TRADE MISSION TO EMBALLAGE-PARIS, TERMS AND CONDITIONS The following Terms and Conditions shall govern participation in ‘Business Meeting at EMBALLAGE’ Organized in association with Trade Facilitation Office Nigeria following EMBALLAGE 2016 presented by Comexposium. Upon acceptance of your completed signed Reservation Form, you unconditionally agree to have read, understood and agreed to be bound by the following offer, terms, rules, conditions, indemnity and official issuances applicable on the matter, now existing or which may hereinafter be enacted, issued or enforced. These Terms and Conditions comprise the Agreement between Trade Facilitation Office Nigeria and the Participant in connection with the participation in ‘Business Meeting at EMBALLAGE’ following EMBALLAGE scheduled from 14- 17 November 2016 in Paris, France . Please keep a copy for your records. • (1) The following terms and conditions as well as rules and regulations (regarding visiting) laid down by the organizers of EMBALLAGE 2016, are part of the participation agreement made through the signing of the ‘Reservation Form’ as though fully incorporated therein, and each applicant herein referred as ‘Participant’ is bound by each and everyone hereof. • (2) Trade Facilitation Office Nigeria hereinafter referred to as the ‘organizers’ of “Business Meeting at EMBALLAGE’’ undertakes within the framework of the offer to carry out the project: ‘Business Meeting at EMBALLAGE from 14-17 November 2016 as scheduled and organized by Comexposium to take place at Paris Nord Villepinte, France. • (3) Business Meeting at EMBALLAGE (Activity name) is an international buyer program designed to help Nigerian trade visitors explore EMBALLAGE 2016 where they’ll find packaging solutions for all activity sectors. And the participant agreed to participate in the program at the specified registration fee and terms as indicated in the Reservation and Contract Form. Full payment entitles the trade visitor, registration to participate, including appointment service for business-t0- business meetings which are made on the basis of opportunities available t0 Messe Athems International and it’s organizing partners. Including 3Nights hotel accommodation, Airport shuttle to official hotel, Visa invitation and one personalized entry badge to the event. No request/registration will be official until a completed reservation form and a 50 percent deposit fee has been received by the organizers. A meeting pre-arranged for a participant is subject to change at the sole discretion of the organizers. The meeting venue or name of the company/exhibitor to meet may also change in an effort to match commercial requests. Participants will be advised by the organizers at a latter date at least seven days before the meeting date on specific companies, dates and time to meet within EMBALLAGE 2016 in Paris. • (3) Participant agrees: to provide his or her own travel insurance, and make full payments for participation, and be fully responsible for his or her flight fare and entry clearance (visa) into France for the event. The participant also accepts to handle immigration formalities independently and agrees that the organizers shall not be responsible for related fees involved in obtaining permission (visa) for entry into France. The organizers will provide the visa invitation letter only in this respect as their visa support package. It is also agreed that in the event of delay or rejection of entry permission (visa) into France, the participant can make cancellations and will be liable to a cancellation fee according to terms and conditions of Article 6 of this contract. • (4) Liability: The participant agrees to indemnify and hold harmless Trade Facilitation Office Nigeria , the marketing Team, the EMBALLAGE management, the conference facility and City of Paris in which the summit and expo is being held, their officers, Agents and Employees, against all claims, losses, suits, damages, judgments, expenses, costs and charges of any kind resulting from their participation contracted herein by reason of personal injuries, death, property damages or any other cause sustained by any persons or others. Trade Facilitation Office Nigeria shall not be responsible for any loss or damage to properties belonging to participants whether resulting from fire, storms, acts of God, air conditioning or heating failure, theft, pilferage, mysterious disappearances, bomb, treats or other causes. All such items are brought to the exhibition at the participant’s own risk, and should be safeguarded at all times. The Participant agrees that Trade Facilitation Office Nigeria shall not be responsible in the event of disappointments, errors or omissions in listings in our business directory and in any promotional material. Participant agrees to indemnify Trade Facilitation Office Nigeria against and hold it harmless from any claims and for all damages, costs and expenses, including, without limitation, attorneys’ fees and amount paid in settlement, incurred in connection with such claims arising out of the acts or negligence of participant, his agents or Employees. • (5) Payment Schedule: A deposit of 50% of the total registration fee is required with the submission of the Reservation form and the balance of 50% must be paid before 9th September 2016. No meeting appointment will be confirmed for participants who have not paid the full registration fee. Organizers have the right to replace any participant who have not paid its registration fee in full before 9th September 2016. The cancellation policy listed below will apply in that case. • (6) Cancellations: In the event the Participant (trade visitor) seeks to cancel all or part of this contract, participant can only do so by submitting his or her request in a completed official Cancellation form ‘TFO76’ provided by the organizers of ‘Business Meeting at EMBALLAGE 2016’. Alternatively, cancellations, withdrawal or other official requests regarding participation/or this contract can be forwarded to the organizers through this specified email: nigeriapavilion@gmail.com. Refunds will be provided prior to November 17, 2014 and a 25% of the registration fee will be applied for the processing and administration charges for each registration refund so long as the written notice of cancellation is received prior to 9th September 2016. If written cancellation notice (only made through the official Cancellation form TFO76) is received by Trade Facilitation Office Nigeria on or after 9th September 2016, the participant shall pay a cancellation fee equal to the total registration fee. The cancellation fees are considered to be liquidated damages for injuries the organizers will suffer as a result of participant’s cancellation or withdrawal. The participant acknowledges that damages for cancellation or breach of this contract are difficult to ascertain at the time of this contract’s formation and moreover, participant acknowledges that the agreed upon liquidated damages are a reasonable forecast of compensatory damages in case of breach. The participant also acknowledges that its withdrawal from its booked space at a time when other entities would not be interested in occupying the space will cause the organizers some damage. In such situation, the organizer’s damage will be significant, but not precisely calculable. This provision for liquidated and agreed upon damages is not a penalty and therefore the provision for liquidated damages is valid. The date of cancellation should be the (organizer's received) stamped date on such correspondence. However, participants who intend to register for participation from 9th September 2016 will not be allowed to cancel their participation. In principle, No refunds to such cancellation or request can be attended to and the services must be provided.• (7) Force Majeure: Where the management of EMBALLAGE 2016 finds it impossible to stage the exhibition and thereby postpone or cancel the expo or in the event of fire, war, public calamity, force majeure or other reasons beyond the organizer's control thereby preventing the staging of ‘Business Meeting at EMBALLAGE’ following EMBALLAGE 2016 in Paris, Trade Facilitation Office Nigeria may decide at any time to cancel all reservations for participation already received while notifying participants of this decision in writing. Whatever the reason of such cancellation, the participants are not entitled to any compensation or indemnity. Funds remaining after payment of all costs will be distributed among participants proportionately to the amount paid by them. It is herewith expressly agreed that participants shall have no rights of preferring claims against Trade Facilitation Office Nigeria or any of its staff or agents on any grounds or for any reason whatsoever. •This Agreement is governed by the laws of the Federal Republic of Nigeria. Incase of dissatisfaction or disputes that could not be resolved within both parties, the participant and organizer agrees for a law suit in court in Federal Republic of Nigeria whose decisions will be final and binding on the parties.
