All iPad devices are the property of the New Providence School District. To protect your child’s iPad, you must purchase insurance by Friday, August 29th. The nonrefundable fee for the 2014-2015 school year will be $55.00. Once insurance is paid, the administration will be notified. GRADES 10-12 In order to purchase the iPad insurance, please follow the directions below:

Go to www.payforit.net. All parents/guardians will have a login and password that was created last school year when you purchased

insurance. If you do not remember either of these, please follow instructions on the homepage (Forgot Username or Password). If you are still having problems, please click “Contact Us” and follow the on-screen instructions. PLEASE NOTE: Your username and password login is the same as your son/daughter’s cafeteria account.

Once logged in, please go to FEES, choose MAKE FEE PAYMENT from the drop-down menu and follow the on-screen instructions. You will see the iPad insurance payment in the amount of $55.00.

Your student should already be added, however, in the case that your student(s) are not, please follow the on-screen instructions. Please see instructions below for “Locating Your Student ID Number.”

New Providence School District STUDENT AND PARENT/GUARDIAN IPAD USER AGREEMENT

The one-to-one iPad initiative will give students the opportunity to be involved in the learning process in new and engaging ways. As a tool with such a prominent role in the daily educational process, it’s imperative to establish procedures and guidelines for the appropriate use of this device. The iPad that students will be issued is the property of the New Providence School District and the use of the iPad is a privilege. The purpose of this document is to outline appropriate procedures and expectations as they relate to New Providence High School.

What students will be getting: An iPad, a charger and an iPad case with a Belkin Bluetooth keyboard.

Title: At all times, the legal title to the iPad is maintained by New Providence School District (NPSD). Students’ right of possession and use is limited to and conditioned upon their full and complete compliance with this Agreement and the District’s Acceptable Use of Computer Networks and Resources Policy and Regulation, which are available on the New Providence School District web site: www.npsd.k12.nj.us. The District will cooperate fully with local, state, or federal officials in any investigation concerning or relating to violations of computer crime laws. Students have no rights of confidentiality when using the iPad. Contents of email, information regarding internet usage, and network communications may be reviewed at the sole discretion of the District. By signing this Agreement, students further acknowledge that the New Providence School District is required by law to comply with the New Jersey Public Information Act. As such, students agree to comply fully and in a timely manner with any and all directives issued by the District in its efforts to comply with the Public Information Act. Students further recognize that this may result in the release of email content, Internet use history, network communications, and other similar information to third parties, if so required by law. In accordance with the New Jersey Anti-Big Brother Act, parents and students are advised that District iPads may record or collect information on a student’s activity and location when the device is outside of school. The New Providence School District shall not use iPad program capabilities in a manner contrary to law. Terms of Agreement: Students shall comply at all times with the New Providence School District Student Handbook and Code of Conduct, including the NPSD Acceptable Use of Computer Networks and Resources Policy and Regulation. Failure to comply may result in the immediate termination of student’s rights of possession, and the District may repossess the iPad. Students’ right to use and possess the iPad terminates upon withdrawal/graduation from NPHS, unless otherwise terminated earlier by the New Providence School District. Students’ failure to return the property in a timely manner will be considered unlawful appropriation of New Providence School District property. Students’ continued use of the iPad for non-school purposes without district consent may also be considered unlawful appropriation of district property and may result in disciplinary and/or legal action.

Insurance Coverage, Loss or Damage: All parents/guardians must purchase insurance on an annual basis for the iPad. The Belkin Bluetooth keyboard and case is not covered by the insurance. The nonrefundable annual usage and maintenance fee for the basic warranty plan for the iPad is $55.00. For information on the specifics of the coverage, please refer to the IPAD INSURANCE AGREEMENT.

Use of iPads on Network: The New Providence School District is committed to the availability of technology resources for student work. If students are experiencing problems with their iPad, students will be able to continue with class work. Inappropriate Content: Inappropriate content will not be allowed on iPad devices. (See NPSD Acceptable Use of Computer Networks and Resources Policy and Regulation.) The presence of inappropriate material, including but not limited to pornographic material; inappropriate language;

weapon-related content; alcohol, drug, and/or gang-related symbols or pictures will result in disciplinary action and possible loss of iPad privileges. Loaning or Borrowing iPads: Students shall not loan their iPads to other students or borrow an iPad from another student. Students shall not share their passwords or usernames with others.

Setting Security Passcodes: Every student must have a security passcode on their iPad. Please note that the District has the right to bypass the security code. Access by unauthorized persons to another individual’s account or iPad without their consent or knowledge is considered hacking and is prohibited. This is subject to discipline in accordance with the Student Handbook and Code of Conduct.

Modification of the iPad: Students shall not modify the iPad in a way that will permanently alter it, either physically or electronically, other than as instructed by an administrator or other school personnel. Students are not permitted to apply marks, stickers, or other decorations to District-provided iPad covers. Any alteration or destruction of an iPad or cover will result in the student having to pay for its replacement. Student iPads will be labeled by New Providence School District in order to identify and track each device. iPads will be identified by a serial number and a NPSD label. Students are prohibited from altering these identifying marks.

iPads are Required Each Day in Class: Students are required to bring fully charged iPads to class every day. Students are expected to take home their iPad every night for assignments and recharging. All rules and regulations that are in effect during the school day extend to the use of the iPad at home. If students leave their iPad at home, they are responsible for getting the coursework completed as if they had their iPad present. If a student repeatedly leaves their iPad at home, they may be subject to disciplinary consequences. Sound: Sound will be muted at all times unless permission is obtained from the teacher. Recording Feature and Camera: The iPad comes equipped with a microphone, front- and rear-facing camera, and video capabilities. The New Providence School District retains the rights concerning the recording and/or publishing of any student or staff member’s work or image. Students must obtain permission from the principal or designee before recording an individual or group or publishing a photograph or video of any school-related activity. Unauthorized recordings are subject to disciplinary action in accordance with the District’s Acceptable Use of Computer Networks and Resources Policy and Regulation. Storage: The iPad affords limited electronic storage space. If students are lacking a sufficient amount of storage space on the iPad device, students will be required to delete apps, music, photos, etc., in order to make necessary educational-related programs accessible. Students are expected to back up, duplicate or archive files to Google Drive. iCloud will no longer be used for backing up a student’s iPad. It is the student’s responsibility to ensure that work is not lost due to mechanical failure, accidental deletion or re-imaging. Music, Books and Apps: Music, books, and apps not provided by the District can be downloaded through personal iTunes accounts at the student’s expense. Content must be school appropriate and follow all terms of this Agreement and the Acceptable Use of Computer Networks and Resources Policy and Regulation. When iPads are returned to the district for repair or because the student is leaving the district, students may lose all downloaded content unless it has been backed up on Google Drive.

New Providence High School STUDENT GOOGLE APPS PERMISSION FORM

Google Accounts for Students: New Providence High School now has the ability to create accounts for all students that allow for collaborative sharing using Google Apps for Education. These accounts, which will be used for school-related projects, offer students access to a wealth of collaborative tools available through Google Apps. Housed on Google servers, these accounts give your student 24-hour access to Google Docs (word processor, spreadsheet, and presentation software), instant messaging, email, calendar, website authoring tools, plus additional services. This will allow your student to collaborate with teachers and other students as well as share information with other Internet users. School-Related Email Address: All students will be assigned an npsdnj.org student email account. This account will be considered the student's official New Providence High School email address until such time as the student is no longer enrolled in the New Providence School District. The naming convention will be last name and first initial (followed by a number, if needed), ending with @npsdnj.org. For example: John Doe would have [email protected] as an email address. Access Restriction: Access to and use of Google Apps for Education is considered a privilege given at the discretion of the New Providence School District. The District maintains the right to immediately withdraw the access and use of the account when there is reason to believe that violations of law or School Board policies have occurred. In such cases, the alleged violation will be referred to the Principal for further investigation and appropriate consequences, in accordance with the Student Code of Conduct, will be imposed. Conduct: Students are responsible for acceptable and appropriate behavior and conduct on school district computer networks/computers as described in the Acceptable Use of Computer Networks/Computers and Resources Policy. Violations of the District policy may result in a loss of access as well as other disciplinary or legal action, including if warranted, reports to legal authorities and entities. Disciplinary action shall be taken as indicated in the following Polices and/or Regulations: #2361, Acceptable Use of Computer Networks/Computers and Resources; #5600, Student Discipline/Code of Conduct; and #5610, Suspensions, Expulsions and Mandatory Removals from School. Privacy: The Board of Education reserves the right to access and review content in the Google Apps for Education system at any time. The Board of Education complies with all state and federal privacy laws. Security: The New Providence School District cannot and does not guarantee the security of electronic files located on Google systems. Although Google does have a powerful content filter in place, the Board of Education cannot assure that users will not be exposed to non-educational material.

APPLE ID ACCOUNT PERMISSION FORM

In order to support collaborative and individual learning for 21st Century learners, each student will use an iTunes account. Students will use their iTunes Apple ID to download and manage free and prepaid apps to their iPads. What is an Apple ID? When you want to download a new app (for free or by district purchase) from the Apps Store or from the District App Catalog, you need to access an Apple ID. The iPad will prompt you to input your Apple ID and password each time you try to access a new app for the iPad. Goal: Empower students to manage and be responsible for their own iPads while minimizing the opportunities for them to access inappropriate or damaging content or information. • Students will either create an Apple ID or use a current Apple ID. This will allow students to install free and paid apps from the district through the New Providence App Catalog. • Apple’s terms and conditions for creating an Apple ID require users to be at least 13 years old and to review and agree to the terms and conditions with a parent or guardian. By signing the APPLE ID ACCOUNT SIGNATURE section of the Consent Form, student and parent/guardian are acknowledging agreement with these terms and conditions. • Parents should not associate a credit card with their student’s Apple ID as any purchases they then make will effectively belong to the district. Expectations: Students will be responsible for the contents of their iPad. • The district mobile device management software regularly collects an inventory of installed apps on each iPad allowing IT staff to see which apps are installed on which iPads and search for specific apps, but this may also be used as an investigative tool in response to specific concerns. • Students should have no expectations of privacy for the contents of their iPads just as they do not for their lockers and desks. The district reserves the right to inspect the contents of a student’s iPad at any time and without any advance notice.

New Providence High School IPAD INSURANCE AGREEMENT

All parents and their students must purchase insurance through the school on an annual basis. The nonrefundable annual usage and maintenance fee for the basic warranty plan is $55.00 for the 2014-2015 school year. The guidelines for damage coverage are outlined in the GoCare Protection Agreement, which is available on the high school website at www.npsd.k12.nj.us. A brief summary of the coverage is provided below.

Insurance Coverage, Loss or Damage: The insurance coverage plan provides repair or replacement coverage, parts and labor for the iPad, the battery, and up to two incidents of “accidental” damage. The insurance fee will be waived or reduced based on financial hardship using the New Jersey eligibility standards established for free and reduced price lunch. The fee will be waived for families that qualify for free lunch; families qualifying for reduced price lunch will be assessed 50% of the fee. What is Covered: Accidental damage from normal use including, but not limited to, drops, cracks, liquid spills, liquid submersion, fire, flood, vandalism, natural disaster or power surge due to lightening and any other damage that is caused by accident. Theft of the property must be reported to the police department and to New Providence School District by the next school day after the occurrence. A copy of the police theft report must be provided to the principal. Items Not Covered by Insurance: Loss of or any deliberate and purposeful damage to the iPad, cables, and/or cords, is not covered by the insurance. The Belkin Bluetooth keyboard and case is not covered by insurance. In these instances, students are responsible for the full repair or replacement value if not covered by the manufacturer’s warranty. Effective & Expiration Dates: This coverage is effective from the September 1, 2014 to August 31, 2015. Parents will need to renew coverage for the 2015-2016 school year.

ACCEPTABLE USE OF COMPUTER NETWORKS/COMPUTERS AND RESOURCES M The Board of Education recognizes that as new technologies shift the manner in which information is accessed, communicated and transferred, these changes will alter the nature of teaching and learning. Access to technology will allow students to explore databases, libraries, Internet sites, and bulletin boards while exchanging information with individuals throughout the world. The Board supports access by students to these information sources but reserves the right to limit in school use to materials appropriate for educational purposes. The Board directs the Superintendent to effect training of teaching staff members in skills appropriate to analyzing and evaluating such resources as to appropriateness for educational purposes. The Board also recognizes that technology allows students access to information sources that have not been pre-screened by educators using Board approved standards. The Board therefore adopts the following standards of conduct for the use of computer networks and declares unethical, unacceptable or illegal behavior as just cause for taking disciplinary action, limiting or revoking network access privileges and/or instituting legal action. The Board provides access to computer networks/computers for educational purposes only. The Board retains the right to restrict or terminate student access to the computer networks/computers at any time, for any reason. School personnel will monitor networks and online activity, in any form necessary, to maintain the integrity of the networks, ensure their proper use, and ensure compliance with Federal and State laws that regulate Internet safety. Standards for Use of Computer Networks Any individual engaging in the following actions when using computer networks/computers shall be subject to discipline or legal action: A. Using the computer network(s)/computers for illegal, inappropriate or obscene purposes, or in support of such activities. Illegal activities are defined as activities that violate federal, state, local laws and regulations. Inappropriate activities are defined as those that violate the intended use of the networks. Obscene activities shall be defined as a violation of generally accepted social standards for use of publicly owned and operated communication vehicles.

B. Using the computer network(s)/computers to violate copyrights, institutional or third party

copyrights, license agreements or other contracts. C. Using the computer network(s) in a manner that:

1. Intentionally disrupts network traffic or crashes the network;

2. Degrades or disrupts equipment or system performance;

3. Uses the computing resources of the school district for commercial purposes, financial gain or fraud;

4. Steals data or other intellectual property;

5. Gains or seeks unauthorized access to the files of others or vandalizes the data of another person;

6. Gains or seeks unauthorized access to resources or entities;

7. Forges electronic mail messages or uses an account owned by others;

8. Invades privacy of others;

9. Posts anonymous messages;

10. Possesses any data which is a violation of this Policy; and/or

11. Engages in other activities that do not advance the educational purposes for which computer networks/computers are provided.

Internet Safety/Protection As a condition for receipt of certain Federal funding, the school district shall be in compliance with the Children's Internet Protection Act, the Neighborhood Children’s Internet Protection Act, and has installed technology protection measures for all computers in the school district, including computers in media centers/libraries., The technology protection must block and/or filter material and visual depictions that are obscene as defined in section 1460 of Title 18, United States Code; child pornography, as defined in section 2256 of Title 18, United States Code; are harmful to minors including any pictures, images, graphic image file or other material or visual depiction that taken as a

whole and with respect to minors, appeals to a prurient interest in nudity, sex, or excretion; or depicts, describes, or represents in a patently offensive way, with respect to what is suitable for minors, sexual acts or conduct; or taken as a whole, lacks serious literary, artistic, political, or scientific value as to minors. This Policy also establishes Internet safety policy and procedures in the district as required in the Neighborhood Children's Internet Protection Act. Policy 2361 addresses access by minors to inappropriate matter on the Internet and World Wide Web; the safety and security of minors when using electronic mail, chat rooms, and other forms of direct electronic communications; unauthorized access, including “hacking” and other unlawful activities by minors online; unauthorized disclosures, use, and dissemination of personal identification information regarding minors; and measures designed to restrict minors' access to materials harmful to minors. Notwithstanding blocking and/or filtering material and the visual depictions prohibited in the Children's Internet Protection Act and the Neighborhood Children’s Internet Protection Act, the Board shall determine other Internet material that is inappropriate for minors. In accordance with the provisions of the Children's Internet Protection Act, the Superintendent of Schools or designee will develop and ensure education is provided to every student regarding appropriate online behavior, including students interacting with other individuals on social networking sites and/or chat rooms, and cyberbullying awareness and response. The Board will provide reasonable public notice and will hold one annual public hearing during a regular monthly Board meeting or during a designated special Board meeting to address and receive public community input on the Internet safety policy - Policy and Regulation 2361. Any changes in Policy and Regulation 2361 since the previous year's annual public hearing will also be discussed at a meeting following the annual public hearing. The school district will certify on an annual basis, that the schools, including media centers/libraries in the district, are in compliance with the Children's Internet Protection Act and the Neighborhood Children's Internet Protection Act and the school district enforces the requirements of these Acts and this Policy. Consent Requirement No student shall be allowed to use the school district’s computer networks/computers and the Internet unless they shall have filed with the Principal’s office a consent form signed by the student and his/her parent(s) or legal guardian(s).

Violations Individuals violating this Policy shall be subject to the consequences as indicated in Regulation No. 2361 and other appropriate discipline, which includes but are not limited to:

3. Revocation of network privileges;

5. Revocation of computer privileges;

STUDENT DISCIPLINE/CODE OF CONDUCT M The Board of Education adopts this Student Discipline/Code of Conduct Policy to establish standards and procedures for positive student development and behavioral expectations on school grounds, including on a school bus or at school-sponsored functions, and as appropriate, for conduct away from school grounds. Every student enrolled in this district shall observe promulgated rules and regulations and submit to the discipline imposed for infraction of those rules. Regulation 5600 shall include a description of school responses and consequences to violations of the behavioral expectations established by the Board that, at a minimum, are graded according to the severity of the offenses, considering the developmental ages of the student offenders and students' histories of inappropriate behaviors pursuant to N.J.A.C. 6A:16-7.1(c)5. The development, annual review, and update of this Policy shall involve parent, student, and community involvement which represents, where possible, the composition of the schools and community and shall be based on locally determined and accepted core ethical values. The Board will review this Policy and Regulation after considering the findings of the annual reports of student conduct, including suspensions and expulsions, pursuant to N.J.A.C. 6A:16-7.1(a)5 and 6, and the incidences reported under the Electronic Violence and Vandalism Reporting System, in accordance with N.J.A.C. 6A:16-5.3. The Superintendent shall report annually on the implementation of the Student Discipline/Code of Conduct Policy to the Board at a public meeting pursuant to N.J.A.C. 6A:16-7.1(a)5. The Superintendent shall submit a report annually to the New Jersey Department of Education on student conduct, including all student suspensions and expulsions, and the implementation of the Student Discipline/Code of Conduct Policy in accordance with the format prescribed by the Commissioner of Education and the Electronic Violence and Vandalism Reporting System, pursuant to N.J.A.C. 6A:16-5.3(e). For students with disabilities, subject to Individualized Education Programs in accordance with 20 U.S.C. §1400 et seq., the Individuals with Disabilities Education Improvement Act, and accommodation plans under 29 U.S.C. §§794 and 705(20), student discipline and the code of conduct shall be implemented in accordance with the components of the applicable plans.

The Building Principal or designee shall have the authority to assign discipline to students. School authorities also have the right to impose a consequence on a student for conduct away from school grounds, including on a school bus or at a school-sponsored function pursuant to N.J.A.C. 6A:16-7.6. This authority shall be exercised only when it is reasonably necessary for the student's physical or emotional safety, security, and well-being or for reasons relating to the safety, security, and well-being of other students, staff, or school grounds, pursuant to N.J.S.A. 18A:25-2 and 18A:37-2. This authority shall be exercised only when the conduct which is the subject of the proposed consequence materially and substantially interferes with the requirements of appropriate discipline in the operation of the school. Consequences shall be handled in accordance with Policy and Regulation 5600, pursuant to N.J.A.C. 6A:16-7.1, and as appropriate, in accordance with N.J.A.C. 6A:16-7-2, 6A:16-7.3, or 6A:16-7.5. Consequences and appropriate remedial action for a student who commits one or more acts of harassment, intimidation, or bullying may range from positive behavioral interventions up to and including suspension or expulsion. The factors for determining consequences and remedial measures and examples of consequences and remedial measures are listed in Policy 5512 - Harassment, Intimidation, and Bullying. Consequences for a student who commits an act of harassment, intimidation, or bullying shall be varied and graded according to the nature of the behavior, the developmental age of the student and the student's history of problem behaviors and performance, and shall be consistent with this Policy and the school district's student discipline/code of conduct pursuant to N.J.A.C. 6A:16-7.1. Remedial measures shall be designed to correct the problem behavior; prevent another occurrence of the problem; protect and provide support for the victim of the act; and take corrective action for documented systemic problems related to harassment, intimidation, or bullying. Any student to be disciplined shall be provided the due process procedures for students and their families as set forth in N.J.A.C. 6A:16-7.2 through 7.6. When a student transfers to a public school district from another public school district, all information in the student's record related to disciplinary actions taken against the student by the school district and any information the school district has obtained pursuant to N.J.S.A. 2A:4A-60, Disclosure of Juvenile Information, Penalties for Disclosure, shall be provided to the receiving public school district, in accordance with the provisions of N.J.S.A. 18A:36-19(a), N.J.A.C. 6A:32(e)10.iv., and N.J.A.C. 6A:16-7.10. Regulation 5600 shall include a description of student responsibilities that include expectations for academic achievement and behavior, a description of behaviors that will result in suspension or

expulsion pursuant to N.J.S.A. 37-2, and a description of student rights pursuant to N.J.A.C. 6A:16-7.1(c)3.i through vii. Comprehensive behavioral supports that promote positive student development and the student's abilities to fulfill the behavioral expectations established by the Board will include: positive reinforcement for good conduct and academic success including the programs as outlined in Policy 5440; supportive interventions and referral services including those services outlined in Policy 2417; remediation of problem behaviors that take into account the nature of the behaviors, the developmental ages of the students and the student's histories of problem behaviors and performance; and for students with disabilities, the behavior interventions and supports shall be determined and provided pursuant to the requirements of N.J.A.C. 6A:14. The Building Principal shall maintain a current list of community-based health and social service provider agencies available to support a student and the student's family, as appropriate, and a list of legal resources available to serve the community. Student discipline and code of conduct in the district will be applied without regard to race, color, religion, ancestry, national origin, gender, sexual orientation, gender identity and expression, or a mental, physical or sensory disability or by any other distinguishing characteristic, pursuant to N.J.S.A. 10:5. SUSPENSION, EXPULSION AND MANDATORY REMOVALS FROM SCHOOL M The Board of Education recognizes that even the temporary exclusion of a student from the educational program of this district is a severe sanction and one that cannot be imposed without due process. The Board of Education also recognizes that expulsion from the district is the most severe sanction and one that cannot be imposed, absent extraordinary circumstances, until other reasonable and appropriate means of discipline have been exhausted. For the purposes of this policy, "suspension" means the temporary removal of a student from the regular instructional program and includes in-school suspension; "short-term suspension" means a suspension of not more than ten consecutive school days; "long-term suspension" means a suspension of more than ten consecutive schools days; and "expulsion" means the permanent exclusion of a student from the district's schools. "Assault," as used in this policy and in accordance with N.J.S.A. 2C:12-1(a)(1), means that the student attempts to cause or purposely, knowingly or recklessly causes bodily injury to another. No student otherwise eligible for attendance shall be removed from the instructional program to which he or she has been assigned unless that student has materially and substantially interfered with the maintenance of good order, or for other good cause, or removal is necessary to protect the well-being of the student or others. Nor shall a student be removed without first being told the charges against him and provided an opportunity to respond to them, except when the continued presence of the student threatens the safety of the student or others and it is impossible or unreasonably difficult to afford prior notice and an opportunity to respond. In that event, notice and the opportunity to respond may be delayed until circumstances permit. A Principal may impose a short-term suspension for cause and, in the case of an offense listed below, shall immediately remove a student from school pending a Board hearing: 1. Assault upon a Board member or any employee of the Board, with or without the use of a weapon or firearm. 2. Assault upon a Board member, any employee of the Board, or another student with a weapon other than a firearm, on school property, on a school bus, or at a school- sponsored function.

3. Knowing possession of a firearm on school property, on a school bus, or at a school- school-sponsored function, or conviction or adjudication of delinquency for possessing a firearm or committing a crime while armed with a firearm on school property, on a school bus, or at a school-sponsored function. A Principal shall immediately report any suspension to the Superintendent and, if the student is classified, to the Case Manager or other member of the Child Study Team. In the case of a mandatory removal for an assault with a weapon or possession of a firearm as delineated above, the Principal shall also report the incident to the local law enforcement agency. The report to the Superintendent should be in writing in all cases, but must be in writing if the Principal receives a written allegation from a Board member or Board employee, or a labor representative on behalf of an employee, that a Board member or employee has been assaulted by a student. Pursuant to statute, a person failing to file a written report of an alleged assault may be subject to disciplinary action. Upon removal, the student shall be isolated and placed by the Principal under the supervision of school staff until the student is taken into custody by his parent or a law enforcement official. The Superintendent shall report the suspension and the alleged offense to the Board at its next regular meeting. The name of the student shall not be disclosed to the public. Unless the Board orders the student's reinstatement at its first regular meeting following the suspension, the Superintendent may continue a student's suspension for an additional period of time but not beyond the second regularly scheduled meeting of the Board following the suspension. A student who is suspended for any reason for more than ten consecutive school days shall be offered the opportunity for a hearing before the Board. The hearing will be held no later than thirty calendar days from the first day of the removal, unless the hearing is delayed to a later date with the consent of the student's parent or the adult student. A student who has requested a hearing and who has not been charged with assault with a weapon or an offense involving a firearm, may be reinstated pending the outcome of the hearing if the Superintendent determines that the student’s reinstatement poses no threat to the safety or well-being of the student or others. Students not reinstated shall be offered home instruction or other educational program pending the outcome of the hearing, and such instruction shall be provided within five school days of the removal. In the case of a long-term suspension of a classified student, and except as provided below (at #3), the Individualized Educational Program ("IEP") Team shall conduct a manifestation determination within ten school days of the decision to suspend the student. If the Team determines that the student's misconduct is a manifestation of his disability or was the direct result of the district's failure

to implement the IEP, the student will be reinstated to his or her program unless one of the following exceptions exists: 1. A hearing officer orders a change of placement; 2. The parent and district agree to a change of placement; 3. The student is charged with (i) possession of a weapon at school, on school premises or at a school function, (ii) knowing possession, use, sale, or solicitation of illegal drugs at school, on school premises or at a school function, or (iii) infliction of serious bodily injury upon another person at school, on school premises or at a school function. In any of the circumstances under "3" above, the Principal, with the approval of the Superintendent, may remove the classified student to an alternative educational setting, the identity of which shall be determined by the IEP Team, without regard to whether the misconduct was a manifestation of the student's disability, for a period up to forty-five school days. A classified student whose misconduct is determined not to be a manifestation of disability or to result from the failure to implement the IEP may be suspended to the same extent as a non-classified student in accordance with this policy. When any student is suspended, and in addition to notifying the student of the charge, the Principal must give verbal or written notice of the charge to the student's parent before the end of the school day on which the decision to suspend the student is made. In the case of a long-term suspension, the Superintendent or his or her designee must provide written notice to the parent within two days of the initial suspension, which notice shall include the following information: 1. The date, place, and time of the Board hearing; 2. The specific charges to be heard and the facts on which they are based; 3. A statement that further engagement by the student in conduct that would warrant expulsion pursuant to N.J.S.A. 18A:37-2 shall amount to a knowing and voluntary waiver of his right to a free public education. 4. A statement that during the Board hearing, the student may cross-examine the district's witnesses, may be represented by private counsel, and may present evidence, affidavits and argument in defense. 5. A current list of community-based health and social service provider agencies, such as the Mental Health Association of Union County, 23 North Avenue East, Cranford, New Jersey 07016, phone (908) 272-0300.

6. A current list of legal resources available in the community, for example, the Lawyer Referral Service for Union County, (908) 353-4715, and the County Legal Services Office, (908) 354-4340. No later than five days before the Board hearing, the district shall also provide to the parents a list of the district's witnesses and their statements, if any. The hearing will be closed to the public. In the event the hearing is held before a committee of the Board or a school administrator, or an impartial hearing officer designated by the Board, it shall be recorded or a detailed record of the proceeding shall be made for consideration by the Board as a whole. The Board's decision shall be based upon the preponderance of the competent evidence. The district shall notify the student's parents of the Board's decision on each charge within five school days of the hearing. The notice will include a statement of the charges considered, a summary of the evidence presented, the factual findings relative to each charge, the educational services to be provided to the student during a long-suspension, if imposed, and the student's right to appeal the decision. If the Board finds a student not guilty of the offense, the student shall be promptly returned to his or her regular educational program. If the Board finds the student guilty of one of the following offenses but determines not to expel the student, the Board will order the student removed to an alternative educational placement or, pending the availability of an alternative educational placement, to home instruction or other suitable program, which will be identified by the IEP Team in the case of a classified student. 1. Assault upon a Board member, any employee of the Board, or another student, with a weapon other than a firearm, on school property, on a school bus, or at a school-sponsored function. 2. Knowing possession of a firearm on school property, on a school bus, or at a school-sponsored function, or conviction or adjudication of delinquency for possessing a firearm or committing a crime while armed with a firearm on school property, on a school bus, or at a school-sponsored function. The period of removal for an offense listed in "2" above shall be not less than one calendar year unless modified by the Superintendent based upon a determination that the student is prepared to return to the regular educational program. For all other offenses, the student's suspension shall not be continued beyond the second regular meeting following the suspension, unless the Board determines to continue the suspension based on (i) the nature and severity of the offense, (ii) the Board's removal

decision, (iii) results of relevant testing, assessments or evaluations of the student, and (iv) the recommendations of the Superintendent or the Principal or director of the alternative education program where the students has been placed. In the event that the second regular board meeting is cancelled for any reason, the Board President and Superintendent shall determine, based upon the foregoing factors, whether to return the student to his regular placement or continue the suspension until the next following Board meeting. When it is determined to continue the suspension of a non-classified student beyond the second regular meeting following the suspension, the Board and Superintendent shall review the student's suspension at each subsequent board meeting to determine (i) the status of the student's suspension, (ii) the appropriateness of the placement, (iii) whether the placement should continue, (iv) when the student is prepared to return to the regular educational program, and (v) whether to initiate expulsion proceedings. The final determination with respect to continuing the suspension or retaining the student in the alternative education program or home or in-school or out-of-school instruction shall likewise be based upon (i) the nature and severity of the offense, (ii) the Board's removal decision, (iii) results of relevant testing, assessments or evaluations of the student, and (iv) the recommendations of the Superintendent or the principal or director of the alternative education program where the student has been placed. In the case of a classified student, all placement decisions regarding the student shall be made by the IEP Team. No student will be given a failing grade because of absence caused by suspension. For each student on long-term suspension, the district shall provide an Individualized Program Plan ("IPP") within thirty days of the Board's determination to impose the suspension and shall maintain a record of the delivery of instructional services and student progress. The IPP shall be developed and reviewed no less than every sixty calendar days by a multidisciplinary team of teaching staff members having knowledge of the student's needs, in consultation with the student's parent. The IPP shall identify the appropriate instructional and support services necessary to address the student's educational and behavioral needs, incorporate any prior findings and actions recommended by the district pursuant to its intervention and referral system, and recommend placement in an appropriate educational program, including support for transition back to the general education setting. Instruction provided through the IPP shall meet Core Curriculum Content Standards and district requirements for promotion and graduation and shall be comparable to instruction given in the public schools for students of similar grades and attainments. Appropriate alternative educational services. When a student appeals an expulsion to the Commissioner of Education in accordance with the requirements for filing such appeals, the district will continue to provide educational services to the student pending the final decision on the appeal. An expulsion of a classified student shall conform to the requirements of N.J.A.C. 6A:14-2.8.
