Our stance all the while is that it is all about monetary resources and jobs. And as it turns out it looks like we were right. Recent surveys of this age group actually out in the world and on their own finds that they largely wish to
have a single family home in the suburbs. This study was conducted by the Urban Land Institute; the very same group that said the vast majority of this age group wished to not own anything. They said they chose mobility over an owned home. They claimed at they preferred walking and bicycling over driving a car. And in lockstep planners lapped up this information and attempted to exact walking hiking and biking trails out of our industry. They attempted to increase the vision for rental units in the urban core over expansion of the suburban lifestyle. They pitched the suburbs as communities to nowhere.
Now don’t get us wrong. We support urban living. It takes a healthy market in all sections to thrive. But when we hear things like “the urban core is where everyone is moving” it is simply a falsehood. Now that the youngest working age group is out and starting to enter the workforce we know a few more things than we had guessed at based upon conjecture and the world of mouth the age group passed along to us. In a recent study by Fannie Mae of young renters some common sense responses were not a surprise to us but left the planners shocked.
37% of young renters are doing so because they are saving up for a down payment for a single family home in the suburbs. Over 20% don’t think they currently make enough money to live in a single family home, while only 12% are choosing to rent to remain flexible to move from city to city and job to job. The remainder of the study included those that don’t believe they have enough credit to get a home loan. So it all goes back to money.
We believe in the golden rule. He who has the gold makes the rules. When these young workers have enough money to move into a single family home they will. Yes, some will live in the urban core, but for a short time. When they have a stable life they will pursue the American Dream just like their parents. So, we ask this. Is it smart to build a glut of urban core rental? Or is it wiser to study what people are actually doing?
Years ago the Sony Corporation conducted a focus group. The study was on portable radios designed for young people. One radio had
black trim on a yellow body. The other had black on black trim against body. Those in the focus group raved about how the black in yellow was far more edgy, appealed to their sense of individuality and their want to stand out in the world. As a thank you a very smart Sony executive awarded the focus group participants with a free radio of their choice. The vast majority chose the black radio with black trim. The exact opposite of what they said they gravitated towards. The focus group’s words were tossed out in favor of their actions. Wise move!

Over the last few years, leading up to the youngest age group of worker’s entry into the labor force, experts have been trying to figure out what these “Millenials” as they are known are going to do. Studies were conducted prior to their entry into the workforce and life outside of their parent’s home. Planners used these studies to realign Comprehensive Plans, long range visions and transportation plans.

Jane’s duties as Director of Sales and Marketing are to allow Melanie Meyers to concentrate on shows and events. Jane previously was the Executive Officer of the Summit County (Colorado) Builders
Association (SCBA). As a staff of 1, she has 11 years experience in all aspects of the builder association operations. SCBA has been in existence since 1993. Jane holds the longest tenure as Executive Officer at SCBA.
Jane will be responsible for show and event sponsorships, Northern Kentucky Builder magazine, annual directory, show guides and Sales & Marketing Council. From her SCBA experience, she will also be able to share information about shows, events and membership with other HBANKY staff.
Jane proved you can always come home. Jane’s early years were in Lawrenceburg, Indiana. At the age of five, her family moved to New Richmond, Ohio. She graduated from Ohio University. She married Al Dvorak and lived in Athens, Ohio for 20 years. Her brother, a builder in the Rocky Mountains in Colorado, lured her husband to work for him. This is where Jane learned about new home construction. She even had the opportunity to work as a (very)rough carpenter for 4 months. Jane returned to Lawrenceburg to care for family members and be closer to her husband’s family in Cleveland.
Jane and her husband, Al, each have their own motorcycles and ride cross country. They also like to boat, fish, camp and spend time together.

Tammy Gorby has been promoted to Director of Membership at your Home Builders Association. Tammy was
originally hired for the Administrative Coordinator position in late January. Tammy succeeds Lindsay Chupek. Lindsay is moving back to Virginia where her husband has accepted a advancement in the Lowe’s Home Improvement company.
Tammy is very eager to work more closely with the membership. Tammy is up to the challenge to be involved in the planning of events. She has already jumped in headfirst with the Elk Creek Sporting Clay Shoot, Keeneland Trip and the Holiday Party/Inaugural Dinner.

To begin with, the standard Good Faith Estimate and Truth in Lending disclosures have been eliminated and are now combined into a new single “Loan Estimate” form, which (like
its predecessors) must be delivered to the buyer no later than three business days after receiving the application. Additionally, the final Truth in Lending Disclosure and HUD-1 Settlement Statement are being replaced by the “Closing Disclosure” form (CD), which must be provided to the consumer three days prior to the closing. If there are financial-related changes to the CD during that 72-hour period, the closing could be delayed.
“Among the biggest changes, is the responsibility of lenders to deliver the CD to
the borrower and insure receipt of it three days before the closing.” – Jennifer Hennessey
Jennifer Hennessey, Northwest Title, explained, “The new changes will provide consumers time to review and really understand what they are doing financially. Among the biggest changes, is the responsibility of lenders to deliver the CD to the borrower and insure receipt of it three days before the closing.” Previously, the HUD-1 Settlement Statement was presented to the buyer as late as the day of closing and changes could
be made to the statement during the actual loan closing. Hennessey explained that the CD becomes the proprietary loan document between the lender and borrower. That means that Realtors or other parties who want to view it need to get the borrower’s permission to do so. Hennessey noted that a secondary document will be required to enable lenders to disburse funds. “We’ll use the ALTA (American Land Title Association) Settlement Statement, which will have both the buyer and seller information fees so we can disburse monies,” she explained.
According to Melinda Lawrence, Fifth Third Bank, communication between everyone involved in the real estate transaction is key. “This is one of the biggest regulatory changes we’ve seen. We’re combining two different regulations into one and taking several different documents and putting them into two. With the new waiting periods, Realtors need to set expectations with their buyers and sellers. Lenders and title companies need to be having conversations with builders and anyone involved in the transaction. The different nuances of the rule can really make an impact on closings in the future,” she explained, citing three factors that could force the three-day waiting period to reset. “If your APR increases or decreases by one-eighth of a percent, if your product on your loan changes or if a prepayment penalty gets added to the loan, the closing could be delayed.” According to Lawrence, lenders are now required to get a written or verbal “intent to proceed” and there are penalties for not quoting fees appropriately, so it’s vital that communication between financial institutions is clear and accurate. The intention of the new

As part of the CFPB’s “Know Before You Owe” project, the mortgage disclosure rules are designed to streamline the loan application process and make it easier for homebuyers to understand. Local experts report that the rules will impact everyone at the closing table. (Of note, the “closing” will further be referred to as the “consummation.”) They anticipate that it will take longer to close on homes as everyone adjusts, but the changes should eliminate last-minute delays and perhaps ease the stress at the consummation.

Dan Scherff, Roeding Insurance, commented on the changes, “The new rules are really consumer-driven, but everyone that has anything to do with monies exchanged at the closing table needs to be aware of them. The important thing that we all need to do is have all our ducks in a row. All the financial information needs to be to the lender sooner than later.” Scherff said that as far as insurance agents are concerned, his office is refreshing quotes about two weeks before each closing to make sure nothing has changed that would stall a closing. “Eighty percent of the time the quote won’t change, but we want to make sure we’re getting all the correct information to the loan officer in time and place the coverage prior to the closing date. In the end, it’s a much better deal for the homebuyer,” he added.

For lenders, there are many responsibilities associated with the new rules. Data gathering upfront will be a big change. Hennessey noted that lenders and title companies will also need to communicate on which entity is responsible for delivering the CD to the client. “What we’re hearing from the big national lenders is that they will take responsibility for delivering it to borrowers. There are still many lingering questions that we have about the new process, but we’re just going to be flexible,” Hennessey added.

This additional time will allow consumers to compare the final terms and costs to the terms and costs they received in the estimate. That will better equip them to raise any questions before they close the deal.
The term “consummation” will replace “closing.”

Statement from NAHB Chairman on the Recent District Court Decisions on EPA Water Rule
Tom Woods, Chairman of the National Association of Home Builders (NAHB) and a home builder from Blue Springs,
Mo., issued the following statement concerning the recent District court rulings in North Dakota, West Virginia and Georgia on the Environmental Protection Agency’s rule defining the “waters of the United States” as found in the Clean Water Act.
“Although the rule will cause harm to all 50 states, the mixed decisions to come out of the various district courts this week only further illustrate the significant issues and confusion caused by the EPA, and the lack of coordination between the agency and its stakeholders in developing this rule. The EPA has misinterpreted which court should even review this rule, leading various courts to disagree on which court has jurisdiction over these cases—which will cause delays while the judicial system figures this out.
“We applaud the District Court of North Dakota for its decision that recognized the damage that the rule may bring to the 13 states that filed in North Dakota and stopped the EPA from implementing it until it can conduct a proper review of the record. The court found that the EPA misinterpreted the Clean Water Act, and the rule likely does not comply with the Supreme Court precedent. Additionally, it found that the EPA has not given the public a fair chance to comment on the rule, and that the final rule would be considered a vast departure from the proposed rule initially seen by the public.
“The EPA has exceeded its authority and completely mismanaged this rule making. In light of the confusion found by the courts this week, and the overall issues with the rule, NAHB again called on the EPA to immediately withdraw this rule.”

The Norton Commons development in Louisville was the topic of discussion at the LDC event held at the Metropolitan Club on August 19. Developers, builders, lenders, subcontractors, government agencies and county government representatives attended the event.
The community is literally a brand new old city center in the greenfield development suburbs. Mr. Tomes discussed the planning process of the community, the education required of
residential and commercial builders to build in the community and the success that has inspired the residents and businesses that call Norton Commons home. The members of the Cincinnati/Northern Kentucky Brick Distributor Council are proud to announce that Henry Fisher Homes has been named as the winner of their inaugural Best-
In-Show Award at the 2015 Northern Kentucky Homefest. This awards program was created by the Council to help promote the use of masonry in residential construction. Henry Fisher’s “Rookwood” home design was selected by the Council for its creative use of brick and stone veneer applications. As a result of their commitment to masonry, the Council will award Henry Fisher Homes the $2,500 Grand Prize.
The Council intends to make this cash award an ongoing awards program to help promote the use of all masonry-related products at Homefest. Due to its popularity, the show is a great way to get the Council’s message about the creative use, aesthetic flexibility, and practical benefits of a masonry home out to the thousands of consumers who attend each year.
The Cincinnati/Northern Kentucky Brick Distributor Council is comprised of Brick Tec Inc., Division 4 Inc., and Star Building Materials. All three companies are local brick and building material suppliers in the community who share a common goal of promoting masonry to both the builder and the homeowner.
Additonally the Council has recently sponsored (3) scholarships to Enzweiler Apprentice Training Program for masonry contractors. The Council is one of eleven councils run by the Brick Industry Association, the national trade association representing distributors and manufacturers of clay brick and suppliers of related products and services. NAHB Issues Statement on Labor Department’s Proposed Overtime Rule
NAHB is concerned that changes to the current overtime standard will reduce job advancement opportunities and the hours of full-time construction supervisors, leading to construction delays, increased costs and less
affordable housing options for consumers. In addition to construction supervisors, the proposed rule could affect other occupations in the industry, including sales representatives, administrative staff and local trade association employees.
With the Department of Labor acting to more than double this overtime threshold to over $50,000, NAHB and others in the business community argue that such a dramatic surge is unlikely to result in an
increase in workers’ take-home pay. Rather, it would force business owners to structure their workforce to compensate by scaling back on pay and benefits, as well as cutting hours to avoid the overtime requirements and convert salaried employees to hourly workers who will see this as a demotion.
The proposed overtime rule is a “one-size-fits-all” standard. Given the potential broad impact of the proposed rule, an obvious issue concerns the fact that wage amounts vary greatly from location to location, as well as among business sectors. Construction wages are very regional, and what one construction supervisor makes in one part of the country is different than what one earns in another—sometimes wages varying significantly.
