Gross pay is defined as the total wage agreed in the employment contract. After deduction of various amounts, which the employer forwards to various authorities on behalf of the employee, the net remuneration paid to the employee is the net remuneration which the employee receives to cover his or her living expenses. The deductions result from the employer‘s legal obligation to withhold taxes and social security contributions and pay them to the following offices:

1. TaxesFor the deduction of wage tax, the solidarity surcharge and church tax we need your wage tax ID. New employees from abroad receive this ID when they register with the registration office (e.g. the city of Passau) with a place of residence, automatically sent within approx. 2 weeks. To register, you need a confirmation from your landlord. If you have rented a room in a staff residence, you will receive the confirmation from the HR Department. The address of the residence is: Leonhard-Paminger-Straße 1, 94032 Passau.

2. Pension InsuranceYou become a compulsory member of the German Pension Insurance. The contribu-tion rate is 9.30 % (employee‘s share). As a physician, you become a compulsory member of the Bavarian Medical Care instead of the German Pension Insurance. Physicians must submit a „Membership survey form“ and an „Application for exemption from statutory pension insurance“. You can obtain the forms directly from the Human Resources Department.

Income Tax and Social Securityrung

3. Health InsuranceThere are basically two systems in Germany for covering oneself in the event of illness. About 90 % of Germans have statutory health insurance. You can choose between almost 90 different health insurance plans, some of which differ - rather slightly - in price and service.

If you change employers or register as a new employee, you also have the option of choosing private health insurance, provided that you are likely to exceed the compulsory insurance limit. The compulsory insurance limit is € 5.212,50 per month or € 62.550 per year. Physicians in the surgical disciplines immediately exceed these limits; physicians in the fields of internal medicine, anesthesia, radiology, nuclear medicine and neurology exceed the limits after 2 to 3 years of medical practice (please also note page 26).

Whether statutory or private health insurance is cheaper/better for you depends on a lot of life circumstances and cannot be generally answered for everybody.

We recommend that you inform yourself early on (e.g. via the Internet, from advisory services or from colleagues) about the individual health insurance offers. The neutral consumer protection organisation Stiftung Warentest also offers the possibility of obtaining non-binding and economical information about the offers at www.test.de.

The employee share of the statutory health insurance amounts to 7.3 %. There is also an additional contribution depending on the insurance company. The contribution for private health insurance is set by the health insurance company, independent of income and based on performance.

At the start of your employment, you must inform us of your health insurance company and preferably present a membership certificate.

4. Unemployment Insurance Contribution Your share (1.2 %) is automatically transferred to the Federal Employment Agency (Bundesagentur für Arbeit) via the health insurance company.

5. Long-term Care InsuranceLong-term care insurance follows health insurance. The contribution rate for people with statutory health insurance without children is 1.775 % (employee share), and 1.525 % with children.

DefinitionSecondary employment is any other occupation within or outside of the Klinikum Passau that does not belong to a main activity. Remuneration for secondary employment is any payment in money or monetary benefits, even if there is no legal claim to it.

Duty of DisclosureIn accordance with § 3 subsection 3 of the TVöD-AT, employees must notify their employer in advance in writing of any secondary employment for which they receive remuneration.

The employer may prohibit or impose conditions on the secondary employment if it is likely to interfere with the fulfillment of the employees‘ contractual obligations or the employer‘s legitimate interests.

For secondary employment with the same employer or in other public service (section 34 subsection (3), sentences 3 and 4), an obligation to deliver may be imposed.

You can obtain the application forms in the Human Resources Department or on the intranet.

Remuneration and Obligation to DeliverIn case of a secondary employment in the interest of the service or on behalf of the Clinic, the regulations of §§ 9 and 10 of the BayNV are to be applied with regard to the remune-ration and the obligation to deliver.

Use of Clinic Facilities, Personnel or EquipmentAll material resources, in particular the premises and their equipment, as well as the machines, apparatus and instruments therein, are considered to be facilities.

Staff members shall require prior written authorization, if they wish to make use of the Clinic’s facilities, staff or equipment in the course of an ancillary activity. Such authori-zation may be granted only if there is a public or scientific interest in the exercise of the secondary employment.The approval is revocable and may be limited in time.

Remuneration conversion is a specific, state-subsidized form of occupational pension provision in Germany. Pursuant to § 1a BetrAVG, every employee has a legal claim against his or her employer to use part of his or her agreed remuneration for the occupational pension scheme.

This form of occupational pension scheme is promoted by not levying income tax(in accordance with § 3 no. 63 EStG) and social security contributions (in accordance with § 1 para. 1 no. 4 + 9 SVeV) on the converted portion of the remuneration.In return, the later pension payment is subject to income tax and is generally subject to the obligation to contribute to the statutory health and long-term care insurance.

Since remuneration conversion is a contract between the employer and the depositary institution, the employer can limit the contracting parties.

Two depositary institutions are currently licensed at the Klinikum Passau. These are: » The Supplementary Pension Fund of Bavarian Municipalities (Zusatzversorgungs-

kasse der Bayer. Gemeinden), where the occupational pension for our employees is already paid in anyway, and

» The Sparkassen-Finanzgruppe (Versicherungskammer Bayern)

Our employees receive documents for remuneration conversion with the Supplemen- tary Pension Fund directly from the service provider shortly after they are employed (welcome package).

Secondary Employment

The approval notice shall specify the extent of the authorized use. There is no legal claim to the use of facilities, personnel or equipment of the Clinic.

Remuneration for Secondary Employment as a PhysicianWith regard to the remuneration for secondary employment as a physician in the clinical sector, the provisions of sections 17 and 18 BayNV are to be applied.

Basic InformationFor business trips and further training, the prior consent of the Clinic is always required. To do this, you submit a business trip application in duplicate to your superior, together with documents relating to the trip. In the medical service, this is the head physician of the Clinic. For all other professional groups, the respective head of department / nursing director will assess the necessity of the individual action. Once they have agreed, the application is to be forwarded to the anteroom of the work management, where a final decision is made.You will be returned a copy of the approval from which you can see which costs the Clinic will cover. You can find the form on the Intranet under Human Resources Department / Forms. ImportantIf the Clinic covers the course costs, you do not have to transfer these costs yourself. You can bring the invoice to Mrs. Schaumburg in the HR Department, we will then transfer the course costs directly to the organizer. After the Project... you have to file the travel expense report with Mrs. Schaumburg in the HR Department. You will find the form in the same section as the approval form ( HR Department/Forms). This form is sufficient in one copy. Attach all relevant receipts. You will receive the accounting promptly, usually between 1 to 2 weeks after receipt. Important: You have 6 months as of the end of the project for the accounting!!!After these 6 months have expired, no further reimbursement can be made.

Further Training Days for PhysiciansAccording to the German TV doctors / VKA, there is a right to exemption for 3 days. Any days in excess of this must generally be contributed by the employee (e.g. vacation, overtime).

SponsorshipIf a training course is sponsored by a third party, a sponsorship notification is required in addition to the business trip approval. You can find the form in the same section as the other forms (HR Personnel Department/Forms). Any agreements sent by the sponsor are signed by the Head Office.

Training and Business Trips

The BVK supplementary pension scheme ... is the occupational pension scheme for public and church employees.

The employees are insured by the Passau Clinic in the supplementary pension scheme. The benefits of the supplementary pension plan include an age pension or reduced earning capacity pension as well as benefits for surviving dependents. The pension benefits resulting from the supplementary pension scheme stand independently alongside the benefits from the statutory pension insurance or other pension schemes. There is no crediting of other pension benefits.

On 1 January 2002 the supplementary pension scheme was fundamentally changed.The overall pension system in force until then was closed and replaced by a point model in which benefits are promised that would result if a total contribution of 4 % of the remuneration subject to supplementary pension obligations were paid in full into a capital-covered system.Contributions are paid exclusively by the employer. The amount of the contribution depends on the additional pensionable remuneration of the respective employee (§ 62 (2) of the statutes). All employees registered with the supplementary pension fund (ZVK) by us for the first time receive a welcome package from the Bavarian Chamber of Pensions shortly after joining, containing further information on the standard benefits of the ZVK, but also additional offers for personal provision, e.g. in the context of remuneration conversion.

Sickness

The rights and obligations in the event of illness are essentially derived from the Continued Remuneration Act (EntgFG) of 26.05.1994. Here you will find the most important regulations: Notification and Proof Obligations (§ 5 ENTGFG)The employee is obliged to inform the employer immediately of the incapacity for work and its probable duration. If the incapacity for work lasts longer than three calendar days, the employee shall submit a medical certificate confirming the existence of the incapacity for work and its expected duration no later than on the following working day.

The employer is entitled to demand the presentation of the medical certificate earlier. If the inability to work lasts longer than stated in the certificate, the employee is obliged to submit a new medical certificate.

If the employee is a member of a statutory health insurance company, the medical certificate must contain a note from the doctor treating him stating that a certificate of incapacity for work with details of the findings and the expected duration of the incapacity for work will be sent immediately to the health insurance company.

If the employee is staying abroad at the beginning of the incapacity for work, he/she is obliged to notify the employer of the incapacity for work, its probable duration and the address at the place of residence in the fastest possible way. The employer shall bear the costs incurred by the notification.

Furthermore, if the employee is a member of a statutory health insurance company, he/she is also obliged to notify the latter immediately of the incapacity for work and its probable duration.

If the incapacity for work lasts longer than indicated, the employee is obliged to inform the statutory health insurance company of the probable continuation of the incapacity for work. Once an employee who is incapable of working returns to Germany, he/she is obliged to notify the employer and the health insurance company of his/her return immediately.

Duration of Continued PayIf employees are prevented from performing their work due to incapacity to work resulting from sickness, through no fault of their own, they will receive their remuneration for a period of up to six weeks.

In the event of renewed incapacity for work as a result of the same illness and in the event of terminationof the employment relationship, the statutory provisions shall apply.Incapacity for work within the meaning of sentences 1 and 2 shall also be deemed to be an incapacity for work through no fault of one‘s own as a result of a medical prevention and rehabilitation measure within the meaning of § 9 EntgFG.

After expiry of the period referred to in paragraph 1, employees shall receive a sickness allowance equal to the difference between gross sickness benefit and net remuneration for the period for which they receive sickness benefit or equivalent statutory benefits. Net remuneration is the remuneration reduced by the statutory deductions. For voluntarily-insured persons, their total health and long-term care insurance contribution minus employer‘s allowance must be taken into account.

For physicians who are not subject to compulsory insurance under the statutory health insurance scheme because they exceed the annual earnings limit, the maximum sickness benefit rate is used to calculate the sickness benefit supplement, which would be due in the case of compulsory insurance in the statutory health insurance scheme.

The Sickness Allowance is Paid for a Period of Employment» of more than one year up to the end of the 13th week and» of more than three years up to the end of the 39th weekfrom the beginning of the incapacity for work due to the same illness. The period of employment completed during the course of the incapacity to work due to the sickness shall be decisive for the calculation of the periods in accordance with sentence 1.

According to § 257 SGB V, employees who only because they exceed the annual earnings limit are not subject to compulsory health insurance receive a subsidy from their employer for their health insurance contribution, if they are voluntarily insured in the statutory health insurance scheme or are insured with a private health insurance company and receive insurance benefits for themselves and their relatives for whom they are entitled to family support, which correspond to the benefits of statutory health support.

If you are insured against illness and wish to benefit from the aforementioned allowance, you are requested to submit a certificate from your health insurance company to the HR Department as soon as possible.

It must be clear in the certificate of the health insurance company:1. that a voluntary insurance agreement exists and how much the monthly contribution is, and

2. (only in case of employees who are insured with a private health insurance company) whether the health insurance chosen provides for benefits for the employee and his dependants, which must be listed by name, which correspond in nature to the benefits of statutory health assistance (certificate according to § 257 SGB V).

1. Workplace AccidentsAccidents at work that result in an inability to work for more than 3 calendar days must be reported immediately to the HR Department of the hospital.Work-related accidents that occur to colleagues who are unable to make an accident report themselves due to injuries must also be reported immediately.Accidents at work also include accidents on the way to and from the place of work and accidents, which occur outside the workplace in the course of an activity connected with the employment.

2. Accidents Involving Third PartiesAny accident suffered during or outside of work (e.g. traffic accident) caused by another member of the Clinic or another person (third party) and as a result of which an employee of the Clinic has suffered personal injury, must be reported immediately to the Clinic’s HR Department for the purpose of asserting claims for damages.

You will receive your new Clinic ID card when you start work. This card will now probably accompany you every day of the week, around the clock.

You will need the card when you enter the central dressing rooms and during lunch in our dining room. Some employees also need the card when recording their working hours.

In order to keep the card functional for a longer period of time, there are some points to consider:

» Please make sure that the card is not bent or creased. A free protective cover is available at the HR Department.

» Please do not leave the card in your working clothes when you hand it in for washing.

» Please do not pass on the card to third parties.

» The card must be returned to the employer at the end of the employment or training relationship.

If you lose or damage the card, you will have to pay the material costs of € 10 for a new card. However, the credit on the card can be credited back to you.

To recharge the card: You will find recharging machines in the entrance area of the Clinic (opposite the visitor toilets) as well as in the dining room itself. You can recharge the card with banknotes at the machines in the dining room and with your EC card in the entrance area.

If you wish, you will receive a parking card at the start of work in addition to your Clinic ID card, with which you can park in our multi-storey car park at a reduced rate (1 € per 24 hours). You can recharge your parking card at one of the three parking garage machines. These are located in the foyer of the clinic, in the Visitors Park and in the multi-storey car park at the entrance on level 4. Cashless recharging is possibleat the machines in the Visitors Park.

Please observe the following: » Each employee receives only one parking card. » Your parking card is specifically assigned to you via a parking card number. » The parking card may not be passed on to third parties. » For technical reasons a deposit must be charged on the parking card. The deposit of 10 € will be charged to the card at the first credit recharge at the vending machine. Of course the deposit will be refunded when the card is returned. » It is not possible to leave the car park without credit. Therefore please always leave a balance on your card.

It is important to the management that you have quick and uncomplicated access to current and relevant information. That is why the library is made available to you online on the intranet. There you will find an overview of all available journals (online, print or both), databases and books.

A short information (under Miscellaneous) helps you to find your way around the library online and to search there specifically. You will also find basic information about the databases offered there.

Almost all necessary documents, both medical and administrative, are made available to you here. The personal legal liabilities of the Clinic arising from the official duties » of the physicians on duty » of the medical auxiliary staff » of other civil servants, employees and workers and » of the members of the constitutional bodies and the legal representativesare automatically covered by the municipal liability insurance of the city of Passau.

For example, activities, which are carried out as a freelance secondary activity on the basis of a contractual agreement between the insured body and the doctors employed, are not considered as official duties.

The insurer‘s obligation to pay benefits is in general NOT limited at the top for personal injury, property damage and financial losses.

The collectively agreed vacation leave is regulated in § 26 TVöD and § 27 TV-Ärzte/VKA.

If the weekly working time is allocated to 5 days in a calendar week, it is 30 working days in each calendar year.

If the weekly working hours are distributed differently, the holiday entitlement is increased or reduced accordingly. If the employment relationship begins or ends in the course of a year, the doctor (m/f ) receives one twelfth of the holiday entitlement for each month of the employment contract. The annual leave entitlement from two employment contracts is summed up and may not exceed the annual entitlement under the collective agreement, which is why a leave certificate is usually required each time there is a change of employer.

Holiday leave must be granted and taken in the current calendar year. In case of a holiday transfer, the holiday must be taken in the first 3 months of the following calendar year. If the holiday cannot be taken by 31 March due to inability to work or for official reasons, it must be taken up by 31 May. A formal transfer by the HR Director is required for this!

There are also additional holidays for certain activities: 1. one working day for every two consecutive months in the case of alternating shift work 2. one working day per four consecutive months in the case of shift work 3. one working day for every 150 night working hours 4. two working days for at least 288 night hours (21.00 - 06.00 hours) on standby

Each hour can only be included once, e.g. not in parallel for shift work and night work hours.

There are also up to 5 days of additional holiday according to SGB IX in the case of a recognized severe disability.

Recreational Vacation

The Klinikum Passau grants its employees a free afternoon on their birthday.

The details of the scheme: » On their birthday employees are given half of their working time off. (Part-time employees therefore receive a proportionate time-off ). » The maximum number of hours credited is 3.5 hours. » Time off compensation is only granted if the employee actually has to work

(employees who, for example, have their birthday at the weekend and are not working shifts, will not receive time off this year).

» Time off compensation is rounded off to 0.5 hours.

Radiation Protection and X-ray Protection

The Klinikum Passau, as a main hospital, is equipped with the most modern medical equipment and facilities. This also includes equipment and facilities for the generation of ionizing radiation (e.g. X-rays) for a wide range of tasks in diagnostics and therapy. Furthermore, as in the Nuclear Medicine Department, we work with enclosed and open radionuclides.

The premises in which these devices and installations are operated or in which radionuclides are handled are defined as „controlled area“ according to radiation protection legislation.

Mandatory basic conditions apply to this controlled area, which have to be observed by the staff working there in the interest of radiation protection.

These basic conditions include: 1. Occupational medical examination by the occupational physician of the city of Passau 2. Before entering the controlled area for the first time:

Handing out of a personal dosimeter, combined with instruction in radiation protection by Medical Physics Department. 3. In the control area: The appropriate wearing of the personal dosimeter and personal radiation protection clothing is mandatory. 4. Pregnant personnel may not enter the controlled area without prior examination of the field of activity by the Medical Physics Department. 5. Information about the Radiation Protection Officers in the respective department.

The respective Radiation Protection Officers are responsible for compliance with radiation protection in the respective departments.

Within the framework of your job description, check to what extent you need to enter these so-called control areas in order to fulfill your job profile. If you are not able to make this decision on your own, then please seek a clarifying discussion in your new department.
