ITEMS FOR CONSIDERATION AND APPROVAL

To consider and approve the proposal for lmplementdion Of reservation atAssistant Professor (AGP 6000/000/8000) Le`rel-10,11 and 12, malnfalnlngflexlble structue.

A letter has been received from Ministry of HRD, New Delhi vide F. No. 33-3/2018 Tslll dated 5th November 2019, regarding implementation of CentralEducational Institutions (Reservation in Teachers cadre). NITs are under 4 tierflexible strucfure; but under this flexible structure scheme the facufty positionsat different levels are not fixed. How to caleulate faculty positions at differentlevel maintaining flexiiible structure .is not clear?

Prior to this Act, all the Associate Professor and Professor were recruited underunreserved categories. The reservation was implemented only at the level ofAssistant Professor (AGP 6000/7000/8000) Level-]0,11 and 12. A single rosterwas made at Ass.istant Professor Level i.e.10, I 1 &12 considering entry level inNITs. Assistant Professor recruited at level-10 and 11 needs to move in level 12in three to five years. In such cases how to calculate number of vacancy ofAssistant Professor at Level 12 is not clear.

In view of the above, the lnstit`ite proposes that the disfrlbutlon Of number Ofpositions dr the three entry levels Of the Assistant Professor i.e. AssistantProfessor (Cr.-I) In le`/el-12, Assistant Professor (Cr.-II) ln level-11 a AsslsfantProfessor (Gr.-ll) in level- 10 may be ln the ratio Of 4±1 and accordinglyreservatlon roster may be prepared..

This will resolve the pending issue of recruitment at Ass.istant Professor Level.

Agenda: - To consider the proposal to directly hlre the servlces Of ShriShankar Prosad Singh as Network Admlnlslrator (currently working asTechnlcfan-on-can from local cigency) on a monthly remuneratlon Of Rs.40,000/- only, lnlticllly on contract for one year extendable up to 03 yearspurely on contract`ial basis.

Imstitute Internet network was facing challenges and complete network wasaccessible to anyone without any security check. In past, Institute networkfaced many hacking incidents and that was reported by Miniistry ofEduccition and NIC aiso. We received much wlnerab"fry, fragmentations,infringement claimed from NIC. Institute website also faliled to handle the

`-hacking and it was reported by ministry. The action taken report was aiso

submitted to Ministry. Website was hacked and it was recovered cifter 24 hrapproximately. In the view of these challenges Institute expends the Internetfacilities in terms of networit security, users and bandwidth. The ComputerCenter of Institute has procured the different equipments, whieh are specificto control the Internet network, and provides the security to Institute Internetnetwork. The devices 48 ports L3 Switches, Hieh-end servers other networklayers switches have been procured recenfty. The toad balancer firewalis,Internet leg control book has also been installed to smoothen flow of Internetbandwidth in the campus.

All these devices need a technical person who is expert in Internet networkbut the Institute has no sanctioned post of Network Administrator. Currenfty,Computer Centre has only one Technical Assistant which is on contract andhandlfng Institute website and other software dependent appncatiorrs.Institute has hired a technical person Shri Shankar Prasad Singh from agenciesto look after the day-to-day Institute lnternet problems. Since, the technicianis coming through the cigency; hence he is not getting the whole amountwhat Institute is giving to the agency (Taxes, Service charge of the agencyetc.).

In the view of above fact, Computer Centre needs to have a dedieatedtechnical person who .Is responsible to handle these devices and fuftydedieated to the Institute.

Hence; it is proposed to hire the same person as a network administrator onthe monthly remuneration of Rs. 40000/- only for one year extendable up tothree years based on the scltisfactory performance and it will purely be oncontractual basis.

Agenda. To consider and take decision on the complaint against Dr. J.P.Slngh, the then Principcll, RIT Jamshedpur, clnd others regarding Illegalappolntment and financlal lrregularmes

A complaint was made by Sri Bishsewar Mahato to the VigiidnceCommissioner, Central Vignance Commission, Government of India, datecd1002-2009 regarding nlegal appointment and financial irregulclrities duningtenure of Dr. J. P. Singh. For the same MHRD, Govt. of India sefup an inquirycommittee. Sri Rajesh Tiwary was deputed as Inquiry Officer for the same.Another Inquiry Committee headed by Prof. M. Chakraborty, Dean(Academic Affairs), lIT Kharagpur, as Chairman was also set up by the BOG totook into the apparent /anomalous irregularities in some construction work.Inquiry report submitted by Inquiry Committee headed by Prof. M.Chakraborty and by Sri Rajesh Tiwary, Inquiry officer, MHRD and are asfollows:

in The complalnt regarding illegal construction/ repairing of bufldfngs.

As per observation of Enquiry Committee headed by Prof. M. Chakraborty,Dean AA, lIT_Kharagpur, as Chairman constituted to look into the apparent/anomalous irregularities in some construction work it was found that all thecases referred to the enquiry committee were processed at a time when theadministrative machinery of RIT (now Nrty Jamshedpur was not functioning

properly. The problems arose particularty when the state of Jharkhand wascreated and in the transition period of conversion of RIT to NIT. The complaintwas made after expiry of defect lidbtlfty period. Therefore, the committeeconstiituted in this regard observed that the quanty of the work couid not beassessed at that stage. Furthermore, the committee aiso observed that theInstitute had started repairing work on the same site. Hence no liablllty wasfixed for illegal constructlon/repair on any indMdual Including Prof. J. P. Singhwhieh is evident from Enquiry Committee Report.

(ji) The Enquiry committee report was placed in 5th BOG held on 31-05-2004. Report of the committee was perused and it was stated that suchaction where no charges have been filed shouid not impede payment forwork done in the past. For implementation of suggestion of Bu"ding enquirycommittee, the BWC accepted the final report of the enquiry committee.Further, The Chairman BOG referred the complaints related to constructionworks executed during the period to an enquiry committee whichrecommended appointing a chaffed accountant to take a close look andmake suitable recommendations to NIT JSR regarding payment of final bilis

and adjustment of security deposit. 5th BOG at its meeting held on 31ro504directed implementation of committee's observation and that payment bemade as per CA's advice.

(lil) lnqutry repoit submitted by Srl Rojesh Tlwary, Inqutry Officer, MHRD, on 02-06-11 concluded that the complaint regarding alleged lllegol regularappointment was withdrawn by the complalnant himself. In fact all thesecases were related to regularieation of Daily wages employees, whieh hasbeen done as per the practice of Institute with due approval of the thenChairman, BOG Hence Committee could not find any substance in thecomplaint/ allegation. However, some of the regular appointments made byProf. J. P. Singh were challenged in the High court and the Hon'ble HighCourt cancelled the appointments only on technical ground. No mala fldeIntention `^/as there on the `^/orklng Of any officer/ officlcil.

Further it is to be mentioned that Prof J. P,-Singh expired on 28-05-20.

After going through the details of the reports, CVO of NIT Jamshedpur hasrecommended this case for closure.

Agendcl:- To conslder and take decision on reply submrmed by Sri DeepakKumar, Asslstant Engineer, NIT Jomshedpur to show cause nolfce served tohim for lock Of his devotion to duty regarding selection Of Architect-cum-consulfant

Shree Deepak Kumar, Assistant Engineer, NIT Jamshedpur was special inviteeto buiiding advisory committee held on 18-12-2003. Dr. Ashok Kumar Khan,Chairman of Building Advisory Committee (BAC) invited tender on 05-12-2003for appointment of architect{um consultant for 10 number of Civil andElectrical works of the Institute. Twelve bidders including M/s TPE, Tata Steelsubmitted their bids. Prof. A. K. Khan along with Dr. A 8 Chattopadhyay andShll Deepcik Kumar, AE prepared a tender opening as well as tenderopening-cum-comparative statement respectively and there upon shorflistedL -6 to L-9 bidders including M/s TPE, Tata Steel for negotiation on 23-12-2003instead of L-1. Thereafter, the negotiation was held by Prof. A. K. Khan, Dr. R.P. Singh, Shri Deepak Kumcir and others. The committee recommended M/sTPE, Tata Steel for award of Architect{um-consultancy servicesafternegotiation without inviting L-I party in contravention to CPWD andCVC norms. The Building Advisory Committee |BAC) did not follow two bidsystems namely, price bid and commercial bid for selection of consultant forspeciarized items as per CPWD norms. After approval from BWC and the

Chairman (BOG, NIT Jamshedpur), M/s TPE was awarded the consultancy.Post-facto ratification from the BOG was also obtained.

In this case DA of this institute has resolved to impose Major penalty to Prof.Khan and Minor penafty to Dr. R. P. Slngh and Dr. A. 8. Chattopadyay.

While preparing the memorandum of charges, OSD (Legal) of the Instituteadvised that RDA should also be initiated against Shri Deepak Kumar, thethen Assistant Engineer of the Institute in the same case which was placed inBOG of NIT Jamshedpur. The BOG, NIT Jamshedpur directed the Institute toseek the lst stage advice from CVC whether RDA can also be started againstShri Deepak Kumar. The reply of Sri Deepak Kumar to the charge sheet hasnot been placed in the BOG till date. Reply of Sri Deepak Kumar is being

placed for perusal.

Resolutlon: - The Board perused the mater and noted that Shrl Deepak Kumoris a `witness Of the CBl in the sold matter.

Fuither, RDA has already been Initiated and brought to concluslon resumng inimposition Of Major penalty on Ex-Professor Dr. A. K. Khan and minor penaftyon Dr. R. P. Slngh and Dr. A. 8. Chatlopadyay.

LasHy, the Board also noted that Shri Deepak Kumar vvcis Just ci special invifeeln Bul[dlrig Advisory Committee which recommended the award Of Architect-cum-consultc]ncy services to M/s TPE, Tata Steel.

In view Of the ciforesoid facts and clrcumstances, the Board resolved that noRDA is required to be in"aled agclinst Shri Deepak Kumar, Assistant EngiiieerOf the Institute and the matter be closed.

Agenda:-To consider and take decision for imposition Of Major Penalty on Dr.Neeta Bharti, Assistcint Librclrlan, for charges agalnsl her regarding violation Ofmode Of deposition Of fine/dues through Bank Challan and not deposltlng thecollected amount frl cash to the lnsllt`/te Account durlng the period from 2014to 2018.Fines / dues towards late submission of books / less of books were depositedby sfudents to Institute Account through Bank Challan till 2013. However,since year 2014 fine / dues were collected in cash by Dr. Neeta Bhahi,AAssistant Librarian through frorary staff without any office order.

The fine/dues thus collected during 2014-2018 were not deposited in lnstifuteAccount till 28-11 -2018. The matter came in cognieance of the Director and aletter No. 0.0. No. NIT (D)-113/18 dated 29-11-18 was issued to her seeki`hgstatus of dues / fine collected from the sfudents for last five years.

Consequently, she deposited the collected amount of Rs.8,73,251.42 for theperiod 2014-2018. As per lot srdge advice Of CVC to Impose Major penafty onDr. Neefa Bhartl proceeding agcllnst her \Aras inltlated.

Enquiry officer Dr. S. P. Mathur, Reg.istrar, lIT BHU has estobllshed the chargesle`relled ogalnst Dr. N. Bhcl". As per directive of the BOG, NIT Jamshedpur,Inquiry committee report submitted by I.0. Dr. S.P. Mathur, Registrar, lIT BHU,was served to Dr. Neeta Bharfi for her written reply,

The reply submitted by Dr. Neeta Bharti was placed in the BOG. Her reply wasperused and BOG, NIT Jamshedpur was in view of submitting this case toCVC for 2nd stage advice. CVO, NIT Jarnshedpur sought 2nd stage advicefrom CvC.

As per letter of CVC dated 1902-21 ";n cases where the disc/.p`/.nor)/ author7.ly(DA), on conclusion of disciplinary proceedings, proposes to impose apenalty which is in line with the commission's first stage advice in respect ofofficers fallI.ng within the jurisdiction of the commission, 2nd stage advice ofthe commission is not required. Such cases would be dealt at the level of theCVO and DA concerned in the Organization| Department.

CVO of NIT has also recommended for major penafty on Dr. (Ms.) NeetaBharti.

The Board is requested to decide the quanfum of penafty to be imposed onDr. (Ms. ) Neeta Bhcm.

Agenda:- To consider and approve the lnstilute's Budget Estimates for the F.V.2021.22.

Budget Estimates for the Financial Year 2021 -22 was prepared and submittedto MOE in the format prescribed by the Ministry. The detailed budget isenclosed. The demand raised under the various heads as follows:-

Agenda:- To consider and approve the reimbursement Of medical billssubmitted by lit. Uday Kumar and Dr. Rlna Sahu for geffing treolment lnHospilc]Ls/ Medical Centres not empanelled under CGHS.

1. Dr. Uday Kumar, Assistant Professor, Department of Physics has submittedthe medical bills of her daughter Miss Aakriti Singh, amounting to Rs. 58,974/-only for reimbursement. The case of her daughter Miss Aakriti Singh wasreferred by MGM Medical College & Hospital, Jamshedpur (a Govt. Hospital)for better treatment at higher centre. As per referral letter, her treatment wasreferred to Genesis Hospilol, Kolkalo and Dr. Sajal Sur, HERE Hyderabad.However, both are nol empanelled under the CGHS.

2. Dr. Rina Sahu, Assistant Professor, Department of Metallurgical & Maten.alsEngineen.ng, NIT Jamshedpur is suffering from cancer. She has been takingtreatment from various hospitals in Jamshedpur. Lastly, she was referred byMahatma Gandhi Memorial Medical College and Hospital Jamshedpur (aGovt. Hospital) for better treatment at higher centre. She chose to be treatedat Apollo Hospirdl, Bhubaneswar (not empanelled under CGHS) andsubmitted the medical bill amounting to Rs. 13, 97,001/- only forreimbursement.

As per decision of the 17th BOG meeting, the reimbursement of medicalexpenditure incurred by the employees for treatment of himself/dependantat only CGHS recognised Hospital/ nursing home is to done only if the referralis done by TMH, govt. Hospital/ State Dispensary. Apparently, the ApolloHospital, Bhubaneswar is not empanelled under CGHS.

Resolution:- The Board perused the agenda Notes and resolved thch thereimbursement for medical expenses incurred by Dr. Uday Kumar, AssistantProfessor and Dr. (Mrs.) Rind Sahu, Asslslonl Professor foi availing medicaltrecitment ot Hospftclls/ Medical Centers not empanelled under CGHS bemade at CGHS rates. The Board further clarified lhot the instant case may beconsidered as a stand-alone case and shc]ll not result in making precedencefor claiming further such reimbursement on sympathetic grounds.

Agenda- To consider and approve the reimbursement Of medical bllls lnrespect Of Late Parmarrh Mukhl, Ex- Core Taker, Housekeeping and GreenCampus Divlslon, NIT Jamshedpur

Smt. Rajwati Mukhi, wife and nominee of Late Parmath Mukhi, Ex-Care Taker,Housekeeping and Green Campus Division, NIT Jamshedpur has given arepresentation of waiver of Tata Main Hospital, Jamshedpur bill pertaining toLate Parmath Mukhi for the periiod from 01 /09/2019 to 19/09/2019 for 19 days.Late Parmath Mukhi was admitted in TMH on 08/08/2019 for the treatment ofChronie Epididymo- orchitis and Obstructive Jaundiee as per the TMHmedical documents and expired on 19/09/2019 while trecltment in TMH as inpatient. TMH was providing services to the Institute employees and thepayment was made to TMH as per bills raised. However, new agreementwith TMH came into effect from 01/09/2019 in which the employees \^/ill be

paid only as per CGHS rates for the treatment and the balance expenditurewill have to be borne by the concerned employee. The same has beenapproved in 39th BOG. The total bin of TMH is Rs 6, 04,632/- only which hasalready been paid by NIT Jamshedpur to TMH. The treatment period was 43days from 08/08/2019 to 19/09/2019. The bill of 24 days from 08/08/2019 to31/08/2019 is to be paid by NIT Jamshedpur and the bill of 19 days is to be

paid by the concerned employee at CGHS rates. Hence, the bill of 19 daysi.e from 01/09/2019 to 19/09/2019 has been sent by TMH amounting to Rs 1,68,210/-only.

As per CGHS rate amounting to Rs 88,800/- only is to be paid by employeeconcern. But he was admitted in TMH from 08/08/2019 and the newagreement came into effect from 01/09/2019. His wife and nominee Smt.Raivati Mukhi is requesting for waiver of Rs 88,800/-only sympathetically.

AA & ES amounting to Rs. 3,95,05,692/-for construction of 33/llKV indoortype sub-station with 2x6 MVA transformer was given to FEE, CPWD, Ranchi. inthe P.E., there was provision for construction of control room bu"ding 120 SQMcosting Rs. 25.00 fakhs but there is already a newly constructed buiiding wasavailable for the sol.d purpose. Accordingly, CPWD has not executed thebuiding work as considered in the P.E. However, CPWD has executed theelectrical works as per sanctioned P.E. and the work is in progress. Now, tocomplete the aforesaid work in all respect as per requirement of JUSCO,Jamshedpur considering the safety measures and proper approach to thesobrstcition butlding, EEE has requested EE and SMCE-I to give PE for thesame. Accordingly, a PE for Rs.23.98 lakhs has been submitted by EE (Civil),CPWD, Jamshedpur for the required works as per suggestion of JUSCO,Jamshedpur and FEE, CPWD, Jamshedpur.

The matter was discussed in detaft and it was informed that the proposedsafety mecisures consist of fencing around the sub-station as perspecifications. BWC approved and recommended the same and suggestedthat the same be reported in the next FC and BOG.

Resolution:- The Board perused the agendcl and approved the same.

Agenda:- To consider and approve the proposal "Repair, Retrofitling &Renovdion including Internal electrical installation Of CF Iype Quarters 40Nos." by CPWD.

As reported by Executive Engineer & SM (C-1), CPWD, Jamshedpur, theAA/ES for the above mentioned work was received on 20.03.2018 videNITJSR/PDD/046/2018 (vide BWC/MIN/23/2016-04/06; FC/MIN/21 /2018-1 /10 &

BOG/AGEN/31/2018-01/28.03) amounting to Rs.5,18,78,960/- (Civ":Rs.4,37,56,000/-Elect: Rs. 81,22,960/-). The tendering was done for the abovework after getting AA/ES \^/ith total tendered cost as Rs.3,53,17,993/-. Till dateout of the total 40 nos. quarters 28 nos. renovated and handed over to NIT. Asper the condition of the tender, the total completion cost shall not exceed1.25 times the tendered cost, therefore the tender was closed and due tovarious reasons the cost increased and only 28 nas. quarters couid berenovated up to 1.25 times the tendered cost. Major reasons for cost increaseare as follows:

1. The PE cum DE was sent in Apr-2016 based on CPWD DSR-2014,however the AA/ES was received in March-2018 after approximately 2years time. Till that time DSR-2016 was pubrished and detailed estimatefor the purpose of tendchng was prepared based on DSR-2016. Duringth.is peri.od approximate cost increase based on cost indiees is116/ 102= 1.13 i.e. approx. 13 %.

2. Change ln speclflcatlon by MoUD for quorteJs: During the joint siteinspection of CPWD and NIT officials on 27.12.2018, it was decided thatthe up-gradation of the quarters shall be done as per the latest normsand specification of the MoUD. Accordingly the renovation wascarried out as per norms of MoUD issued vide F No.18/25/2015-W-1 /DGdated 08.03.2018. Following modifications had to be done in the scopeof the work:

(i) Udaipur green marble to be taken in staircase instead of kotastone.

(11) The flush door shutters, cup board shutter as well as the shutter ofthe kitchen cabinet was taken with lamination instead of nondecorative shutter as taken in the BOQ.

(try Dado in the kitchen was done up to full height against 2.1mtrheight as taken in the BOO.

(iv) Separate water tank of capacity 3cO litre was provided forkitchen in addition to the 2000 litre tank as tc)ken in the BOQ.

(v) All the door fittings were provided of Stainless steel instead ofaluminium fittings as taken in the BOQ.

3. AddMonal works beyond the scope (BOO):At the time of prepan.ng tender, it was assumed that existing sewer line andseptic tank is functioning properly. Later on, it was found that septic tank wasnot functioning properly creating unhygienic condition in the campus andsewer line was also broken.During the joint site visit on 27.12.18 and 19.01.2019 as well as in the meetingheld on 27.02.2019, following items which were not in the BOQ were decidedto execute to make the renovated quarters fully safe and operational:

i) Construction of boundary wall with gate to ensure safety against theftas well as entry of cattles/animals.

ii) Two nos. septic tank of capacity for 150 users each were constructedto make the quarters operational.

iii) Sewer line along with chambers was constructed for proper dischargeof sewer.

iv) The sunshade box on the facade of the building was completelydamaged and the external wall was also damaged. The same wasbeyond repair and it was decided that additional structural membersmay be constructed/erected for retrofitting of the external 'faeade ofthe building. Accordingly 4 nos. RCC columns (G+1), Beams, lintels,chaiia were constructed on the main entrance.

v) Additional safety gate at the main entrance as well as additional doorwas provided on the backside of the block.

vi) Stainless ramng provided in the staircases.vif) Cement based wan putty was provided on the external side aiso to

provide better finish and aesthetics.wi) Construct.Ion of pathway with payer block from the road to the

entrance of the bu"ding.Considering above facts, overall execution cost increased due to which only28 nos. quarters out of 40 could have been renovated and handed overwithin the limit of 1.25 times the tendered cost and the tender was closed.The final bill is under process and final amount is expected to be approx. 4.40Cr. However some more quarters may be renovated withiin the 1.10 times theAA/ES amount which shaH be assessed after final biH settlement and shall bedone by separate call of tender.

BWC considered and recommended the same. It was suggested that thesame may be put up in the next FC and BOG for its approval. Further, it wasciiso considered and recommended that the remaining quarters may aiso begot renovated from the savings of other type of quarters, if any.

Resolutlon:- The Board resolved to defei the agenda for consideration in thenext BOG and advised the Institute to put up a well-documentedcomprehensive proposal with revised estimcites and elaborate details beforethe BWC for rescrufinising/ recommendofions and then plclce it before the FCAOG for re-consideration.
