SUMMARY
� The legal basis of the report
This Ethnic Minority Development Plan (EMDP) report based on the following documents
and instructions:
- Regulations of the Government of Vietnam
- The World Bank’s OP/BP 4.10 Indigenous People
- Ethnic Minority Planning Framework prepared for Vietnam Transmission Efficiency
Project
� The target of the report
EMDP is prepared to that the development process fosters full respect for their dignity, human
rights, cultural uniqueness and that ethnic minorities do not suffer adverse impacts during the
development process and they will receive culturally-compatible social and economic benefits.
� Scope of the report
EMDP is applied in the Hoa Binh – Tay Hanoi 220kV transmission line subproject with the
total length of 50.6 km and the total land area in ROW is 1,113,200 square meters, going
through 16 communes of 4 districts of Hoa Binh province and Ha Noi capital.
� Subproject overview
The subproject “Hoa Binh - Tay Ha Noi 220kV transmission line” aims to transmit the power
from Hoa Binh hydropower to the national grid with the following targets: i) Providing the
power safely and efficiently for the western area of Hanoi, including Son Tay and 5 districts in
the north of Highway 6: Ba Vi, Phuc Tho, Dan Phuong, Hoai Duc, Thach That and Quoc Oai.
These are the important areas of additional charge and they are achieving a rapid economic and
social development. ii) Reducing the load of 220kV transmission line from Hoa Binh to Ha
Dong, Xuan Mai. iii) Enhancing the capacity to provide stable electricity for transmission
system in Hanoi and other regions; ensuring a stable operation in the national electrical.

Capital: investment loan from the World Bank.
� Main characteristics of the subproject:
- Voltage: 220kV;
- No. of circuits: 02, 04 circuits;
- Length of the line: 50.6km;
- Location: going through Hoa Binh city, Ky Son and Luong Son district (Hoa Binh
province), Quoc Oai district (Hanoi City);
- Starting point: 220kV bus of 220kV Hoa Binh hydroelectric power station’s
switchyard;
- End point: 220kV bus of 220kV Tay Ha Noi, located in Quoc Oai district, Ha Noi
city;
- Conductor: 2xACSR 330/43 (2 conductors per phase) and 2xAACSR 380/50 (for
span length getting over Da river);

- Overhead ground wire: PHLOX 116 and overhead ground wire with fiber cable
OPGW 120, 24 fiber, exclusively installed more one ground wire PHLOX 116 in 3 km head line
from Hoa Binh switchyard;
- Insulators: Insulator with suitable load, ceramic, glass or composite. Quantity of
insulators based on creeppage distance of 20mm/kV and 25mm/kV.Specification equal to type
U70B, U120B, U160B, 210B, U300B (according to IEC standard);
- Tower: Hot-dip galvanized steel tower with 4 circuits and 2 circuits Tower is 72m in
height for Da river span;
- Foundation: reinforced concrete foundation;
- Earthing: Radial and galvannized-steel earthing;
- Vibration damping for conductor and ground wire.
� Scope of the subproject
The subproject go through 16 communes of 4 districts in 2 provinces of Hanoi and Hoa Binh
including: Tan Thinh Ward, Tan Hoa Ward, Huu Nghi Ward, Hoa Binh Commune and Yen
Mong Commune of Hoa Binh City; Dan Hoa Commune, Dan Ha Commune, Mong Hoa
Commune and Ky Son Town of Ky Son District, Hoa Son Commune, Lam Son Commune,
Luong Son Town of Luong Son District in Hoa Binh Province; Dong Yen, Can Huu, Thach
Than, Dong Quang of Quoc Oai District in Hanoi.
� Characteristics of ethnic minorities affected by the subproject
The majority of ethnics living in the subproject area are Hmong people living in villages. There
have been a variety of projects supporting ethnic minorities living lower standard life such as
Program 134, Program 135, etc. Therefore, living standard of ethnic minorities has been
improved. They have the same land use rights as the Kinh. The ethnic minority households
affected by the live on farming and raising cattle.
� Impact of subproject on ethnic minorities
The long-term and short-term impacts of subproject on ethnic minorities mainly due to the
acquisition of land for construction and installation activities. The impacts include the reduction
of agricultural land and housing area, the damage to crops, houses and buildings in the
subproject area.
The permanent impacts on houses, buildings during the construction to ensure the safety of
high-voltage grid regulated in Decree No. 106/2005/ND-CP proclaimed on August 17th, 2005
by the Government detailing and guiding a number of articles of the Electricity Law on ensuring
the safety of high-voltage grid and Decree No. 81/2009/ND-CP proclaimed on October 12th,
2009 by the Government amending for Decree No. 106/2005/ND-CP proclaimed on August
17th, 2005 by the Government. Acording to the survey reports through invesment project
period:
+ 194 households located in ROW 194 including 95 ethnic minority households will be
affected by the permanent land acquisition for the construction of the electric poles’ base (about
475 people).
During the community counseling, all people affected by the subproject wish to receive
compensation for land area, trees, crops affected by this subproject in cash instead of
relocation.

� Information Disclosure and Community Counseling
- Information Disclosure and Community consulting have been carried in the stage of
preparation for the subproject.
- Methods and implementing forms: notices, interview, discussion with the relevant agencies.
- Content: consulting unit presented about the location of subproject and compensation
policies for relocation. Participants discussed and raised opinions on the damage caused by
the subproject , compensation, relocation and development program.
� Implementation
The implementation of compensation and relocation was presented in RP report. To effectively
implement EMDP, NPPMB should actively and positively co-operate with relevant agencies or
independently carry out involving works such as participating in the subproject implementation,
monitoring and ensuring the EMDP implementation, and ensuring the participation of affected
people.
� Monitoring and evaluation
Monitoring the implementation of EMDP is a part of monitoring the implementation of the RP
report. The RP report describes the overall plan for monitoring the implementation of RP.
� Estimated costs for the specific training program in EMDP
- Dissemination of information about the subproject , compensation and relocation
policy, and EMDP subproject in 12 villages of ethnic minorities that subproject
affecting on.
- Teaching the high-voltage safety for residents and students at 16 communes in
subproject.
I. INTRODUCTION
I.1. Objectives of the Subproject
The subproject “Hoa Binh - Tay Ha Noi 220kV transmission line” aims to transmit the
power from Hoa Binh hydropower to the national grid with the following targets:
i) Safety providing the power safely and efficiently for the western Hanoi, including Son
Tay and 5 districts in the north of Highway 6: Ba Vi, Phuc Tho, Dan Phuong, Hoai Duc, Thach
That and Quoc Oai. These are important areas of additional charge and they are achieving a
economic and social development.
ii) Reducing the load of 220kV line from Hoa Binh to Ha Dong, Xuan Mai.
iii) Enhancing the capacity to provide stable electricity for transmission system in Hanoi
and other regions; ensure a stable operation in the national electrical.
I.2. Main characteristics of the subproject
The subproject only includes 50,6km of the transmission line with the scale of:
- Voltage: 220kV;
- No. of circuits: 02, 04 circuits;
- Length of the line: 50.6km;

- Location: going through Hoa Binh city, Ky Son and Luong Son district (Hoa Binh
province), Quoc Oai district (Hanoi City);
- Starting point: 220kV bus of 220kV Hoa Binh hydroelectric power station’s
switchyard;
- End point: 220kV bus of 220kV Tay Ha Noi, located in Quoc Oai district, Ha Noi
city;

The plan of 220kV tranmission line from Hoa Binh – the West of Hanoi crossing Hoa Binh
province with the length of 39.8km, through Hoa Binh city, Luong Son district and Ky Son
district, shown in the following table:

137 cows, 3,285 pigs; 7,966
poultry; 92 goats.
Forestry: Exploit and replant 41
hectares of acacia.

reached 13 billion, reached 77% of
the plan, increasing 12.5%
compared with the same period in
2011.

10 Mong Hoa

output is 579 tons. Livestock
develops stable.
Forestry: Replanting the total
area of 40 hectares.
Industry – Handicraft Industry: 3

11 Ky Son town
Agriculture: Mainly farming of
rice, corn and vegetables, livestock
for a stable development.

traditional handicraft are still being
developed, a number of workshops
create jobs with stable incomes for
workers.
Trade - Services: small business

Population: 2,439 people

II.1.2. Natural, cultural and social characteristics of ethnic minorities in the subproject area
The process of investigation found out that life of ethnic minorities has positively changed;
however, they still confronted difficulties. Low income, high illiteracy in high-land communes,
and low-quality infrastructure has been remained difficulty. Below is some statistic about the
life of ethnic minorities in subproject area.
� Living and producing practice of Muong ethnic group
Muong people normally live near rivers, springs or at low-hill areas. Today, Muong
people still keeps the particular trait of their ethnic group:
- Living practice
� Social relations: are mainly neighbourhood relations. Two to three generations of
Muong’s family live together. Children take their father’s family name. Muong people respect
the eldest son’s rights. At Muong’s family, son will inherit the family’s assets.
� House: Most of Muong people live at house on stilts (house with 4 rooves; people living
on the floor; livestock, poultry living under floor; production tools also left under floor….).
Normally, there are several tens of houses at Muong village. Each family usually plants
coconut-trees and jack-fruit trees at the garden..
� Clothing: Female clothing is more varied and typical than male clothing. Head scarf is
made from rectangle white cloth without embroidery. Brassiere and short jacket normally has
cut-out at the breast area. Dress lengthens up to ankle. There are two parts of a dress: body and
the edge. Dress’ edge is normally embroidered with various partterns..
- Jewelry: Bracelets, beads, xa tich set consisting of two or four silver chains with peach-
shaped box and tiger’s claws.
� Performing arts: Muong people prefer to sing “the Xec bua”- kind of single style which
praises working and ethnic beauty. In addition, there are other kinds of singing style such as Bo
meng, Vi dum, lullaby, Dong giao….
� Games: Muong people’s games are familiar to everybody such as crossbow competition,
swinging, throwing sacre ball, danh mang, cham chi…
� Marriage: Man and woman of Muong group are free to choose their partners. Their
family will help to prepare wedding when they decide to get married. Main stages of a wedding
include sounding out, presenting betel, asking permission for wedding, first wedding, taking
bride to groom’s house. On the wedding day, match making man leads the groom’s team to
bring gifts to bride’s house. Groom wears nice clothes and white head scarf, carries a dosser
with cooked rice put on mouth of two boiled castrated cocks. Bride wears hat, nice dress coated
with black long shirt with two front flaps tied. Bride present her parents – in- law with two
blankets, two mattresses, two bearing pads.
� Funeral : When people takes his last breath, the eldest son breathlessly takes the knife
and chops the window three times at the worshipping room. Then, that family will ring the gong
to announce the burial. Dead body will be covered with several clothings in line with custom,
then put in coffin which is empty trunk of tree, then covered with dragon scale clothes.The
funeral will be led by a powwow. Son and daughter’s roles in the funeral are the same as

- Production
� Production activities: Muong people lives in mountainous area where land for
production is large. Main job of Muong people is farming. Wet rice is main food crop. Their
main earthmoving tool is early plow and single edged rake made of wood or bamboo. When the
rice is ripen, it is cut and bound in sheaves to be carried to home. Then it is seasoned and piled
on garret. Whenver there is use, people will take each sheaf, put in wooden trough, crush to take
the grains with foot, then grind them. Besides wet rice, Muong people also cultivate other
plants, raise domestic fowls, go for hunting, catch fishes, gather and produce handmade
products (weaving textile, knitting…).
� Mean of transport: Woman usually uses dosser made of giang (dendrocalamus
patellaris) or bamboo. In addition, they also use arm with notches at 2 ends, incitier.
II.1.3. Ethnic minority people affected by the subproject
Survey result shows that most of people living at the subproject fields are ethnic
minority. Among 194 households at corridor lines influenced by the subproject , there are 95
households having their long term lands claimed back for column foundation construction. The
area at corridor lines unwithdrawn is temporarily influenced during construction period.
II.2. Socio – economic conditions in local area of Ha Noi city The project goes through territories of Hanoi with the length of 10.8 kilometers. The
socio-economic conditions of local areas where the project goes through is depicted in the table
below:

II.3. Ethnic minority development plan (EMDP)
The subproject will be implemented at Tan Thinh district, Tan Hoa district, Huu Nghi district,
Yen Mong commune, Hoa Binh commune at Hoa Binh city; Dan Hoa commune, Dan Ha
commune, Mong Hoa commune, Ky Son town at Ky Son district; Hoa Son commune, Lam Son
commune, town Luong Son at Luong Son district, Hoa Binh province. Most of people living at
subproject area are Muong people. There is few amount of Kinh people living there. It is
unavoidable to claim back lands of ethinic minority to build column foundation. Impacts caused
by subproject implementation are temporary. Households with living houses and buildings
within corridor lines will be temporarily influenced. Therefore, subproject will influence on
social economic and cultural life of those households. EMDP is developoped for subproject
220kV line from Hoa Binh to west Hà Nội because of following reasons:
- Subproject implemented on the production land of ethinic minority. RP and EMDP
establishment will help ethnic minority to stabilize their lives and develop economy,
increase living standard.

- EMDP establishment will raise ethnic minority’s awareness on high voltage system,
Government’s goals on implementing subproject through publishing subproject
information, carrying out communication and training on high voltage system...
The objective of ethnic minority development plan is to ensure that the development process
will promote all aspects of values, human rights and cultural uniqueness of ethnic minorities
simultaneously ensure (i) the ethnic minorities in the subproject area are voluntarily consulted
and prior informed (ii) ensure that negative impacts caused by the subproject are eliminated and
minimized , and (iii) ensure that affected people fully receive economic, social and cultural
benefits from the subproject. EMDP report is drawn up in line with WB’s guideline OP 4.10.
This report is made during establishing investment subproject plan to meet WB’s policy
requirements. Report is based on survey result and local community, union, ethinic people’s
consultancy at the subproject fields to gather information and their feedbacks on subproject ,
potential influences and definite influences on local people. Moreover, EMDP report also
recommends compensation plans, enhances social economic benefits for people directly
influenced by the subproject and raises local ethnic minority’s awareness and knowledge on
electric system security.
This instrument is also prepared based on policies of the Government of Viet Nam. The
Constitution states that the Ethnic People Committee has the right to submit proposals, plans or
related issues of indigenous peoples to the Assembly, monitor, control the implementation of
national policies, development programs on various areas such as, education, health care, etc.
Article 5 of the Constitution also indicates that ethnic minority people could use their own
languages to reserve its cultural distinctions. In the Government of Viet Nam, directly under the
supervision of the Prime Minister is the Committee of Ethnic Minorities Affairs (CEMA which
is equivalent to a Ministry).

of ethnic minority at subproject fields, other information about life, culture, sources of income, cultivation features, polulation and people’s

IV. FREE, INFORMED AND PRIOR CONSULTATION
IV.1. Community consulting (in the period of preparation for the subproject )
During the stage of preparation for the subproject, the investor and counselor carried out the
information disclosure and community consulting to collect the direct feedbacks of local
authorities and people whole life affected by the subproject . The consulting process was
carried out according to the following steps:
Step 1: During the phase of exploration and agreement the direction of power line, the
consultant board reported to the local authorities about the power lines; all matter related to
the subproject including scale, location, purpose and the significance of the subproject .
Step 2: Explored the terrain; collected the information of socio-economic and cultural life of
locals and collected the damage of subproject and made a report.
Step 3: Organized a meeting with local authorities, unions, and the community of people
affected by the subproject for collecting their opinions and sharing of difficulty and desires.
The documents presented at the meeting include:
- Place and time of meetings: the CPCs that subproject put effect on.
- Language used in the meetings: Vietnamese
- Documents support for the meetings: EMDP interim report, the map of the total
land used for the subproject .
- During the counseling, the counselor presented the content as following:
+ An overview of the subproject (Main characteristics, communes affected by the
subproject )
+ The environment impact (both positive and negative impacts of subproject to
the environment)
+ Methods to eliminate the impacts
+ The compensation policy, support policy when land is recovered by the State
under the provisions of government.
+ Way to complain
+ Discover the public notices at PCs including: Tan Thinh, Tan Hoa, Huu Nghi,
Yen Mong, Hoa Binh – a part of Hoa Binh City, Dan Hoa, Dan Ha, Mong Hoa, Ky
Son Town of Ky Son District, Hoa Son, Lam Son, Luong Son Town of Luong Son
District, Hoa Binh Province to collect opinions and suggestions of locals regarding
to the issue of damage, compensation and Relocation policy, the implementing
plan, the impact arising during the subproject implementation.
IV.2. Community consulting (in the period of construction)
During the construction, construction supervision consultant will be hired to supervise the
technical as well as the implementation of EMDP, simultaneously co-operate with the
subproject owner in community counseling. The collected opinions will be conveyed to the
subproject owner then subproject owner will co-operate with the contractor at aim of better
implementing EMDP or update this EMDP (if necessary).

V. Conversations with ethnic minority communities
For ethnic minority residents better accessing and understanding the basic information about
the subproject, during the implementation, the consultant representatives investigated every
commune that the power lines go through and talked to local government representatives and
ethnic communities, provided them basic information about the subproject , the damage may
be caused by the subproject and the interest of people whose life affected by the subproject.
During the conversations between the consultant board and ethnic minority communities, the
consultant set up questions and participants discussed. Questions of locals about the
subproject will were answered by subproject owner representatives and consultants. Most of
questions related to the locals’ life and their rights as their lands recovered by the State. The
collected questions include:
1. Who are affected by the subproject
All the agencies, organizations or individual whose land and assets on land such as houses,
buildings, trees, crops directly or indirectly affected by the constructing activities in the
subproject or located in ROW.
2. Who will measure the impact of subproject on land and property
Northen Power Works Project Management Unit (PMU) will provide necessary information
for the Compensation, Support and Relocation Council at Hoa Binh City, Ky Son District
and Luong Son District including the maps of construction as the base for measure and
statistic the impact.
- The Compensation, Support and Relocation Council at Hoa Binh City, Ky Son
District and Luong Son District will be responsible for investigating the damage in
the subproject zone.
- The affected areas are the area in the safety aisle of power line system with the
standard width regulated in Decree 106/2005/ND-CP proclaimed on August 17th
,
2005 by the Government; Decree 81/2009 / ND-CP proclaimed on October 12th
,
2009 amending for 106/2005/ND-CP proclaimed on August 17th
, 2005 by the
Government.
3. Different impacts
Long-term impacts:
+ The area within the construction area of electric pole base: land, houses, buildings,
trees and other assets located on the ground.
+ Within the power line safety aisle zone

according to Article 5, Section C, Decree No. 106/2005/ND-CP proclaimed on August
17th
, 2005 by the Government.

Short-term impacts: Trees, crops and other assets affected in the construction
process.
4. Land located in the ROW will be revoked for the subproject
Yes. However, only the area used for construction of electric pole base will be revoked.
5. Who will be compensated
All households, agencies, individuals and organizations own land and property affected by the
subproject and can prove the legitimate land use rights and ownership of other assets before
the regulated time will be compensated. The case of invasion, building houses or planting
perennials after the regulated time must be removed without any compensation or support.
6. The applied compensation rate
The compensation rate will be decided by the People’s committee of Hoa Binh Province.
7. Houses with one part affected
All households with houses or ancillary building partly affected will be reasonably
compensated based on the degree of influence. (The classification of influence was specified
in the RP report).
8. The time of receipt of compensation and relocation
- The displaced households will be compensated at least 1 month before the land recovery.
- The households with trees and crop affected will be compensated at least 1 month before the
construction (The compensation and construction should be immediately carried out after the
season to reduce the effect on locals’ income).
9. In addition to compensation, what are the other interests of affected households
- Yes. Affected households will be supported the replacement, career change support and
offering jobs, livelihood support, production disruptions support, health care support, text
books for children support, poor household support, reward for household giving land before
the due date. In addition, residents participate in training courses, workshops, high-voltage
safety guidelines classes.
10. During the construction, will locals be supported and offer jobs
Yes. subproject owners and contractors will offer simple jobs not asking for the special
qualification and knowledge that will be suitable for ethnic minorities such as excavation for
electric pole base, clear the corridors for creating more jobs for ethnic minorities.
11. The case of household receiving a part of compensation but have been asked to
relocate
Only after receiving full compensation, affected households will have to relocate.
12. Upon receiving land remuneration, must affected households make monetary
contribution to any organization or the CPC
No agencies or organization authorized to collect remuneration money from affected
households. If there is such a case, the affected households should immediately inform the
Compensation, Support and Relocation Council, or PMU or any local authorities.
13. Who is in charge of informing necessary information to affected households

The PMU, the Compensation, Support and Relocation Council at Hoa Binh City, Ky Son
District and Luong Son District are responsible for providing adequate and necessary
information on the Compensation and Relocation plan, remuneration pricing, land-owners’
rights, time frame for remuneration, timeline to land inquisition, etc. for the affected
households.
14. Where to logde a grievance/complaint
First Stage - At Commune People’s Committee (CPC)
An aggrieved person may bring his/her complaint to any member of the CPC, in writing or
verbally. It is incumbent upon said member of CPC to notify the CPC about the complaint.
The CPC will meet personally with the aggrieved person and will have 15 days following the
lodging of the complaint to resolve it. The CPC secretariat is responsible for documenting and
keeping file of all complaints that it handles.
Second Stage - At District People’s Committee (DPC)
If after 15 days the aggrieved person does not hear from the CPC, or if the CPC gives its
solutions, but DP is not satisfied with the decision taken on his/her complaint, the person may
bring the case, either in writing or verbally, to any member of DPC or DCB. The DCB in turn
will have 30 days to resolve the case. The DPC is responsible for documenting and keeping
file of all complaints that it handles.
Third Stage - At Provincial People’s Committee (PPC)
If after 30 days the aggrieved person does not hear from the DCB, or if the DP is not satisfied
with the decision taken on his/her complaint, the aggrieved person may bring the case, either
in writing or verbally, to any member of the PPC. The PPC has 45 days within which to
resolve the complaint to the satisfaction of all concerned. The PPC secretariat is also
responsible for documenting and keeping file of all complaints that it handles.
Final Stage - Court of Law Decides
If after 45 days following the lodging of the complaint with the PPC, the aggrieved person
does not hear from the PPC, or if he/she is not satisfied with the decision taken on his/her
complaint, the case may be brought to a court of law for adjudication. Under no circumstance,
can the aggrieved person be evicted from his/her property nor can the Government take over
his/her property without the explicit permission of the court.
15. Who supervise the remuneration process
• A group appointed by NPPMB will supervise the remuneration process
• An independent audit group will be selected by NPPMB to sign the supervising
contract for the remuneration process.
16. What are the duties of the affected households
- Be present at all meetings of the community and read all of the information related to the
local subproject .

- Prepare in advance legal documents, such as land-ownership certificate, family-listing
booklet, identification papers, low-income-family-status booklet, etc.
- Read and understand fully all information presented in sample documents such as socio-
economic investigative survey, land-measurement profile, property-listing form, leaflets
regarding compensation activities.
- Vacate and return land to the subproject upon receiving full remuneration payment and
other supporting aids.
17. Affected households can make enquiry, anytime, at any of these organizations
- Supervising Committee for the Electrical subproject s, Northern region.
- Compensation for Land-requisition Committees of Hoa Binh City, Ky Son District, or
Luong Son District
- PCs of Hoa Binh City, Ky Son District, or Luong Son District.

communities. The activities are proposed, taking into account the actual project impact as well
as actual needs of community at local level.
VI.1. Support EMs in accessing the credit support policies
+ Credit support policies will be offered to those who were greatly affected by the subproject .
These feature several programs on resource utilisation and management.
+ The subproject director will coordinate with the PCs of Wards that are affected by the
subproject to provide opportunities for affected families to obtain loans from government-
administered Program 134, 135, etc.
+ According to ground survey, an estimated number of 154 families will be affected by the
subproject . All of these families have expressed interest in receiving cash remuneration for
their affected land.
+ Detailed payments for compensation of affected land and properties, and supporting aids for
affected families are presented in RP report.
VI.2. Information, Education and Communication (IEC) support
To increase the people’s knowledge on the subproject and equip them with necessary
information on high-voltage electrical network, there is a need to host 01 workshop for the
local residents on Safety within the High-voltage Electrical Network, especially aiming at the
minorities near the subproject site to ensure safety on life and health of these people. For the
workshop to be effective, NPPMB needs to work with the PCs of affected Wards to identify
contents for the workshop. The key activities will be carried out as followed:
• Giving out leaflets to families, communities, schools on the regulations of Safety on
High-voltage Electrical Network, spotting danger signs and first-aiding methods on
electrocuted victims.
• Demonstrating for the local residents and students to practice safety measures while
living under the High-voltage Electrical Network and first-aid methods for victims.
• Teaching local residents how to estimate the safety zones around the high-voltage
cables, the dos and don’ts under the high-voltage cables.

VII. implementation arrangement
VII.1. Institutional Arrangement
NPPMB is responsible to collaborate with relevant local authority in implementing this EMDP.
All activities of the EMDP implementation throughout a subproject should take place in a
culturally appropriate way for affected EM people. The NPPMB will set up routines for regular
dialogue and meetings with local authorities, representative community groups, and
traditional leaders representing EMs. Mass organizations, particularly the Women’s Union,
will play an active role in implementing and monitoring of the EMDP.
The capacity of the executing agencies at province and district levels for social safeguard
implementation should be strengthened and improved to meet the WB’s requirements. It also
needs to build capacity of local communitieson implementation and monitoring of RP and
EMDP. Therefore, NPPMB is responsible for providing training courses and workshops on
the implementation and monitoring of RP and EMDP for local executing agencies and
communities. The training should be organized before starting any activities relating to the
implementation of RP and EMDP. Training courses should be held at each level including
province, district and commune so that different stakeholders could be involved in. The
training courses given to ethnic peoples should be in a culturally appropriate manner for them.
VII.2. Greviance Mechanism
The grievance mechanism is established to resolve complaints of EMs, which will pass
through 3 stages before they could be elevated to a court of law as a last resort.
Stage 1, at the commune people’s committee level.
An aggrieved affected household may bring his/her complaint before the receiving
department of a Commune People’s Committee to be received and guided for necessary
procedures. The CPC will meet personally with the aggrieved affected household and will
have 5 days following the lodging of the complaint to resolve it (Note: in remote and
mountainous areas, the complaint should be resolved within 15 days. The CPC secretariat is
responsible for documenting and keeping file of all complaints that it handles. Upon
issuance of decision of CPC, the complainants can make an appeal within 30 days. If the
second decision has been issued and the household is still not satisfied with the decision, the
household can elevate his/her complaint to the DPC.
Stage 2, at the district people’s committee level:
Upon receipt of a complaint from a household, the DPC will have 15 days (or 45 days in
remote and mountainous areas) following the lodging of the complaint to resolve the case.
The DPC is responsible for documenting and keeping file of all complaints that it handles.
Upon issuance of decision of DPC, the complainants can make an appeal within 30 days. If
the second decision has been issued and the household is still not satisfied with the decision,
the household can elevate his/her complaint to the PPC.
Stage 3, at the provincial people’s committee level:
Upon receipt of complaint from the household, the PPC will have 30 days (or 45 days in
remote and mountainous areas) following the lodging of the complaint to resolve the case.
The PPC is responsible for documenting and keeping file of all complaints. Upon issuance
of decision of PPC, the household can make an appeal within 45 days. If the second
decision has been issued and the household is still not satisfied with the decision, the

household can elevate his/her complaint to the court within 45 days.
Stage 4, the Court of Law:
Should the complainant file his/her case to the court and the court rule in favor of the
complainant, then provincial government agency will have to increase the compensation at
a level to be decided by the court. In case the court will rule in favor of PPC, the
complainant will have to receive compensation as described in the approved compensation
plan and obey all requirements of land clearance.
To assure that the mechanism described above is pragmatic and acceptable to affected EMs,
consultations with local authorities and affected communities about this mechanism is in need,
particularly consultations with vulnerable groups.
VII.3. Monitoring and Evaluation
To ensure that the EMDP is transparently implemented and complies with the EMPF and the
World Bank’s Indigenous People Policy (OP4.10), a monitoring and evaluation mechanism
is necessarily established for all project components throughout the process of the project
implementation. Monitoring and evaluation is a continuous process. The NPPMB will be in
charge of the internal monitoring and an external agency recruited by NPPMB will be in
charge of the independent monitoring and evaluation. To the extent possible, NPPMB will
consider to integrate the internal and external monitoring required under OP 4.10 into
similar task under OP 4.12. The findings of both RP monitoring and EMDP monitoring
should be included in one report to submit to the NPT and the WB for review.
The internal monitoring will be monthly conducted by the NPPMB, with the following
objectives:
a. ensure that all negative impacts of the subprojects on EMs are mitigated, minimized
or compensated in compliance with EMPF and EMDP.
b. ensure that measures of benefit maximization and adverse impact mitigation are
implemented in culturally appropriate way for ethnic peoples.
c. identify whether the free, prior and informed consultations for ethnic people
communities are conducted in culturally appropriate manner for ethnic peoples or
not.
d. determine if complaint procedures are followed the EMPF and propose solutions if
there are pending issues.
e. conformity between relocation and land clearance and construction commencement
to ensure that affected EMs have been provided with compensation, allowance, and
relocation satisfactorily before construction commencement.
The external monitoring will be conducted by an external agency specialized in the social
science. Key indicators of external monitoring and evaluation is presented as follow:
a. Public consultation and awareness of project benefits, resettlement policy and
entitlements of affected EM (if relevant);

b. Level of satisfaction of affected EMs with the provisions and implementation of
the EMDP;
c. Grievance redress mechanism (documentation, process, resolution);
d. Effectiveness and sustainability of entitlements and income rehabilitation measures
for affected EMs;
e. Gender impacts and strategy;
f. Capacity of affected EMs to restore/re-establish livelihoods and living standards.
Special attention provided or to be provided to severely affected and vulnerable
households;
g. Resettlement impacts caused during construction activities;
h. Participation of affected EMs in EMDP planning, updating and implementation;
i. Institutional capacity, internal monitoring and reporting; and
j. Channeling of government funds for compensation payment and allowances for
severely affected EMs if any.
ViII. Estimated Expenditure
Some expenditures in EMDP had been mentioned in RP’s expenditures (on land
compensation and relocating supports)
- Hiring fees for Independent Auditors, as subproject Manager works directly with
the Independent audit group.
- Costs for educational programs are listed below.
- Costs for recovery methods as mentioned in Contractor’s documents while
carrying out the subproject .
- Reserved costs as mentioned in RP.
