 16.04.2012 appointing the same part time lecturers in Craft and Physical Education on regular scale of pay with allowances. The Council, therefore, concluded that there was adequate justification to accept the appeal and remand the matter to WRC to examine the details of faculty appointed and take further decision.

AND WHEREAS Shri Parveen Goyal, Chairman, Swami Dayanand College of Education, Bathinda, Punjab presented the case of the appellant institution on 25-06-2012. In the appeal and during personal presentation it was submitted that recognition for B.Ed. course (basic unit) was granted by the NRC vide order dated 01-07-2005 and for additional intake in B.Ed. course was granted vide order dated 19-08-2008 from the academic session 2008-09, and as on date the institute has also already completed three academic sessions i.e., 2008-09, 2009-10 & 2010-11 and fourth academic session 2011-12 is also likely to be completed in couple of months. The completion of above mentioned three academic sessions of the concerned course is also confirmed by the affiliating University, Punjabi University, Patiala (letter issued by Punjabi University, Patiala for completion of three academic session is also attached for reference along with its translation from Punjabi to English language). AND WHEREAS the Council after taking into account the facts and circumstances of the case and the decision of the NCTE Committee taken in their meeting held on 9-10th July, 2010 with regard to Clause 8(3) of the NCTE Regulation 2009, came to the conclusion that an institution which has completed three academic sessions of a course can apply for an additional course after completion of that period, irrespective of the recognition granted for additional intake of existing course. Hence the Council decided to accept the appeal and remand the matter to the NRC for further processing of the application as per Regulations.

AND WHEREAS Shri. Santosh Mahto, Chairman and Shri. Mukesh Kr. Kandarwar, Member, Uday Memorial B.Ed College, Ranchi, Jharkhand presented the case of the appellant institution on 24-05-2012. In the appeal and during personal presentation it was submitted that (a) their application for grant of recognition had been rejected under Section 14(3)(b) of NCTE Act 1993 by the ERC vide order dated 14-02-2012 on the ground that State Govt. of Jharkhand did not give "No Objection Certificate"; (b) that they applied to ERC, for grant of recognition for B.Ed. Course on 27/10/2009 and established requisite infrastructure; (c) that Jharkhand State Govt. deputed their Official for inspection prior to issue of NOC. RD DE, Ranchi visited their college on 22/02/2010 and observed that building & other infrastructure was developed by the institution as per norms and standard as laid down by NCTE for B.Ed. course. (copy of inspection report by RD DE, South Chotanagpur Div., Ranchi annexed as annexure-II to the appeal); (d) that the general recommendation of the Govt. was, not to further grant recognition to teachers training institutions. This recommendation is contrary to the fact that "there is a shortage of teachers training institutions in the Sate of Jharkhand as revealed in the demand and supply estimates of school teachers and teacher educators (2007-08 - 2016-17) prepared by the NCTE Hqrs. after considering the data received from the State Govt. itself"; (e) that the appellant again submitted application on 11-01-2011 to the State Govt. for issuance of `NOC’. Their application for NOC had been reconsidered by the Deptt. of HRD, Govt. of Jharkhand and therefore he requested for giving 15 days time to produce the `NOC’ before the Council. the Council acceding to the request of the appellant, listed the case for hearing again on 25-06-2012

O R D E R WHEREAS the appeal of Vijaya College of Education, Dharmapuri, Tamilnadu dated 17/08/2010 is against the Order No. SRO/NCTE/B.Ed/2009-2010/14918 dated 31/07/2009 of the Southern Regional Committee, refusing recognition for conducting M.Ed course on the grounds “The applicant institution has not submitted its written representation. Again a final reminder was sent to the institution on 02-07-2009 to submit the reply within 10-07-2009. The institution did not submit its written representation even after the completion of stipulated time. the Council discussed about non-submission of clarification reply 178 Meeting held on 13-14 July, 2009 which came to the conclusion that the deficiencies issued in the show cause notice still exists and hence, decided to refuse recognition to the institution for B.Ed course.” AND WHEREAS the Correspondent, Vijaya College of Education (hereinafter referred to as the appellant), preferred an appeal dated 18/08/2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS the above appeal of the institution was not preferred within the stipulated period of 60 days as per Appeal Rules and it was late by 10 months and 13 days. The Council did not condone the delay and issued letter/ order dated 15-10-2010 for not admitting the appeal on account of delay. Aggrieved by the decision of the Council for not condoning the delay, the appellant approached Hon’ble High Court of Judicature at Madras in Writ Petition No. 13199/2011 and the Court vide order dated 16.04.2012 quashed the Council’s order dated 05-10-2010 and directed the Council to process the appeal filed by the petitioner in its own merits and in accordance with the law. In compliance with the Court directions, the case was listed for hearing on 25-06-2012. AND WHEREAS Shri. Nandagopalakrishnan R., Member and Shri. Ramasundaram C., Staff presented the case of the appellant institution on 25-06-2012. In the appeal and during personal presentation it was submitted that (a) they submitted application to the SRC for grant of recognition of B.Ed. course on 07-05-2008. SRC issued deficiency letter on 05-06-2008 for submission of certain documents and the appellant in compliance vide letter dt 04-09-2008 submitted all the sought documents. (b) the SRC by letter dated 06-04-2009 had informed the appellant that they would conduct inspection of the institution on 16-04-2009. The appellant in his letter addressed to Regional Committee dt 11-4-2009 informed that inspection may be postponed due to the drought condition in the District and the appellant had been making arrangements for supply of water. The Regional Committee had acknowledged the said letter on 13-04-2009. (c) further, the appellant personally visited the SRC on 14.05.2009 and informed that within weeks time water problem would be solved and requested the SRC to cause

inspection of the institution at the cost of the appellant. However, SRC vide order dated 31.07.2009 rejected the application on the ground that the appellant was not ready for inspection. AND WHEREAS the Council noted that (a) the appellant submitted application for recognition of M.Ed. course from the session 2009-10 and in the application he mentioned that the building construction would be completed by 30.08.2008; (b) further vide his letter dated 02.09.2008 informed that the construction would be completed before 31.12.2008 and requested for arranging inspection after 01.01.2009; (c) accordingly, SRC caused inspection of the institution on 13.03.2009. The visiting team in their report inter alia stated that the management was not ready for inspection and requested for inspection in the first week of August, 2009 on the pretext that the building construction was in progress. The appellant further vide letter dated 11.04.2009 requested SRC for considering the application for the forthcoming session 2010-11.

AND WHEREAS the Council further noted that Regulations, 2007 were applicable on the application submitted in the year 2008. Clause 5(5) of the Regulation stipulated that “All complete applications received on or before 31st October of the year shall be preferred for the next academic session and final decision, either recognition granted or refused, shall be communicated by 15th May of the succeeding year.” As per this clause the final decision on the applications submitted by the appellant has to be taken by 15th May, 2009. Therefore, request of the institution for postponement of the inspection scheduled in March and April, 2009 on the ground that building was under construction, which would be completed by July, 2009, was not acceptable as Regional Committees cannot wait till the institution completes construction of the building and cause inspection by keeping the application in pendency contrary to the provisions of the NCTE Regulations. The Council, therefore, concluded there was no justification to accept the Appeal. AND WHEREAS after perusal of the documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council concluded that there was no ground to accept the appeal. Accordingly, the appeal is rejected and SRC’s order dated 31-07-2009 is confirmed. NOW THEREFORE, the Council hereby confirms the Order appealed against.

AND WHEREAS Ms. Indu Shekher and Shri. Shalendra Tripathi, Staff, Acharya Chanakya Mahavidyalay, Sultanpur, Uttar Pradesh presented the case of the appellant institution on 26-06-2012. In the appeal and during personal presentation it was submitted that the land of institution is already for non-agricultural purpose and this has been mentioned in the ‘khatauni’ document of the land submitted to the NRC. The institution also submitted to NRC notarized copy of CLU, certified by SDM, Jaininghpur District Sultanpur. AND WHEREAS the Council noted that the appellant institution has acquired agriculture land at Sy.No.393 & 400 from Manager PR Inter College by a gift deed executed on 10-11-2007. The Khatauni document submitted to NRC mentioned that the land has been mutated in the name of the institution -`Acharya Chanakya Mahavidyalaya’ and it also stated that the land is for non-agriculture purpose. Further Tehsildar Office on 23-12-2011 certified that the said land is in use for college and it is for non-agriculture purpose. AND WHEREAS in view of the above, the Council concluded that there was adequate justification to remand the case to the NRC with a direction to verify the land use from the concerned authority and to take further decision thereafter.

As per norms, land must be in the name of the institution. 2) The latest Building Completion Certificate from the authorized competent Government Engineer is not submitted. 3) Land Usage Certificate from the concerned Government authorities stating that the land is exclusively permitted/ sanctioned for Educational Purposes is to be submitted. 4) The Building completion certificate submitted is not in the name of the College. AND WHEREAS the Correspondent, Acharya College of Education (hereinafter referred to as the appellant), preferred an appeal dated 08/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. B.G. Bhaskar, Vice Principal and Shri. CBM Bhoochan, Acharya College of Education, Bangalore, Karnataka presented the case of the appellant institution on 26-06-2012. In the appeal and during personal presentation it was submitted that (a) the appellant society ‘JMJ Education Society’ was in possession of 5 Acre 3 Guntas (excluding Kharab of 7 Guntas) of land at Survey no. 91 of Slodevanahalli Village, Hesaraghatta Hobli, Bangalore North Taluk, Bangalore Urban District. (b) The Society had purchased the pre-converted property for Educational Purpose, from Mysore Stoneware Pipes & Potteries Limited (a company incorporated under the provisions of the Companies Act-1956) through an absolute Sale Deed. (c) the Building completion certificate was issued by the authorized competent Government Engineer viz Assistant Engineer, Taluk Panchayat, Bangalore North Taluk and Panchayat Development Officer, Kasaghatapura Gram Panchayat, Bangalore North Taluk. The conversion of property referred above from Industrial use to Educational purpose had been obtained from the office of the Deputy Commissioner, Bangalore District vide no. ALN.SR (NA)43/2001-02 dated 25-02-2003 by Mysore Stoneware Pipes & Potteries Limited prior to the sale of the property to JMJ Educational Society. (d) the building completion certificate for a total built-up area of 40,429.65 sq.ft. was in the name of Acharya College of Education. Out of which 16,000.65 sq.ft. was being used for B.Ed and D.Ed course and the remaining 24,429 sq.ft. would be used for the proposed M.Ed course in future. (e) The Non-Encumbrance Certificate in respect of Survey No. 91, translated from Kannada version to English was submitted. (f) the language lab was established with adequate facilities with Broad Band Internet connection & LAN. All the

procurements for the language lab were done by the JMJ Education society for Acharya College of Education. Accordingly all bills were in the name of JMJ Education Society. AND WHEREAS the Council noted that (a) the appellant institution was granted recognition for B.Ed. course by the SRC vide order dated 30-11-2004 with a condition to shift to own premises/building within 3 years from the date of recognition; (b) the appellant submitted a proposal on 05-10-2007 to the SRC for shifting of premises; (c) SRC caused inspection of new premises on 25-11-2010 and a re-inspection on 23-04-2011. After issuing show cause notice it withdrew recognition of the institution for B.Ed course on the grounds as stated in para 1 above. AND WHEREAS the Council further noted that (a) the second visiting team in their report dated 23-04-2011 observed that the institution was having adequate land, built-up area and other instructional facilities as per NCTE course; 19,700 Sq.ft. of built-up area was earmarked for B.Ed. course and the remaining area was shown for proposed D.Ed. and M.Ed. programmes; No other programme/course was being run in the name of appellant society; (b) With regard to withdrawal grounds it was observed that sale deed executed was in favour of the society; CLU issued by Deputy Commissioner, Building Completion Certificate issued by Asstt. Engineer and Panchayat Development Officer, Non-encumbrance Certificate issued by Sub-Registrar Officer were acceptable; the building at present was exclusively meant for B.Ed. course; and the language learning lab was adequately equipped.

AND WHEREAS in view of the submission made by the appellant and the documents submitted in support and VT observations, the Council concluded that there was adequate justification to accept the appeal with a direction to the SRC for re-consideration of the matter for restoration of the recognition to the institution. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT reports and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal with a direction to the SRC for re-consideration of the matter for restoration of the recognition to the institution. NOW THEREFORE, the Council hereby remands back the case of Acharya College of Education, Bangalore, Karnataka to the SRC, NCTE, for necessary action as indicated above.

O R D E R WHEREAS the appeal of New Era College of Education, Guntur, Andhra Pradesh dated 28/03/2012 is against the Order No. APS04830/B.ED/AP/201213/39026 dated 07/03/2012 of the Southern Regional Committee, withdrawing recognition for conducting B.Ed course on the grounds “The appellant institution was issued a withdrawal order dated 30-9-2008. Aggrieved by the withdrawal order of SRC, the institution preferred appeal in NCTE Hqrs. An order dated 28-10-2011 issued by the Council with the direction to SRC to issue a fresh order modifying the order of withdrawal of recognition with effect from academic session 2012-13. Accordingly, the recognition to the institution for B.Ed course withdrawn with effect from academic session 2012-13”. AND WHEREAS the Correspondent, New Era College of Education (hereinafter referred to as the appellant), preferred an appeal dated 03/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Dr. A. S. Ramakrishna, Principal and Shri. A.R.K. Murthy, Admn. Officer, New Era College of Education, Guntur, Andhra Pradesh presented the case of the appellant institution on 26-06-2012. In the appeal and during personal presentation it was submitted that (a) the first ground pointed out in the 1st withdrawal order dated 30-09-2008 was related to built up area. The institution did not err in this respect as it had shown the same RCC building having 9049 sq.ft to NCTE, State Govt and University inspection teams, based on the reports of the same recognition was granted by SRC vide Order dated 12-04-2007; NCTE new Regulations, 2007 came into force on 21-7-2007 and it was very difficult for the management to construct the building immediately as per Regulations 2007. However the management has now fulfilled the built-up area requirement constructing own building as per NCTE norms. (b) Ground 2 was related to asbestos roofed structure having built up space of 673 sq.mts. This space adjacent to RCC building and asbestos roof was on strong high walls on four sides. It was not a go-down as pointed by Visiting team. (c) Ground 3 was related to the fact that the management had not taken any step to construct the permanent building. In their reply dated 01-09-2008 to the show cause notice, the appellant requested for giving one year more time to construct the permanent building on own land. They took steps for the construction of the permanent building on the society's own land in Agathavarappadu Village 12 Kms away from the present rented building as stated in their reply on 01-08-2008 to SRC. The site of 6.97 acre of society’s land is not convenient now for the construction of permanent building as private contractors around the site are digging with heavy machines for soil, used for Roads and House purpose and as a result big pits are formed. (d) Ground 4 was related to - not removing the deficiencies pointed out in Show cause notice dt 04-08-2008. In the show cause notice it was pointed out that the visiting

team observed that the instructional facilities were not adequate and very poor. It was totally incorrect, as they appointed faculty members (7+1) as per NCTE norms. The institution library was having 3500 educational books, subscribed for 5 educational journals and five general journals. (e) Ground 5 was related to classroom and labs size. The classrooms provided were adequate for seating of 50 B.Ed students and were furnished with required number of benches and tables. The multi-purpose hall and seminar hall were spacious. The science labs were equipped with all important items. The ET lab consisted of TV, OHP, Slide Projector and one Computer and 25 CDs. The Computer lab had 10 computers. The rooms in the new building are also spacious as per NCTE norms and this deficiency is also removed. AND WHEREAS the Council noted that (a) the appellant against the withdrawal order dated 30-09-2008, approached Hon’ble High Court of Andhra Pradesh at Hyderabad in W.P. No.22090/2009. The Hon’ble Court vide Order dated 11-08-2009 disposed off a bunch of petitions “granting liberty to the petitioners to file statutory appeals U/s 18 of the NCTE Act, 1993, if not already filed, within a period of four weeks from today. If any such appeals are preferred, the appellate authority shall receive treating the same as appeals filed within limitation and dispose of in accordance with law after hearing both the parties. Till such time, status quo obtaining as on day in all respects shall be maintained.” (c) The Council vide order dated 28-10-2011 confirmed SRC’s withdrawal order dated 30-09-2008 and directed SRC to issue a modified order withdrawing recognition w.e.f. 2012-13 in order to safeguard the interest of already admitted students. (d) On the directions of the Council only, SRC issued order dated 07-03-2012 withdrawing recognition w.e.f. 2012-13. (e) As the appeal dated 05-09-2009 filed against the earlier withdrawal order dated 30-09-3008, was rejected by the Council vide Order dated 28-10-2011 after carefully considering the case against the withdrawal grounds. Therefore, there was nothing more left for the appellant to file again appeal on 28-03-3012 against the grounds of earlier withdrawal order dated 30-09-2008. As on the date of issue of Council’s decision (i.e. 28-10-2011) also the appellant institution was running from rented premises with inadequate facilities. The appellant’s claim for having constructed now its own building was not acceptable, as these developments have been taken place much after the withdrawal of recognition and rejection of the appeal. Therefore, the Council concluded to re-confirm their earlier decision upholding withdrawal of recognition by the SRC vide order dated 30-09-2008. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council concluded that there was no ground to accept the appeal. Accordingly, the appeal is rejected and SRC’s order dated 07-03-2012 is confirmed. NOW THEREFORE, the Council hereby confirms the Order appealed against.

O R D E R WHEREAS the appeal of Paramount Teachers Training College, Musaffarpur, Bihar dated 20/03/2012 is against the Order No. ERC/7-130.5(i).20/2012/11060 dated 09/04/2012 of the Eastern Regional Committee, refusing recognition for conducting B.Ed course on the grounds “(1) Covered area of the building was less. (2) Building Completion Certificate has not been signed by the Competent Authority”. AND WHEREAS the Correspondent, Paramount Teachers Training College (hereinafter referred to as the appellant), preferred an appeal dated 26/03/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. A.K. Thakur, Chairman and Shri. Mahesh Pd. Raj, Secretary, Paramount Teachers Training College, Muzaffarpur, Bihar presented the case of the appellant institution on 26-06-2012. In the appeal and during personal presentation it was submitted that (a) as per NCTE norms the covered area required is 1500 Sq.mt., whereas the covered area of the college building was 1503 Sq.mt. (b) Building completion certificate dated 04-01-2010 submitted to ERC was duly signed by the Govt Asst. Engineer of Kudhani Block Muzaffarpur and it mentioned built-up area as 1503 Sq.mt. Another certificate of building completion was sent with the previous certificate duly signed by the Block Development Officer of Kudhani Block Muzaffarpur. AND WHEREAS the Council noted that (a) ERC did not issue any show cause notice as required under the provisions of Section 14 of the NCTE Act, before refusing recognition; (b) the visiting team in their report dated 16-11-2011 mentioned availability of 1505 sq.mt. of built-up area and with the VT report a building completion certificate dated 04-01-2010 issued by Asstt. Engineer was submitted and it mentioned the built-up area as 1503 Sq.mt. So, the built-up area mentioned in the VTR and building completion certificate meets the requirement. The Council therefore concluded that there was adequate justification to accept the appeal and remand the matter to ERC for consideration of the building completion certificate and further processing of the application as per Regulations. The institution is directed to submit to the ERC building completion certificates issued by Asst. Engineer as well as Block Development Officer.

O R D E R WHEREAS the appeal of Parbati Teachers Training Institute, Bardhaman, West Bengal dated 09/05/2012 is against the Order No. ERC/7-130.6(iii).15/2012/10633 dated 12/03/2012 of the Eastern Regional Committee, refusing recognition for conducting B.Ed course on the ground “Due to non-submission of fresh/revised building plan by the institution”. AND WHEREAS the Correspondent, Parbati Teachers Training Institute (hereinafter referred to as the appellant), preferred an appeal dated 09/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Goutam Basu, Administrator, Parbati Teachers Training Institute, Bardhaman, West Bengal presented the case of the appellant institution on 26-06-2012. In the appeal and during personal presentation it was submitted that ERC vide their notice dated 18-10-2011 informed the appellant that in the building plan submitted by the institution, the size of multipurpose hall, class room etc. are not given. The institution is required to submit a fresh building plan indicating the size of multipurpose hall, classroom etc. as per NCTE norms duly approved by the competent authority within 21days. (b) The said notice was delivered to them too late and only two days of expiry of last date were left for submission of reply (a copy of the envelope showing the date of post office of delivering the letter on 08-11-2011 is produced in the appeal). (c) They have got revised the building plan showing size of multipurpose hall, classroom etc. and the plan has been approved by competent authority of Jamuria Municipality. AND WHEREAS the Council taking into consideration the submission made by the appellant and looking at the status of Teacher Education in the State of West Bengal, concluded that there was adequate justification to remand the case to the ERC with a direction to consider the revised building plan and for further processing of the application as per Regulations. The institution is directed to forward a copy of the revised plan to the ERC.

O R D E R WHEREAS the appeal of Radha Krishna Kanya Mahavidyalaya, Agra, Uttar Pradesh dated 21/04/2012 is against the Order No. NRC/NCTE/NRCAPP-936/194th Meeting/2012/18766 dated 30/03/2012 of the Northern Regional Committee, refusing recognition for conducting D.El.Ed course on the grounds “1) The institution was recognized for B.Ed. (Additional intake) course in May 2008, therefore, the institution did not complete three academic sessions at the time of application for the D.El.Ed. course in October 2010. As such the application is in violation of the provisions under clause 8(3) of the NCTE Regulations, 2009. 2) The building plan submitted is not the original plan as approved by the Competent Authority. Only a photocopy of the approved plan has been submitted which is not acceptable. 3) As per building plan the total built up area is 1678 sq. mtrs. which is not sufficient for the B.Ed.,B.Ed. (Additional intake) and proposed D.El.Ed. course for which a total area of 3500 sq. meters is required as per NCTE norms. The institution did mention in its application about availability of 3000 sq. mt. for the proposed programme but it is not matched by corresponding building plan. 4) A certificate from the Architect that they have constructed second floor 1500 sq. mt. cannot be accepted in the absence of approved building plan for additional construction. In any way, even 3000 sq. mt. of built up area is short of the requirement of 3500 sq. mt. as per NCTE norms”. AND WHEREAS the Correspondent, Radha Krishna Kanya Mahavidyalaya (hereinafter referred to as the appellant), preferred an appeal dated 04/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Dr. C. Gautam, Secretary, Radha Krishna Kanya Mahavidyalaya, Agra, Uttar Pradesh presented the case of the appellant institution on 26-06-2012. In the appeal and during personal presentation it was submitted that (a) NRC granted recognition for B.Ed. (Addl intake) vide Order dated 05-01-2008. With the approval of the affiliating body it admitted students from the session 2007-08 and 2009-10. The session 2010-11 being zero session for B.Ed. course in the UP State, no admissions were made. The Session 2011-12 was in progress; (b) original building plan approved on 17-03-2012 by `Aavas Vikas Parishad, Lucknow’ is produced in the appeal. (c) at the time of submission of application, 3032 sq.mt. of built-up area was available and additional construction of 500 Sq.mt. was going on. Now the institution has 3532.82 Sq.mt. of built-up area as per building plan; (d) the building had been constructed in accordance with the norms of national building code. AND WHEREAS the Council noted that as submitted by the appellant the institution had conducted and completed three academic sessions of B.Ed. course; (b) a copy of the approved building plan submitted to NRC mentioned only 1678 sq.mt. of built-up area and it was not

adequate for the existing two units of B.Ed. and proposed D.El.Ed. course. The building plan now submitted in the appeal, approved on 12-03-3012 mentioned 1605.52 Sq.mts. as existing and 1927.30 Sq.mts. as proposed covered area on ground, first and second floors of a building. The appellant was asked to show building completion certificate issued by the Competent Authority for constructing the proposed area of 1927.30 Sq.mts. as per approved building plan. He admitted that the building completion certificate for total built-up area of 3532.8 Sq.mt. has not yet been obtained. This revealed that after obtaining the approval on 12-03-2012 for additional covered area of 1927.30 Sq.mts; the construction of the additional area has not been completed. The existing built-up area does not cater to the requirement of the 2 units of B.Ed. and 1 unit of D.El.Ed. course. Further the certificate issued by architect for constructing 500 Sq.mt. of built-up area on second floor was not acceptable as it was not issued by competent Govt. authority. AND WHEREAS in view of the above the Council came to the conclusion that there was no justification to accept the appeal . AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, and after considering oral arguments advanced during the hearing, the Council concluded that there was no ground to accept the appeal. Accordingly, the appeal is rejected and NRC’s order dated 30-03-2012 is confirmed NOW THEREFORE, the Council hereby confirms the Order appealed against.

AND WHEREAS the Correspondent, Sacchidanand Kala Krida & Shikshan Mandal, (hereinafter referred to as the appellant), preferred an appeal dated 08/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Sandip Raosaheb Kolhe, Member, Sacchidanand Kala Krida & Shikshan Mandal,, Ahmednagar, Maharashtra presented the case of the appellant institution on 26-06-2012 . In the appeal and during personal presentation it was submitted that it is erroneous to say that the CLU is not submitted in the prescribed proforma because no where in the rules and regulations on any specific proforma is prescribed and secondly the competent authority i.e. Tahsildar of Taluka Parner has issued the certificate i.e. CLU in the proforma which is prescribed by the State of Maharashtra. Irrespective of the proforma, the certificate placed on record makes it clear that the property bearing No. 1747 belongs to the appellant and said property is in use for the purpose of school, college and like educational activities. As regards, the validity of the non-encumbrance certificate, it is submitted that the respondent has not looked into the certificate of non-encumbrance filed by the appellant. The said certificate is not issued by the Sarpanch as mentioned by the respondent but it is issued by the competent Govt. authority i.e. Tahsildar. AND WHEREAS the Council noted that the appellant society executed gift deed for the property at Gat No.3601/1 and sale deed for the property at Gat No. 3547 in Parner Village. Both the land documents mentioned that it was agriculture land. The appellant did not submit `CLU’ document specifying that the land at Gat No.3601/1 and 3547 has been diverted from agriculture purpose, in the format of State Govt. of Maharashtra. The certificate dated 05-10-2006 of Tehsildar Office merely stated that the property No.1747 belonged to appellant trust and it is utilized for educational activities. This certificate does not mention conversion of land from agriculture to education purpose and also date of conversion as per land revenue records. Moreover this certificate was not for the property mentioned in the sale and gift deeds; (b) the appellant submitted to WRC non-encumbrance certificate issued by the Sarpanch only. As it was not issued by Land Revenue Authority/Registration authority, this certificate was not valid. Non-

The Council, therefore concluded that there was no justification to accept the appeal. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, and after considering oral arguments advanced during the hearing, the Council concluded that there was no ground to accept the appeal. Accordingly, the appeal is rejected and WRC’s order dated 27-03-2012 is confirmed. NOW THEREFORE, the Council hereby confirms the Order appealed against.

O R D E R WHEREAS the appeal of Tagore Institute of Art and Education, Birbhum, West Bengal dated 30/04/2012 is against the Order No. ERC/7-130.6(iii).13/2012/10617 dated 06/03/2012 of the Eastern Regional Committee, refusing recognition for conducting B.Ed course on the ground “Due to Non-submission of building plan approved by Competent Govt. Authority”. AND WHEREAS the Correspondent, Tagore Institute of Art and Education (hereinafter referred to as the appellant), preferred an appeal dated 03/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Apurbo Kumar Roy, Secretary, Tagore Institute of Art and Education, Birbhum, West Bengal presented the case of the appellant institution on 26-06-2012. In the appeal and during personal presentation it was submitted that approved building plan sanctioned by competent Govt. Authority was submitted to ERC. In West Bengal, Gram Panchayat is the only authority in the rural area to sanction building plan. But upon the insistence/demand of ERC the appellant approached the SDO, Bolpur, under jurisdiction of whom the institute is coming up for getting the building plan sanctioned by him, to which SDO, Bolpur replied that as per rule 27 of West Bengal Panchayat (Gram Panchayet Administration) rules, 2004 part II Gram Panchayat Administration chapter IV Pradhan/Upa Pradhan of the Gram Panchayat is the competent authority to approve the building plan in Panchayat area. Other authorities have no right to do so in case of the State of West Bengal. Therefore the building plan has been duly and lawfully approved/sanctioned by Pradhan, Illambazar Gram Panchayat, who is the competent authority for this purpose. AND WHEREAS the Council taking into consideration the submission made by the appellant, and further noting that the building plan available in ERC file is approved by the Competent Local Govt. Authority i.e. Pradhan of Village Panchayat Office concluded that there was adequate justification to accept the appeal with a direction to ERC for further processing of the application as per Regulations.

AND WHEREAS the Correspondent, Yadaiah B.Ed College (hereinafter referred to as the appellant), preferred an appeal dated 04/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Yadaiah, Secretary, Yadaiah B.Ed College, Ranga Reddy, Andhra Pradesh presented the case of the appellant institution on 26-06-2012 . In the appeal and during personal presentation it was submitted that they sent a proposal vide letter dated 26-12-2011 about shifting of the college to its own premises at Sy.No.293 & 294 at Yadgarpally east Village & Grampanchayath, Keesar Mandal, Ranga Reddy District, Andhra Pradesh State. Alongwith this letter he submitted land documents in the name of the Society, location of the building and other relevant documents and the same was acknowledged by SRC on 09-01-2012. The SRC failed to consider that the appellant had already submitted original fixed deposit receipt of Canara Bank, Lalapet Branch for Rs. 5.00 lakhs dt 09-06-2007 with FDR no. 0658340 and another FDR for Rs. 3.00 lakh issued by State Bank of Hyderabad, Ramnagar Branch, Hyderabad kept in joint account with the SRC, which were verified and acknowledged by SRC on 09-01-2012. The appellant further stated that the institution’s new premises had already been inspected by the affiliating University, which accorded permission to shift the institution to own premises. AND WHEREAS the Council perused the SRC’s file and noted that (a) the appellant in his reply to the show cause notice dated 09-10-2009 of SRC submitted copy of the land

documents in favour of the society pertaining to new location of the building. Therefore first withdrawal ground was not valid. (b) Certified copies of the registered land documents was not called for by SRC. So, the appellant could not submit the same to SRC. However they are now submitted in the appeal. (c) A copy of the building plan approved by Sarpanch was submitted to SRC, therefore third ground of withdrawal was not valid. (d) The building completion certificate submitted to SRC was issued by a private architect. So, the appellant is required to submit the completion certificate issued by Competent Govt. Authority. (e) Non-encumbrance certificate issued for Sy.No.293 was only submitted to SRC, but not for Sy.No.294. (f) the SRC’s file contains only photo copy of the FDR for Rs.5 lakhs, so the appellant need to submit the original FDR to SRC.(g) further withdrawal of the recognition without verifying the facilities provided at the new promises by way of inspection was not in order. AND WHEREAS in view of the above the Council concluded that there was adequate justification to remand the case to SRC to cause inspection of the new premises, as the institution had already submitted inspection fee of Rs.40,000. The appellant is directed to submit again to the SRC, all the documents mentioned in the SRC’s withdrawal Order. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council concluded that there was adequate ground to remand the case to the SRC to cause inspection of the new premises, as the institution had already submitted inspection fee of Rs.40,000. The appellant is directed to submit again to the SRC, all the documents mentioned in the SRC’s withdrawal Order. NOW THEREFORE, the Council hereby remands back the case of Yadaiah B.Ed College, Ranga Reddy, Andhra Pradesh to the SRC, NCTE, for necessary action as indicated above.

AND WHEREAS the Correspondent, Adarshabani Teachers Training college (hereinafter referred to as the appellant), preferred an appeal dated 14/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Ashutosh Sarkar, Chairman, Adarshabani Teachers Training college, Malda, West Bengal presented the case of the appellant institution on 26-06-2012. In the appeal and during personal presentation it was submitted that ERC vide their letter dated 12-10-2011 granted two months time for expanding the size of multipurpose hall and directed the appellant to submit amended building plan duly approved by the Competent Authority and building completion certificate in the prescribed format accompanied with an affidavit in support of multipurpose hall size expansion; (b) the appellant in his reply dated 29-11-2011 informed ERC that the multipurpose hall size had been increased to 2222 Sq.ft. by merging the earlier hall with adjacent rooms. And in support submitted revised building plan issued by Competent Govt. Authority (p-55), building completion certificate , still photographs of the expanded multipurpose hall and an affidavit. Therefore, the institution has complied with the deficiency as mentioned in the ERC’s letter and hence refusal ground was not valid. AND WHEREAS the Council perused the reply dated 29-11-2011 of the institution and the documents sent therewith and noted that the size of the multipurpose hall had been increased to 2200 sq.ft. with certain internal alterations and hence it had complied with the deficiency mentioned in the ERC’s letter 12-10-2011 . Therefore the Council concluded there was adequate justification to accept the appeal and remand the matter to ERC for further processing as per Regulations.

AND WHEREAS Shri. Janadin Singh, Manager, B D S P Mahavidyalay Samiti, Varanasi, Uttar Pradesh presented the case of the appellant institution on 26-06-2012. In the appeal and during personal presentation it was submitted that the online application was submitted at 12:41:04 P.M. on September 22, 2011. On the same date at 5:1:3 P.M. all the papers in duplicate, were sent to the Regional Office, Jaipur, by speed-post. AND WHEREAS the Council observed that as per Clause 5(3) of NCTE Regulations 2009, the applications have to be submitted electronically through online module available on the website of NCTE. Further on verification in the NCTE website it was found that the appellant institution name did not exist in the online registration link in NCTE website and hence no `ID’ of the application was generated. The Council, therefore concluded that there was no justification to accept the appeal.

O R D E R WHEREAS the appeal of Dhupguri College of Education, Jalpaiguri, West Bengal dated 11/05/2012 is against the Order No. ERC/7-130.6(i).19/2012/10709 dated 15/03/2012 of the Eastern Regional Committee, refusing recognition for conducting B.Ed course on the ground “The staff list submitted by the institution is not signed by the Registrar of Affiliating Body”. AND WHEREAS the Correspondent, Dhupguri College of Education (hereinafter referred to as the appellant), preferred an appeal dated 11/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Santosh Kumar Saha, Secretary and Shri. Jatmitra Nath Sarkar, President, Dhupguri College of Education, Jalpaiguri, West Bengal presented the case of the appellant institution on 26-06-2012. In the appeal and during personal presentation it was submitted that (a) ERC vide letter dated 06-04-2011 directed the institution to submit the documents related to faculty selection and approval of the university within 60 days; (b) the appellant requested `North Bengal University’ the affiliating body for constitution of Selection Committee and the University vide letter dated 03-05-2011 appointed university nominee. Thereafter, after inviting applications through advertisement in daily newspapers, interviews were conducted by the duly constituted Selection Committee and selected panel of faculty was forwarded to the Registrar of the University by their letter dated 07-06-2011, followed by reminders dated 17-06-2011, 20-07-2011; (d) when there was undue delay on the part of the University in giving approval to the selected faculty and the time limit given by ERC for sending compliance was over, the appellant approached Hon’ble High Court, Calcutta in W.P. No.10133/2011 against the University. The Court vide Order dated 15-11-2011 disposed off the petition with certain directions to the university; (e) the University vide letter dt. 08-02-2012 interalia informed the appellant for fresh selection of faculty. In compliance with the direction of the University the appellant first selected Principal following laid down procedure. After getting the approval of University, they appointed the Principal. Rest of the faculty members were selected by a Selection Committee constituted afresh including the Principal on 23-26th April 2012. The faculty members were appointed on 27-04-2012; (f) refusal of recognition by ERC vide order dated 15-03-2012, when the faculty selection and appointments involving the affiliating body were in progress, was not justified. AND WHEREAS the Council taking into consideration the submission made by the appellant and the supporting documents furnished therewith noted that the institution failed to

The Council, therefore concluded that there was adequate justification to remand the case to the ERC for considering the staff list approved by North Bengal University and for taking further decision thereafter. O R D E R WHEREAS the appeal of Karmyogi College of Education, Raibareilly, Uttar Pradesh dated 11/05/2012 is against the Order No. NRC/NCTE/NRCAPP-722/194TH MEETING/2012/18995 dated 02/04/2012 of the Northern Regional Committee, refusing recognition for conducting D.El.Ed course on the grounds “1) Original documents were not shown to the Visiting Team. 2) Land documents were not found in order. 3) FDRs not submitted in original”. AND WHEREAS the Correspondent, Karmyogi College of Education (hereinafter referred to as the appellant), preferred an appeal dated 14/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Ramkishore Mishra and Shri. Basant Kumar Singh, Member, Karmyogi College of Education, Raibareilly, Uttar Pradesh presented the case of the appellant institution on 26-06-2012. In the appeal and during personal presentation it was submitted that (a) the visiting team during the course of its inspection of the college had gone through all the documents related to land, building, building completion certificate, bills of procurement of the lab materials consumables and chemicals, psychological lab, books, journals, magazines etc. in the library very carefully, and never mentioned anytime that the institution had not been shown originals of the various documents stated above. The appellant is in possession of all the original documents, which can be seen at any time; (b) the second refusal ground had neither been communicated through Show Cause Notice nor was understood as a deficiency as such. The land had been registered in the name of the Society after paying stipulated Stamp Duty. Therefore the institution has required land area as stipulated in the NCTE Norms for D.El.Ed. course. The original land document was produced during presentation; (c) NRC in its Refusal Order itself returned FDRs which were submitted to them along with application. Therefore, the deficiency had been created for the name sake. Therefore the refusal order was invalid as none of the deficiencies stated in the refusal order exist. AND WHEREAS the Council noted that (a) the visiting team in their report dated 29-07-2011 inter-alia mentioned that the land was in the name of the college, but original document was misplaced and could not be shown to the VT members. Attested copy was shown to them; (b) as per the certified copy of the sale deed available in NRC’s file (which was submitted in reply to the deficiency letter). Karmayodi College of Education had purchased 0.7517 Hect. of agriculture land at Sy.No.949/1 in village Maulihamau. The original land document shown to the

Council corroborated the certified copy of the land document. Therefore the institution meets the land requirement as stipulated under Clause 7(1)(A) of NCTE Regulations 2009; (c) NRC vide their refusal order dated 02-04-2012 returned the original FDRs submitted to NRC towards endowment and reserve fund. Hence, the last refusal ground was not valid. AND WHEREAS in view of the above, the Council concluded that there was adequate justification to accept the appeal and remand the case to the NRC for further processing as per Regulations. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council concluded that there was adequate ground to accept the appeal and to remand the case to the NRC for further processing as per Regulations. AND WHEREAS Shri. Munish Sabharwal, Executive Director and Shri. Neeraj Singh, Secretary, Kishan Institute of Teachers Education, Meerut, Uttar Pradesh presented the case of the appellant institution on 26-06-2012. In the appeal and during personal presentation it was submitted that as per Clause 8(3) of the NCTE, Regulations 2009, institution can apply for an additional unit of the existing recognized course after completion of three academic sessions of the respective course. They have applied for additional intake in D.El.Ed (BTC) course. for which recognition of basic unit was granted in 2004, that was 8 years ago. The clause clearly states that recognition date of M.Ed. course would apply only if additional intake in M.Ed. course is sought by the institution & not for additional intake in D.El.Ed course. Further as per the above Clause 8(3) of the NCTE, Regulations 2009, even after recognition is granted for the proposed additional intake in D.El.Ed. course, the maximum intake capacity of the institution taking into consideration of all courses, along with additional intake, in any case, will not exceed 300. AND WHEREAS the Council taking into consideration the facts of the case and the decision taken by the NCTE Committee in their meeting held on 9-10th July 2012 with regard to Clause 8(3) of NCTE Regulations 2009, concluded that the institution can apply for additional unit in the existing recognized course, after completion of three academic sessions of the existing course concerned. Hence, the Council decided to accept the appeal and remand the matter to the NRC for further processing of the case as per Regulation. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit and after considering oral arguments advanced during the hearing, the Council concluded that there was

O R D E R WHEREAS the appeal of Maa Vidyavashni College of Education, Hazaribagh, Jharkhand dated 11/05/2012 is against the Order No. ERC/7-130.5(i).18/2012/11226 dated 30/04/2012 of the Eastern Regional Committee, refusing recognition for conducting B.Ed course on the ground “that the building completion certificate was prepared one year before plan was approved”. AND WHEREAS the Correspondent, Maa Vidyavashni College of Education (hereinafter referred to as the appellant), preferred an appeal dated 14/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Ajeet Kumar, Secretary and Shri. Anup Kumar Mehta, Member, Maa Vidyavashni College of Education, Hazaribagh, Jharkhand presented the case of the appellant institution on 26-06-2012. In the appeal and during personal presentation it was submitted that (a) the building completion certificate was not issued one year before the approval of building plan. The building completion certificate had been issued on 21st Oct., 2011 by the Assistant Engineer, Padma Block, Hazaribagh and countersigned by Circle Officer and the building plan had been approved by the Circle Officer on 27th Oct., 2009, who is the Competent Authority; (b) the ERC failed to appreciate the fact that initially the building plan was approved by the circle officer on 27th Oct., 2009 (annexure-2). It was only after the ERC raised the deficiency about the structural safety in the plan, the same was re-approved on 22nd July, 2011 by the Circle Officer (Anneuxre-3). A certificate to this effect certifying the above has also been obtained from the Circle Officer; and (c) moreover the appellant institution had not been given any show cause notice on the ground stated in the refusal order, before passing refusal order and this is contrary to the provisions of the NCTE Act. AND WHEREAS the Council noted that (a) the appellant alongwith the application submitted the building plan approved by Circle Officer on 27-10-2009 and building completion certificate dated 25-09-2010; (b) ERC vide their deficiency letter dated 06-06-2011 inter-alia informed the institution that the building plan submitted by it, did not mention structural safety measures adopted as per building standards; (c) the appellant in reply submitted a building plan approved on 22-07-2011 mentioning the structural safety measures; (d) alongwith the visiting team report the building plan approved on 22-07-2011 and building completion certificate dated 21-10-2011 including the structural safety measures were submitted.

AND WHEREAS in view of the above the Council concluded that the building plan has been approved much before the date of issue of building completion certificate and therefore there was adequate justification to accept the appeal with direction to the ERC for further processing of the case as per Regulations. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council concluded that there was adequate ground to accept the appeal with direction to the ERC for further processing of the case as per Regulations. AND WHEREAS the Council taking into consideration the submission made by the appellant and noting that NRC had not asked for original building plan before refusing recognition, came to the conclusion that there was adequate justification to accept the appeal and remand the case to the NRC for considering the building plan and taking further decision thereafter. (2) As the application does not have any application Code Number, hence the name of your institution and the name of your society was entered in the computer to find out the same form the data of Online Applications available in NCTE website, but the both name are not found in the data of NCTE website, therefore, the application of your institution can't be treated as online applications”. AND WHEREAS the Correspondent, Shree Traymbakeshwer Nath Trust, (hereinafter referred to as the appellant), preferred an appeal dated 15/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Alok Dixit, Secretary and Dr. Radhey Shayam Goel, Director, Shree Traymbakeshwer Nath Trust, Mainpuri, Uttar Pradesh presented the case of the appellant institution on 26-06-2012. In the appeal and during personal presentation it was submitted that they had filed application through online module after inserting the information required in various columns in the online application. The supplied information was saved online. On final submission of the application, the printout generated was submitted to the NRC, alongwith other required documents such as DD of the processing fee, FDR, Land documents and Building Plan etc. Even at the time of submitting hard copy of the online application nobody pointed out about the Code No non availability on the printout. AND WHEREAS the Council noted that as Clause 5(3) of Regulations 2009, it is mandatory to submit application in the online module available on NCTE’s website. Further on verification in the NCTE website it was found that the appellant institution name did not exist in

O R D E R WHEREAS the appeal of Sir J P College of Education And Research, Thane, Maharashtra dated 07/05/2012 is against the Order No. WRC/WRCAPP978/159/2012/87471 dated 13/03/2012 of the Western Regional Committee, refusing recognition for conducting B.Ed course on the grounds “1) The institution has not submitted the FDRs from the nationalized bank. 2) The building plan submitted is for school purpose”. AND WHEREAS the Correspondent, Sir J P College of Education And Research (hereinafter referred to as the appellant), preferred an appeal dated 10/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Yashwant Singh, Director and Shri. Bharat Singh, Employee Staff, Sir J P College of Education And Research, Thane, Maharashtra presented the case of the appellant institution on 26-06-2012. In the appeal and during personal presentation it was submitted that (a) they had submitted original FDRs of Rs. 5.00 lakh and Rs. 3.00 lakh which were issued by the scheduled bank. This was done in compliance of clause 10 of NCTE (Recognition Norms & Procedure) Regulation 2009 Even in reply to show cause notice dated 05/07/201, the appellant informed WRC that if FDRs of a nationalized bank are required, then WRC may return FDRs of scheduled bank so that the trust can encash them and submit fresh fixed deposit receipt of a Nationalised Bank. However, WRC did not return their scheduled bank FDRs; (b) trust purchased the building and land from M/s Master Ji & Co. vide sale deed No. PLR-04425-2009 dated 27/10/2009 registered at Sub-Registrar Palghar. On Page-4 and 5 of the sale deed it was clearly mentioned that the land and building would be for education purpose of `Sir J.P. B.Ed. College’,.. that the vendor has sold the said plot alongwith construction approvals obtained from Additional Collector and also ‘NOC’ from the Gram Panchayat office. In the light of this specific recordings in the sale deed the building plan submitted mentioning `proposed construction of school building’ for education purpose may be accepted. AND WHEREAS the Council taking into consideration the submission made by the appellant and examining the documents noted that FDRs and the building plan submitted by the appellant were acceptable. The Council, therefore, concluded that there was adequate justification to accept the appeal and remand the case to the WRC for further processing of the application as per Regulations. AND WHEREAS the Correspondent, Subhash Degree College (hereinafter referred to as the appellant), preferred an appeal dated 11/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Sunil Bhatt, CEO, Subhash Degree College, Kanpur Nagar, Uttar Pradesh presented the case of the appellant institution on 26-06-2012. In the appeal and during personal presentation it was submitted that (a) the NRC vide their show cause notice dated 20-01-2012 inter-alia informed the institution that the building plan submitted by the institution is not approved by the Competent Authority of Uttar Pradesh State; (b) the appellant with his reply dated 11-02-2012 forwarded self attested copy of the building plan approved by Kanpur Development Authority, Kanpur. The plan clearly mentioned Plot No. (1420) land area (5020 Sq.mt.), built-up area (3930 Sq.mt.) and dimension of various rooms; (c) the NRC did not ask for the original plan so they submitted attested copy of the plan. But with the appeal original building plan is produced. AND WHEREAS the Council perused the original building plan and noted that the plan submitted to NRC was a copy of the original plan produced in the appeal. It was approved by competent authority and meets the specifications mentioned in the refusal ground. The Council, therefore concluded that there was adequate justification to accept the appeal and remand the matter to the NRC for further processing of the case as per Regulations. The appellant is directed to send original building plan as mentioned in the refusal order to the NRC. AND WHEREAS Shri. Arun Kumar Paul, H.M. and Anup Alu, Secretary, Chaipat Bhagabati Devi Teachers Training Institute, Midnapore, West Bengal presented the case of the appellant institution on 27-06-2012 . In the appeal and during personal presentation it was submitted that the Management or Managing Committee of Chaipat High School, a State Govt. affiliated century old school, is the sole authority of the proposed teacher training institute; there is no involvement of another NGO in this regard; their school itself has sufficient infrastructure and other necessary facilities including playground etc; more than 120 reputed persons, educationalists and well wishers attended the meeting which was held to take the decision for setting up the B.Ed college; and there is no B. Ed College within a radius of at least 40 KMs. AND WHEREAS the Council noted that the secretary of the Chaipat High School applied for grant of recognition for the proposed B. Ed College and the land document submitted by the appellant indicated that the land will be exclusively used for a school and its building and play ground. Further the land document indicated that in case the School is abolished the land will revert to the party which has given the land. In the course of personal presentation the appellant informed that the Govt. of West Bengal has to approve the use of the said land for B.Ed College. AND WHEREAS the Council, therefore, concluded that there was no land in the name of the proposed B. Ed College and the Chaipat High School, the applicant, cannot set up the proposed institution on the School’s land without valid permission of the concerned authorities. In the Circumstances the appeal deserved to be rejected and the order of the ERC confirmed . AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, and after considering oral arguments advanced during the hearing, the Council concluded that there was

O. , sought clarification; the appellant in his letter dated 06-07-2011 enclosed a copy of the certificate dated 04-07-2011 issued by the Sub- Divisional officer, Uluberia, Howarh in which it was certified that the land of the Trust is in rural area, it does not fall under the urban Land ceiling Jurisdiction and the SDO is not the concerned authority for vetting the plan in respect of any construction of rural areas; and in response to further letters from the ERC regarding approval of the building plan by the competent authority , they got it approved by the Asst. Engineer Howral zilla parishad on 26-03-2012. AND WHEREAS the Council noted that the appellant has complied with all the requirements in regard to the approval of the building plan. In the circumstances the Council concluded that the appeal deserved to be accepted and the matter remanded to the ERC for further processing as per the NCTE Regulations.

AND WHEREAS the Correspondent, Mahatma Gandhi University (hereinafter referred to as the appellant), preferred an appeal dated 21/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri.S.K. Lamba, Registrar and Shri. Navin Kumar, Sharma, BDM, Mahatma Gandhi University, Rl-Bhoi, Meghalaya presented the case of the appellant institution on 27-06-2012 . In the appeal and during personal presentation it was submitted that the application was sent through online on 30th September 2011 and the hard copy of the same in triplicate alongwith the necessary documents was delivered in ERC office on Friday the 7th Oct, 2011 at 12:50 hrs within the stipulated period of 7 days as laid down by ERC, NCTE. Regarding the land document , it has been submitted that as per the order of the State Govt of Meghalaya regarding land transfer all the proposals for land transfer to non-tribal entities viz. Companies, Societies, NGO's etc in terms of Section 14(1)(e) and 4(1)(f) of Meghalaya Transfer of Land (Regulation)Act, 1972 are put on hold and in the circumstances the paper related to land with general power of attorney was submitted to the ERC. AND WHEREAS the Council noted that the hard copy of the application was received in the office of the ERC on 07-10-2011 i.e. within seven days of online application and therefore non-submission of application in time cannot be a ground for refusal. the Council however noted that the land purchased by a private company is held by Mahatma Gandhi University c/o Layman Education Society through a General power of Attorney and the Govt of Meghalaya has kept all proposals for land transfers to non- tribal entities on hold. This will indicate that the applicant

In the appeal and during personal presentation it was submitted that the institution’s building is ready and completed in all respects as per NCTE norms, and CD and Photographs are being enclosed. The appellant in his letter dated 27-06-2012 reiterated that the building has been completed as per NCTE norms and standards and there could be a technical error in the recording of the CD which showed the building as incomplete. The appellant submitted the building completion certificate issued on 31-12-2010 by the Zilla Panchayat office mentioning 2811 sq.mt. of built-up area. AND WHEREAS the Council noted that the refusal ground is a CD based observation and the NRC did not make available the CD viewed by them for perusal of the Council. The CD submitted by the appellant in the appeal is without VT members and so it cannot be considered as a valid one. The Council,therefore, considering the submission made by the appellant concluded that the appeal deserved to be accepted and the matter remanded to the NRC with a direction to conduct a re-inspection of the institution on payment of the inspection fee and take a fresh decision thereafter .

O R D E R WHEREAS the appeal of MSD Memorial Mahavidyalaya, Jalaun, Uttar Pradesh dated 15/05/2012 is against the Order No. NRC/NCTE/NRCAPP-698/195TH MEETING/2012/19577 dated 12/04/2012 of the Northern Regional Committee, refusing recognition for conducting D.El.Ed course on the ground “the Institution has not submitted original FDRs of Rs. 5 Lakhs & Rs 3 Lakhs towards endowment fund and reserve fund respectively as per NCTE, Regulation, 2009”. AND WHEREAS the Correspondent, MSD Memorial Mahavidyalaya (hereinafter referred to as the appellant), preferred an appeal dated 15/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Uttam Singh, Minister and Shri. Raja Bhaiya, Clerk, MSD Memorial Mahavidyalaya, Jalaun, Uttar Pradesh presented the case of the appellant institution on 27-06-2012. In the appeal and during personal presentation it was submitted that as per NCTE, Regulations, 2009, they had already submitted on 28/09/2010 original FDRs of Rs 5,00,000 and Rs 3,00,000 towards endowment fund and reserve fund respectively . AND WHEREAS the Council noted that the NRC, which received the two FDRs in original along with other documents on 28-09-2012, has inadvertently enclosed them along with the application to their letter to the Govt of U. P . Deptt. of Higher Education seeking their recommendations on the application. The Principal, DIET, Pindari, Jalaun in his letter dated 22-06-2012 addressed to the appellant institution, in response to their letter dated 21-06-2012, with a copy to the Regional Director, NRC, Jaipur, has confirmed that the two FDRs are in their safe custody. AND WHEREAS in view of the above position, the Council concluded that the appeal deserved to be accepted and the matter remanded to the NRC for further processing of the application as per NCTE regulations .

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, and after considering oral arguments advanced during the hearing, the Council concluded that there was adequate ground to accept the appeal and remand the case to the NRC for further processing of the application as per NCTE Regulations. NOW THEREFORE, the Council hereby remands back the case of MSD Memorial Mahavidyalaya, Jalaun, Uttar Pradesh to the NRC, NCTE, for necessary action as indicated above.

WHEREAS the appeal of Narayan College of Science and Arts, Etawah, Uttar Pradesh dated 17/05/2012 is against the Order No. NRC/NCTE/NRCAPP-1288/195th Meeting/2012/20132-133 dated 01/05/2012 of the Northern Regional Committee, refusing recognition for conducting D.El.Ed course on the ground “the institution has not submitted building plan duly approved by the Competent Authority mentioning name of the institution plot no. (khasra no.) total land area, built-up area, classrooms, principal room, multipurpose hall, different resource centre, library etc. as per the NCTE Regulations, 2009”. AND WHEREAS the Correspondent, Narayan College of Science and Arts (hereinafter referred to as the appellant), preferred an appeal dated 25/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Hari Kishore Tiwari, Secretary, Narayan College of Science and Arts, Etawah, Uttar Pradesh presented the case of the appellant institution on 27-06-2012. In the appeal and during personal presentation it was submitted that the institution has submitted building plan duly approved by the competent authority as per law of rural area mentioning name of the institution, total land area, classroom, principal room, multipurpose hall, different resource centers, Library etc; they have presented a certificate from competent authority about approval of building by Gram Panchayat (Gram Panchayat, Samiti manual para 25 (ka); their school is situated in rural area which is under control of Gram Sabha and Panchayat area, and not in the periphery of Nagar Palika and this has been certified by Nagar Palika and a certificate from Nagar Palika is attached the Rural Engineering Department also interfere in rural areas and they also got their plan approved from Rural Engineering Department; and being near by a road, they had also taken No Objection Certificate from P.W.D. which is also shown in building plan. AND WHEREAS the Council noted that along with the application a building plan approved by the Gram Pradhan and Executive Engineer PWD, Etawah giving necessary details was enclosed. However the plan did not provide for a multipurpose hall. The appellant, along with the appeal, has forwarded a building plan which indicates the Khata numbers, land area, building details including multipurpose hall duly approved by the Pradhan and the Executive Engineer,PWD, Etawah. AND WHEREAS the Council, having considered the submissions of the appellant, concluded that the appeal deserved to be accepted and the matter remanded to the NRC for further processing as per NCTE Regulations.

O R D E R WHEREAS the appeal of Navjeevan Adhyapak Vidyalaya, Jalgaon, Maharashtra dated 14/05/2012 is against the Order No. WRC/WRCAPP1311/159TH/2012/87768 dated 19/03/2012 of the Western Regional Committee, refusing recognition for conducting D.El.Ed course on the grounds “1) Notarized CLU not submitted and 2) Non-encumbrance certificate not submitted”. AND WHEREAS the Correspondent, Navjeevan Adhyapak Vidyalaya (hereinafter referred to as the appellant), preferred an appeal dated 17/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Rakesh G. Singh Tomar, President and S.S. Gadri, Member, Navjeevan Adhyapak Vidyalaya, Jalgaon, Maharashtra presented the case of the appellant institution on 27-06-2012. In the appeal and during personal presentation it was submitted that Both Certificates were already submitted. AND WHEREAS the Council noted that in response to the show cause notice dated 05-07-2011, the applicant with his letter dated 20-09-2011 has furnished the documents relating to CLU and non–encumbrance certificate to the WRC. Refusal of the recognition on the ground that these documents have not been submitted is therefore not justified. In the circumstances the Council concluded that the appeal deserved to be accepted and the matter remanded to the WRC for further processing as per the NCTE regulations. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, and after considering oral arguments advanced during the hearing, the Council concluded that there was adequate ground to accept the appeal and remand the case to the WRC for further processing of the application as per NCTE Regulations. O R D E R WHEREAS the appeal of Pandit Ram Kedar Ram Kishor Tripathi Mahavidyalaya, Sultanpur, Uttar Pradesh dated 23/05/2012 is against the Order No. NRC/NCTE/NRCAPP-915/195th Meeting/2012/20138 dated 01/05/2012 of the Northern Regional Committee, refusing recognition for conducting D.El.Ed course on the ground “the institution has not submitted building plan duly approved by the Competent Authority mentioning name of the institution, plot no. (khasra No.) total land area, built-up area, classrooms, principal room, multipurpose hall, labs, library etc. as per the NCTE Regulations, 2009”. AND WHEREAS the Correspondent, Pandit Ram Kedar Ram Kishor Tripathi Mahavidyalaya (hereinafter referred to as the appellant), preferred an appeal dated 25/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Ms. Indu Shekhar Upadhaya and Dr. S.P. Tripathi, Staff, Pandit Ram Kedar Ram Kishor Tripathi Mahavidyalaya, Sultanpur, Uttar Pradesh presented the case of the appellant institution on 27-06-2012. In the appeal and during personal presentation it was submitted that Institution has submitted building plan duly approved by the Competent Authority mentioning name of the institution, plot no. (Khasra no.), total land area, built-up area, class room, principal room, multipurpose hall, labs, library etc. at the lower side of the map as per the NCTE Regulation, 2009. The office of NRC has omitted to note these details as a result of which the file of the institution is closed. AND WHEREAS the Council noted that in response to the deficiency letter and another letter as well as the show cause notice issued by the NRC regarding the building plan, the institution furnished a copy of the revised building plan with their letter dated 29-12-2011 which provided for a multipurpose hall, which was lacking in the earlier plans. That plan was also not accepted by the NRC for want of other details like plot number etc. as mentioned in the refusal order. The appellant, with the appeal, has sent a copy of his letter dated 05-03-2012 addressed to the Regional Director, NRC with which be enclosed a building plan containing all the requisite details and also approved by the competent authorities. However this letter and its enclosures are not found in the file of the NRC . AND WHEREAS the Council, in the above circumstances, concluded that the appeal deserved to be accepted and the matter remanded to the NRC with a direction to consider the building plan sent by the applicant on 05-03-2012 and process further as per the NCTE

O R D E R WHEREAS the appeal of Ram Girish Rai Teachers Training College, Gorakakhpur, Uttar Pradesh dated 17/05/2012 is against the Order No. NRC/NCTE/NRCAPP-980/195th Meeting/2012/19006 dated 02/04/2012 of the Northern Regional Committee, refusing recognition for conducting D.El.Ed course on the grounds “1) the institution has not submitted original building plan duly approved by the Competent Authority mentioning name of the institution, plot no. (khasra No.) total land area, built-up area, classrooms, principal room, multipurpose hall, different resource centre, library etc. as per the NCTE Regulations, 2009;and 2) the institution has not completed three academic sessions of the existing course at the time of applying for the proposed D.El.Ed. course as required under clause 8(3) of NCTE Regulations, 2009”. AND WHEREAS the Correspondent, Ram Girish Rai Teachers Training College (hereinafter referred to as the appellant), preferred an appeal dated 23/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Vinay Kumar Rai, Secretary and Shri. Jayant Dhar Dubey, Member, Ram Girish Rai Teachers Training College, Gorakakhpur, Uttar Pradesh presented the case of the appellant institution on 27-06-2012. In the appeal and during personal presentation it was submitted that (i) the institution has already submitted the original approved building plan to NRC, NCTE in the reply to deficiency letter and (ii) the New College viz., Ram Girish Rai Teachers Training College exclusively meant for D.El.Ed. course has new land and building; the college is not running/proposed any course on the said land and building and hence the college is not violating 8(3) clause of NCTE Regulation 2009. In the course of hearing the appellant stated that Ram Girish Rai Mahavidyalaya, which was granted recognition for conducting B. Ed course on 27-10-2007 and which is adjacent to the proposed Ram Girish Rai Teachers Training College for D. Ed course is a different institution and hence the provisions of clause 8(3) of NCTE Regulations 2009 are not attracted. AND WHEREAS the Council noted that the Mahavidyalaya offering B. Ed programme and the proposed Teachers Training College for D. Ed programme are located at Dubaute only. The existing Mahavidyalaya and the proposed Teachers Training college are under the aegis of the same Society, Viz. Ram Girish Rai Seva Samiti. It is therefore evident that the Samiti, to circumvent the restrictions imposed under clause 8(3) of the NCTE Regulations, 2009 only,

AND WHEREAS in the above circumstances the Council concluded that the NRC was justified in refusing recognition and therefore the appeal deserved to be rejected and the order of NRC confirmed. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, and after considering oral arguments advanced during the hearing, the Council concluded that there was no ground to accept the appeal. Accordingly, the appeal is rejected and NRC’s order dated 02-04-2012 is confirmed. NOW THEREFORE, the Council hereby confirms the Order appealed against.

O R D E R WHEREAS the appeal of North Bengal Teachers Training College, Uttar Dinajpur, West Bengal dated 24/05/2012 is against the Order No. ERC/7-131.8(i).65/2012/10960 dated 29/03/2012 of the Eastern Regional Committee, refusing recognition for conducting B.Ed course due to non-submission of land document at the time of application. AND WHEREAS the Correspondent, North Bengal Teachers Training College (hereinafter referred to as the appellant), preferred an appeal dated 28/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Md. Adbul Kalam, Secretary and Shri. Sukanta Dao, Employee, North Bengal Teachers Training College, Uttar Dinajpur, West Bengal presented the case of the appellant institution on 27-06-2012. In the appeal and during personal presentation it was submitted that with reference to E.R.C’s letter no. ERCAPP1247/9605, dated 08/12/2011 the land documents were sent by within 30 days; even though the said documents were sent by Courier on 06/01/12, (Memo No. U73321900) from the Bhubaneswar City they reached at Regional Office quite late on (11/01/12) due to intervening Saturday & Sunday, but before the meeting of the Regional Committee held on 15th to 18th Feb., 2012. AND WHEREAS the Council noted that the gift deed donating land measuring 49 decimals and 24.5 decimals to the society was registered on 30-09-2011 and on the same day the appellant submitted his application for grant of recognition. In the circumstances it would not have been possible for the applicant to submit the land document also on the date of application itself. The applicant submitted the document later on 06-01-2012. AND WHEREAS in the above circumstances the Council concluded that the appeal deserved to be accepted and the matter remanded to the ERC for further processing of the application on merit as per Regulations.

O R D E R WHEREAS the appeal of Pratap BTC College, Mirzapur, Uttar Pradesh dated 31/05/2012 is against the Order No. NRC/NCTE/NRCAPP-630/198th Meeting/2012/20611 dated 11/05/2012 of the Northern Regional Committee, refusing recognition for conducting D.El.Ed. course on the grounds “the building was not complete at the time of inspection i. e. on 23-01-2012 and the institution has submitted an affidavit dated 03/04/2012 in which it has been accepted that the building construction work was going on even on the date of inspection by VT and the plastering and painting work shall take another 15 days from 03/04/2012”. AND WHEREAS the Correspondent, Pratap BTC College (hereinafter referred to as the appellant), preferred an appeal dated 31/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Jagdish Singh, Manager, Pratap BTC College , Mirzapur, Uttar Pradesh presented the case of the appellant institution on 27-06-2012. In the appeal and during personal presentation it was submitted that the Manager and relative was hospitalized in a severe condition and therefore they could not send the CD and photographs to the NRC. He, therefore, requested for one more opportunity to the Manager of the College. AND WHEREAS the Council noted that in accordance with the provisions contained in Clause 8(10) of the NCTE Regulations, 2009 , at the time of inspection the building of the institution shall be complete in the form of a permanent structure. The appellant himself has admitted that their building was not complete at the time of inspection (23-01-2012) and even as on 03-04-2012 the work was not complete. AND WHEREAS in the above circumstances, the Council concluded that the appeal deserved to be rejected and the order of the NRC confirmed.

O R D E R WHEREAS the appeal of Raja Narayanlal Pittle College of Education (B.Ed.), Vadodara, Gujarat dated 11/11/2011 is against the Order No. WRC/APW02724/323338/153RD/2011/82217 dated 01/10/2011 of the Western Regional Committee, withdrawing recognition for conducting B.Ed. course on the grounds “1) Principal not appointed. 2) Sizable portion of the building has tin shed roofing which is not permissible as per the NCTE norms. 3) Institution does not possess land on ownership basis.” AND WHEREAS the Correspondent, Raja Narayanlal Pittle College of Education (B.Ed) (hereinafter referred to as the appellant), preferred an appeal dated 16/11/2011 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri Raja Narayanlal, Principal, Raja Narayanlal Pittle College of Education (B.Ed.), Vadodara, Gujarat presented the case of the appellant institution on 17-01-2012. In the appeal and during personal presentation it was submitted that a) presently appellant’s institution was being run by an in-charge Principal, Ms. Smitaben Parmar, who has got administrative experience of more than 5 years and in total 12 years teaching experience; the in-charge Principal is on the verge of completion of her Ph.D. Course and only her viva examination was due for awarding Ph.D. degree. She had been working as Principal for the last 5 years. Her profile is approved by S.N.D.T. University, Mumbai. b) that the building does not have tin shed roof, it is actually cement shed, if it is objectionable the same shall be removed. It had not been mentioned in the NCTE norms at any point of time that the tin shed roofing was not permissible and further the institution is not having the tin shed roofing in any manner. c) that the appellant’s institution was having its own land which is in the name of the Aryakumar Maha Sabha Trust and the institution is run by the Aryakumar Maha Sabha Trust and, therefore, the land on which the institution is established is in the name of Aryakumar Maha Sabha Trust. AND WHEREAS the Council noted that a) Aryakumar Maha Sabha Trust submitted an application to the WRC on 28-12-2005 for grant of recognition of B.Ed. course in the name of ‘Raja Narayanlal Pittle College of Education’. WRC vide order dated 03-05-2007 granted recognition. b) State Govt. of Gujarat on the basis of Prof. A.U. Patel Committee report, forwarded a list of 129 colleges including the appellant institution which were not adhering to the NCTE Norms and Standards. Thereafter WRC caused an inspection of the institution U/s 17 of the NCTE Act on 09-06-2008, issued show cause notice on 04-08-2008 and subsequently withdrew recognition of the institution vide order dated 18-12-2008. Against this order, the institution preferred an appeal and the Council vide order dated 11-06-2009 confirmed WRC’s

withdrawal order. c) Aggrieved by the decision of the Council, the appellant approached Hon’ble High Court of Gujarat at Ahmadabad in SCA No. 5611/2009 and the Court vide order dated 14-05-2010 disposed of a bunch of similar petitions inter-alia directing the petitioners ‘to remove all the defects and confirm to all the norms of NCTE, by 31-12-2010 and institutions after curing all the defects, not later than by 07-01-2011, shall intimate to the NCTE that defects have been cured and invite the inspection team to carry out inspection’. d) In compliance with the Court directions, WRC caused an inspection of the institution on 15-04-2011, after issuing show cause notice on 21-06-2011, it withdrew recognition of the institution vide order dated 01-10-2011 on the grounds as stated under para 1 above.

AND WHEREAS the Council further noted specifically with regard to the withdrawal grounds that a) the appellant in the appeal admitted that the institution had been functioning with an in-charge Principal, who is also not qualified for the post of Principal; b) that the appellant in its reply dated 04-07-2011 in response to the show cause notice as well as in the appeal clearly stated that some portion of the building was with cement sheet roofing i.e. temporary roofing. However it did not mention the area of the building with temporary roof. Even the building plan submitted in the appeal also depicted certain portion of the building having temporary roof. As per norms the institution should have a pucca building with RCC roof. c) that the village form no. 5, 6, 7 &12 mentioned that the land was in the name of Narayan Lal Bansilal Pittle. Hence neither the society nor institution was in possession of the required land. In view of the above the Council concluded that there was no justification in accepting the appeal and hence it should be rejected. The Council accordingly issued an order dated 15-02-2012 rejecting the appeal. AND WHEREAS aggrieved by the order of the Council, the appellant filed a Special Civil Application No 3231 of 2012 before the Hon’ble High Court of Gujarat at Ahmadabad. The Hon’ble High Court in their order dated 10-05-2012, while keeping the petition pending and without setting aside the order dated 15-02-2012, however, by suspending the operation of the said order, remitted the matter to the appellant authority, who shall, after hearing the petitioner and after taking into account the material which may be relied on by the petitioner, pass fresh reasoned order, which may be done within 4 weeks from the service of copy of the present order. The Hon’ble High Court also clarified that the said direction is passed only with a view to enabling the appellate authority to re-consider the order . The Hon’ble High Court’s order having been received in the Council on 12-06-2012, the appellant was called for personal presentation before the Council on 27-06-2012.

AND WHEREAS Ms. Samita J. Parmar, Principal presented the case of appellant institution. She also gave a letter dated 27-06-2012. In this letter it is again admitted that Shri Narayanlal Pittie, who is a trustee of Aryakumar Mahasabha Trust is the proprietor of the property and the land is owned by him. This confirms that the institution/ trust does not possess land in its own name. Regarding the principal, it has been mentioned in the said letter that the present incharge Principal will clear Ph. D before the end of 2012 and they have also appointed one Administrator, who is a retired employee of M. S. University, Baroda and her qualification is B. A. M. Ed, Ph. D and her experience is 30 years. This also confirms that there is no qualified Principal as on date even. The appellant through another latter dated 27-06-2012 given during personal presentation requested for a year’s time for replacing the temporary roofing. This is a vague request which cannot be accepted.

AND WHEREAS the Council, in view of the position stated above, concluded that there is no justification for accepting the appeal and reversing the order of the WRC. The appellate order dated 15-02-2012 is ,therefore, reconfirmed. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council concluded that there was no ground to accept the appeal. AND WHEREAS the Correspondent, Reimalie Academy College (hereinafter referred to as the appellant), preferred an appeal dated 30/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Rajen Basumatary, Chairman, Reimalie Academy College, Bongaigaon, Assam presented the case of the appellant institution on 27-06-2012. In the appeal and during personal presentation it was submitted that the Reimalie Academy College Committee has a plot of land measuring 4 Bighas of Kathas, 5 Lessas, vide Patta No. 58 and Dag No. 511 at Lot No. 10 in the village Bhatipara (Bijni) under Bijni Revenue Circle, Dist. Chirang, Bodoland, Assam and the said plot of land was mutated on 14-8-2009 vide No. BC-1/2010/3172 dt 19-7-2011 on the basis of Register Deed No. 102/89 dt 9-08-2009 and Registered Deed No. 34 dated 26-2-2008 in the name of "Reimalie Academy College, Bijni". The mutation certificate was issued before the submission of the Online Application for recognition of the Reimalie Academy College, Bijni to run B.Ed Course. On the other hand, due to bonafied mistake, the Sale Deed of the said land was made between the seller Sri Paresh Chandra Ghose etc and Sri Rajen Basumatry, the Chairman cum Managing Executive of the Reimalie Academy College, Bijni instead of "Sri Paresh Chandra Ghose, etc and the present Chairman cum Managing Executive of the Reimalie Academy College on behalf of the Managing Committee, Reimalie Academy College, Bijni. So one rectification is made against the Sale Deed made on the last 09-04-2009 for mistakenly putting of the name of purchaser in the name of individual Sri Rajen Basumatary, Chairman cum Managing Executive, Reimalie Academy College, Bijni. The rectification of the sale deed is made on 21-05-2012. AND WHEREAS the Council noted that both the sale deed and the mutation certificate are dated prior to the date of application and the institution got a rectification made on 21-01-2012 in the sale deed of 09-04-2009 indicating that the buyer is not an individual by name but an officer bearer of the institution. AND WHEREAS in the above circumstances the Council concluded that the appeal deserved to be accepted and the matter remanded to the ERC for further processing as per the

AND WHEREAS Shri. Soam Sachdeva and Dr. A.K. Singh, Authorised Signatory, Sachdeva College of Advanced Studies, Mathura, Uttar Pradesh presented the case of the appellant institution on 27-06-2012. In the appeal and during personal presentation it was submitted that (i) The Mathura Development Authority had issued the "memo" as per their comments and they do not assign any dispatch no. to the memo; and on their request Mathura Development Authority has again issued a Certificate with despatch number and it is also attested by the Notarised Advocate; (ii) they have submitted the document as received from the District Development Officer and it is authentic and the change of land use (CLU) certificate given by SDM, Sadar Tahsil is also attached; and they will submit the attested copy; (iii) the ink of impression seal of the authorised authority is not clearly imprinted on the Khasra so it seems that is not attested by the authorised authority; and they will submit the authorized original copy;(iv) Advocate Meghraj is a authentic Notary registered advocate under Govt. of India (registration No. 736), and the advocate by mistake wrote "Fotocopy" instead of Photocopy; and (v) the certificate of the Land is not suspicious as the authority has issued it without dispatch no. after submitting the minutes of meeting deficiency they issued a fresh certificate which bears a dispatch no. In the reply to show cause notice they have submitted the same to NCTE on dated 13/01/2012.

Authority not submitted; 2) Certified copy of registered land document in the name of institution/society not submitted; 3) Affidavit on prescribed format is not completely filled up; 4) Notarized copy of CLU is also to be submitted; and 5) The institution will submit the supporting document from the Registrar of the concerned University that it is a constituent unit of an University”. AND WHEREAS the Correspondent, Shanti Prasad Jain Collage (hereinafter referred to as the appellant), preferred an appeal dated 28/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Dr. Rajendra Pd. Singh, Principal and Md. Abdul Kalam, Head Accountant, Shanti Prasad Jain College, Rohtas, Bihar presented the case of the appellant institution on 27-06-2012. In the appeal and during personal presentation it was submitted that the petitioner institution established in 1950 is one of the oldest Govt / Constituent Colleges of Veer Kunwar Singh University and is fully funded by the Govt of Bihar and the U. G. C. It has a large campus spread over 14 acres with a number of cluster of buildings. The appellant with his letter dated 25-06-2012 addressed to the Member Secretary, NCTE furnished copies of letters issued by the Govt. of Bihar, Deptt. of Education dated 01-03-2012 and the Registrar of Veer Kunwar singh University dated 03-01-2011 which establish that the applicant institution is a constituent College of the said university. Regarding the other grounds of rejection he has submitted that (i) the building plan has been approved by the Mukhya of Gram Panchayat; (ii) copies of land possession certificate dated 11-06-2011 issued by Circle Officer, Sasaram, change of land use certificate dated 15-07-2011 issued by S.D.O, (Civil) Sasaram and non-encumbrance certificate dated 22-07-2011 have already been sent to the ERC on 23-07-2011; and (iii) affidavit on Rs 100 stamp paper has already been submitted. AND WHEREAS the Council noted that all the requisite documents reported to have been furnished to ERC in response to their communications are already available on the file of the ERC. In the circumstances the Council concluded that the appeal deserved to be accepted and the matter remanded to the ERC for further processing as per the Regulations. The appellant is

O R D E R WHEREAS the appeal of Shivani Institute of Teacher Education, Warangal, Andhra Pradesh dated 26/05/2012 is against the Order No. SRCAPP1065/D.EL.ED/AP/2012-13/41562 dated 24/05/2012 of the Southern Regional Committee, refusing recognition for conducting D.El.Ed course on the grounds “the institution submitted reply for deficiency letter after the stipulated time of 60 days period as per clause 7(1) of NCTE, Regulations 2009”. AND WHEREAS the Correspondent, Shivani Institute of Teacher Education (hereinafter referred to as the appellant), preferred an appeal dated 28/05/2012 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. M. Vijaya Bhaskar Reddy, Lecturer, Shivani Institute of Teacher Education, Warrangal, Andhra Pradesh presented the case of the appellant institution on 27-06-2012. In the appeal and during personal presentation it was submitted that the deficiency letter dated 28-12-2011 was received on 16-01-2012; due to Sakalajanula Samme in Telangana Region of A.P., all the Govt. employees were on strike for nearly two and half months; after call off of the strike they tried to get all the certificates in time but due to procedural delay they could not get in time. and they finally sent all the certificates a few days late. AND WHEREAS the Council noted that according to the deficiency letter dated 28-12-2011 issued by the SRC, removal of the deficiencies has to be intimated within 60 days from the date of receipt of communication of the deficiencies. The institution submitted their reply dated 27-02-2012 to the deficiency letter, which was received in the office of the SRC on 12-03-2012. Going by the reported date of receipt of the deficiency letter i.e. 16-01-2012, the reply thereto has been received within the stipulated time. AND WHEREAS in view of the above position the Council concluded that the appeal deserved to be accepted and the matter remanded to SRC for examination of the reply of the institution and taking further necessary action.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit and after considering oral arguments advanced during the hearing, the Council concluded that there was adequate ground to accept the appeal and remand the matter to the SRC for examination of the reply of the institution and further necessary action. NOW THEREFORE, the Council hereby remands back the case of Shivani Institute of Teacher Education, Warrangal, Andhra Pradesh to the SRC, NCTE, for necessary action as indicated above.
