1. Hold a public hearing regarding a request for a development agreement for Carpenter Hill Subdivision, being approximately 64.737+/- acres out of the P.J. Chair Strother opened the public hearing 7:03 p.m. Having received no comments, Chair Strother closed the public hearing at 7:03 p.m.

Chair Strother adjourned into executive session pursuant to Texas Government Code Chapter 551.071 to deliberate with and seek legal advice of the City Attorney regarding the Carpenter Hill Development Agreement. Chair Strother reconvened in open session. Assistant City Manager Chance Sparks presented the item. Brandon Namken and Pam Madere, representing C-Ray Development as applicant, spoke regarding the project. Keith Townsend, current property owner, spoke regarding the Carpenter Hill Cabin and associated Texas Historical Marker. Chair Strother made the motion, seconded my Commissioner Altmiller, to recommend approval of the Development Agreement contingent upon corrections to address typographical errors, reflect corrections to align Agreement language with plan layout pertaining to the five street stub-outs and two connections, and to include preservation of the Carpenter Hill Cabin and associated open space lot. Motion approved 6-0.

I. EXECUTIVE SESSION

1. The Commission shall recess its open session and convene in executive session pursuant to Texas Government Code Chapter 551.071 to deliberate with and seek legal advice of the City Attorney regarding the Carpenter Hill Development Agreement. Described in H.1., above.

J. CONVENE INTO REGULAR SESSION AND TAKE ACTION, IF ANY, ON MATTERS DISCUSSED IN EXECUTIVE SESSION

GENERALLY LOCATED NORTH OF FM 967 AND EAST OF CANYON WREN DRIVE (FP 17-21). 1. BACKGROUND/HISTORY

This is the action item for considering approval of a final plat of Canyon Wren Place, a single-lot plat located on the east side of Canyon Wren Place and north of FM 967. The plat site is located in the Buda ETJ, but is under consideration for annexation. The site is within the Green Growth Area in the Buda 2030 Comprehensive Plan.

2. FINDINGS/CURRENT ACTIVITY

This plat encompasses 1 lot covering 5.97 acres. The lot is intended for use as a commercial site. The site is in the Edwards Aquifer Contributing Zone within the Transition Zone. The plat includes a 35’ foot deep setback that is designed to accommodate future right-of-way for a right turn lane from FM 967 to Canyon Wren Drive.

Water and Wastewater service will be provided by the City of Buda after annexation is completed. The site will drain into nearby Garlic Creek, with onsite detention and water quality facilities to insure compliance with the Buda UDC and no negative impacts up or down stream.

3. FINANCIAL IMPACT

N/A

4. ACTION OPTIONS/RECOMMENDATION Staff recommends approval of this final plat as it is consistent with the requirements of the Unified Development Code.

THREE, SECTION FOUR SUBDIVISION, BEING 27.385+/- ACRES OUT OF THE GEORGE HERDER

SURVEY NO. 537, ABSTRACT NO. 239 GENERALLY LOCATED EAST SOUTHEAST OF THE EASTERN

TERMINUS OF CAMPO DEL SOL PARKWAY. (FP 17-30)

1. BACKGROUND/HISTORY This is the action item for considering approval of a final plat of Sunfield Phase 3, Section 4.

Water and sewer service is provided through the Sunfield Municipal Utility District. Hays County is responsible for road maintenance, though the City reviews and approves infrastructure plans.

2. FINDINGS/CURRENT ACTIVITY This plat covers 27.385 acres. This plat contains 103 lots, 96 of which are reserved for single family residential use. These residential lots cover 18.107 acres. This section also includes 7 lots in the combined category of Drainage/Landscape/Open Space lots, covering 2.995 acres. The remaining acreage consists of 6.285 acres to be dedicated as right-of-way. This section is bound by Campo del Sol Parkway (110’ ROW) on the north and Sunfield Parkway (98’ ROW) on the west and Promenade Parkway (variable ROW) on the south. Only half of the eventual width of Campo del Sol Parkway is included in this plat.

Campo del Sol Parkway intersects with the off-site Sunfield Parkway at the northwest corner of the plat and continues eastward until terminating at Flameleaf Drive, a one-block entrance street (50’ ROW). Adjacent to this plat, Sunfield Parkway extends south until turning eastward after intersecting Promenade Parkway (Variable ROW), which is part of the recently-approved Sunfield Amenity Center Subdivision. This plat connects to Sunfield Parkway via the one-block Basket Elm Drive (50’ ROW) and connects to Promenade Parkway via Elder Drive(50’ ROW) , also a one-block street. Internally, the subdivision forms two loops, with Baretta Circle being the larger loop and Ashleaf Drive connecting to Barretta Circle to form a smaller loop. Because this plat has document number blanks for the adjacent arterial streets, this plat cannot be recorded until the Sunfiled Phase 3 Amenity Center Plat has been recorded. 12

Although this subdivision is vested under a previous UDC, it has a connectivity ratio of 1.5, which does not quite meet the city’s current requirement of 1.6. Also notable is that the subdivision has three connections to outside streets, which exceeds the minimum 2 access points for a subdivision of this size in the Buda UDC.

The Land Plan in the Sunfield Development Agreement places a maximum density of 4.4 units per acre, calculated across all areas on the Land Plan. It remains below 4.4 units per acre to date and this section is itself below 4.4 units per acre. The lot and street layout in this plat is consistent with the Sunfield Phase Three Preliminary Plan, approved in 2016.

Water service will be provided by the Sunfield MUD through Goforth SUD. Waste water service will be provided by the Sunfield MUD. The site will drain through the subdivision’s storm sewer system, releasing to Soil Conservation Service Site 10 Reservoir, which is a tributary of Plum Creek.

3. FINANCIAL IMPACT N/A

4. ACTION OPTIONS/RECOMMENDATION Staff recommends approval of this final plat as it is consistent with the associated preliminary plan, the requirements of the Unified Development Code, and the Development Agreement.
