OVERVIEW OF THE MINI NEW PASSENGER CAR LIMITED WARRANTIES

The MINI limited warranties apply only to U.S.-specification MINI vehicles and cover eligible warranty repairor replacement work when the warranty service is performed at an authorized MINI dealer in the UnitedStates (including Puerto Rico), subject to all applicable exclusions and/or limitations.

*The California Emissions Control System Limited Warranty applies to all 2017 U.S.-specification MINI vehiclesregistered in California, Connecticut, Delaware, Maine, Maryland, Massachusetts, New Jersey, New York, Oregon,Pennsylvania, Rhode Island, Vermont or Washington.

**The California Emissions Control System Limited Warranty also applies to 2017 SULEV (PZEV) models registeredin Delaware, Oregon, Pennsylvania and Washington. The SULEV (PZEV) models registered in California, Connecticut,Maine, Maryland, Massachusetts, New Jersey, New York, Rhode Island and Vermont have different emissionswarranty coverage.

MINI NEW PASSENGER CAR LIMITEDWARRANTY — 2017 MODELS (VALIDONLY IN THE U.S.A. INCLUDINGPUERTO RICO)

WARRANTOR

MINI USA, a division of BMW of North America, LLC(“MINI USA”) warrants during the Warranty Periodthe 2017 U.S.-specification MINI vehicles distributedby MINI USA against defects in materials orworkmanship to the first retail purchaser, and eachsubsequent purchaser.

WARRANTY BEGINS

Coverage begins on the date of first retail sale, or thedate the vehicle is first placed into service as a salesdemonstrator, Aftersales Mobility Program (AMP)Vehicle or company vehicle, whichever is earlier.

WARRANTY PERIOD

The warranty period is 48 months or 50,000 miles,whichever occurs first, except as noted below.

WARRANTY COVERAGE

To obtain warranty service coverage, the vehicle mustbe brought, upon discovery of a defect in material orworkmanship, to the workshop of any authorizedMINI dealer in the United States (including PuertoRico) during normal business hours.

The authorized MINI dealer will, without charge forparts and labor (including diagnosis), either repair orreplace the defective part(s) using new or authorizedremanufactured parts. The decision whether to repairor replace said part(s) is solely the prerogative ofMINI USA. Parts for which replacements are madebecome the property of MINI USA. In all cases, areasonable time must be allowed for warranty repairsto be completed after the vehicle is received by theauthorized MINI dealer.

Warranty repairs do not constitute an extension ofthe original limited warranty period for the vehicle ora part thereof.

SAFETY BELT WARRANTY - KANSAS

Safety belts are covered under the MINI NewPassenger Car Limited Warranty for defects inmaterial or workmanship for a period of 10 years,unlimited mileage from the date of purchase. In orderto be eligible for this coverage, the vehicle must be anew vehicle retailed in the State of Kansas and therepair must be performed by an authorized MINIdealer in Kansas.

OTHER ITEMS

Wheel alignment, balancing and wiper blade insertsare covered up to the first 2,000 miles on the vehicle.

Items which are subject to wear and tear ordeterioration due to driving habits or conditions,such as brake pads/linings, brake discs, clutch disc,pressure plate, filters, upholstery, trim and chromeitems, paint finish, drive belts, glass, and similaritems, their coverage is specifically limited todefects in material or workmanship.

Additionally, wood trim and leather upholstery haveinherent variations in color and texture, dependentupon being properly cleaned and maintained. Theseitems may lighten or darken due to age or exposureto sunlight; this is not a defect in materials orworkmanship.

Battery performance and durability is temperature-dependent. While battery capacity increases inhigher temperatures, colder temperatures will lowerthe battery’s capacity. Extreme high and/or lowtemperatures may impact the battery’s service life.

What is not covered:

Remote control transmitter battery replacement.

Damage, including consequential, which results fromnegligence, misuse/improper operation of the vehicle,improper repair, lack of or improper maintenance,environmental influences, flood, accident or firedamage, road salt corrosion, or the use of improperfuel as described in the Owner’s Manual orcontaminated fuel.

Damage to the engine, transmission or any relatedcomponent caused by improper shifting of thetransmission.

Damage to the paint finish due to stone chips, nicks,dents, acid rain, industrial fallout, otherenvironmental influences, and normal deterioration,such as fading, discoloration, or loss of luster,improper care/repair of “matte” paint finishes, as wellas damage caused by lack of maintenance, excessiverubbing, the use of improper cleaners, polishesand/or waxes.

Maintenance services and parts when replaced duringmaintenance such as spark plugs, lubricants, fluids,engine tune-up parts, replacement of filters, coolant,and refrigerant.

Modification of the vehicle or installation of anyperformance accessories or components attached tothe vehicle which alters the original engineeringand/or operating specifications or which results indamage to the other original components, electricalinterference, electrical short, radio static, water leaks,or wind noise.

Tires are warranted by their respective manufacturer.See the Tire Warranty Statement on page 19.

Driving over rough or damaged road surfaces, aswell as debris, curbs and other obstacles can causeserious damage to wheels, tires and suspensionparts. This is more likely to occur with low-profiletires that provide less cushioning between the wheeland the road. Be careful to avoid road hazards andreduce your speed, especially if your vehicle isequipped with low-profile tires.

Non-genuine MINI Parts – While you may elect to usenon-genuine MINI parts for maintenance or repairservices, the MINI Division is not obligated to pay forrepairs of the non-genuine MINI parts or for repairsof any damage resulting from the use of non-genuineparts.

This warranty shall be null and void for specificvehicle components that were previously replacedwith used or salvaged automobile parts.

This warranty shall be null and void if the odometerhas been replaced or altered and the true mileage onthe vehicle cannot be determined, and/or the VehicleIdentification Number (VIN) is altered and/or cannotbe determined.

This warranty shall be null and void if the vehicle hasbeen declared a total loss or sold for salvagepurposes, or if the vehicle has been used in anycompetitive event.

GENERAL

These warranties give you specific legal rights, andyou may also have other rights which vary from stateto state.

THE DURATION OF ANY IMPLIED WARRANTIES,INCLUDING THE IMPLIED WARRANTY OFMERCHANTABILITY, IS LIMITED TO THEDURATION OF THE EXPRESS WARRANTIESHEREIN.

MINI USA, A DIVISION OF BMW OF NORTHAMERICA, LLC HEREBY EXCLUDES INCIDENTALAND CONSEQUENTIAL DAMAGES, INCLUDING LOSSOF TIME, INCONVENIENCE, OR LOSS OF USE OFTHE VEHICLE, FOR ANY BREACH OF ANY EXPRESSOR IMPLIED WARRANTY, INCLUDING THEIMPLIED WARRANTY OF MERCHANTABILITY,APPLICABLE TO THIS PRODUCT.

Some states do not allow limitations on how long animplied warranty lasts, or the exclusion or limitationof incidental or consequential damages, so the abovelimitations and exclusions may not apply to you.

LIMITED WARRANTY – RUSTPERFORATION 2017 MODELS

MINI USA, a Division of BMW of North America, LLCwarrants this original vehicle against defects inmaterials or workmanship which will result in rustperforation of the vehicle body for a period of12 years unlimited mileage. Coverage begins on thedate of first retail sale or the date the vehicle is firstplaced into service as a sales demonstrator,Aftersales Mobility Program (AMP) Vehicle orcompany vehicle, whichever is earlier.

To obtain warranty service coverage, the vehicle mustbe brought, upon discovery of any rust perforation, tothe workshop of any authorized MINI dealer. Theauthorized MINI dealer will, without charge for partsor labor, either repair or replace the defective part(s).The decision whether to repair or replace said part(s)is solely the prerogative of MINI USA, a Division ofBMW of North America, LLC. Parts for whichreplacements are made become the property of MINIUSA.

Warranty repairs do not constitute an extension ofthe original limited warranty period for the vehicle ora part thereof.

MINI USA, a Division of BMW of North America, LLCmakes no other express warranty on this productexcept for the new vehicle warranty, rust perforationor the emission system warranties.

Some states do not allow limitations on how long animplied warranty lasts, or the exclusion or limitationof incidental or consequential damages, so the abovelimitations and exclusions may not apply to you.

This warranty gives you specific legal rights, and youmay also have other rights which vary from state tostate. Any legal claim or action arising from anyexpress or implied warranty contained herein mustbe brought within 12 months of the date it arises.

WHAT IS NOT COVERED

This warranty does not apply to damage, includingconsequential, which results from negligence,misuse/improper operation of the vehicle, improperrepair, lack of or improper maintenance,environmental influences, flood, accident or firedamage and road salt corrosion.

Non-genuine BMW Parts—While you may elect touse non-genuine BMW parts for repair services,BMW NA is not obligated to pay for repairs of thenon-genuine BMW parts or for repairs of any damageresulting from the use of non-genuine parts.

This warranty shall be null and void for specificvehicle components that were previously replacedwith used or salvaged automobile parts.

This warranty shall be null and void if the odometerhas been replaced or altered and the true mileage onthe vehicle cannot be determined, and/or the VehicleIdentification Number (VIN) is altered and/or cannotbe determined.

FEDERAL EMISSIONS SYSTEMDEFECT WARRANTY (VALID ONLY INTHE U.S.A. INCLUDING PUERTO RICO)

This limited warranty applies only to U.S.-specification vehicles distributed by MINI USA, aDivision of BMW of North America, LLC.

In accordance with the defect warranty provisions ofsection 207(b) of the Clean Air Act, MINI warrants tothe first retail purchaser, and each subsequentpurchaser, that the passenger car: (a) was designed,built and equipped so as to conform, at the time ofsale, with all regulations of the U.S. EnvironmentalProtection Agency applicable at the time ofmanufacture; and (b) is free from defects in materialsand workmanship which would cause it to fail toconform with applicable regulations for a period of2 years or 24,000 miles, whichever occurs first,except for specific emission control components (aslisted on page 8), for which the warranty period is8 years or 80,000 miles, whichever occurs first.

Coverage begins on the date of first retail sale or thedate the vehicle is first placed into service as a salesdemonstrator, Aftersales Mobility Program (AMP)Vehicle or company vehicle, whichever is earlier.

Warranty claims must be made as soon as reasonablypossible after a defect is discovered. To make a claim,the car must be brought to any authorized MINIdealer during normal business hours.

The authorized MINI dealer will, without charge forparts and labor (including diagnosis), either repair orreplace the defective part, if any. The decisionwhether to repair or replace said parts is solely theprerogative of MINI USA, a Division of BMW of NorthAmerica, LLC and must be expected to correct thefailure of the warranted part. Parts for whichreplacements are made become the property of MINIUSA. In all cases, a reasonable time must be allowedfor warranty repairs to be completed after the car isreceived by the authorized MINI dealer.

Warranty repairs do not constitute an extension ofthe original limited warranty period for the vehicle ora part thereof.

It is the owner’s responsibility to have all scheduledinspection and maintenance services performed (at

the owner’s expense when applicable), as prescribedin the maintenance schedule for the MINI EmissionControl System. Service intervals are computed by theonboard MINI Condition Based Service system anddisplayed on the instrument panel. The instructionsfor proper maintenance and use can be found in theOwner’s Manual. It is strongly recommended that anyreplacement parts used for maintenance, repair orreplacement of emission control systems be certifiedMINI Service Parts or MINI AuthorizedRemanufactured Parts. Without invalidating thiswarranty, the owner may elect to have maintenance,repair or replacement of the emission control systemsperformed by any automotive repair establishment, orelect to use parts other than certified MINI ServiceParts. However, the cost of such service or parts willnot be covered under this warranty, except inemergency situations. In an emergency situation,where an authorized MINI dealer or a warrantyreplacement part is not reasonably available (within30 days), repairs may be performed at any availableservice establishment using any equivalent part. MINIUSA, a Division of BMW of North America, LLC willreimburse the owner for such emergency repairs(including labor, parts and diagnosis not to exceedMINI USA’s rates for labor, parts, and diagnosis insaid area) that are covered under this warranty.Replaced parts and paid invoices must be presentedat an authorized MINI dealer as a condition ofreimbursement for emergency repairs not performedby an authorized MINI dealer.

The use of replacement parts, which are not ofequivalent quality, may impair the effectiveness ofthe emission control system. If other than certifiedMINI Service Parts or MINI AuthorizedRemanufactured Parts are used for maintenance,repair or replacement of components affectingemission control, the owner should obtain assurancesthat such parts are warranted by their manufacturerto be equivalent to genuine MINI parts inperformance and durability. MINI USA, a Division ofBMW of North America, LLC assumes no liabilityunder this warranty with respect to parts other thangenuine MINI parts.

However, the use of non-genuine MINI replacementparts or non-EPA certified parts does not invalidatethe warranty on other components, unless non-genuine MINI parts or non-EPA certified parts causedamage to warranted parts.

WHAT IS NOT COVERED

The car or any part of the car, unless the failurecauses the car to fail to conform to the applicableemission regulations.

Malfunctions, including consequential, caused bynegligence, misuse/improper operation of the vehicle,environmental influences, flood, accident or firedamage.

Malfunctions, including consequential, caused byimproper adjustment/repair, modification, alteration,tampering, disconnection, improper or inadequatemaintenance except if one or more of these occurredas a result of repair work that was performed by anauthorized BMW center under warranty.

For gasoline engines, malfunctions caused by the useof leaded fuel or fuels containing more than 10%ethanol, or other oxygenates with more than 2.8%oxygen by weight (i.e., more than 15% MTBE or morethan 3% methanol plus an equivalent amount ofco-solvent and/or as specified in the Owner’sManual).

Spark plugs, filters, and similar maintenance itemsare not covered under this warranty at or beyond thefirst replacement interval, or if the part has beenreplaced earlier for reasons other than it beingdefective.

Any car on which the odometer has been replaced oraltered and the true mileage cannot be determined.

Any car on which the Vehicle Identification Number(VIN) is altered and/or cannot be determined.

For the Federal Emissions Warranty, "null and void"only applies when it is determined that the vehicle’stotal loss, being sold for salvage purposes or its use incompetitive events “directly” caused the vehicle tonot comply with an applicable emission standardand/or caused emission-relevant part(s) to fail.

FEDERAL EMISSION PERFORMANCEWARRANTY (VALID ONLY IN THEU.S.A. INCLUDING PUERTO RICO)

In those states and jurisdictions that have establishedperiodic vehicle emissions tests to encourage propervehicle maintenance and require the vehicle to passan emissions test approved by the U.S. EnvironmentalProtection Agency and:

1. The passenger car was distributed by MINI USA,a Division of BMW of North America, LLC; and

2. The car has been maintained and operated inaccordance with the instructions for propermaintenance and use set forth in the Owner’sManual supplied with the car; and

3. The car fails to conform to the applicableemissions standards of the EPA as judged by anEPA-approved emissions test; and

4. The failure to conform results or will result inthe owner of the car having to bear a penalty orother sanction (including the denial of the rightto use the car) under local, state or federal law ifthe non-conformity is not remedied within aspecified period of time.

Then, in accordance with the provisions of section207(b) of the Clean Air Act, MINI USA, a Division ofBMW of North America, LLC warrants that if the caris eligible for coverage under this warranty, anynon-conformities in the car, which cause it to fail anEPA-approved emissions test will, without charge forparts or labor (including diagnosis), be adjusted,repaired, or replaced, at the option of MINI USA, aDivision of BMW of North America, LLC to properspecifications, in order to make the car comply withapplicable emissions standards. The decision whetherto adjust, repair or replace parts is solely theprerogative of MINI USA and must reasonably beexpected to correct the failure of the warranted part.

Coverage begins on the date of first retail sale, or thedate the vehicle is first placed into service as a salesdemonstrator, Aftersales Mobility Program (AMP)Vehicle or company vehicle, whichever is earlier. Thislimited warranty continues for a period of 2 years or24,000 miles, whichever occurs first, except forspecific emissions control components (as listed onpage 8), for which the warranty period is 8 years or80,000 miles, whichever occurs first.

This limited warranty is made subject to the termsand conditions that apply to the Emission ControlSystem Warranty and the MINI New Passenger CarLimited Warranty.

Warranty repairs do not constitute an extension ofthe original limited warranty period for the vehicle ora part thereof.

No claim under this warranty will be denied on thebasis of use of a properly installed EPA-certifiedemission part for maintenance and repair.

A vehicle manufacturer may deny an emissionperformance warranty claim on the basis of anuncertified replacement part used in the maintenanceor repair of a vehicle only if the vehicle manufacturerpresents evidence that the uncertified replacementpart is either defective in materials or workmanshipor not equivalent from an emission standpoint to theoriginal equipment part.

Maintenance, replacement, or repair of emissioncontrol devices and systems may be performed byany automotive repair establishment or individualusing any certified part.

Immediately after the car has failed an EPA-approvedemission short test, your claim can be made at anyauthorized MINI dealer. The authorized MINI dealerwill honor or deny your claim within the time periodspecified by local or state laws (not to exceed30 days), to avoid further penalties or sanctions. Ifthe claim is denied, the authorized MINI dealer willnotify you in writing of the reason(s). The authorizedMINI dealer is required by law to honor the claim ifnotice of denial is not received by the owner withinthe specified time period.

MANUFACTURER’S WARRANTYCOVERAGE:– For 3 years or 50,000 miles, whichever occurs first:

1. If your vehicle fails a Smog Check inspection, allnecessary repairs and adjustments will be madeby MINI USA to ensure that your vehicle passesthe inspection. This is your emission controlsystem PERFORMANCE WARRANTY.

2. If any emission-related part on your vehicle isdefective, the part will be repaired or replaced byMINI USA. This is your short-term emissioncontrol system DEFECTS WARRANTY.

– For 7 years or 70,000 miles, whichever occurs first:

If an emission-related part specially noted on page 13as having coverage for 7 years or 70,000 miles isdefective, the part will be repaired or replaced byMINI USA. This is your long-term emission controlsystem DEFECTS WARRANTY.

Warranty repairs do not constitute an extension ofthe original limited warranty period for the vehicle ora part thereof.

OWNER’S WARRANTY RESPONSIBILITIES:– As the vehicle owner, you are responsible for the

performance of the required maintenance listed inyour Maintenance booklet. MINI USA recommendsthat you retain all receipts covering maintenanceon your vehicle, but MINI USA cannot denywarranty solely for the lack of receipts or for yourfailure to ensure the performance of all scheduledmaintenance.

To obtain service under this warranty, the vehiclemust be brought, upon failure of a Smog Check test orupon discovery of the defect, to the workshop of anyauthorized MINI dealer, during normal businesshours. The authorized MINI dealer will honor or denyyour claim within 30 days. If the claim is denied, theauthorized MINI dealer will notify you in writing ofthe reason(s). The authorized MINI dealer is requiredby law to honor the claim if notice is not given to theowner within 30 days.

The authorized MINI dealer will, without charge forparts or labor (including diagnosis), either adjust,repair or replace the defective part and other partsaffected by the failure of the warranted part, if any. Ifyour vehicle failed the California Smog Check test oran EPA-approved short test, then MINI USA willrepair your vehicle so that it will pass this test. Itemsthat require scheduled replacement are warranted upto their first replacement interval. MINI USA mayrepair a part in lieu of replacing it when performingwarranty repairs. Parts for which replacements aremade become the property of MINI USA. After 3 yearsor 50,000 miles, and in accordance with paragraph(c) above, such repairs are limited to the repair orreplacement of those parts identified in the CaliforniaEmission Control System Limited Warranty List.

Vehicles sold in California are also subject to Federalemission warranty provisions that run concurrently.For California vehicles, the specific emission controlcomponents listed on page 8 are also covered underthe Federal Emission System Defect Warranty of8 years or 80,000 miles, whichever occurs first.

If, within 7 years or 70,000 miles, whichever occursfirst, the vehicle fails a Smog Check because of adefect in a part listed in the California EmissionWarranty Parts List on page 13, repair or replacementwill be performed under this warranty.

A repair performed as the result of a Smog Check testfailure due to a defect in a part, which is warrantedfor 7 years or 70,000 miles, is covered.

Warranty repairs do not constitute an extension ofthe original limited warranty period for the vehicle ora part thereof.

In all cases, a reasonable time, not to exceed 30 days,must be allowed for a warranty repair to becompleted, after the car is received by the authorizedMINI dealer.

However, MINI USA will not deny your warrantyrepair claims solely because you do not havemaintenance records or you did not perform therequired maintenance unless MINI USA demonstratesthat such lack of required maintenance is a directcause of the emission control system failure. Theinstructions for required maintenance and use can befound in the Owner’s Manual and in the MINIMaintenance Booklet.

It is strongly recommended that any replacementparts used for maintenance, repair or replacement ofemission control systems be genuine MINI ServiceParts or MINI Authorized Remanufactured Parts.Without invalidating this warranty, the owner mayelect to have maintenance, repair or replacement ofthe emission control systems performed by anyautomotive repair establishment, or elect to use parts

other than MINI Authorized Remanufactured orgenuine MINI Service Parts. However, the cost ofsuch service or parts will not be covered under thiswarranty, except in emergency situations. In anemergency situation, where an authorized MINIdealer is not reasonably available or a warrantyreplacement part is not available within 30 days,repairs may be performed at any available serviceestablishment or by any individual using anyreplacement part.

A repair not completed within 30 days constitutes anemergency. MINI USA, a Division of BMW of NorthAmerica, LLC will reimburse the owner for suchemergency repairs (including labor, parts anddiagnosis not to exceed MINI suggested retail pricefor all warranted parts replaced and labor chargesbased on the manufacturer’s recommended timeallowance for the warranty repair and thegeographically appropriate hourly labor rate) that arecovered under this warranty. Replaced parts and paidinvoices must be presented to an authorized MINIdealer as a condition of reimbursement foremergency repairs not performed by an authorizedMINI dealer.

Certain 2017 MINI Cooper models are certified toCalifornia’s stringent Super Ultra Low EmissionVehicle (SULEV) standards and also qualify as aPartial Zero Emission Vehicle (PZEV) under theCalifornia Air Resources Board Zero Emission Vehicleprogram. In addition to very low tailpipe andzero-evaporative emissions, this PZEV certificationincludes a unique warranty when the vehicle isregistered in California, Connecticut, Maine,Maryland, Massachusetts, New Jersey, New York,Rhode Island or Vermont. The SULEV (PZEV) modelsregistered in Delaware, Oregon, Pennsylvania andWashington are covered by the California EmissionsWarranty; this coverage is described beginning onpage 9.

To obtain service under this warranty, the vehiclemust be brought, upon failure of a Smog Check test orupon discovery of the defect, to the workshop of anyauthorized MINI dealer, during normal businesshours. The authorized MINI dealer will honor or denyyour claim within 30 days. If the claim is denied, theauthorized MINI dealer will notify you in writing ofthe reason(s). The authorized MINI dealer is requiredby law to honor the claim if notice is not given to theowner within 30 days.

The authorized MINI dealer will, without charge forparts or labor (including diagnosis), either adjust,repair or replace the defective part and other partsaffected by the failure of the warranted part, if any. Ifyour vehicle failed the California Smog Check test oran EPA-approved short test, then MINI USA willrepair your vehicle so that it will pass this test. Itemsthat require scheduled replacement are warranted upto their first replacement interval. MINI USA mayrepair a part in lieu of replacing it when performingwarranty repairs. Parts for which replacements aremade become the property of MINI USA.

A repair performed as the result of a Smog Check testfailure due to a defect in a part, which is warrantedfor 15 years/150,000 miles, is covered.

Warranty repairs do not constitute an extension ofthe original limited warranty period for the vehicle ora part thereof.

In all cases, a reasonable time, not to exceed 30 days,must be allowed for a warranty repair to becompleted, after the car is received by the authorizedMINI dealer.

It is the owner’s responsibility to have all requiredmaintenance services performed (at the owner’sexpense when applicable), as prescribed in themaintenance schedule for the MINI Emission ControlSystem. Service intervals are computed by theCondition Based Service system and displayed on theinstrument panel.

However, MINI USA will not deny your warrantyrepair claims solely because you do not havemaintenance records or you did not perform therequired maintenance unless MINI USA demonstratesthat such lack of required maintenance is a directcause of the emission control system failure. Theinstructions for required maintenance and use can befound in the Owner’s Manual and in the MINIMaintenance booklet.

It is strongly recommended that any replacementparts used for maintenance, repair or replacement ofemission control systems be genuine MINI ServiceParts or MINI Authorized Remanufactured Parts.

Without invalidating this warranty, the owner mayelect to have maintenance, repair or replacement ofthe emission control systems performed by anyautomotive repair establishment, or elect to use partsother than MINI Authorized Remanufactured orgenuine MINI Service Parts. However, the cost ofsuch service or parts will not be covered under thiswarranty, except in emergency situations. In anemergency situation, where an authorized MINIdealer is not reasonably available or a warrantyreplacement part is not available within 30 days,repairs may be performed at any available serviceestablishment or by any individual using anyreplacement part.

A repair not completed within 30 days constitutes anemergency. MINI USA will reimburse the owner forsuch emergency repairs (including labor, parts anddiagnosis not to exceed MINI suggested retail pricefor all warranted parts replaced and labor chargesbased on the manufacturer’s recommended timeallowance for the warranty repair and thegeographically appropriate hourly labor rate) that arecovered under this warranty. Replaced parts and paidinvoices must be presented to an authorized MINIdealer as a condition of reimbursement foremergency repairs not performed by an authorizedMINI dealer.

The use of replacement parts, which are not ofequivalent quality, may impair the effectiveness ofemission control systems. If other than genuine MINIService Parts or Authorized Remanufactured Partsare used for maintenance, repair or replacement ofcomponents affecting emission control, the ownershould obtain assurances that such parts arewarranted by their manufacturer to be equivalent togenuine MINI parts in performance and durability.MINI USA assumes no liability under this warrantywith respect to parts other than genuine MINI parts.

However, the use of non-genuine MINI replacementparts does not invalidate the warranty on othercomponents, unless non-genuine MINI parts causedamage to warranted parts.

WHAT IS NOT COVERED

This warranty does not cover malfunctions caused byany of the following: accident, flood, misuse,modification, alteration, tampering, disconnection,improper or inadequate maintenance, except ifperformed by an authorized MINI dealer doingwarranty repair work, use of leaded fuel or fuel otherthan as specified in the Owner’s Manual.

Spark plugs, filters, and similar maintenance itemsare not covered under this warranty at or beyond thefirst replacement interval.

Any car on which the odometer has been replaced oraltered and the true mileage cannot be determined.

Any car on which the Vehicle Identification Number(VIN) is altered and/or cannot be determined,declared a total loss and/or sold for salvage purposes.

The warranty gives you specific legal rights, and youmay also have other rights which vary from state tostate.

TIRE WARRANTY STATEMENT

Original equipment tires on new MINI vehicles arewarranted by their respective manufacturer asdetailed in the applicable tire manufacturer’swarranty statement.

The CD ROM MINI provides in the vehicle’sdocuments portfolio contains the warrantystatements for the following original equipment tiremanufacturers (as applicable to your vehicle):

� Bridgestone/Firestone

� Continental

� Goodyear/Dunlop

� Hankook

� Michelin

� Pirelli

The terms and conditions of the tire manufacturers’warranties are independently determined by the tiremanufacturers without input from MINI. Werecommend either contacting or visiting the specifictire manufacturer’s website to ensure that you havethe most current warranty information that applies toyour tires.

Should you have difficulty in obtaining the applicablewarranty service from a tire manufacturer, yourauthorized MINI dealer will assist you in resolvingthe situation.

Instructions for proper tire care and maintenance arecontained in the Wheels and Tires section of yourvehicle’s Owner’s Manual.

BATTERY CARE

Battery posts, terminals and relatedaccessories contain lead and lead compounds;

chemicals known to the State of California to causecancer.

If your car is driven only for short distances of lessthan 10 miles over a prolonged period of time,without an occasional drive at highway speeds, theengine’s charging system will not maintain thebattery. Insufficient use of the vehicle could result inshort-term starting problems and in the long termcould damage the battery.

In case the car will not be operated for more thanfour weeks, it is advisable to:� consider using a proper trickle charger, following

the charger manufacturer’s instructions, tomaintain the battery’s state of charge; or

� consult your authorized MINI dealer or anotherqualified service center regarding battery removal.Once removed, the battery must be charged andstored in a cool, dry place where it can beprotected from freezing. If the battery will bestored for over 3 months, it must be rechargedevery 3 months, or else it will become damagedand useless.

Please consult with your authorized MINI dealer oranother qualified service center for further guidanceand information.

CORROSION PROTECTION

Extensive corrosion protection measures now make itpossible to offer a 12-year unlimited mileageanti-corrosion warranty against rust perforation onyour vehicle provided that the vehicle is properlymaintained. Information on proper maintenance isavailable in this Booklet and your vehicle’s Owner’sManual.

The major degree of corrosion protection is due tothe electrophoretic dip painting process whichcathodically deposits paint particles on all body parts,attracting paint particles into the minutest cavities orseams. Body parts are designed to provide optimumcorrosion protection.

During manufacture, exterior body parts receive anadditional corrosion protection coat. Hood, trunk,doors and other body parts with metal folds arecoated with PVC and sealed from the outside.

All floor panels receive a resilient coating of PVC formaximum protection against damage due to stones,etc.

Corrosion protection materials tested over manyyears are applied to the surfaces of cavities and to theentire underside of the vehicle during and afterassembly.

RESTORING CORROSION PROTECTION

Please take care that anti-corrosion material isreplaced when your car is repaired after body orchassis damage.

UNDERBODY MAINTENANCE

The underbody has to be cleaned at least once a year,in Spring, with plain water in order to remove mud,chemical sediments and other deposits. If thosematerials are not removed, corrosion (rust) will occur.

MINI recommends that your authorized MINI dealerperform this anti-corrosion service for you.

Do not apply additional undercoating orrust-proofing on or near the exhaust manifold,exhaust pipes, catalytic converter or heat

shields. During driving, the substance used forundercoating could overheat and cause a fire.

FUEL QUALITY — GASOLINE

Use fuels advertised to have adequate detergency andlow alcohol (such as ethanol) content. Please refer toyour Owner’s Manual for important information onthe fuel recommended for use in your vehicle. Use offuels with insufficient detergent and/or excessalcohol can cause driveability problems thatnecessitate cleaning intake valves and fuel injectionvalves, and, when applicable, adjusting the engineidle. We recommend having this work performed byyour authorized MINI dealer or another qualifiedservice center, perhaps while regular maintenance isperformed. Your authorized MINI dealer can alsorecommend a gasoline additive that will providesufficient detergency. This recommended,unscheduled maintenance, which may benecessitated by use of inappropriate fuels, is notrequired in order to maintain the emission warranty.It also is not covered by your vehicle’s warrantybecause no defect in material or workmanship orcomponent failure is involved.

CUSTOMER ASSISTANCE - NOTIFICATION

During a specific period (for example, the earlier of12 months or 12,000 miles, though this period variesby state), some states require us or our authorizedMINI dealer to repair in a reasonable number ofattempts, any defect or condition which substantiallyimpairs the use, value, or safety of a new vehicle sold,leased or registered in that state.

A “reasonable number of attempts” is generallydefined as: (i) four or more attempts to repair thesame defect (the number of attempts vary by state) or(ii) the vehicle is out of service by reason of one ormore repair(s) for more than a cumulative total of30 days (this period varies by state), except for delayscreated by conditions beyond our control.

If we are unable to correct a defect or conditioncovered by these statutes in a reasonable number ofattempts, we may be obligated either to replace thevehicle or reimburse the owner/lessee in an amountequal to the purchase price or lease payments paid bythe owner/lessee, less the amount directlyattributable to use of the vehicle by the owner/lessee.

If it is assumed that the manufacturer or yourdealer cannot repair or correct the defect and ifthe same defect continues to substantially existafter that the manufacturer has received a noticeof the defect, sent by certified mail with returnreceipt, and has had a final chance to correct thedefect or condition within 10 days of receivingthe notice. This notice must be received by themanufacturer within the terms of protection andcan only be given after (i) the manufacturer oryour dealer has attempted two or more times tocorrect the defect; (ii) the manufacturer or yourdealer has attempted, at least once, to correctthe defect if the defect is one which can causedeath or serious bodily injury if the vehicle isoperated; or (iii) the vehicle has been out ofservice for repairs by a total of 20 calendar daysaccumulation or more, or in the case of a rollingmotorized house (motorhome) 45 days or more.

4. If the same defect substantially continues toexist after the manufacturer has had the lastopportunity to repair or correct the defect, youmay file a claim for compensation under the NewJersey lemon law.

BBB AUTO LINE will notify you when your claim hasbeen filed. If you decide to arbitrate, you may attendthe hearing in person or by telephone. You may bringwitnesses and give supporting evidence. You mayalso submit your claim in writing and ask for adecision on the documents you submit, withoutattending a hearing. BBB AUTO LINE will usuallyrender a decision within 40 days from the time youfile your complaint. The decision is binding on MINIif you decide to accept it. MINI must comply with thedecision within the time frame specified by thearbitrator.

3. To file a claim with BBB AUTO LINE, call1 800 955-5100. There is no charge for the call.

4. In order to file a claim with BBB AUTO LINE, youwill have to provide your name and address, thebrand name and Vehicle Identification Number(VIN) of your vehicle, and a statement of thenature of your problem or complaint. You willalso be asked to provide: the approximate dateof your acquisition of the vehicle, the vehicle’scurrent mileage, the approximate date andmileage at the time any problem(s) were firstbrought to the attention of MINI or one of ourdealers, and a statement of the relief you areseeking. There is no charge to the customer inbringing this claim.

5. BBB AUTO LINE staff may try to help resolveyour dispute through mediation. If mediation isnot successful, or if you do not wish toparticipate in mediation, claims within theprogram’s jurisdiction may be presented to anarbitrator at an informal hearing. The arbitrator’sdecision should ordinarily be issued within40 days from the time your complaint is filed;there may be a delay of 7 days if you did not firstcontact MINI about your problem, or a delay ofup to 30 days if the arbitrator requests aninspection/report by an impartial technicalexpert or further investigation and report byBBB AUTO LINE.

California Civil Code Section 1793.3(d) requiresthat, if MINI or its representative is unable torepair a new motor vehicle to conform to thevehicle’s applicable express warranty after areasonable number of attempts, BMW NA may berequired to replace or repurchase the vehicle.California Civil Code 1793.22(b) creates apresumption that MINI has had a reasonablenumber of attempts to conform the vehicle to itsapplicable express warranties if, within18 months from delivery to the buyer or18,000 miles on the vehicle’s odometer,whichever occurs first, one or more of thefollowing occurs:

• The same nonconformity [a failure to conformto the written warranty that substantiallyimpairs the use, value or safety of the vehicle]results in a condition that is likely to causedeath or serious bodily injury if the vehicle isdriven AND the nonconformity has been subjectto repair two or more times by MINI or itsagents AND the buyer or lessee has directlynotified MINI of the need for the repair of thenonconformity; OR

• The same nonconformity has been subject torepair 4 or more times by MINI or its agentsAND the buyer has notified MINI of the needfor the repair of the nonconformity; OR

• The vehicle is out of service by reason of repairof nonconformities by MINI or its agents for acumulative total of more than 30 calendar daysafter delivery of the vehicle to the buyer.

SERVICES

DISPATCH SERVICE

A service provider will be dispatched to the site ofyour disabled vehicle.

ON-SITE ASSISTANCE

On-site service for vehicle disablements, such as flattires, dead batteries, and out of fuel conditions, isprovided by MINI Roadside Assistance.

The cost for parts and fuel, when used on-site, is theresponsibility of the owner/driver. The MINI NewPassenger Car Limited Warranty does not cover anyof the above on-site services.

LOCK-OUT

Please contact MINI Roadside Assistance for lock-outsituations. MINI Roadside Assistance will attempt toreunite the owner with a spare key by callingsomeone at the customer’s residence or by sending ataxicab to pick you up. (Cost of the taxi is notreimbursable.) Be sure the vehicle is in a safe locationin the above situations. As a last resort, we will haveyour MINI towed to a dealership. The authorizedMINI dealership can assist with key replacement.Towing services will be provided up to a maximum of$100.00 per incident. The cost for replacement keysis the responsibility of the owner/driver.

TOWING SERVICE

In the event of a mechanical breakdown normallycovered under the MINI New Passenger Car LimitedWarranty, your vehicle will be transported (at no cost)to the nearest authorized MINI dealer, or to theauthorized MINI dealer of your choice, provided thatthe dealer is within a 50-mile radius of the closestdealer. Towing to the nearest authorized MINI dealeris also covered in the event of an accident orcollision.

If a breakdown occurs after normal business hours,your vehicle will be transported to a secure locationand transported to the nearest authorized MINIdealer on the next business day.

If you request that the vehicle be taken to a locationother than the nearest authorized MINI dealer, anyadditional expense will be your responsibility.

Towing requests for vehicles disabled because ofcasualty, fire, act of God, acts of war (declared orundeclared), or violation of law (federal, state or local)are accepted at the expense of the owner/driver.

If it is necessary for you to have your vehicle towedthrough your own arrangements, you must contactMINI Roadside Assistance for prior authorizationand instructions on claim procedures. All claimsmust be submitted within sixty (60) days of thedisablement or occurrence, accompanied by theoriginal receipts. Claims received after that timeperiod may not be honored and are subject to the fulldiscretion of MINI Roadside Assistance. If MINIRoadside Assistance is not contacted for “prior”authorization, the maximum coverage for towingsituations is $50.00.

SIGN-AND-DRIVE

In most instances, services provided under the MINIRoadside Assistance Program do not requireimmediate payment.

Usually, you will be able to sign a receipt, so theprovider of the service can be reimbursed directly byMINI Roadside Assistance.

Parts, materials, and fuel should be paid for by youdirectly to the provider of the services.

TRIP INTERRUPTION BENEFITS

Trip interruption benefits are provided formechanical breakdowns as follows:� Breakdowns that are warranty related; and,

� Must occur in excess of 100 miles from thedriver’s primary residence; and,

� Repairs cannot be completed during normalbusiness hours on the same day of breakdown.

Reimbursements will be made for meals, lodging, carrentals, and alternate transportation to bring thedriver and the MINI passenger car together after thevehicle has been repaired by an authorized MINIdealer. Original receipts and a copy of the vehiclerepair order must accompany all reimbursementrequests.

Trip interruption coverage is limited to $1,000.00per incident, for a maximum of five days per incident.

Always contact MINI Roadside Assistance for tripinterruption benefits. They will assist in making allthe necessary arrangements.

EXCLUSIONS

Specifically excluded from coverage are:� Fines, taxes, or impound towing fees caused by a

violation of local or state law.

� Expenses related to extreme adverse weatherconditions, including, but not limited to, floods,hurricanes and tornadoes (removal from water,snow, ice, etc.).

� Expenses for the removal of snow tires, andmounting or removal of snow chains.
