Commodore’s Comments – November 2016

This edition of the Mainsheet is out a

little later than we had planned.

Unfortunately our editor Paul has to

coax articles from us (me) and there

has been a lot going on of late. This has

got me to thinking about how a club

like ours survives for more than fifty

years and still meets the needs of its

members and visitors.

History is littered with stories of great

initiatives that would make a profound

difference to the world and last forever

because of their intrinsic value. But we

have seen some organisations slowly fade with people’s interests moving to other things and energy petering out.

There must be something about sailing, and more particularly LVYC, that sees us continue to operate successfully

while others don’t. My theory, for what it’s worth, goes to the foundations of the club and the ideas that many have

nurtured over the years.

Firstly, there is a willingness to include new and prospective members, regardless of their background or experience

in sailing. We don’t always get this exactly right but I have seen club members go out of their way to support new

members. It’s tough trying to find a place in a new social group, especially where the friendships are so strongly

established. I think we do this reasonably well and I hope that the members continue to welcome those who are

new to our club.

The second factor that stands out is the willingness of all members to contribute. I know I’ve spoken on this before

but something Frank said a few weeks back when we were chatting stuck in my mind. Every member of our club,

regardless of experience, takes their place on the duty roster. This can be a bit daunting if you are new to the role of

race officer and the starting sequence. I’ve done a bit of checking and it seems that not every club has this

everyone doing their bit and doing

it willingly.

We are fortunate that this culture

survives in our club. I hope we can

all continue to support those new

members who seek to join us on

the water. I hope that the long

term health of the club is in the

back of the member’s minds so that

our children, grandchildren and

others benefit in the way we have

through participation in our sport in

the company of such good people.

The Torchlight Challenge. The race will begin 7.30 – 8pm weather permitting.

After the race there will be Hot Apple Pie and Presentation.

Adventure on the Gippsland Lakes

In late September, Bruce and I arranged to meet up with Mervyn and Yvonne at Paynesville for a few days of sailing. Mervyn and Yvonne had not long been in the possession of a Farr 5..Farrgo!! We caught up with them as they were setting up at the boat ramp and discussed where we will meet up when they were on the water and left them to it. An uneventful trip was made over to Steamer Landing, conditions were cool and cloudy and despite it being school holidays there were few vessels on the jetty. It transpires that the Browns had left most of their vittles in the car! Of the few food items they managed to get on board were the boiled eggs, bread and a bottle of wine! Not to worry -as you do in times of crisis – pool your resources and go adventuring! There was a venture further up Bunga Arm and everyone was snugged up to the jetty before dark. We had a great evening, sharing stories of time spent up north and finding shared memories of places that Bruce and Mervyn had haunted as youngsters in bayside Melbourne. And we recounted some adventures we have had on the lakes with our girls Laura and Louisa. The next morning, after more boiled eggs, we set off for a sail around Raymond Island to finish off a great couple of days on the lakes! Sally Sewell

Inverloch Classic Wooden Dinghy Regatta The South Gippsland Yacht Club working with local businesses, the yachting industry, Bass Coast Shire Council, Inverloch Historical Society and Rotary and Lions Clubs has now conducted three very successful Inverloch Classic Wooden Dinghy Regattas. Since commencing on Australia Day 2014 the yacht club, supporting organisations, business partners and participants have brought the event to life. The club is now planning its fourth Regatta to be held in January 2017 over the Australia Day weekend. Every year, this wonderful regatta not only showcases the history of classic wooden dinghies, on and off the water but also provides the opportunity for current owners and skippers to demonstrate their prowess in restoring, maintaining and sailing these dinghies. Even if a person does not own one of these classic wooden dinghies, they quickly learn to appreciate the workmanship, the timbers used and the foibles of sailing them. For the fourth year in a row I extend a very warm welcome to all sailors, to come and join us at South Gippsland Yacht Club to celebrate the history of wooden dinghy sailing. Inverloch’s regattas, held on Anderson’s Inlet, were first recorded in Melbourne newspapers in 1893 and have always been a festive occasion for the town. The recent regattas conducted by our yacht club continue along similar lines, embracing the town’s sailing and seaside history as an Australia Day Weekend celebration. We are currently planning what we believe will be an outstanding event in 2017 for sailors whether sailing

their wooden dinghies or displaying them for all to see. We are introducing a new activity in this coming regatta for those that enjoy cruising in their wooden boats. On Australia Day, which is a Thursday, you can pack your thermos flask, scones and teacake and get in your wooden boat with family and friends to sail up Anderson Inlet and land on a remote beach for an afternoon picnic. On Friday, there will be the display of wooden dinghies on the beach before the Regatta Race which will provide sailors with the opportunity to test their skills on the water in their more traditional boats. On Saturday wooden dinghies will be displayed in the park next to the yacht club with a range of other attraction for sailors and visitors. Everyone will be encouraged to participate in the selection of overall award winners. A program will be posted on the South Gippsland Yacht Club website closer to the event. RACV Inverloch Resort helped create the Inverloch Classic Wooden Dinghy Regatta and will be a major sponsor again in 2017 providing entry awards for eligible boat owners. RACV Resort accommodation to the value of $1,800, $1,200 and $800 will go to the three people bringing their boats, in order, the greatest distance. Conditions of Entry

I of hereby apply for

membership with LATROBE VALLEY YACHT CLUB INC. In so applying and in consideration of my application for membership being accepted I acknowledge and agree that:

In this membership declaration: “Club” for the purposes of this membership application and declaration means and includes Latrobe Valley Yacht Club (LVYC) Incorporated, its directors, officers, members, servants or agents. "Claim" means and includes any action, suit, proceeding, claim, demand, damage, cost or expense however arising including but not limited to negligence but does not include a claim in respect of any action, suit etc made by any person entitled to compensation under a relevant Club insurance policy or under any right expressly conferred by the Club constitution or regulation. "Club Activities"

means performing or participating in any capacity in any authorised or recognised Club activity.

The Club Constitution is a contract between me and the Club. I will be bound by it and any By-Laws, regulations or policies made under it. I also agree to

abide by the rules and policies of LVYC, and be subject to the jurisdiction of LVYC in relation to the application and enforcement of such rules and policies.

Warning: Club Activities can be inherently dangerous. I acknowledge that I am exposed to certain risks during Club Activities including, but not limited to,

physical exertion and injury, bodily contact, falls, equipment failure and unpredictable weather conditions. I acknowledge that accidents can and often do happen which may result in me being injured or even killed, or my property being damaged. I have voluntarily read and understood this warning and accept and assume the inherent risks in participating in the Club Activities.

WARNING UNDER THE FAIR TRADING ACT 1999

Under the provisions of the Fair Trading Act 1999 several conditions are implied into contracts for the supply of certain goods and services. These conditions mean that the supplier named on this form is required to ensure that the recreational services it supplies to you are:

rendered with due care and skill; and

as fit for the purpose for which they are commonly bought as it is reasonable to expect in the circumstances; and

reasonably fit for any particular purpose or might reasonably be expected to achieve any result you have made known to the supplier.

Under section 32N of the Fair Trading Act 1999, the supplier is entitled to ask you to agree that these conditions do not apply to you. If you sign this form, you will be agreeing that your rights to sue the supplier under the Fair Trading Act 1999 if you are killed or injured because the services were not rendered with due care and skill or they were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in this form.

NOTE: The change to your rights, as set out in this form, does not apply if your death or injury is due to gross negligence on the supplier's part. "Gross negligence"

is defined in the Fair Trading (Recreational Services) Regulations 2004.

For the purposes of this clause 4, “the Supplier” shall mean and include the Club.

Exclusion of Implied Terms: I acknowledge that where I am a consumer of recreational services, as defined by any relevant law, certain terms and rights usually

implied into a contract for the supply of goods or services may be excluded. I acknowledge that these implied terms and rights and any liability of the Club flowing from them, are expressly excluded to the extent possible by law, by this membership declaration. To the extent of any liability arising, the l iability of the Club will, at its discretion be limited to the resupply of the services or payment of the cost of having the services supplied again.

Release and Indemnity: In consideration of the Club accepting my application for membership I, to the full extent permitted by law:

(a) release and will release the Club from all Claims that I may have or may have had but for this release arising from or in connection with my membership and/or participation in any Club Activity; and

(b) indemnify and will keep indemnified the Club in respect of any Claim by any person arising as a result of or in connection with my membership and/or participation in any Club Activity.

Fitness to Participate: I declare that I am medically and physically fit and able to participate in any Club Activity. I will immediately notify the Club in writing of any change to my fitness and ability to participate. I understand and accept that Club will continue to rely upon this declaration as evidence of my fitness and ability to participate.

Consent to medical treatment: If required, the Club will arrange medical or hospital treatment (including ambulance transportation) for me. I authorise such

actions being taken by the Club where my further consent cannot be obtained and agree to meet all costs associated with such action.

Privacy: I understand that the information I have provided is necessary for the objects of Club. I acknowledge and agree that the information may be disclosed by my Club to Yachting Victoria and will only be used for the objects of the Club, LVYC and to provide me with membership services. I understand that I will be able to access my information through the Club upon request. If the information is not provided my membership application may be rejected.

Copyright and right to use image: I acknowledge and consent to photographs being taken of me during my participation in Club Activities and authorise the Club

to use such photographs for promotional or other purposes without my further consent being obtained. Further, I consent to the Club using my name, image, likeness and also my performance in any Club Activities, at any time, to promote the Club by any form of media.

Severance: If any provision of this membership declaration is invalid or unenforceable in any jurisdiction, the phrase or clause is to be read down for the purpose

of that jurisdiction, if possible, so as to be valid and enforceable. If the phrase or clause cannot be so read down it will be severed to the extent of the invalidity or unenforceability. Such severance does not affect the remaining provisions of this membership declaration or af fect the validity or enforceability of it in any other jurisdiction.

12. I agree to be bound by the policies of LVYC Inc. and LVYC Inc as they are published from time to time on their respective websites

13 I acknowledge that it is my responsibility entirely to ensure my boat complies with the safety prescriptions of LVYC and that any such safety equipment required under the safety category declared in this application is at all times in proper working order.

I have read, understood, acknowledge and agree to the above declaration including the warning, exclusion of implied terms, release and indemnity. I warrant that all information provided is true and correct. I acknowledge this membership declaration cannot be amended. If I do amend it my application will be null and void.
