Introduction
The Federal Republic of Germany is a Federal state. The Lnder are
responsible for general hospital care, general medical care outside hospital,
care of elderly or chronically sick patients, health education and public health.1
Germany formally implemented the EEC sectoral nursing directives of 1977
by the Nursing Act of 4 June 1985 (the Krankenpflegegesetz).2
The federal structure accounts for a system of divided responsibilty. The
system of Rahmengesetzgebung applies in this legislative area according to
Art. 74, no. 19 of the Basic Law3. Federal law regulates the basic training for
nurses and sets out the framework for the training of nurses in general, but it
is for the Lnder to implement it within the guidelines of the Nursing Act and
the rules and regulations for the training and general provisions of exams4.
Post basic nurse education is left to the Lnder. This has resulted in different
Lnder recognising different types of speciality. In the post basic sector
various, mostly indepent, organisations and institutions are involved in
providing the training. The DKG (Deutsche Krankenhausgesellschaft) has
produced a series of recommendations that are generally used by the Lnder
which have not in fact legislated post basic nurse training.5

Types of Nurse
At the basic level there are the general care nurses, and direct entry
paediatric nurses. At the post basic level there are a range of specialist titles
which vary from Land to Land. They are detailed in Appendix 2.
Regulation of Nursing Basic Level
Titles
The Nursing Act (Krankenpflegegesetz) protects three titles.
- Krankenschwester/Krankenpfleger (general female/male nurse)
- Kinderkrankenschwester/Kinderkrankenpfleger (pediatric female/male
nurse)
- Krankenpflegehelfer/Krankenpflegehelferin (assistant male/female
nurse).6
Persons wishing to bear one of these titles must have a licence to do so
according to 1 (1) Krankenpflegegesetz7. The titles are protected; bearing
them without a licence according to 1 (1) KrPflG is deemed an
administrative offence; this behaviour carries a fine of a maximum of 5,000
Deutschmark8.
The sectoral nursing directives are given effect by 2(3). The permission is
revocable if the conditions are not met.9
The law treats nurses and pediatric nurses in a similar way. The same period
of time is spent on the training of nurses and pediatric nurses (3 years), the

aims of training and entry requirements are the same, and both nurses and
pediatric nurses are equally admitted to most courses of post basic training.
The pediatric nurse is a direct entry branch nurse.
The nursing assistant (Krankenpflegehelferin / Krankenpflegehelfer) on the
other hand follows a different route of training (1 year10) and the entry
requirements are not as demanding 11; nursing assistants are not admitted to
courses of post basic training.
Rules for take-up and pursuit of nursing activities
The minimum age for persons wishing to be admitted to basic training is 17
years; their state of health must be suited to the exercise of the profession.
Permission to bear one of the protected titles presupposes, in addition to
successful completion of the training, the fulfilment of certain other
requirements: the applicant must not be guilty of any conduct indicating that
he or she is unreliable in the exercise of the profession12 and the applicant
must not be incapable or unsuited to exercising this profession (physical and
mental reasons are mentioned in the Act)13. The law sets out further
requirements referring to the previous training expected by applicants for
basic training leading to the titles of nurses / pediatric nurses14, namely:
1. Completion of an intermediate school education
(Realschulabschlu) or equivalent, or completion of another
ten-year school education or

2. Completion of a secondary general school education
(Hauptschulabschlu) or equivalent schooling provided that
the applicant
a) has successfully attended a preparatory nursing school for at
least two years or
b) has completed vocational training with a required training
period of at least two years
There is also a provision enabling existing nurse assistants to start their
training towards the titles of nurses / pediatric nurses; their licence
automatically qualifies them15.
Training
Training for the basic nurse is in principle set out in the Federal Law, but
implemented in each Land. The tables in Appendix 1 show the training for the
Basic branch nurses in the various Lnder. Appendix 1a sets out the training
details for the pediatric nurse.
Nurse and pediatric nurse have to pass State exams which are taken after
three years of training; training involves theoretical and practical tuition as well
as a practical training16 Once passed the diploma is issued by the health
authority of the relevant Lnder. The permission to practice operates
throughout Germany. The Krankenpflegehelfer / Krankenpflegehelferin
(assistant nurse) has to pass State examination after one year of training (

Details on training and examination are set out in the Ausbildungs- und
Prfungsverordnung fr die Berufe in der Krankenpflege (KrPflAPrV), a

federal law passed on 16 October 198517. Its annex 1 deals with the training
of nurses (a total of 1,600 tuition hours and 3,000 hours of practical training),
annex 2 with the training of pediatric nurses (again 1,600 tuition hours and
3,000 hours of practical training) and annex 3 with the training of nurse
assistants (500 tuition hours and 1,100 practical hours).
Scope of Activity
4 KrPflG sets out, in very general terms, the aims that shall guide the
training of nurses and pediatric nurses and nurse assistants.
4 KrPflG
(1) The training of nurses and of pediatric nurses shall impart the requisite
knowledge, capabilities and skills to enable the student to provide assistance
in the prevention, detection and curing of diseases (training objective). In
particular, training shall be geared to:
1. informed and proficient, comprehensive, systematic nursing care of the
patient,
2. conscientious preparation, assistance and follow-up of diagnosis and
therapy measures
3. encouragement and instruction of patients in health-promoting behaviour
4. observation of the physical and mental condition of the patient and the
circumstances influencing his / her health as well as notifying those
participating in diagnosis, therapy and care of these observations
5. initiation of life-saving emergency measures until the arrival of the physician
6. execution of administrative functions where they are closely connected with
the nursing measures
(2) The training of nursing assistants (second level
nursing) shall impart the knowledge, capabilities
and skills required for the care of patients as well
as the related domestic and other auxiliary

functions in wards, functional units and other areas
of the health services (training objective).
However, there is no legally defined scope of activity for nurses in Germany. 18
Whilst the Krankenpflegegesetz protects titles, it does not protect the
functions and activities of the nurse.
The first national regulation on health care in 1938 envisaged the requirement
of a licence for the exercise of care.19 The relevant provision however, was
suspended and never entered into force. When, in 1968 the regulation of care
was subject of parliamentary debate, the question occurred if legal protection
should be granted not only to nurse titles, but also to the exercise of care. This
however was denied; partly, because non-professional employees in health
care were still needed, partly, because it seemed hardly possible to
distinguish activities of care from other hospital-related activities.20
Other titles in the profession of care
As we have seen, the training for the basic nurse is in principle set out in the
Federal Law, but implemented in each Lnder. The tables in Appendix 1 show
the training for the Basic branch nurses in the various Lnder.
Members of other professions are also active in the realm of care. The
Hebamme / Entbindungshelfer is a midwife. The Altenpflegerin / Altenpfleger
(elderly care nurse) is styled as a branch nurse in Germany, but their primary
function is as a social rather than a nursing profession. The precise nature of
this profession social or medical is a subject of current discussion in

Germany.21 The training of elderly care nurses, as opposed to that of nurses
and pediatric nurses, does not follow a uniform federal regulation individual
States have issued their own laws to regulate courses, examination etc.22
However, a draft for federal legislation on the training of elderly care nurses is
presently in parliamentary debate.23
There are also academic qualifications for nurses in Germany. Again these
vary between the Lnder but broadly they are as follows:
The Lehrerin / Lehrer fr Pflegeberufe (nursing teacher); the
Pflegedienstleitung (nurse manager) at a graduate diploma but vocational
level. At the vocational masters level there are three further qualifications
Diplom-Pflegelehrer24 (FH); Diplom-Pflegewirt (FH); and Diplom-
Pflegewissenschaftler (FH). Some universities also offer qualifications in this
field (masters-level)25: Berlin (Diplom-Medizinpdagogik / Diplom-
Pflegepdagogik), Bremen (Lehramt an ffentlichen Schulen Sekundarstufe
II Fachrichtung Pflegewissenschaft), Nordrhein-Westfalen
(Pflegewissenschaft), Sachsen-Anhalt (Pflegewissenschaft).

Regulation of Nursing Post basic level
Post basic specialisation is dealt with at the Lnder level. The table on page
Error! Bookmark not defined. sets out the types of specialist in each
Lnder. Appendix 2 gives a summary of the post-basic training in the different
Lnder. The section after the table deals with each Lnder in turn.
The essential point here is that the title of specialist nurse does not reserve
any particular sphere of activity to that specialist. The exception is the nurse
teacher; the Krankenpflegegesetz requires a specialisation as nurse teacher
for nurses wishing to become principal of a nursing school. Otherwise, all
nurses have access to all areas of nursing activity. The title itself may
however be protected. Clearly in the employment market there is value to be
gained from having specialist training (and titles). There is pressure to
designate spheres of competence to specialist nurses, but there is no
concrete result yet (nor expected imminently).
The following table shows the distribution of specialist nurses in the differentLnder.

Individual Lnder and the DKG
Regulation of the details of post basic training lies within the authority of theLnder (see supra). If a State opts to make use of this right, the legislativeform chosen is often that of a statutory order (Ordnung / Rechtsverordnung).As such it will be based on a general Act (Gesetz) which describes thegeneral subject of the matter of regulation and authorizes a member of theexecutive branch to exercise legislative power in this field.
Beyond that, regulations of the DKG, a private organization, exist and arewidely used.
I. The German Society of Hospitals (DeutscheKrankenhausgesellschaft DKG)
When the State of Sachsen-Anhalt decided to privatise post basic training inprofessions of health care, it based its decision on a report which containedthe following recommendation:
In the area of nursing tasks in connection with post basic trainingwhich are currently executed by State institutions should be performedby private suppliers. The task could be transferred to the DeutscheKrankenhausgesellschaft or other suitable suppliers.27
In fact the DKG already carries out many of the tasks which otherwise wouldfall to the States. Traditionally, post basic training of nurses takes place inhospitals. Over the years, the DKG as the umbrella organization has issuedseveral detailed directives which serve as guidelines for institutions of postbasic training and at the same time as recommendations for States wishing tointroduce State legislation on post basic training.

In four of the Lnder Bayern, Sachsen, Thringen and Baden-Wrttemberg
- there is currently no State regulation of specialist nurse titles.35 They use
the DKGs (Deutsche Krankenhausgesellschaft) recommendations.36
Sachsen-Anhalt decided in 1995 to privatise post-basic training in professions
on health care; in this State, the DKG recommendations are employed as
well.
With the exception of Hessen and Rheinland-Pfalz, all German States make
use of the recommendations, as far as they have not (yet) regulated post-
basic training themselves. In Saarland, statutory orders on post-basic training
are in progress, the DKG recommendations are used as well37. Beyond that, a
strong influence of the DKG regulations can often been seen in the statutory
orders of the individual Lnder.

Post-basic training is regulated by statutory order in the areas

Persons can participate in courses of post basic training, if they
1. have the permission to bear a professional title of a qualified medical
profession [Krankenschwester, -pfleger, Kinderkrankenschwester, -pfleger] or
recognition by the State as an elderly care nurse
2. have already worked for (in general) two years in the learned profession, of
these at least 12 months immediately before the beginning of the post-basic
training

Post basic training takes place as a full-time course of at least one year or as
a course in tandem with the professional activity of at least two years. It
embraces

V. Brandenburg
Titles of post-basic training in Brandenburg are protected according to the
following provisions
3 (Professional title of post basic training)
Titles of post basic training within the meaning of this statute are titles
which point out specialised knowledge and abilities in a specific area of
a profession of the health service. The titles can be borne according to
the condition of 4 Nr. 1 besides the basic professional title.
4 Bearing of a title of a post basic training
(2) Persons have permission to bear a title of post-basic training
According to 3, if they demonstrate that they
i. Have permission entitling them to bear the
professional title of a legally regulated profession of
the health service
ii. Have completed the required course of post-basic
training at a state approved institution of post-basic
training
iii. Have passed the prescribed exam.
The permission for the bearing of one of the post basic training
specialist titles is to be confirmed according to 7 Abs.4 in the
certificate for the successful final examination of the post basic training
of an official post basic training institute.
(2) The permission within the meaning of Abs.1 lapses if
1. the permission of bearing on of the professional titles as listed
in Abs. 1 Nr.1 is taken away or
2. the post basic training is subsequently declared to be void.....
(3) Post basic training specialist titles, which are obtained in other
German states according to statutory or generally recognised
regulations, may be borne in the state of Brandenburg.
13 Administrative Offences
(1) A person commits an administrative offence if he/she deliberately or
negligently
1. bears a post basic training specialist title without a permission
according to 4 and 5
(2) The administrative offence according to Abs. 1 Nr.1 can be
punished with a fine of up to 5000 DM....
In 1997, Brandenburg issued a statutory order regulating training and title of
nurses specialised in ambulatory care55. The regulation of other disciplines of
post-basic training follows the recommendations of the DKG.

VI. Bremen
In Bremen the Law protects post registration specialist titles for nurses.58

Persons bearing, deliberately or negligently, a title of post basic training
according to para. 3, without having permission according to para. 4,
commit an administrative offence.

This administrative offence can be punished by a penance of up to

Several of the statutory orders deal with the question of recognition of titles
awarded or training performed in other German States. Thus, in the discipline
of the operation department, post-basic training acquired in another German
State will be recognised, if its level is of equal value ( 4 (2)78). Post-basic
training or recognition acquired in a different State in the discipline of
psychiatry will be considered equal to recognition in Hamburg if the statutory
order regulating training in that State corresponds to the minimum
requirements of the Rahmenordnung der Lnder fr die Weiterbildung in den
verschiedenen Fachrichtungen der Krankenpflege ( 2 (2)).79 Under the
same requirement, training in the field of hygiene will be recognised, but the
training must also have been performed according to the recommendations of

recognition as nurse [Krankenschwester / Krankenpfleger] or childrens nurse

least 6 months in an area of increased risk. As areas of increased risk shall
count, e.g. , units for the care of cases of transplantation or cases of burns or
for intensive medicine, operation departments, sterile cells, units of central
sterilization, isolation wards, dialysis departments, wards of the prematurely
born.

training according to 6, without having the required permission
according to 2 Abs.2, commits an administrative offence.
(2) This administrative offence can be punished by a fine of up to 2000
